Authorize the Filing of a Notice of Completion,
Release of Contract Retention, and Release of
Performance and Payment Bonds
SUMMARY:
MG & JC Construction, Inc. (MG & JC) has completed the construction of the Towne Centre Drive Raised Crosswalk ( Project), Capital Improvement Project ( CIP) PS 24-
07. Staff inspected the improvements, and they have been deemed complete and in accordance with the approved plans and specifications by the City Engineer.
MG & JC has submitted lien releases confirming all suppliers have been paid in full and provided a one- year warranty bond ( based on 10% of the total construction cost) for the improvements to be accepted.
City staff request that City Council accept the completed improvements constructed by MG & JC for the Project. Staff also request City Council authorize the filing of a Notice of Completion with the San Joaquin County Clerk - Recorder, the release of contract retention to MG & JC, in the amount of $ 2, 417, within forty-ive (45) days after the recording of the Notice of Completion, and the release of performance and payment bonds.
BACKGROUND:
On September 9, 2024, City Council awarded a construction contract to MG & JC for construction of the Project in the amount of $ 42, 340 and approved a 20% construction contingency of $ 8, 468, for staff to use as necessary to achieve the goals of the Project. The scope of work consisted of a 3" grind of asphalt paving, minor demolition of concrete curb and landscape, installation of grouted cobble, installation of a 1" conduit, installation of two City furnished 13' type 1-B poles, construction of ADA ramps and landings, construction of a concrete raised crosswalk, and striping.
One contract change order totaling $ 6, 000 was issued during the construction of the Project for a final contract amount of $48, 340.

Upon acceptance of the improvements by City Council, the performance bond ( Bond No. 67148, $42, 340) and payment bond ( Bond No. 67148, $42, 340) will be released and replaced with a one- year warranty bond ( Bond No. 67148, $4, 834). The warranty bond covers any repairs or replacements that become necessary during the one- year period, beginning with this acceptance, due to defective materials or workmanship in connection with the completed improvements. MG & JC has also provided the necessary lien releases for the materials supplied and completed work.
Staff request City Council accept the improvements constructed by MG & JC for Towne Centre Drive Raised Crosswalk, CIP PS 24- 07. Staff also request City Council authorize the filing of a Notice of Completion with the San Joaquin County Clerk - Recorder, the release of contract retention to MG & JC in the amount of $ 2, 417 within forty-ive (45) days after the recording of the Notice of Completion, and the release of performance and payment bonds.
REASON FOR RECOMMENDATION:
MG & JC has completed the Project pursuant to the contract documents dated September 9, 2024. Staff inspected the improvements, and they have been deemed complete and in accordance with the plans and specifications approved by the City Engineer.
The performance and payment bond ( Bond No. 67148, $42, 340) will be released and replaced with a one- year warranty bond ( Bond No. 67148, $ 4, 834) upon City Council' sacceptance of the improvements.
FISCAL IMPACT:
The final construction contract amount with MG & JC for the Project is $ 48, 340.

As part of CIP PS 24- 07 Traffic Calming Measures, adequate funds were allocated in the Fiscal Year 24/5 budget to complete the Project. With the Project now complete, staff request that any unused funds be transferred to the original funding source.

NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of Lathrop does hereby accept the public improvements constructed by MG & JC for Towne Centre Drive Raised Crosswalk, CIP PS 24- 07, pursuant to the contract documents dated September 9, 2024; and
BE IT FURTHER RESOLVED, that the City Council of the City of Lathrop authorizes the filing of the Notice of Completion with the San Joaquin County Clerk - Recorder and the release of the contract retention to MG & JC, in the amount of 2, 417 within forty-ive (45) days after the recording of the Notice of Completion, and authorizes the release of the performance and payment bonds.
