CITY MANAGER' S REPORT
NOVEMBER 10, 2025 CITY COUNCIL REGULAR MEETING
ITEM: ACCEPT PUBLIC IMPROVEMENTS IN TRACT 4151
WITH CONDITIONS FROM D. R. HORTON BAY, INC.
RECOMMENDATION: Adopt Resolution to Accept Public Improvements in Tract 4151 with Conditions from D. R. Horton Bay,
Inc.
SUMMARY:
D. R. Horton Bay, Inc. ( DRH) has completed the construction of the public improvements identified in the GASB 34 Reports, included as Attachment " C," associated with the Subdivision Improvement Agreement ( SIA) for Final Map Tract 4151.
Staff has inspected the improvements listed in Attachment " C," and the City Engineer has deemed them complete and in compliance with the approved plans and specifications, with one exception. All required improvements have been completed except for the levee trail, which is delayed pending Central Valley Flood Protection Board ( CVFPB) review and approval. Upon City Council acceptance of the completed improvements, the City will release the performance and labor and materials bonds associated with the completed improvements, receive a one- year warranty bond covering all improvements proposed for acceptance, accept a separate performance bond specifically for the levee trail, and require a separate one- year warranty bond for the levee trail after the City Engineer confirms completion.
DRH has provided a one- year warranty bond equal to 10% of the completed construction costs, along with lien releases for the improvements proposed for acceptance. A vicinity map is provided in Attachment " B." Staff recommend City Council accept the completed improvements and conditionally accept the levee trail upon completion, the City' s receipt of final unconditional lien releases, and receipt of the required one- year maintenance bond for the trail.
BACKGROUND:
On October 14, 2022, City Council approved Vesting Tentative Map 22- 100 (VTM- 22- 100) to create 85 residential lots and a 3. 5 -acre park on 19. 98 acres. On June 6, 2023, the Community Development Director issued a finding of substantial conformance for VTM- 22- 100, increasing the lot count from 85 to 95, reducing the park size by one ( 1) acre, and extending " Street B" by approximately 120 feet.
On July 10, 2023, City Council approved a wastewater treatment capacity transfer agreement securing 17,00 gallons per day of wastewater capacity for the project from South Lathrop Land, LLC to DRH.

NOVEMBER 10, 2025 CITY COUNCIL REGULAR MEETING
ACCEPT PUBLIC IMPROVEMENTS IN TRACT 4151 WITH CONDITIONS FROM D. R. HORTON BAY, INC.
On August 14, 2023, City Council approved the Final Map for Tract 4151, establishing 95 single- family lots. Pursuant to Lathrop Municipal Code Chapter 16.6, all final maps must include a SIA to guarantee specific offsite and onsite improvements.
Construction of the park improvements is required by the SIA and is proceeding under an Encroachment Permit ( EP) because the park land was dedicated to the City with the Tract 4151 Final Map.
On October 9, 2023, City Council approved the creation of Capital Improvement Project ( CIP) PK 24-6 (Eagle' s Landing Park) and a reimbursement agreement for Eagle' s Landing Park authorizing reimbursement to DRH for eligible costs incurred in excess of $ 1, 233, 854. 61, not to exceed $ 1, 250, 000, with reimbursement contingent upon completion of the park to current City standards and specifications, dedication of the improvements to the City, submission of unconditional lien releases, a oneyear warranty bond, and City Council acceptance of the dedicated improvements.
Staff has inspected the public improvements associated with the SIA for Tract 4151, as listed in the GASB 34 Reports, and the City Engineer has deemed them complete and in conformance with approved plans and specifications, with the exception of the levee trail, which has not yet been constructed due to ongoing review by the CVFPB.
The neighborhood park improvements are being constructed under EP No. 23- 132, and the public improvements along Sadler Oak were completed under EP No. 23- 131.
To implement acceptance while securing the remaining levee trail work, upon Council acceptance of the completed improvements the City will release the existing performance and labor and materials bonds associated with the completed work, receive a one- year warranty bond covering all improvements proposed for acceptance, and accept a separate performance bond dedicated to the levee trail to guarantee its completion. Following the City Engineer' sconfirmation that the levee trail is complete and in conformance with City specifications, the City will require a separate one- year warranty bond for the levee trail prior to releasing the performance bond for the levee trail.
DRH has submitted lien releases and a one- year maintenance bond equal to 10% of the completed construction costs for the improvements proposed for acceptance. The bonds and actions are detailed in Table 1 below.

REASON FOR RECOMMENDATION:
Staff has inspected the improvements listed in the GASB 34 Reports and confirmed that they have been completed in accordance with City specifications, with the exception of the levee trail, which is pending CVFPB review.
To accept the completed improvements and maintain adequate security for the outstanding levee trail, staff recommends releasing the performance and Tabor & materials bonds for the completed work, receiving a one- year warranty bond now that covers all improvements proposed for acceptance, accepting a separate performance bond for the levee trail, and requiring a separate one- year warranty bond for the levee trail upon completion and prior to final acceptance of that improvement.
