Item 5.2 revision to Attachment 2 (HP-22)
of the CMR
any zone(s) where agricultural use is permitted subject to a conditional use permit, such employee housing shall be subject to a conditional use permit.
a. Permitted occupancy in employee housing in an agricultural zone shall include agricultural employees who may or may not work on the property where the employee housing is located. b. Establish a streamlined, ministerial process for eligible agricultural employee housing developments pursuant to Health and Safety Code Section 17021.8.
B. Design Standards: The City will adopt objective design and development standards for multifamily housing, including ministerial (by-right) residential and mixed-use development, and will ensure that the standards, including floor area ratio, unit size, height, setback, and parking requirements, accommodate the maximum densities permitted, and provide flexibility with the design of building types and units to accommodate irregular lots and steep slopes. These objective standards will replace any subjective standards, including site plan review findings, design review standards, use permit conditions, and other standards required for single-family and multifamily housing or will remove or include objective definitions and/or illustrations of any subjective terms, such as "compatibility", "orderly", "harmonious", "character", and "integrity."
Additional amendments to the Zoning Ordinance are necessary to advance affordable housing opportunities and further fair housing:
C. Group Homes for Seven or More Persons: Amend the Zoning Ordinance to allow large group homes for 7 or more persons in additional residential zones to affirmatively further fair housing opportunities for persons with a disability and other persons in need of group living.
D. Planned Development Districts: Continue to permit Planned Development District zoning that promotes a variety of housing types in the City through the utilization of innovative development techniques and flexible standards, such as:
zero lot lines, clustering of dwelling units, narrower streets, increased densities, and fewer dedication requirements.
E._ Parking: Reduce the multifamily parking requirement to 1 space per studio unit, 1.25 spaces per 1 bedroom unit, and 2 spaces per 2 bedroom unit. In the TOD-RI zone, reduce the multifamily parking requirement to 0.5 space per studio unit, 1 space per 1 bedroom unit, and 1.75 spaces per 2 bedroom unit.
I.K. Reasonable Accommodation: The City's reasonable accommodation findings (Section 17.125.050) shall be revised to remove findings 5 and 6 and to either remove finding 7 or revise finding 7 to include several examples of alternative accommodations to ensure objective application of the finding.
Amendments to Specific Plans are made to encourage multifamily development that can accommodate lower income uses in the River Islands and Central Lathrop areas.
Specific Plans: Continue to encourage development of well-designed and innovative projects that provide for the development of compatible residential, commercial, industrial, institutional, and/or public uses within a single project or neighborhood by continuing to implement the West Lathrop and Central Lathrop Specific Plans, which encourage mixed use development. As part of updates to Specific Plans, review to ensure that minimum and maximum densities for high density residential and mixed use sites are maintained.-
a. River Island/West Lathrop Specific Plan:
i. As part of any amendments to the Specific Plan, or issuance of entitlements that would require replacement sites under No Net Loss Law, associated with RH-R, MU-RI, and TOD-RI designations, eEnsure that the Specific Plan and associated maps:
1. M-maintain a minimum of 77-36.06 acres of high density sites (RH-RI) that allow development at maximum densities of 40 or more du/ac as part of any-entitlements for of amendments, and require a minimum density of 20 du/ac on such sites necessary to accommodate the lower income RHNA: and

2023-2031 Housing Element Housing Plan
2. Maintain a minimum of either: a) 96.9 acres of mixed use residential sites (MU-RI and TOD-RI) in River Islands that are designated by the Specific Plan for development of multifamily uses at 15-40 du/ac or allow development at maximum densities of at least 20 te 40 or more du/ac, or b) 73.4 acres of sites designated for high density residential or mixed use at a minimum of 30 du/ac. as part ef any entitlements for or amendments.
3. As an alternative to item 2, a combination of sites with a maximum density of 40 du/ac (or higher) and a minimum density of 20 du/ac or a minimum density of 30 du/ac (or higher) and maximum density of 40 du/ac (or higher) may be provided as long as the sites would yield at least 2, 193 units calculating the units at 50% of maximum density for mixed use sites, 80% of maximum density for high density residential sites, or, if a required minimum density is higher than those calculations. calculating units at the minimum required density). If the Specific Plan is revised to identify a target number of units for individual sites, that number shall be used as the realistic capacity. i The architectural design plans for the Paradise Cut Village Center and Employment Center/Transit Oriented Development areas shall require minimum average setbacks of no more than 12 feet for the sites identified to accommodate the very low and low income RHNA.
b. Central Lathrop Specific Plan: As part of any amendments to the Specific Plan that would require replacement sites under No Net Loss Law, associated with HR-CL and R/MU-CL designations, Ensure that the Specific Plan and associated maps maintain a minimum of 69-61.05 acres of high density and mixed use residential sites that allow development at least 20 du/ac and up to 40 or more du/ac as part of any entitlements for or amendments. To further encourage development of the RHNA, as part of the amendment, revise the Zoning Ordinance to require a minimum of 20 du/ac on at least 61.0 acres of high density and mixed use residential sites or redesignate sites to high density residential and require a minimum of 30 du/ac on at least 39.8 acres of high density and/or mixed use residential sites. As future phases of the Specific Plan are amended entitled, work with the project proponent to create parcels of 4-10 acres on the sites identified to accommodate the very low and low income RHNA. To achieve this, a combination of sites with a minimum density of 20 du/ac and a minimum density of 30 du/ac (or higher) and maximum density of 40 du/ac (or higher) may be provided as long as the sites would yield at least 1.274 units (calculating the units at 50% of maximum density for mixed use sites, 80% of maximum density for high density residential sites, or, if a required minimum density is higher than those calculations, calculating units at the minimum required density. If the Specific Plan is revised to identify a target number of units for individual sites, that number shall be used as the realistic capacity.in the Central Lathrop Specific Plan area.

Item 5.2 revision to Attachment 2 (HBR-102)
of the CMR 2023-2031 Housing Element Background Report
A limited number of sites zoned CC are included in the inventory, these sites are designated MD by the General Plan and are required to develop with a minimum of 8 du/ac and a maximum of 15 du/ac. Program 3 in the Housing Plan requires these sites to be rezoned to RM-3 to be consistent with the General Plan land use designation.
Mixed use sites in the Central Lathrop, River Islands, and Mossale Village areas have been included in the inventory. These master planned areas have strong trends for multifamily residential uses in these areas zoned to accommodate residential and nonresidential uses. The Central Lathrop Specific Plan identifies 723 units in the R/MU-CL zone. The West Lathrop Specific Plan specifies that 668 multifamily units (425 apartments, 17.7 acres at 24 du/ac) and 243 townhomes (21 acres at 11.6 du/ac) will be provided within the existing mixed use Town Center (River Islands Phase 1). The Specific Plan identifies that River Islands Phase 2 will implement the Housing Element (2015-2023 Housing Element was in effect at the time the Specific Plan was updated) and provide a minimum of 28 acres with high density housing of 20 du/ac or more (at least 560 units). These units will be accommodated in two neighborhoods, Paradise Cut Village Center (MU-RI) and the TOD/Employment Center (TOD-RI). Paradise Cut Village Center will accommodate 1,562 multifamily units at 15-40 du/ac. The TOD/Employment Center will accommodate 1,385 units at 15-40 du/ac. The master developer has identified MU-8 for 403 units, MU-9 for 336 units.
MU-10 for 302 units, and MU-11 for 279 units and has identified TOD-2 for 255 units and TOD-3 for 474 units; these subareas are identified on Figure 4.
In Mossdale Village, 70% of sites designated for mixed use [CV-MV (Village Center)] have developed with multifamily residential uses. In River Islands Phase 1, the MU-RI designation was planned to accommodate residential uses as well as multiple schools and several governmental/quasi-public uses. The 5" Cycle Housing Element did not anticipate residential development on MU-RI sites reserved for schools and limited the amount of residential development anticipated for this area to the number of units planned for the MU-RI designation in Phase 1. One of these sites has a proposed multifamily project.
Van Daele Town Center Apartments, and the other site is available for multifamily development. These sites are included in this 6' Cycle Housing Element. For River Islands Phase 2, the West Lathrop Specific Plan has not programmed schools in the areas designated MU-RI and TOD-RI, so it is anticipated that sites designated MU-RI and TOD-RI will have higher rates of residential uses than in Phase 1. The West Lathrop Specific Plan identifies residential uses in its mixed use areas, specifically 1,562 units of high density residential (15-40 du/ac) in Paradise Cut Village Center (designated MU-RI) and 1,385 units of high density residential (15-40 du/ac) in the Employment Center/Transit Oriented Development area. The inventory of sites assumes that development will occur consistent with the West Lathrop Specific Plan and that 85% of the high density residential units planned for River Islands Phase 2 MU-RI district and 59% of the units planned for River Islands Phase 2 TOD-RI will be approved and accommodated during the Planning Period. The Central Lathrop Specific Plan has not yet received any development proposals on its R/MU-CL-MU sites; however, the Central Lathrop Specific Plan designates sites for public/quasi-public uses and commercial uses, so it is not anticipated that the R/MU-CL sites will be used for purposes other than residential and mixed use development. Therefore, it is calculated that 50% of sites designated R/MU-CL will develop with residential uses as it is not anticipated that R/MU-CL sites will develop with schools or other quasi-public uses as in Phase 1 of River Islands.
The inventory of sites assumes 50% of sites designated R/MU-CL will be developed with multifamily residential uses affordable to lower income households and assumes that a portion of the MU-RI and TOD-RI designations will develop with affordable units. To ensure that the lower income, high density residential uses are accommodated on the mixed use sites in the River Islands and Central Lathrop areas and to ensure a minimum acreage is available in these areas and committed to multifamily development, Program 13 requires that, in the event of an amendment that would result in a reduction in sites that would require replacement under No Net Loss law, the River Islands/West Lathrop Specific Plan and Central Lathrop Specific Plan shall maintain minimum acreages of high density residential and mixed use sites. As part of the amendment, Program 13 requires that the Central Lathrop Specific Plan and River Islands/West Lathrop Specific Plan be revised to require a minimum of 20 du/ac and up to 40 du/ac on at least 40 acres in the River Islands Paradise Cut Village Center area (accommodating 800 to 1,600 units), 26 acres in the River Islands Employment Center/Transit Oriented Development (accommodating 520 to 1,040 units), and 30.5 acres in the Central Lathrop Specific Plan (accommodating 610 to 1,494 units). and at 50% of density in the mixed use districts (CC, CV-MV, MU-RI, R/MU-CL, TOD-RI, CO-CL). and range from multifamily (HDR and CMU) projects in the City tend to be at the upper end of the permitted density range, while single family projects have a broader range of densities. Realistic capacity was calculated based on historic development trends in the City, at amounts consistent with capacities demonstrated in Table 3-19 and further supported by Program 13.
