3. The proposer, prior to proposing, made adequate good faith efforts to meet the goal.
D. A DBE joint venture partner must be responsible for specific contract items of work or clearly defined portions thereof. Responsibility means actually performing, managing, and supervising the work with its own forces. The DBE joint venture partner must share in the capital contribution, control, management, risks and profits of the joint venture commensurate with its ownership interest.
E. A DBE must perform a commercially useful function pursuant to 49 CFR 26.55, that is, a DBE firm must be responsible for the execution of a distinct element of the work and must carry out its responsibility by actually performing, managing and supervising the work.
F. The proposer must list only one subconsultant for each portion of work as defined in their proposal and all DBE subconsultants should be listed in the bid/cost proposal list of subconsultants.
G. A prime consultant who is a certified DBE is eligible to claim all of the work in the Contract toward the DBE participation except that portion of the work to be performed by non-DBE subconsultants.
5. COUNTING DBE PARTICIPATION
Materials or supplies purchased from DBEs count towards the DBE goal under the following conditions:
A. If the materials or supplies are obtained from a DBE manufacturer, count 100 percent of the cost of the materials or supplies. A DBE manufacturer is a firm that operates or maintains a factory, or establishment that produces on the premises the materials, supplies, articles, or equipment required under the Contract and of the general character described by the specifications.
B. If the materials or supplies purchased from a DBE regular dealer, count 60 percent of the cost of the materials or supplies. A DBE regular dealer is a firm that owns, operates or maintains a store, warehouse, or other establishment in which the materials, supplies, articles or equipment of the general character described by the specifications and required under the Contract are bought, kept in stock, and regularly sold or leased to the public in the usual course of business. To be a DBE regular dealer, the firm must be an established, regular business that engages, as its principal business and under its own name, in the purchase and sale or lease of the products in question. A person may be a DBE regular dealer in such bulk items as petroleum products, steel, cement, gravel, stone or asphalt without owning, operating or maintaining a place of business provided in this section.
C. If the person both owns and operates distribution equipment for the products, any supplementing of regular dealers’ own distribution equipment must be, by a long-term lease agreement and not an ad hoc or Agreement-by-Agreement basis. Packagers, brokers, manufacturers’ representatives, or other persons who arrange or expedite transactions are not DBE regular dealers within the meaning of this section.
D. Materials or supplies purchased from a DBE, which is neither a manufacturer nor a regular dealer, will be limited to the entire amount of fees or commissions charged for assistance in the procurement of the materials and supplies, or fees or transportation charges for the delivery of materials or supplies required on the job site, provided the fees are reasonable and not excessive as compared with fees charged for similar services

Quality Control | PCE has established a vigorous and extensive quality control program that is structured to ensure project timelines and budgets are met, as follows:
Calculations and plans are placed in a thorough peer review process, corrected, and backchecked prior to submission.
Cost estimate quantities are reviewed for accuracy and unit cost is verified with current relative construction cost prior to submittal.
PCE will confirm that the designs will not incorporate materials or equipment of a single source or requiring long lead times, without the prior consent of the City.
Plans, estimates, drawings, reports, and other documents are reviewed to ensure that they are neat in appearance, well organized, and technically and grammatically correct to assist in the construction process.
Backcheck comments are reviewed prior to follow- up revisions being made (including back check meetings to clarify if necessary) and fully addressed to submittal.
Plans are reviewed to identify all standards and specifications meet City standards and other potentially required standards.
Precision Civil Engineering Inc. provides all the in-house services needed to complete projects, thus our management structure is formulated to ensure that projects will be completed on time and within budget. Our staff has vast experience preparing and reviewing plans, specifications and estimates; making us confident that our processes are practical and timely.
Project Management | PCE’s project management and cost control includes:
Develop project schedules and tracking.
Critical path project management timeline kept up to date.
Any task requiring long lead times will be identified and scheduled to start as early as possible.
Any portions of work that can be performed simultaneously or overlap will be scheduled as such, to reduce the overall project timeline.
Update and maintain project schedules.
Plans are reviewed to identify cost-savings where possible.
Identify issues that arise during design and construction, that may impact the project schedule and budget.
Conduct periodic coordination meetings with the City and/or contractors, as needed.
PCE uses Computer-Aided Drafting software, Civil 3D, which allows seamless integration of revisions/changes, therefore increasing efficiency. Review will utilize BlueBeam.
Perform thorough due diligence and research to minimize potential redundancy.
Conduct periodic Project Team meetings with all team members including sub-consultants, if used.

The project is funded through the Hazard Mitigation Grant Program (HMGP) and the Prepare California Match Program.
On October 14, 2025, the City Council authorized staff to issue a Request for Qualifications (RFQ) to solicit proposals from qualified engineering firms to provide professional engineering and design services for the project. The RFQ was released on December 3, 2025, with a submittal deadline of January 5, 2025, at 2PM.
The city received qualifications from the following firms:
• REFIK ELECTRICAL ENGINEERS
• BORELLI AND ASSOCIATES, INC.
• INTEGRATED PROJECT SOLUTIONS
Each submittal was evaluated by an internal selection committee using the criteria outlined in the RFQ. The selection process was qualifications-based and conducted in accordance with Government Code Sections 4525–4529.5. Evaluation criteria included professional qualifications, technical understanding of the project, relevant experience, and the firm’s demonstrated ability to complete work of similar scope and complexity.
Interviews were optional under the RFQ; however, the city elected not to conduct interviews and evaluated proposals solely on the written submittals.
Item #: 16.9
Consent
Based on the scoring results, Integrated Project Solutions received the highest overall ranking. The firm demonstrated strong experience with generator and electrical design for public infrastructure, a clear understanding of the city’s operational needs, and the technical capacity to complete the required design, environmental, and permitting work. APPENDIX 1 – QUALITY CONTROL PLAN
Quality Assurance/Quality Control Processes
The Integrated Project Solution’s Design Quality Management Plan (DQMP) is applied on all our projects. The DQMP structure includes quality management and interdisciplinary reviews by an independent team of subject matter experts and senior discipline-specific engineers, architects, and support personnel.
As work begins, our design quality control manager will implement the DQMP for the project and confirm final documents are coordinated and completed in accordance with the DQMP.
The assigned project manager, acting as the task order manager, will assemble the required project team based on the scope of work and establish clear lines of communication with our team and the government team. Working with the quality control manager, the project manager will schedule internal DQMP reviews and external reviews with the client and stakeholders, along with managing the comment database, if required.
Our program is highly effective and provides interdisciplinary reviews by professional engineers, architects, and support personnel at various milestones throughout execution of the project.
Design quality control tasks are separately scheduled, identified and monitored within the accounting system. The project manager will coordinate these items with the team to assure that the project design quality control plan is consistent with corporate procedures, the statement of work and the client’s expectations.
Our design quality assurance/quality control tasks, or QTs, are integrated, scheduled, and monitored into each design contract and in concurrence with each design phase. How these are integrated is shown in our design process map in this proposal. Our QTs are:
QT-1
Conceptual and preliminary design review by an independent project quality control review team of senior staff members
QT-2
Review of design notes, drawings and specifications by the project manager, team leaders and design team at various milestones throughout the design
QT-3
Final review of design notes, drawings, and specifications by an independent project quality control review team of senior staff members. Review of “rough draft” specifications by an independent team in our specifications department
QT-4
Final review of drawings, specifications, and cost estimates by the review team in the company’s quality control department.

Engineering Management
IPS assigns a dedicated discipline lead to oversee the design process, maintain technical issue logs, and participate in regular coordination meetings with City staff. Discipline leads are accountable for coordination across engineering teams, document tracking, and value engineering reviews. All design activities are governed by a defined Quality Management Plan to ensure technical accuracy and compliance throughout the project lifecycle.
Safety Through Design
The IPS team integrates safety into every stage of the design process. Early in design development, we conduct hazard identification workshops with stakeholders to address risks related to installation, operations, and long-term maintenance. Our goal is to engineer out or minimize environmental, safety, and health hazards. We consider material handling, access/egress, and maintenance during design to support safe construction and future operations.
Risk Management
IPS supports the City’s Risk Management Program by identifying and addressing project risks and opportunities throughout design. Our proactive approach includes early identification of threats to cost, schedule, or constructability, along with mitigation strategies aligned with project priorities. We continuously optimize workflows to maintain schedule and cost performance without compromising quality.
Cost & Schedule Control
IPS is structured for rapid deployment and schedule-sensitive delivery. Our internal controls include weekly tracking of hours and budget, centralized project oversight, and change management protocols to prevent scope creep. Our team is cross-trained and scalable, allowing us to adjust resources as project needs evolve. This agility ensures continuity, accountability, and on-time, on-budget delivery—even under accelerated timelines.

Attachment 1: Federal Contract Provisions Addendum Page 1 of 6 Attachment 1: Federal Contract Provisions Addendum
This Addendum is hereby incorporated into and made part of the Agreement between the City of Lindsay (“CITY”) and the Consultant (“CONSULTANT”). The provisions set forth below are required for federally assisted contracts pursuant to 2 CFR Part 200, Appendix II and other applicable federal statutes and executive orders.
Remedies for Breach of Contract
In the event of CONSULTANT’s failure to perform or other breach of contract, the CITY shall have all remedies available at law and in equity. These include, but are not limited to, withholding of payment, contract termination, and recovery of damages.
Termination for Cause and Convenience
The CITY may terminate this Agreement, in whole or in part, for cause in the event of CONSULTANT’s failure to comply with any material term or condition. The CITY may also terminate this Agreement for no cause at its sole discretion if determined to be in the CITY’s or the Federal Government’s interest. In the event of termination for no cause, CONSULTANT shall be paid for all eligible costs incurred and work satisfactorily performed up to the date of termination. Termination shall be effective upon CONSULTANT’s receipt of CITY’s written termination notice.
Equal Employment Opportunity
During the performance of this Agreement, CONSULTANT agrees as follows:
(1) CONSULTANT will not discriminate against any employee or applicant for employment because of race, color, religion, sex, sexual orientation, gender identity, or national origin. CONSULTANT will take affirmative action to ensure that applicants are employed, and that employees are treated during employment without regard to their race, color, religion, sex, sexual orientation, gender identity, or national origin. Such action shall include, but not be limited to, the following:
Employment, upgrading, demotion, or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. CONSULTANT agrees to post in conspicuous places, available to employees and applicants for employment, notices to be provided setting forth the provisions of this nondiscrimination clause.
(2) CONSULTANT will, in all solicitations or advertisements for employees placed by or on behalf of CONSULTANT, state that all qualified applicants will receive consideration for employment without regard to race, color, religion, sex, sexual orientation, gender identity, or national origin. (3) CONSULTANT will not discharge or in any other manner discriminate against any employee or applicant for employment because such employee or applicant has inquired about, discussed, or disclosed the compensation of the employee or applicant or another employee or applicant. This provision shall not apply to instances in which an employee who has access to the compensation information of other employees or applicants as a part of such employee’s essential job functions discloses the compensation of such other employees or applicants to individuals who do not otherwise have access to such information, unless such disclosure is in response to a formal complaint or charge, in furtherance of an investigation, proceeding, hearing, or action, including an investigation conducted by the employer, or is consistent with the contractor's legal duty to furnish information.
Attachment 1: Federal Contract Provisions Addendum Page 2 of 6 (4) CONSULTANT will send to each labor union or representative of workers with which he has a collective bargaining agreement or other contract or understanding, a notice to be provided advising the said labor union or workers' representatives of the contractor's commitments under this section, and shall post copies of the notice in conspicuous places available to employees and applicants for employment.
(5) CONSULTANT will comply with all provisions of Executive Order 11246 of September 24, 1965, and of the rules, regulations, and relevant orders of the Secretary of Labor. (6) CONSULTANT will furnish all information and reports required by Executive Order 11246 of September 24, 1965, and by rules, regulations, and orders of the Secretary of Labor, or pursuant thereto, and will permit access to his books, records, and accounts by the administering agency and the Secretary of Labor for purposes of investigation to ascertain compliance with such rules, regulations, and orders. (7) In the event of CONSULTANT’s noncompliance with the nondiscrimination clauses of this Agreement or with any of the said rules, regulations, or orders, this Agreement may be canceled, terminated, or suspended in whole or in part and CONSULTANT may be declared ineligible for further Government contracts or federally assisted construction contracts in accordance with procedures authorized in Executive Order 11246 of September 24, 1965, and such other sanctions may be imposed and remedies invoked as provided in Executive Order 11246 of September 24, 1965, or by rule, regulation, or order of the Secretary of Labor, or as otherwise provided by law. (8) CONSULTANT will include the portion of the sentence immediately preceding paragraph (1) and the provisions of paragraphs (1) through (8) in every subcontract or purchase order unless exempted by rules, regulations, or orders of the Secretary of Labor issued pursuant to section 204 of Executive Order 11246 of September 24, 1965, so that such provisions will be binding upon each subcontractor or vendor.
CONSULTANT will take such action with respect to any subcontract or purchase order as the administering agency may direct as a means of enforcing such provisions, including sanctions for noncompliance:
Provided, however, that in the event CONSULTANT becomes involved in, or is threatened with, litigation with a subcontractor or vendor as a result of such direction by the administering agency, CONSULTANT may request the United States to enter into such litigation to protect the interests of the United States.
CITY further agrees that it will be bound by the above equal opportunity clause with respect to its own employment practices when it participates in federally assisted construction work: Provided, That if CITY so participating is a State or local government, the above equal opportunity clause is not applicable to any agency, instrumentality or subdivision of such government which does not participate in work on or under the Agreement.
CITY agrees that it will assist and cooperate actively with the administering agency and the Secretary of Labor in obtaining the compliance of contractors and subcontractors with the equal opportunity clause and the rules, regulations, and relevant orders of the Secretary of Labor, that it will furnish the administering agency and the Secretary of Labor such information as they may require for the supervision of such compliance, and that it will otherwise assist the administering agency in the discharge of the agency's primary responsibility for securing compliance.
City further agrees that it will refrain from entering into any contract or contract modification subject to Executive Order 11246 of September 24, 1965, with a contractor debarred from, or who has not demonstrated eligibility for, Government contracts and federally assisted construction contracts Attachment 1: Federal Contract Provisions Addendum Page 3 of 6 pursuant to the Executive Order and will carry out such sanctions and penalties for violation of the equal opportunity clause as may be imposed upon contractors and subcontractors by the administering agency or the Secretary of Labor pursuant to Part II, Subpart D of the Executive Order. In addition, CITY agrees that if it fails or refuses to comply with these undertakings, the administering agency may take any or all of the following actions: Cancel, terminate, or suspend in whole or in part this grant (contract, loan, insurance, guarantee); refrain from extending any further assistance to the applicant under the program with respect to which the failure or refund occurred until satisfactory assurance of future compliance has been received from such applicant; and refer the case to the Department of Justice for appropriate legal proceedings.

In the event of any violation of the clause set forth in paragraph (1) of this section CONSULTANT and any subcontractor of CONSULTANT shall be liable for the unpaid wages.
