ITEM: RATIFY OUT OF STATE TRAVEL FOR

YOUNG

LEADERSHIP

ELECTED

PROGRAM

OFFICIALS (
IN

YEO) WOMEN' S
WASHINGTON, D. C.

RECOMMENDATION: Adopt Resolution Ratifying Approval for Out of State Travel for Councilmember Diallo to Attend the
Young Elected Officials ( YEO) Women' sLeadership
Program, February 5-9, 2025, in Washington, DC,
and Approving Related Budget Amendment
BACKGROUND:

On January 23, 2025, Councilmember Diallo received an invitation to attend the 2025 Fellowship Class of the Barbara Jordan and Dolores Huerta, Youth Elected Officials ( YEO) Women' s Leadership Program ( Program). The Program is a cohort is a mix of either the first woman, first person of color, or youngest person to serve in their roles. The Program brings together elected women, issue experts, and a variety of experienced professionals who have expertise in providing continued professional development and leadership. As provided by the YEO, this Program will support women identifying elected officials in the challenges of navigating public office, provide them with continued professional development, and elevate their voices and leadership within the national progressive movement, enabling them to seek higher office and pave the way for more women in political office across the country.

The YEO Women' s Leadership Program is a Program sponsored by the People for The American Way Foundation, and its scheduled to take place Washington, D. C.

February 6 -8th, 2025, with the day before and after as travel days. The sponsorship includes hotel accommodations, travel arrangements, breakfast and lunch on February 7th & 8th and ground transportation to and from the airport for the sponsored registrants.

The Political Reform Act ( the " Act") imposes limits on gifts and imposes limits and other restrictions on the receipt of travel payments received by local elected officers and other local officials specified in Government Code Section 87200. The gift limit for calendar years 2025 is $ 630. The total cost of this Program is approximately 4,00 and will exceed the current gift limit. Generally, when an official receives a payment ( including reimbursement) for their travel, that payment is a reportable
gift or income under the Act. The term " travel payment" includes payments, advances, or reimbursements for travel, including actual transportation, parking and related lodging and subsistence. (Section 89506( a).) If the payment is a gift, it is also normally subject to the Act' s $630 gift limit. Councilmember Diallo has requested written advice from the Fair Political Practices Commission ( FPPC) on the matter, as this Program could be exempt from the gift limit rule.

CITY MANAGER' SREPORT PAGE 2
FEBRUARY 10, 2O25 CITY COUNCIL REGULAR MEETING
2025 YOUNG ELECTED OFFICIALS ( YEO) WOMEN' SLEADERSHIP PROGRAM For example, certain travel payments are reportable and may subject the official to possible conflicts of interest but are not subject to the $ 630 gift limit or honoraria ban of the act. Such as, travel for a public purpose under Section 89506( a). Any payments for actual transportation expenses and related lodging and subsistence that are made for a purpose reasonably related to: ( 1) a legislative or governmental purpose, or ( 2) an issue of state, national, or international policy so long as the travel is either:
a) Travel for Speech. In connection with a speech given by the official and the lodging and subsistence expenses are limited to the day immediately proceeding, the day of, and the day immediately following the speech and the travel is within the United States, or
b) Travel paid for by government agency or 501( c)( 3) organization. Provided by a government agency or authority, (including a foreign government), a bona fide public or private educational institution as defined in Section 203 of the Revenue and Taxation Code, or a nonprofit organization that qualifies under Section 501( c)( 3) of the Internal Revenue Code or a foreign organization that substantially satisfies the criteria of that section.

Therefore, tonight' s action is requesting City Council ratification of out of state travel for the attendance by Councilmember Diallo to the YEO Women' s Leadership Program in Washington, DC and Council authorization to use City funds to pay the cost of approximately $ 500, for the meals and mileage not provided by the Program. Additionally, should the full travel payment not be exempt from the FPPC' s gift limit rule, Council approval of this item also provides Council authorization to use City funds to pay approximately $ 3, 770 of the cost of the Program ( approximate total cost of $4,00 minus $ 630 gift limit).

FISCAL IMPACT:

A budget amendment to the City Council Training and Travel expense fund is being requested to cover the cost of travel in the amount of $ 500, to cover the meals and mileage not provided by the Program, should the FPPC rule that this travel payment is exempt from the gift limit rule. Should the FPPC rule that this Program is not exempt from the gift limit rule, the budget amendment is proposed to be increased to $ 3, 770, to cover the cost of the entire Program, minus the maximum gift limit amount.
