ITEM 4. 17

CITY MANAGER' SREPORT
DECEMBER 8, 2025 CITY COUNCIL REGULAR MEETING
ITEM: ACCEPT LATHROP LANDING COMMUNITY PARK

IMPROVEMENTS WITH CONDITIONS FROM RIVER

ISLANDS CONSTRUCTION, LLC, LOCATED WITHIN

THE TOWN CENTER DISTRICT OF RIVER ISLANDS
RECOMMENDATION: Adopt Resolution to Accept Lathrop Landing Community Park Improvements with Conditions
from River Islands Construction, LLC, Located within
the Town Center District of River Islands
SUMMARY:

River Islands Construction, LLC ( River Islands) has completed construction of the Lathrop Landing Community Park ( C1 Park) located within the Town Center District of River Islands. A vicinity map of the improvements is included as Attachment " B".

Staff has inspected the improvements and the City Engineer has deemed them substantially complete and in accordance with the approved plans and City specifications, with the following exceptions: ( 1) the monument sign, which is still being manufactured, and ( 2) certain safety enhancements that were requested by staff and are pending completion ( Remaining Improvements). The safety enhancements include some additional fencing near the basketball courts, housekeeping pads for all utility structures, and stabilizing the decomposed granite so the material cannot be removed. Staff finds that these requested safety enhancements are not significant enough to prevent acceptance of the C1 Park. The approximate value of the improvements proposed for acceptance is $ 6,92,00. 31, as shown in the GASB 34 Report included in Attachment " C".

River Islands has provided a one- year warranty bond and unconditional lien releases for the completed improvements proposed for acceptance. Staff recommends that City Council accept the completed public improvements for the Lathrop Landing Community Park and accept the Remaining Improvements contingent on staff verification of their completion and receipt of unconditional lien releases for the Remaining Improvements.

BACKGROUND:

On March 27, 2007, City Council approved Vesting Tentative Map ( VTM) 3694, which was amended with updated Conditions of Approval ( COA) on June 1, 2015. On March 20, 2024, the City of Lathrop Planning Commission approved the Neighborhood Development Plan for the Town Center District within Phase 1 of River Islands. On March 25, 2024, City Council approved Tract 4167 Final Map ( Tract 4167) within the Town Center District for Multi -Family and Commercial lots. The final map dedicated the C1 Park parcel to the City of Lathrop as required by the Quimby Act. The C1 Park CITY MANAGER' S REPORT PAGE 2

ACCEPT LATHROP LANDING COMMUNITY PARK IMPROVEMENTS WITH

CONDITIONS FROM RIVER ISLANDS CONSTRUCTION, LLC, LOCATED

WITHIN THE TOWN CENTER DISTRICT OF RIVER ISLANDS
is within the geographic boundary of VTM 3694, Tract 4167, and Phase 1 of River Islands.

Construction of the Lathrop Landing Community Park is substantially complete. The only items remaining are: (1) installation of the monument sign, which is currently being manufactured, and ( 2) completion of staff -requested safety enhancements.

These improvements were identified during the inspection process as necessary to enhance user safety in the park but are not significant enough to prevent acceptance of the C1 Park. All other improvements have been inspected by staff and deemed complete and in accordance with the approved plans and City specifications by the City Engineer. The approximate value of the improvements proposed for acceptance is $ 6,92,00. 31as shown in the GASB 34 Report.

River Islands has provided a one- year warranty bond in the amount of $712, 80. 6 0869579) to cover any repairs or replacements due to defective materials or workmanship for one year beginning with this acceptance. River Islands has also submitted unconditional lien releases for the completed improvements. Staff will confirm installation of the monument sign, completion of the staff requested safety enhancements, and receipt of unconditional lien releases for the Remaining Improvements.

REASON FOR RECOMMENDATION:

Staff has inspected the improvements listed in the GASB 34 Report and confirmed they have been completed in accordance with City specifications and approved plans, with the exception of the monument sign installation and the staff -requested safety enhancements.

Staff recommends that City Council accept the completed public improvements listed in the GASB 34 Report and accept the Remaining Improvements contingent on staff verification of their completion and receipt of unconditional lien releases for the Remaining Improvements. River Islands has submitted unconditional lien releases for the completed improvements and a one- year warranty bond for the improvements proposed for acceptance.

FISCAL IMPACT:

River Islands Public Financing Authority ( RIPFA) will maintain the park at no additional cost to the City pursuant to the existing Maintenance Agreement with the City. The warranty bond, which is active for one year from the date of this acceptance, covers any repairs or replacements due to defective materials or workmanship for any of the improvements that become necessary during this period. The City' s Service Maintenance CFD 2013- 1 has been established to fund the maintenance and operating costs of the adjacent streets.
