CITY MANAGER' S REPORT
APRIL 13, 2026, CITY COUNCIL REGULAR MEETING
ITEM:

ITEM 4. 14

APPROVE RECLASSIFICATION OF THE SENIOR

CONSTRUCTION MANAGER TO AN AT -WILL,

CONFIDENTIAL UNREPRESENTED POSITION
RECOMMENDATION: Adopt Resolution to Approve the Reclassification of the Senior Construction Manager to an At -will,
Confidential Unrepresented Position, Approve the
Amended FY 2025-6 Grade Step Table, and
Amended Job Description to Reflect Unrepresented
Status
SUMMARY:

The City of Lathrop maintains three bargaining units, one sworn - unrepresented group, and one unrepresented group. Unrepresented positions are at -will, FLSAexempt, and typically involve management oversight or responsibility for sensitive or critical operations.

The proposed resolution adds the Senior Construction Manager classification to the unrepresented group due to the position' s high level of responsibility and involvement in complex, sensitive infrastructure projects. This classification is the highest non - sworn mid -management position below the Department Head level positions and is responsible for overseeing major Capital Improvement Projects ( CIPs), infrastructure related to development, and regulatory compliance. The position requires significant technical expertise and a high degree of institutional knowledge to manage and resolve complex municipal infrastructure issues.

BACKGROUND:

The Public Works Department oversees development projects, CIPs, regulatory compliance, and the operation and maintenance of City infrastructure, parks and facilities. It is the City' ssecond- largest department. The current structure includes the Assistant City Manager, Public Works Director/ City Engineer, Senior Construction Manager, two Project Managers, Utility Operations Superintendent, and Parks, Streets & Facilities Superintendent.

Due to the City' srapid growth, staffing has been realigned to meet increasing service demands. The Senior Construction Manager plays a critical leadership role in managing complex projects and ensuring regulatory compliance, requiring advanced technical expertise and decision - making authority. This position is comparable to the Chief Building Official and is recommended for designation as an at -will, unrepresented ( non -Department Head) classification.

FISCAL IMPACT:

There is no fiscal impact associated with this reclassification. The position will remain subject to the unrepresented employee benefit plan.
