SUBJECT:
Adopt a Resolution Authorizing the City Manager to Purchase of a Skeeter Type 5 Wildland Fire Engine for the Fire
Department and rescind Resolution 2024-041 previously
approved by City Council on March 12, 2024. (Mike Osborne) SUBMITTED BY:

Item Number 13.F
STAFF RECOMMENDATION:
Staff recommends that City Council adopt a resolution rescinding Resolution 2024-041 to accommodate a higher cost to procure a Skeeter Type 5 fire engine, authorize the City Manager to execute a purchase order for $415,000 and authorize the use of remaining funds in previously approved CIP V402 for the purchase of additional equipment for the Skeeter.
BACKGROUND/INTRODUCTION:
A new Type 5 engine is necessary for the replacement of unit #1751, a 1999 Type VI engine.
A new Type 5 fire engine will provide the Fire Department with a well-equipped fire-fighting vehicle capable of reliable access to the City's small lots, ravines, open space areas, golf courses and trail systems, which the City’s larger Type I or III engines cannot typically access.
Procurement will be made through HGAC cooperative purchasing. The Houston-Galveston Area Council (H-GAC) is a regional organization in Texas that serves as a voluntary association of local governments.
FINDINGS/ANALYSIS:
The purchase proposed in this report was initially included in the FY 23/24 list of approved CIP vehicles and equipment, which provides a total of $525,000 in Fund 100 CIPV402 for a new fire engine.
The Skeeter Type 5 fire engine's original quoted cost of $396,189 was cooperatively priced through HGAC Contract No. FS12-23 and will be purchased from Golden State Fire Apparatus. A purchase order authorization of $415,000 is now needed rather than the original amount of $410,000 which was previously approved with Resolution No. 2024-041 on March
STAFF REPORT
305
12, 2024. The increase is needed to cover the Fire Department’s change orders to ensure all required specifications are achieved. As the final invoice exceeded the prior authorized $410,000, in full transparency staff is seeking to increase the authorization to cover the final $415,000 invoice.
No budget augmentation is required for this increase as the total budget initially approved for this vehicle was $525,000. The remaining funds from the approved budget will be used to purchase additional equipment for the Skeeter.
FISCAL IMPACT:
A total expense of $525,000 for CIPV402 is included within the approved FY 26/27 budget in Fund 100 – General Fund.

Adopt a Resolution Creating CIP 728; Authorizing the City Manager to Execute an Agreement with West Coast Netting in an Amount not to Exceed $125,000 for the Design, Purchase, and Installation of Additional Protective Netting in the Outfield of McBean Stadium, and Authorizing a Budget Augmentation in the Amount of $150,000. (Scott Boynton)

Item Number 15.A
STAFF RECOMMENDATION:
Staff recommends the City Council adopt a resolution authorizing (1) the City Manager to execute a Contract for Services with West Coast Netting (WCN) in an amount not to exceed $125,000 for the design, purchase, and installation of additional protective netting in the outfield of McBean Stadium; (2) a $25,000 contingency for project change orders, for a total project cost not to exceed $150,000; (3) the creation of CIP 728 - McBean Stadium Safety Netting; (4) making finding authorizing an exception to form and informal competitive process as allowed in section 3.24.100; and (5) a $150,000 budget augmentation to the new CIP. The project will reduce the risk of baseballs leaving the stadium and entering adjacent residential properties. Funding for the augmentation will come from a reduction to the approved budget for CIP 688 - Parking Lot Slurry Seal.
BACKGROUND/INTRODUCTION:
McBean Stadium is located adjacent to residential properties along the southern portion of the playing field, particularly from right field to right-center field. During baseball games and practices, batted baseballs, including home runs and other high-trajectory balls, may travel beyond the existing outfield netting and into neighboring properties.
The stadium currently has protective netting extending approximately 30 feet in height which was installed by West Coast Netting however, the existing system does not provide complete coverage of the area where batted balls have the potential to leave the playing field. Staff have received concerns regarding baseballs entering neighboring yards, potentially resulting in property damage or creating safety risks for residents, visitors, vehicles, and other property.
STAFF REPORT
312
To address these concerns, the proposed project would extend the existing outfield safety netting by an additional 20 feet, resulting in a total netting height of approximately 50 feet along the identified portion of the outfield perimeter. The additional high-strength safety netting would provide a greater physical barrier between the playing field and adjacent residential properties and substantially reduce the likelihood of batted baseballs entering neighboring yards.
Staff have selected West Coast Netting to provide the additional safety netting. West Coast Netting is the original installer of the existing netting at the ballfield. Section 3.24.100 - A.(2) permits an exception to formal or informal competitive process if the addition to or repair of the existing equipment can be more efficiently added to or repair by a particular company or manufacturer. Based on the West Coast Netting's familiarity with McBean Stadium and the company's experience with the existing installations, including the current outfield netting and the VIP and bleacher shade structures staff request City Council make a finding that utilizing this vendor will provide the most efficient addition to the existing netting.
The proposed improvement is intended as a proactive risk-reduction measure in the area identified as having the greatest potential for batted baseballs to travel toward neighboring homes. While no protective netting system can guarantee that a baseball will never leave the stadium, increasing the netting height from 30 feet to 50 feet would provide an additional layer of protection and help reduce the potential for property damage and safety concerns associated with baseballs entering surrounding residential areas.
Staff visited the neighboring homes impacted by balls leaving the stadium. These homes are located in the 200 block of 1
st
street. Of the 7 homes visited, staff talked with 3 of the residents. Of the 3 residents spoken to, they were all in favor of extending the netting. The remaining four residents did not return calls.
FINDINGS/ANALYSIS:
The proposed safety-netting project is intended to be a proactive risk-reduction measure.
While
no protective system can guarantee that a baseball will never leave the stadium, extending the
existing netting would provide an additional physical barrier in the area identified as having the
greatest potential for balls to travel toward neighboring homes.
FISCAL IMPACT:
The proposed project has a total fiscal impact not to exceed $150,000, consisting of a $125,000 contract with West Coast Netting and a $25,000 contingency for potential project change orders. Staff requests creation of CIP - McBean Stadium Safety Netting and a $150,000 budget augmentation.
The $150,000 budget augmentation will be funded by reducing approved CIP Project No. 688 - Parking Lot Slurry Seal by $150,000, reducing that project budget from $690,000 to $540,000. The Parking Lot Slurry Seal project budget reduction may require deferment of some project scope.

SUBJECT:
Adopt a Resolution Approving the City Manager to Enter into an Agreement with White Brenner, Legal Services. (Sean
Scully)
SUBMITTED BY:
City Clerk
DEPARTMENT:
City Manager's Office
DATE:
September 22, 2026
Item Number 15.B
STAFF RECOMMENDATION:
Staff recommends City Council adopt a resolution authorizing the City Manager to execute an agreement for City Attorney services with White Brenner, LLP.
BACKGROUND/INTRODUCTION:
In early 2026, the City of Lincoln (“City”) restructured its City Attorney’s Office. On March 24, 2026, the City retained White Brenner, LLP (“Firm”) to provide interim City Attorney services while the City evaluated its long-term legal-services needs.
Based on the Firm’s services during the interim period, the City seeks to retain Firm and have them provide ongoing City Attorney services, with Douglas L. White serving as City Attorney and Nubia I. Goldstein serving as Assistant City Attorney. The Firm has submitted an Agreement for City Attorney Services (“Agreement”) to govern its ongoing relationship with the City.
FINDINGS/ANALYSIS:
The Agreement retains the Firm to provide legal services requested by the City. Under the Agreement, Douglas White and Nubia Goldstein would be the primary contacts for the City, with City receiving legal services from all Firm attorneys and legal professionals. City Attorney services would include:
• Providing legal advice and consultation as requested by the City and City staff; • Attendance at City Council meetings, when necessary; • Coordination and management of any outside counsel; • Preparation and review of City documents, including contracts, agreements, memoranda, ordinances, meeting agendas, resolutions, and staff reports; • Advice and consultation related to the acquisition and sale of property; • Guidance related to the Brown Act, the Political Reform Act, Public Records Act, Proposition 218, and other legal requirements; and
• Representing the City in legal and regulatory actions, including management of authorized litigation through final disposition as provided in the Agreement.
The Firm’s rates for the City Attorney services are charged at a blended rate for all attorneys
STAFF REPORT

and legal professionals, which includes Firm partners, of counsel, associates, paralegals, and law clerks. Legal service rates are charged on an hourly basis, in six-minute increments, and depend on the type of work being undertaken on behalf of the City. The blended rates are as follows:
• General Counsel legal services: $250 per hour
• Special Counsel legal services: $350 per hour
-Special Counsel legal services include, but are not limited to, review and preparation of contracts, land use and real estate matters, litigation, water, matters paid for by enterprise funds, complex environmental, and labor and employment services. • Reimbursable legal services: $475 per hour
-Reimbursable legal services include, but are not limited to, developer funded land use projects or bond financing.
The rates are adjusted annually on January 1st of each calendar year in accordance with CPI increases for the preceding period, and a 2.5% technology fee is assessed, subject to periodic review and potential increase. The Agreement may be terminated by either the City or the Firm upon thirty (30) days’ advance written notice, except, as set forth in the municipal code, following a City election where Firm cannot be terminated for ninety (90) days without cause.
FISCAL IMPACT:
The Agreement for City Attorney Services is unlikely to have a significant financial impact on the City. The services provided are already budgeted expenses for the City’s legal department.

Agreement for City Attorney Services
a. Secretarial, word processing, or clerical services which are included in the hourly rates of the Firm’s legal professionals; and
b. Charges associated with telephone or facsimile services.
5.7. Invoices and Statements.
a. Firm shall provide City with an itemized statement or invoice for fees, costs, expenses, and advances incurred on a monthly basis . All statements and invoices shall indicate the basis for all charges, including the hours worked or cost incurred, the hourly rate, and a brief description of the work performed. Firm will establish separate billing projects for specific matters and funding categories as City may direct.
b. Payments shall be made by City to Firm within thirty (30) days of receipt of any statement or invoice, except for those specific items on an invoice that are contested or questioned and are returned by City with a written explanation of the question or contest within thirty (30) days of receipt of the statement or invoice. Payments made to Firm more than thirty (30) days after the due date shall draw interest at ten percent (10%) per annum, except as otherwise set forth herein.
5.8. Payment of Taxes . Firm is solely responsible for the payment of employment taxes incurred under this Agreement and any similar federal or state taxes.
5.9. Authorization to Perform Services. Firm shall perform services and incur costs as authorized by this Agreement or by an officer or body of City acting within its lawful authority. Such authorization remains subject to applicable appropriations and spending limitations.
5.10. Continuing Litigation Authority.
a. Scope of Authority. Unless the City Council expressly provides otherwise, its authorization to defend an action or proceeding includes authorization for the City Attorney to conduct and manage that litigation through final disposition, including trial, postjudgment proceedings, appeals, petitions for rehearing or review, extraordinary writ proceedings seeking review of or relief from orders or judgments in that action, and proceedings on remand. This authorization expressly includes authority to make strategic and procedural decisions concerning the litigation and to determine whether to seek, pursue, defend against, or refrain from seeking appellate review or other relief within those proceedings, without further case-specific City Council approval.
325
City of Lincoln
Agreement for City Attorney Services
b. Council Consultation and Oversight. The City Attorney shall exercise this authority consistently with the City Council’s established objectives for the representation and shall keep the City Council reasonably informed of material developments, litigation strategy, and anticipated costs. The City Attorney shall consult with the City Council concerning significant litigation decisions, including whether to seek or refrain from seeking appellate review, and whenever materially changed circumstances affect the objectives of the representation or the basis for a significant litigation decision. When reasonably practicable, consultation shall occur sufficiently before an applicable deadline or implementation of a significant decision to afford the City Council a meaningful opportunity to direct a different course.
c. Preservation of Rights. When necessary to preserve the City’s rights before consultation with the City Council can reasonably occur, the City Attorney may take appropriate protective action within the authority conferred by this section, including filing a notice of appeal or petition for extraordinary relief, and shall promptly inform the City Council.
This authority does not excuse timely consultation when reasonably practicable. d. Retained Council Authority. The City Council retains authority to establish the objectives of the representation, direct the course of the litigation, and limit, modify, or revoke the authority conferred by this section. Consultation with and reporting to the City Council do not, by themselves, condition the exercise of previously delegated authority on further Council approval. The City Attorney shall comply with lawful Council direction and applicable professional obligations.
e. Limitations. This section confers no settlement authority. Settlement authority shall be governed by otherwise applicable law and City authorization. This section does not independently authorize commencement of a separate affirmative action, consent to entry of judgment, or compromise or abandonment of the City’s substantive claims or rights, except for decisions concerning appellate review expressly authorized by subsection (a). All authority conferred by this section remains subject to applicable law, authorized appropriations, and spending limitations.
Section 6. Term and Termination. This Agreement shall begin on the Effective Date and shall continue until terminated by City or Firm upon thirty (30) days’ advance written notice to the non-terminating Party (the “Term”). Notwithstanding the foregoing, City shall not terminate this Agreement or remove the designated City Attorney without cause during the first ninety (90) days of a Councilmember’s term of office, subject to applicable law. This provision applies whether the Councilmember is newly elected or reelected. Upon termination, Firm shall be entitled to, and City shall immediately pay, all amounts owed to Firm. City, however, may condition payment of such compensation upon Firm delivering to City copies of any or all reports, data, maps, models, charts, studies, surveys, photographs, memoranda, plans, specifications, records, files, or any other documents or materials, in electronic or any other form, that Firm prepares or obtains pursuant to this Agreement and that relate to the matters covered hereunder. Originals of attorney work product shall remain the property of the Firm.

Agreement for City Attorney Services
Section 7. Independent Contractor. Firm shall perform all Legal Services required under this Agreement as an independent contractor of City and shall remain, at all times as to City, a wholly independent contractor with only such obligations as are required under this Agreement.
Neither City nor any of its employees shall have any control over the manner, mode, or means by which Firm, its agents, or employees, render the Legal Services required under this Agreement, except as otherwise set forth. City shall have no voice in the selection, discharge, supervision, or control of Firm employees, servants, representatives, or agents, or in fixing their number, compensation, or hours of service. Nothing in this section limits the City Council’s authority to establish the objectives of the representation or to direct the conduct of litigation as provided in Section 5.10.
Section 8. Conflicts.
8.1. No Present Conflicts. Firm has no present or contemplated employment that is adverse to City. Firm agrees that it shall not represent clients in matters , either litigation or non- litigation, against City. However, Firm may have past and present clients , or may have future clients, who, from time to time, may have interests adverse to City, and Firm reserves the right to represent such clients in matters not connected with its representation of City.
8.2. Duty to Disclose Future Conflicts. If a potential conflict of interest arises in Firm’s representation of two clients, if such conflict is only speculative or minor, Firm shall inform City and seek waivers from each client with regard to such representation.
8.3. No Conflict in Violation of Government Code Section 1090. Firm may serve other clients, but none whose activities are within the corporate limits of City or whose business, regardless of location, would place Firm in a “conflict of interest,” as that term is defined in the rules of professional responsibility governing Firm’s profession, unless such conflict may be waived by City and City chooses to waive such conflict in writing.
Section 9. Errors and Omissions Insurance Coverage.
9.1. Insurance Coverage. During the Term of this Agreement, Firm shall at all times maintain insurance coverage for Errors and Omissions with a limit not less than One Million Dollars ($1,000,000.00) per occurrence and Three Million Dollars ($3,000,000.00). A certificate of insurance shall be provided to City within thirty (30) days of execution of this Agreement. In the event that any coverage required by this Section is reduced, limited, or materially affected in any manner, Firm shall provide written notice to City at Firm’s earliest possible opportunity and in no case later than thirty (30) days after Firm is notified of the change in coverage.
9.2. Remedies. In addition to any other remedies City may have, if Firm fails to provide or maintain any insurance policies or policy endorsements to the extent and within the time herein required, City may, at its sole option, exercise any of the following remedies, which are alternatives to other remedies City may have and are not the exclusive remedy for Firm’s breach:
