14. ACTION ITEMS

14.1 CSET Lease Agreement Renewal – Senior Services at Community Center Action & Recommendation: Staff recommends that the City Council approve the renewal of the Property Lease Agreement between the City of Lindsay and Community Services Employment Training (CSET) and authorize the City Manager to execute all documents necessary to complete the agreement.

Submitted by: Dario Domingues, Acting City Manager & Director Public Works Presentation: Angel Avitia and Emma Ibarra from CSET provided an overview of senior services in Tulare County. CSET operates six senior centers, including one in Lindsay, offering hot meals, activities, and socialization. They also provide educational programs, resource referrals, scam prevention, and health-related workshops. CSET manages the county’s Meals on Wheels program, serving about 300 homebound seniors, though a waitlist remains due to limited funding. Staff conduct regular safety-check calls for homebound and congregate seniors. A 24-hour information and assistance hotline is available to seniors in Tulare, Kings, and Kern counties.

Public Comment: The public comment period was opened. The following comments were received:

Diane Mata shared concerns regarding the operations and quality of services at the senior center. She expressed disappointment with the activities offered, stating that seniors often have to organize activities themselves. She discussed past meetings with CSET staff and other partners, noting that she saw little improvement or follow-through.

Mata also raised concerns about the quality and preparation of meals, suggesting a pilot program be tested locally before committing to a broader provider. She stated that communication and guidance for staff at the senior center, particularly regarding activities, is lacking and emphasized the need for clearer direction and better support for both staff and seniors.

Margaret Martinez commented on her past experiences with the senior center, stating that she appreciated the presentation but previously had difficulty reaching staff for assistance. She explained that she had left messages for CSET staff without receiving a response and felt unable to obtain needed information. She expressed concern that contact information for assistance is not posted at the facility, noting that visitors receive individual papers instead. Martinez stated that having clear, visible contact and conduct information posted would help residents feel heard and supported. She concluded by saying she often felt ignored rather than listened to.

Anita Gustuson asked for clarification regarding the lease agreement referenced in the staff report. She noted that the lease for PSW and the Corral Bookshop was mentioned, but PSW did not appear in the list of attendees, and she inquired whether it was intended to be included or handled separately
Director of Parks and Recreation Armando da Silva shared comments regarding recent experiences with CSET’s operations at the senior center. He explained that when he began with the City, staff worked with CSET to return services to the facility, and during that period, the on-site staff member, Robert, was effective and responsive. Following Robert’s departure, da Silva noted a decline in communication and engagement. He and other City staff had previously attended activities such as bingo and interacted regularly with seniors but later felt they were no longer welcome due to new policies. He stated that seniors often expressed concerns about limited activities and resources, prompting staff to donate crafts. Da Silva said the program provides valuable services but may benefit from adjustments and improved coordination. He concluded by expressing support for the program and noting that returning staff similar to Robert would be beneficial.

Recreation Coordinator Gustavo Arredondo provided comments as both a resident and a City employee. He stated that residents have expressed concerns that the senior center’s curriculum and enrichment activities are limited and inconsistently offered.

Although CSET maintains a digital calendar of scheduled activities, he noted that, based on feedback, only the recovery program consistently occurs. He asked CSET leadership to review the programs and resources to ensure seniors receive the services being promoted. Arredondo emphasized that while the City does not oversee the senior center program, it relies on CSET to deliver the services effectively for Lindsay’s residents.

Council Action: Mayor Pro Tem Soria moved to approve the renewal of the Property Lease Agreement between the City of Lindsay and Community Services Employment Training (CSET) and to authorize the City Manager to execute all documents necessary to complete the agreement. The motion was seconded by Councilmember Sanchez and was unanimously approved, 4–0.

15. REQUEST FOR FUTURE ITEMS
Councilmembers requested that the stove at the senior center be addressed and properly situated. The councilmember also asked that the roadway conditions near Burger King be reviewed to determine responsibility for needed improvements. Additionally, the councilmember recognized two local youth troops—one celebrating its one-year anniversary and another newly formed—and expressed appreciation for their involvement in the community. The councilmember encouraged continued engagement and concluded by wishing everyone a good night.

16. ADJOURNMENT

FROM: Dario Dominguez, Acting City Manager & Director of Public Works Agenda Title: Letter of Support for Hanford, Kings County – High-Speed Rail Maintenance Facility Site Selection

ACTION & RECOMMENDATION
Staff recommends that the City Council authorize the Mayor or City Manager to sign and submit a Letter of Support for the selection of the Hanford, Kings County site as the High-Speed Rail Maintenance Facility location.

BACKGROUND | ANALYSIS
The California High-Speed Rail Authority (Authority) is in the process of identifying the preferred location for its High-Speed Rail Maintenance Facility. The letter provided to the Authority expresses regional endorsement and outlines key attributes of the Hanford location.

Subject: High-Speed Rail Maintenance Facility – Hanford, Kings County Dear Chair Kawa,
On behalf of the City of Lindsay, we are writing to express our strong support for selecting the Hanford, Kings County site as the High-Speed Rail Maintenance Facility location. Hanford and the broader Kings County region offer a centrally located, wellconnected, and highly capable site that aligns with the long-term operational needs of California’s high-speed rail system.

The proposed site’s geographic centrality along the statewide rail alignment provides efficient operational support and reduces deadhead costs, while the area’s connectivity to major highways, freight corridors, and regional transit strengthens overall system resilience. These attributes make Hanford an exceptionally strategic location for maintenance operations.

Kings County’s strong record of collaboration with state agencies, regional partners, and the private sector also gives confidence in the region’s readiness to help deliver this critical facility. The local workforce—skilled in trades, logistics, engineering, and advanced manufacturing—is well prepared to support construction and long-term operations, ensuring economic and workforce benefits for surrounding communities like Lindsay and others throughout the Central Valley.

The City of Lindsay recognizes that locating the maintenance facility in Hanford will generate meaningful positive impacts across the region. The project will catalyze new

development, strengthen supply chains, and expand training opportunities that elevate economic mobility for our residents and neighboring communities. It reflects a vital commitment to equitable investment in the Central Valley.

For these reasons, the City of Lindsay strongly encourages the California High-Speed Rail Authority to select the Hanford, Kings County site for the High-Speed Rail Maintenance Facility. We stand ready to collaborate with our regional partners to support a world-class operational center that advances California’s future transportation network.

STAFF REPORT
TO: Lindsay City Council
MEETING DATE: September 22, 2026
DEPARTMENT: Public Safety
FROM: Nicholas Nave, Director of Public Safety
AGENDA TITLE: Fire Emergency Dispatching & Communications Agreement Renewal

ACTION & RECOMMENDATION
Approve the renewal of the agreement between the City of Lindsay and the County of Tulare for Fire Dispatching services for the period of August 1st, 2026 through July 31st, 2031, and to authorize the City Manager to execute documents.

BACKGROUND | ANALYSIS
The Lindsay Department of Public Safety provides 24-hour fire services within the City of Lindsay’s urban boundaries, as well as mutual aid to other agencies as requested. Prior to 2018, the Lindsay Department of Public Safety had a part-time dispatch center, which operated during normal business hours but contracted with the Tulare County Fire Department for after-hours dispatching services.

In 2022, the department transitioned back to full-time stand-alone fire services dispatching through the Tulare County Fire Department as a way to enhance service and reduce overall cost. This service is provided by annual or multi-year agreement between the City of Lindsay and the County of Tulare and includes a sliding-scale concession based on mutual aid responses within the City of Lindsay’s sphere of influence.

The proposed renewal would cover the next five years, expiring on July 31st, 2031, and is billed at 50% of the actual cost to the county based on mutual aid concession. The Lindsay Department of Public Safety has been pleased with the services provided during the current and prior years, and staff recommend this agreement be renewed for the coming year.

FISCAL IMPACT
The total annual cost for services to be provided under the renewed agreement is $63,944.22, which is typically incorporated in the department’s budget from the General Fund.

occupancy connect.

It also shows where corrections may return to
staff and where planning and building work can
occur concurrently. This gives applicants a
clearer view of the full approval path before they
submit construction plans.

Purpose: clearer expectations, fewer incomplete
submittals, and better coordination among
Planning, Building, Fire, and Engineering.

Variance Guide for Applicants
PCE prepared a plain-language guide that explains when a variance may be appropriate and what the City needs to
make the required findings.

The guide covers:
• Purpose and limits of a variance
• Application materials and supporting evidence
• Findings required for a decision
• Public notice, hearing, conditions, and appeal steps
• Difference between a variance and a zoning-code change The guide will help applicants submit complete requests before investing in detailed plans.

Zoning Ordinance and Online Code Update
Current work
• Compare adopted ordinances with the code currently available online
• Correct errors, outdated references, formatting problems, and internal inconsistencies
• Consolidate current zoning regulations so staff and applicants rely on the same source
• Establish a routine for posting future amendments promptly Outcome
A more accurate, searchable online zoning ordinance that supports consistent decisions and reduces applicant confusion.

Planning Programs and City Initiatives
• Permanent Local Housing Allocation funds: PCE will prepare an options memo so the City can select an approach and direct the application process.
• Pro-Housing Designation: City to begin evaluating and preparing for an application to HCD's Prohousing Designation Program. Designated jurisdictions can compete for Prohousing Incentive Program grants and may receive priority or additional points in certain state funding programs. • Emergency generator project: Six generator pads are proposed at lift stations and the wastewater treatment plant. Staff will document the applicable CEQA exemption as design advances. • Planning process guides and flowcharts: PCE will work on these as needed. Recently identified need for a Tentative Pacel Map/Pacel Map (final) process to help applicants understand the process from beginning to end.

Meeting Time 9:45 a.m. - 10:45 a.m.

Program Format Social, recreational, wellness, educational, and enrichment activities Programming
Programming would rotate throughout the month to provide a mix of structured activities and informal social opportunities. Examples may include bingo, arts and crafts, trivia, card and board games, coffee socials, technology assistance, guest speakers, health and wellness presentations, nutrition education, seasonal activities, birthday celebrations, community resource presentations, and participant-choice activities.

The program would also provide a foundation for future older-adult recreation opportunities such as excursions, walking groups, special events, volunteer projects, intergenerational activities, and additional wellness or enrichment programming as participation and community interest develop.

Program Access and Fee Structure
Staff recommends a two-path access structure that adds value to existing Wellness Center memberships while maintaining an affordable standalone program option for adults who are interested only in Lindsay 55.

Item #: 15.1
Presentations
Qualifying Standard Wellness
Center Memberships
Lindsay 55 access is included at no additional charge for members who meet the age requirement.

Excluded Limited-Use
Memberships
3-Month Pickleball, 3-Month Swim, and LUSD Learner memberships would not include Lindsay 55 access.

Lindsay 55 Program Fee $15.00 per month for access to regularly scheduled Lindsay 55 Club meetings and standard Club activities.

Program Fee Limitations Does not include access to the gym, pool, fitness classes, or other Wellness Center amenities or programs requiring separate membership, registration, or admission.

Initial Evaluation
Staff plans to evaluate the program during its first three months of operation. Evaluation measures would include total enrollment, unique participants, average attendance per meeting, continued enrollment, program fee revenue and direct expenses, highest- and lowest-attended activities, and participant satisfaction. Results would be used to refine the activity mix, fee structure, and future program development.

FISCAL IMPACT
The program is anticipated to be administered within existing Wellness Center space and existing Recreation Services staffing. No new position or facility modification is proposed as part of this action. Qualifying standard Wellness Center members would receive Lindsay 55 Club access at no additional charge; therefore, no additional revenue would be generated from those participants specifically for Club access.

Participants who do not hold a qualifying standard Wellness Center membership may enroll in Lindsay 55 by paying the proposed $15.00 monthly Program Fee. Payment of the Program Fee provides access to regularly scheduled Lindsay 55 Club meetings and standard Club activities for the applicable month, but does not provide access to the gym, pool, fitness classes, or other Wellness Center amenities. Program fee revenue would help offset direct program costs such as arts and crafts materials, games, small prizes, refreshments, educational materials, and other activity supplies. Actual fiscal impact will depend on enrollment and participation.

No additional General Fund appropriation is requested at this time.

STAFF REPORT
TO: Lindsay City Council
MEETING DATE: September 22, 2026
DEPARTMENT: Parks and Recreation
FROM: Armando da Silva, Director of Parks and Recreation Services AGENDA TITLE: Awarding the contract for the Palm Tree and Tree Trimming Services

ACTION & RECOMMENDATION
Staff recommends the Council award the contract for Palm Tree and Tree Trimming Services to ELITE Maintenance & Tree Services in the amount of $55,095.00 for three (3) years, plus additional funds for alternate sites and a 3% increase on the total amount for years two (2) and three (3).

Staff further recommends authorizing the City Manager and/or his designee to execute the Agreement.

BACKGROUND
The City of Lindsay is seeking the services of a qualified contractor to perform routine maintenance and trimming of City-managed trees and palm trees. The majority of the trees and palms included in this proposal have received contracted maintenance services over the past three years, from 2023 through 2025.

However, due to previous City budget constraints, some trees have not received significant maintenance trimming since 2017.

On September 2, 2026, a public bid opening was held, and five (5) bid proposals were received and publicly opened. The five (5) responsive bidders and the corresponding bid results are listed as follows:

The District may terminate this Agreement by giving thirty (30) days’ written notice to the Contractor. Such written notice shall be sufficient to stop further performance of services by Contractor. Neither party shall be required to indemnify the other for the other party’s negligence or willful misconduct.

The City’s responsibilities include its operation and maintenance of the pool and associated facilities and the acts and omissions of City-provided staff and lifeguards. LUSD and City of Lindsay | Swimming Pool Use | 2026–27
Proposed revision • September 15, 2026 Page 2
Each party shall initially provide and pay for its own defense. Neither party has an immediate obligation to assume or fund the other party’s defense solely upon tender of a claim. Following a final determination of relative fault or a written allocation agreed to by both parties, reasonable defense costs attributable to the indemnifying party’s share of fault shall be reimbursed under this section. The parties expressly intend this defense-cost arrangement to apply in place of any contrary default defense obligation under Civil Code section 2778. The parties may agree in writing to a joint defense or another allocation of defense costs in a particular matter. Each party shall promptly notify the other of a claim involving this Agreement and reasonably cooperate in its defense. These obligations survive expiration or termination of this Agreement. 7 Liability Insurance and Evidence of Coverage
Each party shall maintain, at its own expense throughout the term of this Agreement, commercial general liability coverage on an occurrence basis with limits of at least $2,000,000 per occurrence and $4,000,000 aggregate, and automobile liability coverage for vehicles used in performance of this Agreement with a combined single limit of at least $2,000,000 per accident. Coverage may be provided through insurance, a public-agency self-insurance program, a joint powers authority risk pool, or a combination of these arrangements.

Before the first scheduled District use, each party shall provide the other with a certificate of insurance or other evidence of coverage. Each party shall provide an endorsement or equivalent coverage document naming the other party and its governing body, officers, employees, and agents as additional insureds or additional covered parties under its general liability coverage, but only with respect to liability caused, in whole or in part, by the covered acts or omissions of the party providing that coverage in performance of this Agreement. If a party’s insurer or risk pool cannot provide that protection, the parties shall agree in writing to an alternative before District use begins. A certificate alone does not satisfy the endorsement or equivalent coverage requirement.

This Agreement does not require either party’s coverage to be primary and noncontributory to the other party’s coverage and does not require a waiver of subrogation. Any such requirement must be separately agreed to in writing by both parties after confirmation by their respective insurers or risk pools. Insurance requirements do not expand or reduce the responsibilities allocated in Section 6.

Each party shall give the other at least 30 days’ advance written notice of cancellation, nonrenewal, or a material reduction in required coverage when known in advance, and otherwise promptly after receiving notice or becoming aware of the change. Each party shall maintain replacement coverage sufficient to meet this section without a lapse.
8 Independent Contractor Status
While engaged in carrying out the terms and conditions of this Agreement, the Contractor is an independent Contractor, and not an officer, employee, agent, partner, or joint venturer of the District. 9 Workers’ Compensation Insurance
Contractor agrees to provide all necessary workers’ compensation insurance for Contractor’s principals and employees, if any, at Contractor’s own cost and expense. 10 Fingerprinting
Contractor shall at all times comply with the fingerprinting and criminal background investigation requirements of the California Education Code (“Education Code”) section 45125.1. Accordingly, by checking the applicable boxes below, Contractor and District agree to the following:
[ ] A. Contractor and principals, employees, and subcontractors assigned to provide services under this Agreement will always be in the presence of a District employee or have no contact with District students. [ ] B. Attachment A
Scope of Work
City of Lindsay Swimming Pool Use
July 1, 2026 – June 30, 2027
1 Purpose
The City of Lindsay (“City”) will provide Lindsay Unified School District (“District”) access to the City of Lindsay swimming pool for District-sponsored educational, athletic, recreational, and community programming during the 2026-27 fiscal year.

The intent of this agreement is to provide the District with a broad and flexible allocation of pool access that may be used based on District needs throughout the year. 2 Term
The term of this Scope of Work is July 1, 2026 through June 30, 2027. 3 Compensation
The District will pay the City a flat amount of $70,000 for the services and pool access described in this Scope of Work.

The $70,000 represents full compensation for the District’s use of the pool under this agreement, including normal City staffing and lifeguard services required for scheduled activities. No additional pool rental, staffing, lifeguard, or facility-use fees will be charged for activities occurring within the District’s 400-hour allocation unless mutually agreed to in writing.
4 Pool Use Allocation
The District will receive up to 400 hours of pool use during the agreement term.

The 400 hours may be used flexibly for District-sponsored purposes, including, but not limited to:

Lindsay High School Swim Team practices, meets, and related activities; Lindsay High School physical education;
Other District or learning community activities and programs; and District-sponsored summer open swim.

The District may adjust the allocation of hours among these uses throughout the year based on program needs and pool availability.

For purposes of this agreement, one hour of use means one clock hour of scheduled District access to the pool, regardless of the number of City employees, lifeguards, or other personnel assigned to support that use.
5 Scheduling
The City and District will designate representatives to coordinate scheduling.

The parties will make reasonable efforts to establish anticipated dates and recurring uses in advance while maintaining flexibility for additional District requests throughout the year.

Use is subject to pool availability, previously scheduled activities, necessary maintenance, and temporary closures. Activities covered by this agreement will not require separate rental agreements or additional facility- use fees.

Coordinate scheduling with the District; and
Promptly communicate known closures, maintenance periods, or other conditions that may affect District use.
7 District Responsibilities
The District will:

Coordinate requested pool use with the City;
Provide appropriate District supervision for learners and District-sponsored participants; Ensure participants comply with applicable facility and safety requirements; and Leave the facility in reasonable condition following District use. 8 Facility Closures and Unavailable Hours
Hours that cannot be used because the pool is unavailable due to City maintenance, repairs, mechanical issues, safety closures, or other City-related facility interruptions will not count against the District’s 400-hour allocation.

The parties will make reasonable efforts to reschedule affected hours during the agreement term.

If the City is unable to provide the full 400 hours by June 30, 2027, the District will receive a credit or refund for the unused hours at a rate of $175 per hour, unless the parties mutually agree to another resolution in writing.
