Village 7 Specific Plan Amendment Revised Conditions of Approval
The purpose of this memorandum is to include additional conditions of approval in regard to the Village 7B Amendments Project, specifically the City Council resolution to amend Village 7 Specific Plan. These conditions respond to additional requests related to the Scheiber and Aitken Ranch II properties with Village 7 and are intended to strengthen trail accessibility, recreational connectivity, and public amenity delivery within the project area.

The recommended conditions are intended to ensure that future development within the affected properties provides functional, accessible, and well-integrated recreational improvements consistent with the goals of the Village 7 Specific Plan and City of Lincoln General Plan.

The Village 7 Specific Plan Amendment includes land use modifications affecting the Scheiber and Aitken Ranch II properties within the Village 7 plan area. During review of the application, additional requests were identified regarding trail access, public recreational features, and the relationship between future development and open space or trail corridors.

The Scheiber and Aitken Ranch II properties are located within an area where future residential development, open space areas, parks, and pedestrian and/or bicycle facilities are expected to function as an integrated network. To ensure that these improvements are planned and implemented in a coordinated manner, additional conditions of approval are recommended for incorporation into the resolution.

Attached you’ll find a revised version of Attachment 8, Exhibit A (Village 7 Specific Plan Amendment Conditions of Approval) for your consideration. Please include the revised conditions of approval if a motion is made on this project/resolution.

1. Item 14B Attachment 8, Exhibit A – Village 7 Specific Plan Amendment Revised Conditions of Approval

EXHIBIT A
The Amended Village 7 Specific Plan is recommended for approval subject to the following conditions:

1. All property within the Amended Village 7 Specific Plan Area shall be subject to the applicable mitigation measures adopted as part of the Village 7B Addendum and the updated Mitigation Monitoring Plan for the certified Village 7 Specific Plan Project EIR (SCH No. 2005062001).

2. The amendments to the Village 7 Specific Plan, approved by this action, are set forth in Exhibit B and incorporated by this reference.

3. The ability to proceed under any approvals, entitlements, or authorizations granted by this action are contingent upon a Development Agreement being executed with the City of Lincoln and Lincoln Land Holdings, LLC specifying the terms and conditions of financing public improvements, conditions of development and reimbursement matters.

The City Council shall have complete discretion to approve the terms and conditions of the Development Agreement and will not be bound by any provisions adopted as part of this resolution. Where any conflict exists between these conditions of approval and the Development Agreement, the terms of the Development Agreement will control.

4. Future development entitlements within the Village 7B project site will be required to analyze the following intersections pursuant to the recommendations of the Village 7 Specific Plan Amendment Local Transportation Analysis: Ferrari Ranch Road/Caledon Circle (East) Courtyard Loop; Ferrari Ranch Road/Groveland Lane; Moore Road/Ferrari Ranch Road/Shallus Boulevard.

5. 80% of residential lots within the Scheiber and Aitken Ranch II properties will be located within 350 feet radius of paseos, trails, and/or linear parks. The remaining 20% of residential lots within the Scheiber and Aitken Ranch II properties will be located within 500 feet radius of paseos, trails, and/or linear parks. Distances shall be measured from the property line.

6. Paseos and linear parks will include larger nodes or areas to accommodate features including, but not limited to, grass and/or gathering areas, benches, picnic tables, and volleyball spaces.

7. If feasible, paseos and trails should not cross collector streets and try to avoid street intersections as much as traffic patterns and egress requirements will allow. If paseos and trails must intersect major streets, the pedestrian facilities should go under the roadway if topography allows and is feasible.

8. The proposed trail south of Auburn Ravine within the northern portion of the project should meander and be located near the ravine to the extent feasible. The trail system should include benches and signage dispersed throughout. 14B Attachment 8, Exhibit A REVISED

9. The Developer shall research the potential to include a pathway along the northern project boundary for pedestrian and equestrian use. If this multi-use trail is feasible, it shall comply with the City of Lincoln Design Criteria and Procedures Manual, and should include at minimum two access points to remaining project area. 14B Attachment 8, Exhibit A REVISED
