SUMMARY:
Stanford Crossing 195 Owner, LLC ( Stanford), the developer of the improvements at 400 Stanford Crossing ( Escala), has completed the public improvements associated with Encroachment Permit No 2023- 153 (EP 23- 153) and 2024- 07 (EP 24- 07). A Vicinity Map of the improvements is included in Attachment " B".
Staff has inspected the improvements listed in Attachment " C", and the City Engineer has deemed them complete and in compliance with the approved plans and specifications. Stanford provided a one- year warranty bond based on 10% of the completed construction costs, as well as lien releases for the improvements proposed for acceptance.
Staff request City Council accept the public improvements listed in Attachment " C" and approve a change order with the City' slandscape contractor for future landscape maintenance.
BACKGROUND:
On October 5, 2006, the City approved a Vesting Tentative Map ( VTM) for Tract 3533 to create 62 parcels on 960 acres of land. The location of the improvements are the frontage of Lot 4 of Tract 3533. On August 22, 2023, the Central Lathrop Design Review Board ( CLDRB) approved the Escala at Stanford Crossing Site Plan Review No. (SPR- 23- 53). This approved construction of 195 duplex homes that range in size from 1, 340 - 1, 540 square feet, 448 parking spaces to serve the project, and a 3,07 square foot community center and leasing office.

MAINTENANCE WITH DAVID SILVA, DBA SILVA LANDSCAPE
The conditions of approval associated with the entitlement of the project required the installation of frontage improvements along Stanford Crossing and Barbara Terry Boulevard, including but not limited to curb, gutter, sidewalk, landscaping, and streetlights. The work was done under EP 23- 153 and EP 24- 07.
Staff has inspected the public improvements associated with EP 23- 153 and EP 24- 07, as listed in Attachment " C", and the City Engineer has deemed them complete and in compliance with the approved plans and specification.
Stanford has submitted a one- year warranty bond equal to 10% of the completed construction costs, along with lien releases for the improvements proposed for acceptance. Upon acceptance, the performance bond will be released and replaced with the warranty bond. The bonds associated with the improvements proposed for acceptance are detailed in Table 1 below:

REASON FOR RECOMMENDATION:
Staff has inspected the public improvements associated with EP 23- 153 and EP 24- 07 listed in the GASB 34 Reports and they have been deemed complete and in accordance with the approved plans and specifications by the City Engineer.
Stanford has provided unconditional lien releases and a one- year maintenance bond for the completed improvements. Staff recommend that the City Council accept the public improvements listed in Attachment " C."
FISCAL IMPACT:
The City' s
maintenance costs will increase to maintain the accepted improvements.
The warranty bond will cover any repairs or replacements due to defective materials or workmanship required during the one- year period beginning with this acceptance.
The City' s Service Maintenance Capital Facilities District 2019- 02 has been established to fund City maintenance and operating costs.

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lathrop does hereby accept the public improvements associated with EP No. 2023- 153 and 2024- 07 located at 400 Stanford Crossing from Stanford Crossing 195 Owner, LLC, and authorize staff to release the performance bond; and BE IT FURTHER RESOLVED, that the City Council of the City of Lathrop does hereby approve Contract Change Order No. 35 with David Silva, dba Silva Landscape to add this new landscape to future maintenance services.

RELEASE AND WAIVER
Acceptance of this Contract Change Order constitutes a full and final resolution of all pending disputes between City and Contractor regarding scope of work and payment for work. Contractor accepts this Contract Change Order as full payment for all work performed to date and hereafter to be performed, up to and including Contract Change Order No. 35. Contractor releases and discharges City from any and all claims, demands, damages, actions and causes of actions and causes of action for injuries, damages or losses, whether known or unknown, foreseen or unforeseen, arising directly from Contractor' swork on this contract. Contractor expressly waives the provisions of California Civil Code, Section 1542, which reads as follows:
A general release does not extend to claims which the Creditor does not know or suspect to exist in his favor at time of executing the release, which if known by him must have materially affected his settlement with the debtor.
