SUMMARY:
Construction and development activities related to capital improvement, private land development, residential, commercial, and industrial projects, have continued to see a significant increase in the Building Department, with a budgeted influx in permit submittals for the next biennial fiscal years, specifically commercial and industrial, that require comprehensive plan review. To efficiently manage the workload for plan review, and ensure timely delivery of services, the Department relies on external professional consulting services for Plan Review Services, Building Inspection Services, and Permitting Services.

This ensures that the City benefits from streamlined processes, expertise, and experience of the Consultants. The City can manage costs effectively while maintaining service quality to applicants.
Sufficient funds are allocated in the Building Department budget for the next two fiscal years, and professional services will be fully funded by building permit fees assessed and collected during permit issuance.
BACKGROUND:
The Building Department plays a crucial role in ensuring the safety and compliance of construction projects within our jurisdiction and is responsible for the permitting and inspection of construction ( including but not limited to; new construction, additions, alterations, repairs, and remodeling) throughout the City' s building permitting jurisdiction as required by the Building Codes. The Building Department enforces International Building Codes, when applicable, California Building Codes, and Lathrop Municipal Code.
The City sought proposals and selected three ( 3) Consulting Agencies ( Consultant) with Master Professional Consulting Service Agreements with 4LEAF, Inc. (4LEAF), BPR Consulting Group LLC ( BPR), and TRB and Associates, Inc. (TRB+) on August 12, 2024. Unless extended, the Agreements with 4LEAF, BPR and TRB+ will end on September 1, 2025.
Due to the continued increase in construction and development activity, resources have become limited for necessary comprehensive plan review and on an as -needed basis, on -site services. The current Consultants on contract have provided professional services to the Building Department in the past calendar year, after being awarded Master Professional Service Agreements at City Council on August 12, 2024, pursuant to Resolution 24- 5610. The Department would like to move forward with these consultant agencies and amend the existing Master Agreements to extend the Term End Date of services from the original termination date of September 1, 2025, to September 1, 2027. This option to extend the term of the Master Agreements was cited in the Request for Proposals that was publicly advertised on July 15, 2024.

The City recovers its costs for providing building permitting services for active construction projects by charging a construction permit fee collected before building permits are issued. These services are fully funded in the Building Department budget and offset by revenue received from building permits.
Sufficient funds are allocated in the Building Department budget for the next two fiscal years, and professional services will be fully funded by building permit fees assessed and collected during permit issuance.
REASON FOR RECOMMENDATION:
Continual and increased Professional Consulting Services are needed for the Building Department to keep up with the continued increase in construction activity related to capital improvement, private land development, and residential, commercial and industrial projects.
The proposed amendments to the Master Agreements to extend to extend Term End Dates will enable the Building Department to continue to enhance operational efficiency, maintain regulatory compliance, and provide timely services to our residents and stakeholders involved in construction activities, while resolving the flexibility needed for resources to continue providing streamline operations and service quality without interruption of contract term constraints currently written and executed.
The three ( 3) proposed Task Orders for each Consultant will have sufficient funds allocated to cover all service costs for the span of two fiscal years, 2025-6and 2026- 27, and will be fully funded by building permit fees assessed and collected during permit issuance. These new Task Orders would ensure operational functionality and collaboration between Department and Consultant for the next two years.
