Background:
On May 7, 2024, City of Lancaster accepted the dedication of the 4-foot Landscape and Maintenance easement for Tract Map No. 66842, recorded in Map Book 1449, pages 5 through 14 of official records, in the office of the County Recorder of Los Angeles, State of California.
The proposed landscape improvements within said 4-foot easement have not been constructed, and the easement will no longer be utilized for its intended purpose. It has been determined that the street section of this tract is wider than the rest of the neighborhood along Avenue J-8. The 4-foot easement adds unnecessary landscape improvements as there is adequate space to add the required landscaping within the 14-foot meandering sidewalk.
Section 8333(c) of the Streets and Highways Code states that the legislative body of a local agency may summarily vacate an easement when it is determined to be “excess by the easement holder”, no public funds have been used, and there are no public facilities located within the easement to be vacated.
