PUBLIC HEARING ( PUBLISHED NOTICE) TO CONSIDER AN ORDINANCE TO AMEND SECTION 10. 08.30 OF THE CITY OF LATHROP MUNICIPAL CODE TO
ESTABLISH SCHOOL -ZONE PRIMA FACIE SPEED - LIMIT PROVISIONS, AND RESOLUTIONS TO ESTABLISH 20 MPH AND 15 MPH SCHOOL -ZONE PRIMA
FACIE SPEED -LIMITS
Staff requests that City, Council hold a public hearing, consider all information and public testimony, introduce and conduct the first reading of the proposed Ordinance, and adopt the accompanying 20 mph and 15 mph resolutions. The resolutions will become operative after the Ordinance to amend LMC Section 10. 08.30 becomes effective and applicable speed -limit signs are installed.
BACKGROUND:
Staff conducted a review of school - zone roadway segments to evaluate opportunities to reduce vehicle speeds and improve safety for students walking and bicycling to and from school. The review considered school - related pedestrian and bicycle activity, crossings, loading and pick- up/ drop- off activity, roadway configuration, existing posted speed limits, and applicable CVC requirements.
CVC Section 22352. 5authorizes a local authority to determine and declare, by ordinance or resolution, a 20 mph prima facie speed limit within a school zone. For purposes of this program, the 20 mph limit will apply during the school- zone/ childpresence conditions described in CVC Section 22352, including when children are going to or leaving school during school hours or the noon recess period and, where school grounds are not separated from the highway by a fence, gate, or other physical barrier, while the school grounds are in use by children. The 20 mph limit becomes operative when signs giving notice of the speed limit are erected.
CVC Section 22358. 4authorizes a local authority to establish a 15 mph prima facie speed limit at qualifying school - zone locations. To qualify, the roadway must be located within a residential district, contain no more than two traffic lanes, and have a maximum posted 30 mph prima facie speed limit immediately before and after the school zone. In addition, the proposed 15 mph school - zone segment must meet applicable requirements related to school -ground proximity, signing, and application to all lanes and both directions of travel. The proposed 15 mph resolution includes the required location - specific findings and establishes the qualifying segments identified in Attachment C.
The proposed Ordinance to amend LMC Section 10. 08.30 willestablish the City' s school - zone prima facie speed - limit provisions. The accompanying resolutions establish the initial 20 mph and 15 mph roadway segments.
The resolutions will be effective upon adoption; however, the speed -limit designations established by the resolutions will become operative only after the Ordinance to amend LMC Section 10. 08.30 has been finally adopted and becomes effective, and after signs giving notice of the applicable speed limits are erected. Following adoption of the proposed Ordinance, future roadway segments that meet the applicable CITY MANAGER' SREPORT PAGE 3

statutory criteria may be brought to City Council for consideration and designation by resolution. This process retains City Council authority over each future speed -limit designation without requiring a subsequent amendment to LMC Section 10. 08.30.
REASON FOR RECOMMENDATION:
The proposed Ordinance to amend LMC Section 10. 08.30 provides a consistent City process for establishing school -zone prima facie speed limits in accordance with state law. The accompanying resolutions identify the initial street segments recommended for 20 mph and 15 mph limits based on the applicable statutory criteria and school - related pedestrian and bicycle activity.
Reducing vehicle speeds during applicable school - zone periods is intended to improve the safety margin for students walking, bicycling, and crossing streets near schools.
The proposed process also maintains City Council authority over future school - zone speed - limit designations while allowing future qualifying segments to be considered by resolution.
FISCAL IMPACT:
Sufficient funds are included in the adopted FY 2026/7 budget under Capital Improvement Project ( CIP) PS 26- 08 for staff time and the purchase and installation of required speed - limit signage. Any future school - zone speed -limit designations will be evaluated for available funding at the time of City Council consideration.
