Dear Mayor, Members of the City Council and Mr. Moore,
This agenda item 5 was brought to my attention. We respectively request that the city pull the agenda item until we have a chance to discuss. The item appears to require that an entity pay deposits and other fees prior to performing work in the public right of way. SoCalGas has a franchise agreement with the City that provides for the payment of franchise fees in exchange for the right to perform work.
It should be amended to include explicit language that utilities are exempt.
SoCalGas therefore requests that the item be pulled to accommodate SCG's review of the ordinance with City staff.
The ordinance under review states as follows:
A MIP encroachment permit deposit in the amount of $10,000 is proposed with the understanding that depending on the potential impact and complexity of the proposed MIP and level of city staff time required to review and analyze, the fee may be adjusted to a higher amount. Additionally, the fee will be considered a "time and matcrials" fee subject to reimbursement if less than the full amount is utilized by City staff and City Engineer in overseeing and enforcing the permit.
5. Second Reading and Adoption of Ordinance No. 1197-23 to amend certain sections in Chapter 12.08 of Title 12 of the Lawndale Municipal Code establishing Encroachment Permits for Major Improvement Projects Recommendation: that the City Council approve the second reading and adopt Ordinance No. 1197-23, Ordinance amending Chapter 12.08 of Title 12 the Lawndale Municipal Code establishing Encroachment Permits for Major Improvement Projects to reflect recent changes in rules, regulations, and fees.
Thank you for the ongoing partnership.

This agenda item 5 was brought to my attention. We respectively request that the City pull the agenda item until we have a chance to discuss. The item appears to require that an entity pay deposits and other fees prior to performing work in the public right of way. SCE has a franchise agreement with the City that provides for the payment of franchise fees in exchange for the right to perform work. The subject fees appear to violate SCE's long-standing franchise and exposes the City to considerable liability.
It should be amended to include explicit language that utilities are exempt.
SCE therefore requests that the item be pulled to accommodate SCE's review of the ordinance with City staff.
