DATE: September 2, 2024
TO: Honorable Mayor and City Council
FROM: Sean M. Moore, City Manager
PREPARED BY: Michael Reyes, Municipal Services Director SUBJECT: Lease Agreement w/ Sheriff Dept

BACKGROUND
For the past two decades the City of Lawndale has contracted with the Sheriff's Department for all law enforcement needs regarding public safety and crime reduction within the City of Lawndale. The City has allowed the use of one of its buildings, located at 15331 Prairie Ave. to be used by the Sheriff's Department for office work, equipment and storage space, and as a facility for the public to access Sheriff's Department personnel and services.

STAFF REVIEW
Ever since the partnership between the City of Lawndale and the Los Angeles County Sheriff's Department (LASD) began for Public Safety services, the City and County have had a long standing agreement in which the City provides a City owned building for use by the Sheriff's Department, known as the Lawndale Service Center.

The Lawndale Service Center operates as a resource for residents to access Monday through Friday from 9:00 am until 5:00 pm for assistance with law enforcement questions and needs. Additionally, the Service Center provides 24 hour a day, 7 day a week access to law enforcement personnel so that they can access computers, write reports, store their equipment and vehicles, and serve the community in a much more efficient manner.

The City provides this facility at no cost to the Sheriff's Department with the understanding that the Sheriff's Department handles any costs for utilities, maintenance and repairs. Further, LASD cannot make alterations to the structure without prior written approval from the City. Periodically, the contract between the City and LASD is re-examined and evaluated to make sure that both parties are sufficiently served by the contract.

The general terms of the existing agreement are for the use of a 3200 square foot building with 18 parking spaces, for no rent, for five years. The agreement also allows for the Tenant to have cancellation rights with thirty (30) days written notice. If no such notice is given then the lease is on a month to month basis with the same terms as the previous lease which state that the Lessee agrees to repair, and maintain as necessary at Lessee's own expense the entire interior and exterior of the Premises.

These shall include windows, exposed plumbing, fire extinguishers, floor coverings, the sewer system, and the grounds.

Lessor shall be responsible for replacing items or building components at the Premises that deteriorate beyond regular repair and maintenance by Lessee.

Staff has been working on extending this Lease Agreement with the County of Los Angeles Real Estate Division Representative Douglas Cole. Mr. Cole is the Senior Real Property Agent for the County of Los Angeles and will draft the new lease for signatures at a later date pending a verbal verification from the City Council that the City still wishes to continue with this lease agreement with all prior conditions and language from the previous contract to remain the same but with an additional five year extension from today's date through August 5, 2029.

In the many years that the City has partnered with the Sheriff's Department, there have been few concerns regarding the terms of this agreement. The partnership between the City of Lawndale and LASD for the use of this building remains strong and after review both parties feel that the contract is sufficient as written and that no significant changes are necessary in order to continue with this agreement.

LEGAL REVIEW
The City Attorney's Office has reviewed this original lease agreement and approves it to form.

FISCAL IMPACT
There is no fiscal impact to the City as a result of this Lease Extension.

RECOMMENDATION
Staff recommends that the City Council approve the extension of the Lease Agreement between the City of Lawndale and the Los Angeles County Sheriff's Department for an additional five years.
