Kendall Brekke, Planning Manager – Community Development Subject:Adoption of a Minor Use Permit Fee
Recommendation:
Adopt Resolution , establishing a Minor Use Permit entitlement application fee.
G.C. Section 84308: No
Fiscal Impact:
Recovery of costs related to the processing of a Minor Use Permit entitlement.
Background:
On October 25, 2022, the City Council of the City of Lancaster (“City Council”) adopted Ordinance No. 1093, a Zone Text Amendment for revisions to Title 17 of the Lancaster Municipal Code, which included the creation of a new Minor Use Permit (MUP) entitlement.
The MUP application allows a property or business owner to undergo thorough review by staff, and through this process, a public notice is sent to neighboring property owners and tenants. A public hearing is not required for approval.
Since the adoption of Ordinance No. 1093, staff has applied the existing Conditional Use Permit (CUP) for Existing Facilities fee to MUP applications, as the processes are similar. However, a CUP process is more extensive than an MUP and best practices dictate that an independent fee be established for MUP applications.
In addition, the City is currently updating regulations for Massage, Alcohol, Recycling, and Tobacco (MART) uses, and many of these uses require an MUP in order to operate. As a result of community feedback received during MART outreach, the City aims to establish a reduced, more accessible and appropriate MUP fee prior to this influx of applications. 2 4

The City engaged Willdan Group to calculate the full cost of processing an MUP under current requirements. The proposed MUP fee will be reduced from $4,347 to $1,058. This reduction still ensures direct cost recovery, while balancing the needs of prospective applicants.
A notice of Public Hearing was completed in compliance with the Lancaster Municipal Code on August 1, 2026.
