PRESENTATION - DRAFT
City of Lemon Grove
Proclamation
“FIRE PREVENTION WEEK”
October 8th – 14th, 2023
WHEREAS, fire is a serious public safety concern both locally and nationally, and homes are the locations where people are at greatest risk from fire. Cooking is the leading cause of home fires and home fire injuries. Home fires killed an estimated 2,840 people in the United States in 2021, and fire departments in the United States responded to an estimated 353,500 home fires. Almost three out of five home fire deaths occur in homes with no smoke alarms (40%), or smoke alarms which failed to operate (17%). Lemon Grove’s residents should take action when alarms chirp or beep. Missing or non-functional power sources, including missing or disconnected batteries, dead batteries, and disconnected hardwired alarms or other AC power issues, are the most common factors when smoke alarms fail to operate; and
WHEREAS, cooking safety is critical to prevent home fires, injuries, and deaths. When leaving the kitchen for any reason turn off all burners and heat sources. When the smoke alarm sounds, Lemon Grove’s residents may have less than two minutes to escape to safety. It is important to have a home escape plan, drawing a map of each level of the home, showing all doors and windows for different ways out. Lemon Grove’s residents should practice the home fire escape plan with everyone in the household, including visitors; and teach children to escape on their own in case adults can’t help them. Once residents are out, they should stay out, never going back inside the home for people, pets, or things; and
WHEREAS, Lemon Grove’s residents are responsive to public education measures and are able to take action to increase their safety from fire, especially in their homes. The 2023 Fire Prevention Week™ theme, “Cooking safety starts with YOU. Pay attention to fire prevention™" effectively serves to help us better understand the importance of cooking safely.

NOW, THEREFORE, I, Racquel Vasquez, Mayor for the City of Lemon Grove, together with the City Council, do hereby proclaim October 8-14, 2023, to be “FIRE PREVENTION WEEK” in the City of Lemon Grove.

We urge all the residents of the City of Lemon Grove to plan your escape in case of fire. These efforts support the many public safety activities of the City of Lemon Grove’s fire and emergency services. ___________________________________

CITY OF LEMON GROVE

CITY COUNCIL

STAFF REPORT
Item No. 2.

Meeting Date: October 3, 2023
Submitted to: Honorable Mayor and Members of the City Council Department: Community Development Department
Staff Contact: Bill Chopyk, Special Planning Consultant Michael Fellows, AICP, Community Development Manager
[email protected]
Item Title: Public Hearing to Consider an Appeal of the Community Development Manager’s Decision to Deny Minor Use Permit MUP-220-0007, a Request for Early Separation Findings for a Cannabis Dispensary at 8280 Broadway in the Heavy
Commercial Zone. APN 499-200-22-00
Recommended Action:
1) Conduct the Public Hearing;
2) Receive Public Comment; and
3) Adopt a Resolution (Attachment A) denying an Appeal of the Community Development Manager’s decision to deny Minor Use Permit (MUP) MUP-220- 0007 for early separation findings for a proposed cannabis dispensary (CD) at 8280 Broadway in the Heavy Commercial (HC) zone.

Background:

On April 19, 2023, the Appellant, Pick Axe Holdings, LLC, filed a MUP application for early separation findings for a CD at 8280 Broadway, File No. MUP-220-0007 (Attachment B). On May 3, 2023, the Community Development Manager (CDM) denied MUP-220-0007 (Attachment C). On May 9, 2023, an appeal was filed by the Appellant (Attachment D) of the Community Development Manager’s decision to deny the MUP, File No. AA2-200-0006. The Appellant requested that the Appeal hearing be scheduled on the August 15, 2023 City Council agenda. City staff consented to the requested Appeal hearing date. However, the August 15, 2023 Council meeting was cancelled. Thus, the Appellant and City staff agreed to hold the public hearing on October 3, 2023.

Appeal of MUP-220-0007
October 3, 2023
P a g e | 2
Discussion:

The basis for the CDM denial of MUP-220-0007 is as follows:
• The property is located within 1,000 feet of an approved Conditional Use Permit (CUP-210-0002) for a CD at 8290 Broadway. The City Council approved CUP-210- 0007 on May 2, 2023.

Zoning requirements found in Lemon Grove Municipal Code (LGMC) 17.32.090 B. 1. require that dispensaries not be located within one thousand feet of any other regulated use (CD’s) either inside or outside the jurisdiction of the city.

LGMC 17.28.020 O, states that the sole purpose of an MUP for early separation findings is to determine if an application meets or does not meet separation requirements. No other approval may be granted as part of this this permit type. The finding is valid for up to one year.

In the Appeal application (Attachment D), the Appellant claims: “When MUP-220- 0007 was filed there was no record of decision of an early separation finding at 8290 Broadway. The 8290 Broadway CUP-210-0007 is void as a matter of Lemon Grove law.” However, the LGMC does not specifically require approval of a MUP prior to submitting a CUP application for a CD. The MUP merely establishes the protection of a regulated use (CD) for one year. CUP-210-0007 at 8290 Broadway is active and valid for one year (until May 2, 2024) unless extended by the City Council prior to expiration. This is supported by the Lemon Grove Municipal Code, as follows:

LGMC 17.32.040 Application states: Cannabis businesses which dispense, deliver, process, manufacture, distribute, and cultivate cannabis shall be required to obtain a conditional use permit consistent with Section 17.28.050 prior to operation. The fact that an applicant possesses other types of state or city permits or licenses does not exempt the applicant from the requirement of obtaining a conditional use permit to operate a cannabis business; and
LGMC 17.32.090 (B) Distance Requirements states that an application may be submitted provided the proposed facility meets the required distance measurements.

Required Findings for a Minor Use Permit:

Municipal Code Section 17.28.052 C. requires that the following findings be made to approve a MUP:

1. The use is compatible with the neighborhood or the community;

2. The use is not detrimental to the health, safety, convenience or general welfare of persons residing or working in the vicinity;

3. The use complies with performance standards according to Section 17.24.080; Appeal of MUP-220-0007
October 3, 2023
P a g e | 3

4. The use is consistent with the applicable provisions of the particular zoning district and with the policies and standards of the general plan.

In addition to the above findings required for the granting of a MUP, LGMC Section

17.32.080 requires that the decision-making authority shall consider the following:

A. Whether the approval of the proposed use will violate the minimum requirements set forth in this chapter for distance separations between establishments which dispense, process or cultivate cannabis; and separations between establishments which dispense, process or cultivate cannabis and other specific regulated or protected land uses as set forth in this chapter.

B. Whether the proposed use complies with Title 17 of the Lemon Grove Municipal Code. (Ord. 458 § 2, 2021; Ord. 443 § 1, 2016)
Findings made by Staff:

The CDM decision to deny MUP-220-0007 is based on the following finding:

Finding 17.32.080 A.: The proposed location for a CD at 8280 Broadway would violate the minimum distance separations between CD establishments. The subject property is located within 1,000 feet of an approved Conditional Use Permit (CUP-210-0002) for a CD at 8290 Broadway, next door to 8280 Broadway.

The City Council approved CUP-210-0002 on May 2, 2023.

Staff could not make the Finding in 17.32.080 A. in the affirmative.

Conclusion:

The City Council must make the MUP findings, as stated above, in order to overturn the Community Development Manager’s denial of the Appeal. Staff is recommending the City Council uphold the denial of the Appeal for MUP-220-0007.

DISTRICT BOARD

STAFF REPORT
Item No. 4.

Meeting Date: October 3, 2023
Submitted to: Honorable Chair and Members of the District Board Department: Sanitation District
Staff Contact: Izzy Murguia, Public Works Director
[email protected]
Item Title: Amendment No. 1 to the Professional Services Agreement with Rick Engineering Company for the FY 2020-21 and
2021-22 Sewer Replacement and Maintenance Project
(Continued from September 19, 2023)
Recommended Action: Adopt a Resolution approving Amendment No. 1 (Attachment A) to the professional services agreement (No. 2021-24) with Rick Engineering Company and 2021-22 Sewer Replacement and Maintenance Project.

Summary: On January 18, 2022, the District Board adopted Resolution No. 2022-312 awarding an agreement (No. 2021-24) to Rick Engineering Company (Rick Engineering) for a base amount of $331,949 and a not-to-exceed amount of $508,694, for the design of the Fiscal Year 2020-21 and 2021-22 Sewer Replacement and Maintenance Project.

Approval is requested for a first amendment to the agreement in the amount of $139,890 to include the design of upgrading and potential realigning 2,170’ of 8-inch sewer pipe north of Broadway between Massachusetts Ave and West Street (Capital Improvement Project (CIP) #18), and seeks to extend the agreement to January 19, 2024. The requested amendment will increase the agreement’s base amount to $426,439 and the not-toexceed amount to $648,584.

Discussion: On January 18, 2022, the District Board adopted Resolution No. 2022-312 awarding an agreement (No. 2021-24) to Rick Engineering Company to design the Fiscal Year 2020-21 and 2021-22 Sewer Replacement and Maintenance Project. The project consists of developing engineering plans, design specifications and cost estimates (PS&E), Rick Engineering Amendment No. 1 to

related documents, and bid/construction support to repair and replace sewer pipe and appurtenances at the following locations:

1. CIP#2: Miscellaneous Manhole Repairs

2. CIP #5: Mt. Vernon to Shirley Lane (Lining and Replacement of 2,200’)

3. CIP #8: South Broadway (Lining and Replacement of 1,085’)

4. CIP #11: Skyline at Mt. Vernon (Replacement of 632’)

5. CIP #13: Baldwin, Roy, Kempf (Replacement of 1,950’)

6. CIP #25: Cinderella Place (Replacement of 300’)

7. CIP #26: Taft Street (replacement of 270’)

8. CIP #27: Mt Vernon Street (Replacement of 125’)
The agreement’s amount is for $331,949 and includes additive work in the amount of $176,745 for a total not-to-exceed amount of $508,694. The total project cost estimate is $534,000.

Staff seeks the approval of Amendment No. 1 to the Agreement to include the design of upsizing 2,170’ of 8-inch sewer pipe to 10” on north of Broadway between Massachusetts Ave. and West Street (CIP #18). Currently, the sewer runs east to west just north of Broadway within private commercial properties and public alleys between Massachusetts Avenue and West Street, crossing Harris Street and Citrus Street perpendicularly. This project seeks to realign the sewer into the Broadway public right-of-way from Massachusetts Avenue to West Street. This project is included in the FY 2023-24 Capital Improvement Plan as a standalone design project. This project is being “fast-tracked” and seeks to be included in Rick Engineering’s current design project in order to be completed before the construction of a proposed commercial development at 3450 West Street. The construction of the said commercial development would create significant design and construction challenges for CIP #18, if CIP #18 were to be addressed after the development of the commercial property.

Staff seeks an increase to the agreement in the amount of $139,890 for the additional design services and alternatives (traffic control, sewer abandonment plans, easement vacation plats). Amendment No. 1 would increase the agreement’s base amount to $426,439 and the not-to-exceed amount to $648,584; the project total cost would subsequently increase to $673,890. The table below is a summary of the revised project cost estimate as a result of Amendment No. 1:

Amendment No. 1 $94,490
Amendment No. 1 Additive $45,400
Sub-Total $648,584
Contingency $25,306
Project Total $673,890
In addition to the payment terms, this amendment also retroactively extends the term of the agreement by one (1) year to January 19, 2024. Approval of this amendment would ensure continued progress to the existing design work and ensure Rick Engineering staff maintain a consistent and steady workflow to complete design of the project as soon as possible.
