ITEM:
RECOMMENDATION: Adopt Resolution to Accept Various Public Improvements in Tract 4149 from River Islands
SUMMARY:
River Islands Development, LLC, River Islands Stage 2B, LLC, and Califia, LLC (collectively "River Islands") have completed the construction of the public improvements identified in the GASB 34 Reports (Attachment "C") associated witt the Subdivision Improvement Agreement (SIA) for Large Lot Final Map Tract 4149 ("Tract 4149").
Staff has inspected the improvements listed in Attachment "C", and the City Engineer has deemed them complete and in compliance with the approved plans and specifications. River Islands has submitted one-year warranty bonds equal to 10% of the completed construction costs, along with lien releases for the improvements proposed for acceptance. A vicinity map of the improvements is provided in Attachment "B."
Staff recommends that City Council accept the public improvements listed in Attachment "C". Roll Tide Way and Winton Avenue, both dedicated and bonded with Tract 4149, are not proposed to be accepted at this time and will be brought to Council for consideration of acceptance at a future date.
BACKGROUND:
On June 14, 2021, City Council adopted resolutions and ordinances approving the modified River Islands Phase 2 Project. The project included the certification of a subsequent Environmental Impact Report; an amendment to the General Plan Land Use Map; text revisions to the Land Use Element and Circulation Element; amendments to the West Lathrop Specific Plan and Urban Design Concept; zoning map and zoning text amendments; approval of a Preliminary Development Plan and Vesting Tentative Subdivision Map; the sixth amendment to the 2003 Development Agreement; and the Phase 2 Parks and Open Space Master Plan.
On November 14, 2022, City Council approved Tract 4149, which established 34 undevelopable parcels within the West Village District of River Islands, located on the west side of the San Joaquin River, north of the Union Pacific Railroad. In accordance with the Lathrop Municipal Code, approval of Tract 4149 included a SIA to ensure the completion of public improvements.

Staff has inspected the public improvements associated with the SIA for Tract 4149, as listed in Attachment "C", and the City Engineer has deemed them complete ana in compliance with the approved plans and specifications. Roll Tide Way and Winton Avenue, both dedicated and bonded with Tract 4149, are not proposed to be accepted at this time and will be brought to Council for consideration of acceptance at a future To guarantee the completion of the remaining improvements for Tract 4149, Performance Bond No. 0799678 in the sum of $16,643,440 and Labor & Materials No. 0799678 in the sum of $8,321,720 will remain in place until Roll Tide Way and Winton Avenue are inspected by staff, deemed complete to City specifications by the City Engineer, and accepted by a future Council action. Upon completion, staff will present Roll Tide Way and Winton Avenue to Council for consideration of acceptance and subsequent release of the bonds.
River Islands has a submitted a one-year warranty bond equal to 10% of the completed construction costs, along with lien releases for the improvements proposed for acceptance. The bonds are detailed in Table 1 below.

REASON FOR RECOMMENDATION:
Staff has inspected the improvements listed in the GASB 34 Reports, included as Attachment "C", and has confirmed that they have been completed in accordance with City specifications.
River Islands has provided unconditional lien releases and one-year maintenance bonds for the completed improvements. Staff recommends that City Council accept the public improvements listed in Attachment "C".

FISCAL IMPACT:
The City's maintenance costs will increase to maintain the accepted improvements.
The warranty bond covers any repairs or replacements due to defective materials or workmanship for the completed improvements that may become necessary during the one-year period, beginning with this acceptance. The City's Service Maintenance CFD 2023-1 has been established to fund City maintenance and operating costs.

RESOLUTION NO. 25-

WHEREAS, Roll Tide Way and Winton Avenue, both dedicated and bonded with Tract 4149, are not proposed for acceptance at this time and will be presented to the City Council for consideration of acceptance at a future date; and WHEREAS, to guarantee the completion of the remaining improvements for Tract 4149, Performance Bond No. 0799678 in the amount of $16,643,440 and Labor & Materials Bond No. 0799678 in the amount of $8,321, 720 will remain in effect until Roll Tide way and Winton Avenue are inspected by staff, deemed complete to City specifications by the City Engineer, and accepted by a future Council action; and WHEREAS, upon completion of Roll Tide Way and Winton Avenue, staff will present them to the City Council for consideration of acceptance and subsequent release of the bonds; and
WHEREAS, River Islands has provided a one-year warranty bond equal to 10% of the construction cost, along with a developer lien release and lien releases from the contractors. The bonds are detailed in Table 1 below Table 1
