NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY THE CITY
COUNCIL OF THE CITY OF LANCASTER, STATE OF CALIFORNIA, THAT:
Section 1. Recitals. The recitals set forth above are true and correct and are incorporated into this Resolution by this reference.
Section 2. Findings. The City Council hereby finds and determines, based upon the Engineer’s Report and the evidence presented at the public hearing, that with respect to the sewer service charges approved by this Resolution: (a) the revenues derived from the charges will not exceed the funds required to provide the property-related service; (b) the revenues will not be used for any purpose other than that for which the charges were imposed; (c) the amount of the charge imposed upon any parcel will not exceed the proportional cost of the service attributable to that parcel; (d) the charges are imposed only for a service that is actually used by, or immediately available to, the owner of the property in question; and (e) no charge is imposed for general governmental services where the service is available to the public at large in substantially the same manner as it is to property owners. Cal. Const. art. XIII D, § 6(b).
Section 3. Public Interest and Convenience. The City Council finds that the public interest and convenience require the continued operation, maintenance, repair, rehabilitation and replacement of the Lancaster Sewer System within the boundaries of the City of Lancaster.
Section 4. Approval of Engineer’s Report. The Engineer’s Report for Fiscal Year 2026- 2027, as filed with the City Clerk and as it may have been modified at the public hearing, is hereby approved, confirmed and adopted.

Section 5. Approval of Maximum Authorized Charges. The schedule of maximum authorized sewer service charges set forth in Exhibit A, attached hereto and incorporated herein by this reference, is hereby approved and adopted.
Section 6. Fiscal Year 2026-2027 Charge. The adoption of this Resolution constitutes the levy of a sewer service charge of $164.70 per Sewage Unit for benefiting properties for the fiscal year commencing July 1, 2026, and ending June 30, 2027.
Section 7. Future Annual Charges. For each fiscal year following Fiscal Year 2026- 2027, staff shall prepare and file with the City Clerk a written report determining the sewer service charge to be levied, and shall submit the report to the City Council for approval following notice and hearing as required by Health and Safety Code section 5473.1. No annual charge adopted pursuant to this Section shall exceed the maximum authorized charge for that fiscal year set forth in Exhibit A. Any charge exceeding the applicable maximum shall require new proceedings under Article XIII D, section 6 of the California Constitution.
Section 8. Collection on the Tax Roll. Pursuant to Health and Safety Code section 5473, the City Council hereby elects to have the sewer service charges collected on the tax roll on which general taxes of the County of Los Angeles are collected, at the same time and in the same manner as County taxes are collected, and subject to the same penalties and procedures of sale in case of delinquency as provided for those taxes. The charges may alternatively be collected as provided in Ordinance No. 913.
Section 9. Filing with County Auditor. The City Clerk is hereby ordered and directed to file a certified copy of this Resolution, together with the Engineer’s Report as approved, with the Auditor-Controller of the County of Los Angeles on or before the date required by law.
