Date:August 25, 2026
To: Mayor Parris and City Council Members
From:George N. Harris II, Deputy City Manager/Treasurer Trolis Niebla, City Manager
Subject:Amendment to Fair Labor Standards Act (FLSA) Section 7(k) Work Period for Lancaster Police Officers Association Employees.

Recommendation:

Approve the amendment establishing a fourteen (14) day FLSA Section 7(k) work period for overtime calculation purposes for employees represented by the Lancaster Police Officers Association and authorize the City Manager to execute any documents necessary to implement the amendment.

G.C. Section 84308: No
Fiscal Impact:

None
Background:

On June 12, 2026, the City Council approved the Memorandum of Understanding (MOU) between the City of Lancaster and the Lancaster Police Officers Association (LPOA). As outlined in the prior staff report, the MOU included a modification to the Fair Labor Standards Act (FLSA) Section 7(k) work period for overtime calculation purposes. The prior staff report proposed transitioning from a twenty-eight (28) day work period to a seven (7) day work period.

Staff are now recommending that the FLSA Section 7(k) work period be amended to a fourteen (14) day work period for overtime calculation purposes. This amendment is limited to the FLSA work period and does not otherwise modify the terms of the previously approved MOU.
