G.C. Section 84308: No
Fiscal Impact:

Funding for services performed under this agreement is included in the Community Development Department’s approved budget in Account No. 10124100.5782 and will be expended on an as-needed basis. The annual amount expended will be based on the City’s actual abatement needs and the funding approved for that fiscal year. There is no guaranteed minimum expenditure under the agreement. The agreement establishes a total not-to-exceed amount of $1,006,500 through June 30, 2031.

Beginning in July following the first full year of the agreement, and each July thereafter, hourly rates may be adjusted based on the February Consumer Price Index (CPI) for the Los Angeles/Orange Counties area, as applicable under the Department of Industrial Relations (DIR).

Any annual adjustment is limited to the lesser of the applicable CPI increase or five percent (5%) and is subject to City review and approval.

Background:

The Community Preservation Division is responsible for addressing property conditions that impact public health, safety, and welfare. While voluntary compliance is the City’s preferred method of resolving Code Enforcement violations, there are circumstances where property owners fail to correct violations and the City must proceed with administrative abatement.

To ensure the City has a qualified and responsive contractor available when these situations occur, the City issued RFP No. 881-26 for On-Call Abatement Services. The scope includes property and illegal dumping cleanup, vegetation and weed abatement, securing vacant structures, demolition, homeless encampment cleanup, hazardous material response, and biohazard remediation. The RFP also includes requirements for site inspections, contractor licensing and subcontractor qualifications, proper disposal and documentation, prevailing wage compliance, and enhanced safety requirements.

The City received two (2) proposals in response to the RFP. Proposals were evaluated based on experience and past performance, qualifications and ability to perform the work, technical approach, and cost.

Following the evaluation and interview process, Hak-Away Transport was determined to provide the best overall value to the City. Staff recommends awarding the agreement to Hak-Away Transport to provide reliable, on-call resources to address nuisance properties and other Code Enforcement abatements as they arise.
