Subject: Declaration of Surplus Land
Recommendations:
Adopt Resolution No. ______, declaring pursuant to Section 54221 of the Government Code that certain parcels of land owned by the City of Lancaster are surplus and not necessary for the City’s use.
Fiscal Impact:
None.
Background:
The City owns several parcels throughout the community for various purposes: some are held for City operations and other public purposes, while others were acquired to support economic development and spur private investment. Staff have identified several parcels that are no longer needed for City purposes.
Before disposing of these properties, the City Council must formally declare them surplus in accordance with the Surplus Land Act. The proposed action would satisfy this initial requirement.
Following the declaration, the City will issue a Notice of Availability (NOA) to entities specified by law, which will have 60 days to notify the City of their interest in the properties. If interest is received, the City must engage in good-faith negotiations for at least 90 days. Upon completion of this process, the City will submit the required documentation the California Department of Housing and Community Development (HCD) for its 30-day review. Once all applicable requirements have been satisfied, the City may dispose of surplus properties.
The proposed Declaration of Surplus Land does not authorize the lease or sale of the affected properties. After the Surplus Land Act process is complete, each proposed property transaction will be presented to the City Council separately for consideration and approval.
