CITY MANAGER' S REPORT
ANUARY 9, 2023 CITY COUNCIL REGULAR MEETING
ITEM: CREATE CIP GG 23- 11, LATHROP ANIMAL SHELTER,

AND APPROVE INTER- FUND LOAN
RECOMMENDATION: Adopt Resolution Creating CIP GG 23- 11, Lathrop Animal Shelter and Approving Inter-fund Loan
CEQA STATUS: The City finds this is not a project as defined in Section 15378 of State CEQA Guidelines
SUMMARY:

The City is in need of a permanent animal shelter. To fund the design and construction of a permanent animal shelter, staff is proposing the creation of Capital Improvement Project ( CIP) GG 23- 11, Lathrop Animal Shelter ( Project).

The Project includes civil improvements such as a parking lot and concrete walkways, street frontage, landscaping and other improvements along Louise Avenue. The improvements will provide the building and constructed amenities for the Project.

Staff is requesting that City Council approve the creation of CIP GG 23- 11, Lathrop Animal Shelter. Staff is also requesting the approval of an inter-fund loan of 7, 498, 000 from the General Fund Reserves ( 1010) to the Municipal Services CFF Fund 2270 to fund the design and construction.

BACKGROUND:

The City of Lathrop' s ( City) animal shelter services were provided by the City of Manteca ( Manteca) via contract until contract expiration on September 30, 2022. As Manteca continues to grow, their shelter no longer has the capacity to provide these services to the City. On October 10, 2022, City Council approved the creation of CIP GG 22- 36, Temporary Animal Shelter, and funding of $ 502, 000 for the design and construction of this temporary facility. This temporary facility will be constructed at the Corporation Yard under CIP GG 21- 13, Corporation Yard Remodeling, and will provide a building and storage facilities for the temporary sheltering and care of animals under the purview of Lathrop Animal Services until a permanent facility Project) is designed and constructed.

The City- owned parcel at the southwest corner of Louise Avenue and Howland Road APN # 19814019) has been selected for the site of the permanent animal shelter.

The Project will include the design and construction of a parking lot and driveways, concrete walkways, landscaping, and frontage improvements such as curb and gutter, sidewalk, streetscaping and other associated improvements along the entirety of this parcel' s Louise Avenue frontage.

CREATE CIP GG 23- 11, LATHROP ANIMAL SHELTER AND APPROVE INTERFUND LOAN Staff is requesting City Council approve the creation of CIP GG 23- 11, Lathrop Animal Shelter and approval of an inter-fund loan of $ 7, 498, 000 from the General Fund Reserves to the Municipal Services CFF Fund 2270 to fund the design and construction of the Project. An inter- fund loan allows the transfer of unencumbered monies from one or more City accounting funds to another one in need of additional monies.

REASON FOR RECOMMENDATION:

The creation of CIP GG 23- 11, Lathrop Animal Shelter is needed to design and construct a permanent physical facility for the provision animal support services typically provided by municipalities. Approving the creation of CIP GG 23- 11 will allow the City to begin planning and procuring professional engineering and architectural design services for the Project.

Staff will update Council as design progresses and return at a later date to request award of a construction contract.

CEQA STATUS:

The City finds this is not a project as defined in Section 15378 of State CEQA Guidelines.

FISCAL IMPACT:

To initiate the Project and fund the design and construction phases, staff is also requesting City Council approve an interfund loan of $ 7, 498, 000 from the General Fund Reserves ( 1010) to the Municipal Services CFF Fund ( 2270) as follows:

SUMMARY:

Lathrop Land Acquisition, LLC ( Saybrook), the developer for the Central Lathrop Specific Plan ( CLSP), has completed the construction of the 1C Neighborhood Park associated with the Subdivision Improvement Agreement ( SIA) for Tract 4062 and Encroachment Permit No. 2022- 09 ( EP 22- 09). The approximate value of the improvements proposed to be accepted is $ 1, 803, 961 as shown in the GASB 34 Report, included in Attachment " C". These improvements have been inspected by staff and have been deemed complete by the City Engineer. The developer has provided a one- year warranty bond based on 10% of the construction costs and a lien release for the improvements being accepted. A Vicinity Map is included in Attachment " B".

Staff recommends City Council accept the public improvements in accordance with City specifications and approve budget amendments associated with landscape and park light maintenance.

BACKGROUND:

On October 5, 2006, the City approved a Vesting Tentative Map ( VTM) for Tract 3533 to create 62 parcels on 960 acres of land. On March 20, 2007, the City approved a VTM for Tract 3647 to subdivide a portion of Tract 3533 into 1, 071 parcels on 190 acres of land. On August 13, 2018, the City approved VTM 3967 to subdivide a portion of Tract 3533 into 113 parcels on 18 acres of land to replace the previously planned school location with residential lots.

ACCEPT PUBLIC IMPROVEMENTS ASSOCIATED WITH SIA FOR TRACT 4062 AND EP NO. 2022- 09 FROM LATHROP LAND ACQUISITION, LLC, lOCATED WITHIN CLSP NEIGHBORHOOD iC (TRACT 4062) AND APPROVE BUDGET

AMENDMENT FOR MAINTENANCE CONTRACTS
The Phase 1C Neighborhood Park is within the geographic boundaries of the VTMs for Tracts 3647 and 3967.

On October 11, 2021, City Council approved Tract 4062, establishing 191 singlefamily lots. As required by the City' s subdivision ordinance, the approved Tract 4062 included an SIA to guarantee certain public improvements associated with the final map. The construction of the Phase 1C Neighborhood Park improvements is a requirement of the SIA for Tract 4062 and the work was completed under Encroachment Permit Number 2022- 09 ( EP 22- 09).

Saybrook provided a performance bond for EP 22- 09 ( PB01987300006) in the amount of $ 1, 916, 513. 50 and the Labor and Materials Bond ( PB01987300006) in the amount of $ 958, 256. 75 to guarantee the construction of the Phase 1C Neighborhood Park. The bonds will be released and replaced with a warranty bond by the City Engineer upon acceptance of the improvements.

Saybrook has provided a one- year warranty bond based on 10% of the completed improvements construction cost and both a developer lien release and a lien release from the contractor. The warranty bond value and description is detailed in Table 1 below. Staff recommends City Council accept the public improvements listed in the GASB 34 Report.

Table 1
Contractor Scope of Work Bond Number Bond Value

REASON FOR RECOMMENDATION:

Staff has inspected the improvements listed in the GASB 34 Report and confirmed that the improvements have been completed in accordance with City specifications and deemed complete by the City Engineer. Saybrook has submitted lien releases for the improvements being accepted. Staff has received the one- year warranty bond and as- built drawings for said improvements. Staff recommends Council accept the improvements.

FISCAL IMPACT:

The one- year warranty bond covers any repairs or replacements that become necessary during the one- year period, beginning with this acceptance, due to defective materials or workmanship in connection with the completed improvements. 216

AMENDMENT FOR MAINTENANCE CONTRACTS
The City' s Service Maintenance CFD 2019- 02 has been established to help fund City maintenance and operating costs. The improvements listed in the GASB 34 Report detail the $ 1, 803, 961 expended, and the City' s maintenance costs will increase because of the additional improvements that have to be maintained. Since this is a new development area, the initial budget for CFD 2019- 02 for CLSP was planned for gradual development. However, with the rate of development and rise in inflation costs, staff is asking for a budget amendment to cover the cost of the City' s Landscaper, David Silva dba Silva Landscape for the maintenance of the 1C Neighborhood Park and Electrician, St. Francis Electric, LLC. Staff is requesting Council approve a budget amendment for FY 22/ 23 as follows:

Increase A propriation ( Trees & Landscaping)
2680- 50- 55- 420- 27- 00 33, 600
Increase Appropriation ( Park Light Maintenance)
2680- 50- 55- 420- 31- 00 390

CITY MANAGER' S REPORT

ITEM: AUTHORIZE FUNDING OF FIVE ( 5) ADDITIONAL

POLICE OFFICER POSITIONS FOR THE LATHROP

POLICE DEPARTMENT AND RELATED BUDGET

AMENDMENTS
RECOMMENDATION: Adopt Resolution Authorizing the Funding of Five ( 5) Additional Police Officer Positions, Amending the
Position Control Roster, Amending the Sworn
Compensation Plan and Related Budget
Amendments
CEQA STATUS: Not a Project as Defined in Section 15378 of the State CEQA Guidelines
SUMMARY:

The Lathrop Police Department ( LPD) launched on June 29, 2022, with 35 sworn police positions. Currently, the department runs 5 shifts that includes 1 Sergeant and 3 Officers per shift. The remaining positions include: 1 Chief, 2 Commanders, 3 K- 9 Officers, 3 School Resource Officers, 1 Community Resource Officer, 2 Detectives, 1 Detective Sergeant and 2 Traffic Officers.

Over the course of the past 6 months, the department has had the opportunity to evaluate calls for service, define and implement services based on community needs and establish minimum staffing needs. LPD has been very busy delivering excellent service to our community, participating in ongoing training such as leadership, tactical swat training, K- 9, etc. In addition, our proactive approach to policing has led to numerous arrests, significant seizures of guns and drugs from our streets as well as a swift response to crimes in progress in the community. As a result, our patrol officers are required to cover each other on priority calls, appear in court more often and book persons into jail, all activities that take them away from patrol. Current staffing levels allow for minimum staffing, however, with the addition of training, mandatory court time, unplanned sickness and scheduled vacations officers are requested to perform mandatory overtime to cover patrol.

In order to alleviate some of the overtime and maintain minimum staffing levels, staff is proposing hiring 5 additional patrol officers ( 1 officer per shift). This will help minimize overtime and allow officers to take their scheduled days off. The addition of 5 more officers will allow the City to better steward general fund dollars and maintain quality of life for both residents and sworn staffing. It also supports the high level of police service our community expects. The additional staff will allow for predictability in the Police Department' s budget by funding allocated positions and not relying on overtime which is both costly and unpredictable. 227

AUTHORIZE FUNDING OF FIVE ( 5) ADDITIONAL POLICE OFFICERS FOR THE LATHI tOP POLICE DEPARTMENT AND RELATED BUDGET AMENDMENTS The estimated annual salary cost of the five additional officers is $ 845, 000. Onetime costs for the new officers will include; 3 patrol vehicles ($ 215, 500), lateral officer signing bonus ($ 25, 000) and equipment ($ 37, 500).

Staff recommends Council authorize the funding of five additional police officer positions, amend the Sworn Compensation Plan to extend the $ 5, 000 signing bonus and vacation/ sick leave allowance to 12/ 31/ 2023, amend the position control roster and approve related budget amendments.

A General Fund budget amendment will be needed for Fiscal Year 2022/ 23 in the amount of $ 700, 500 ($ 422, 500 salaries ( 6 months) + $ 25, 000 signing bonus + 37, 500 equip + $ 215, 500 vehicles).

BACKGROUND:

At the March 22, 2021, Special City Council Meeting, Council directed staff to create Capital Improvement Project GG 21- 11, to begin the creation of the new Lathrop Police Department, and implement the transition of law enforcement services from the San ) oaquin County Sheriff to the City.

The Lathrop Police Department launched on June 29, 2022, with 35 sworn police positions.

LPD has been very busy delivering excellent service to our community, participating in ongoing training such as ( eadership, tactical swat training, K- 9, etc.

In order to alleviate some of the overtime and maintain minimum staffing levels, staff is proposing hiring five additional patrol ofFicers ( 1 officer per shift). This will help minimize overtime and allow officers to take their scheduled days off. 228

JANUARY 9, 2023 CITY COUNCIL REGULAR MEETING
AUTHORIZE FUNDING OF FIVE ( 5) ADDITIONAL POLICE OFFICERS FOR

THE LATHROP POLICE DEPARTMENT AND RELATED BUDGET AMENDMENTS REASON FOR RECOMMENDATION:

The usage of overtime to meet minimum staffing requirements is not the best use of the City's general fund. The addition of 5 more officers will allow the City to better steward general fund dollars and maintain quality of life for both residents and sworn staff. The additional staffing will allow for predictability in the Police Department' s budget by funding allocated positions and not relying on overtime which is both costly and unpredictable. For those reasons, Staff recommends the City Council add 5 additional Police Officer positions, amend the Position Control Roster, amend the Sworn Compensation Plan and approve the related Budget Amendments.

CEQA STATUS:

Staff has determined that the item is not a project as defined in Section 15378 of the State CEQA Guidelines.

FISCAL IMPACT:

The overall fiscal impact for Fiscal Year 2022/ 23 is $ 700, 500:

ITEM: ESTABLISH A FA ADE AND SIGNAGE IMPROVEMENT

PROGRAM FUNDING, AND APPROVE RESPECTIVE

BUDGET AMENDMENT
RECOMMENDATION: Council to Discuss and Consider Adopting a Resolution to Establish a Fa ade and Signage
Improvement Grant Program and Authorize Its
Funding with the Use of Measure D Program Funds
Pursuant to A Budget Amendment
CEQA STATUS: The project is exempt according to the California Environmental Quality Act ( CEQA) Article 5, §
15061( b)( 3), by the " Common Sense Exemption".

SUMMARY:

Passed by the vote of the electorate on November 7, 2000, Measure D established an Economic Development Fund ( EDF) for the purpose of stimulating business activities in the local economy. The EDF is solely funded through new homes sales in River Islands. At close of escrow for each new home sold, a $ 5, 000 EDF fee is collected with eighty percent ( 80%) deposited to a ' Stewart Tract Account" and twenty percent ( 20%) deposited to a " Citywide Account". Measure D limits allocation of money from the Economic Development Fund, Citywide Account to the east side of Interstate 5.

Lathrop is one of the fastest growing cities in California. While the city is positioned for new development, there are older retail and office buildings on the east side of Interstate 5 that could use a new sign, a fresh coat of paint, refurbished windows or doors, and other such fa ade improvements.

Fa ade and signage improvements have a significant positive impact on the appearance of a building, which promotes community pride; establishes a sense of place and safety; and enhances the marketability of the building and surrounding properties and businesses.

Many municipalities dealing with the issue of aging buildings in their downtown or other areas of their cities have created a Fa ade and Signage Improvement grant program. These programs are meant to encourage business owners/ tenants to enhance the appearance of their businesses and properties through improvements to their exterior building fa ade and/ or renovation or replacement of existing nontemporary building signage. 245

Staff has developed guidelines, eligibility requirements, and detailed specifications in accordance with Measure D provisions. Proposed funding for this program is from Measure D' s Economic Development Fund, Citywide Account. The program will be managed and monitored by City staff for compliance throughout project buildout and final grant approval for reimbursement to the applicant.

Staff recommends that the City Council consider the information given in this report, approve the resolution to establish a Fa ade and Signage Improvement Grant Program ( Program) Authorize Use of $ 250, 000 of Measure D Economic Development Funding from the Citywide Account; and Approve Respective Budget Amendment. Please refer to Attachment B for details on the City of Lathrop East of Interstate 5 Planning Areas Commercial Retail and Office Fa ade and Signage Improvement Grant Program' s Rules, Guidelines, and Application.

BACKG ROU N D:

In May of 2022, the State Department of Finance ranked the City of Lathrop as the second fastest growing city in California. The City prides itself on intelligently planned communities such as River Islands and Stanford Crossing, but also recognizes the need for enhancements to the aging commercial buildings being used for retail and office east of Interstate 5.

Several municipalities have implemented Fa ade and Signage Improvement grant programs to encourage property owners/ tenants to enhance the appearance of their businesses and properties through improvements to their exterior building fa ade and/ or renovation or replacement of existing non- temporary signage.

Typically, these programs specify a limited geographical area, such as a downtown district, where there is a desire to update dilapidated or neglected buildings.

Fa ade and signage improvements have a significant positive impact on the appearance of the building, which promotes community pride; establishes a sense of place and safety; and enhances the marketability of the building and surrounding properties and businesses.

Staff has researched Fa ade Improvement programs offered in Manteca, Tracy, Fairfield, Antioch, Dublin, Vista and Winters. All of these programs offer grant reimbursement to eligible applicants based on completion of qualified improvements. The majority of these municipal grant programs provide up to fifty percent ( 50%) match for reimbursement of the overall cost of an improvement project with the City' s grant assistance being capped at $ 20, 000 for building fa ade improvements and $ 5, 000 for non- temporary building signage improvements. The source of funding for these programs vary from using Community Development Block Grant Programs to General Fund allocations.

ESTABLISH A FACADE AND SIGNAGE IMPROVEMENT GRANT PROGRAM

LIMITED TO RETAIL AND OFFICE BUILDING USES WITHIN SPECIFIED CITY

BOUNDARIES, AUTHORIZE USE OF MEASURE D PROGRAM FUNDING, AND

APPROVE RESPECTIVE BUDGET AMENDMENT
Staff proposes the establishment of a Fa ade and Signage Improvement Grant Program to be funded through the Measure D' s Economic Development Fund, Citywide Account. Initial program funding is requested in the amount of $ 250, 000 with future funding to be appropriated by the Lathrop City Council as part of its biannual budget process beginning in Fiscal Year 2025.

The City of Lathrop' s proposed Program would provide grant reimbursement funding assistance of up to fifty percent ( 50%) match of the overall cost of an improvement project. The City' s reimbursement assistance shall not exceed 20, 000 for building fa ade improvements and $ 5, 000 for non- temporary building signage improvements.

In accordance with Measure D provisions, the Program boundaries are limited to retail and office building uses within commercially zoned areas located within the Lathrop City limits east of Interstate 5 and north of State Route Highway 120. Only existing buildings utilized for business related to retail or office are eligible. New development is not eligible.

REASON FOR RECOMMENDATION:

Staff recommends that the City Council consider the information presented and approve the proposed Resolution.

FISCAL IMPACT:

Staff time to administer the City of Lathrop' s Fa ade and Signage Improvement Grant Program.

A separate project will need to be set up to accommodate this program. Funding will need to be transferred from Measure D' s Economic Development Fund, Citywide Account to the Fa ade and Signage Improvement Program with the initial allotment of $ 250, 000. Balance remaining at fiscal year- end will rollover to future years.

Future funding to be appropriated by the Lathrop City Council as part of its biannual budget process beginning in fiscal year 2025.

CITY MANAGER' S REPORT
JANUARY 9, 2023 CITY COUNCIL REGULAR MEETING
ITEM: CITY COUNCIL DISCUSSION REGARDING

REGULATION AND LIMITATION OF HOTEL

ESTABLISHMENTS
RECOMMENDATION: City Council to Discuss and Provide Staff Direction as to Whether to Prepare an Ordinance for Review by
the Planning Commission and Subsequent
Consideration of the City Council, for Regulation and
Limitation of Hotel Establishments.

CEQA STATUS: Exempt According to California Environmental Quality Act Article 5 § 15061( b)( 3), by the Common
Sense Exemption"
SUMMARY:

On November 14, 2022, the City Council directed staff to research and provide options regarding regulation and limitation of hotel establishments in the City. In particular, the area of concern is the Central Lathrop Specific Plan and Mossdale Landing development areas.

The purpose of this discussion item is to obtain input and direction from the City Council related to the establishment of new hotels in the City.

BACKGROUND:

There are two major commercial development areas along the west side of Interstate5; the Central Lathrop Specific Plan ( CLSP) and Mossdale Landing ( ML). As of writing of this report, there are three approved hotels and one in review within this part of town. The approved hotels include:

Fairfield Inn by Marriott ( 97 rooms), 17401 S. Manthey Rd.

TownePlace Suites by Marriott ( 97 rooms), 17400 Golden Valley Pkwy.

Homewood Suites by Hilton ( 112 rooms), 17100 Golden Valley Pkwy.

In addition, staff is currently processing an application to construct a Home2Suites by Hilton. This project proposes 93 guestrooms and is located at the southeast corner of Golden Valley Parkway and Stanford Crossing ( 15800 Golden Valley Pkwy.) In Central Lathrop, a hotel is listed as a " Permitted Use" in the CO- CL, Commercial Office Zoning designation. This means that no discretionary review is required and the use is allowed by- right ( as long as the project complies with the development standards and design guidelines of the CLSP).
263
CITY MANAGERS REPORT PAGE 2
7ANUARY 9, 2023 CITY COUNCIL REGULAR MEETING

DISCUSSION ON HOTEL LIMITATIONS
In Mossdale, a hotel requires a " Conditional Use Permit" ( CUP) if located within the CH- MV, Highway Commercial and CS- MV, Service Commercial zones. A CUP requires a public hearing and the Planning Commission must make certain findings including the compatibility of the project with the surrounding area. In other words, a hotel is not allowed by- right in Mossdale and must obtain discretionary approval from the City.

ANALYSIS:

In regards to regulation and limitation of hotels in the City, staff is proposing the following options for Council' s consideration:

Option 1: Propose a development limit for new hotels in CLSP and Mossdale. This will require an amendment to the Zoning Ordinance and Mossdale UDC to limit the number of new hotels in these two areas of the City.

O tion 2: Make no modifications to the existing process and let the market dictate the development of new hotels.

RECOMMENDATION:

Staff recommends that the City Council discuss the information contained in the presentation and provide direction.

CEQA STATUS:

Exempt according to California Environmental Quality Act Article 5 § 15061( b)( 3), by the " Common Sense Exemption".

FISCAL IMPACT:

There is no fiscal impact to the City of Lathrop, only staff time to prepare this report. 264
