7 Council Meeting Comment July 20, 2022
Good Evening City Council and Staff,
From: Dale Carlson
I want to reiterate the council approved spending $35,000 for a trash enclosure ($70,000 was asked for originally for two enclosures) and $60,000 for murals, both of which are not a necessity and are funds that could have been applied to a kitchen appliance upgrade at the Community Building.

I do not believe the kitchen has been renovated recently, but the gas oven and stove top that were there during my time have pilot lights that were always lit since they are not the modern electronic ignition system. The kitchen was always hot due to this and consumes excess natural gas, which is a valuable commodity and an additional monthly expense to the city’s PG&E utility bill.

The purchase of self-igniting kitchen appliances would be a safety upgrade to the building and cost savings to the city, as well as an asset to the community. There are a lot of infrastructure issues that need to be looked at and the council needs to be aware of the necessities needed rather than spending tax dollars on non-essential items. I am only stating what I know from my experience at the city, and I have not seen anything in the budgets to indicate the kitchen has been upgraded with new appliances recently.

Thank you

Title: General Plan Annual Progress Report
Contact Information: Kevin Valente, AICP, City Planner
Location: Citywide
Background: All cities and counties in California are required to prepare a long-term comprehensive plan, known as a General Plan, to cover a wide range of issues to guide future growth. General Plans are required to have following components or Elements: Land Use, Circulation, Housing, Conservation, Open Space, Noise, Safety, and Environmental Justice. Pursuant to Government Code (GC) Section 65400, California now requires an annual report on the status of the General Plan and progress in its implementation.

Part of the State's requirement is the presentation of the report to the local legislature, which is the Live Oak City Council. This report has been submitted to the California Office of Planning and Research (OPR), as required.

Analysis: The attached Annual Progress Report Memo provides an overview to the California Office of Planning and Research summarizing the progress the City of Live Oak has made in implementing the programs contained within the General Plan in order to achieve the adopted Goals and Policies.

Overall, the City of Live Oak has made great progress towards reaching its goals related to Land Use, Circulation, Community Character, Conservation and Open Space, Economic Development, Public Utilities, Services, and Facilities, Parks and Recreation, Public Safety, and Noise.

Fiscal Impacts: None.

Recommendation: Receive and file the General Plan Annual Progress Report.

2021 General Plan Annual Progress Report
9 TO: Office of Planning and Research
FROM: Live Oak Planning Department
SUBJECT: City of Live Oak General Plan Annual Progress Report DATE: June 10, 2022
The Live Oak General Plan serves as the foundational document when making planning decisions concerning land use and development. The guiding principles in the General Plan include:
• Maintaining the small-town character of Live Oak;
• Encouraging development that has unique and high-design and creates a sense of place;
• Support for local social and cultural activities;
• Guiding the growth of the downtown area as the City continues to grow; • Creating local employment opportunities;
• Generating fund to maintain and improve infrastructure and public services; and • Prioritizing pedestrian and bicycle safety and convenience.

The Live Oak General Plan also places emphasis on creating balanced neighborhoods.

Neighborhoods should have an activity center with higher activities uses, with density and intensity decreasing as one moves away from that core. The Live Oak General Plan also highlights the need for a balanced land use mix as to create balanced neighborhoods.

This document will provide an overview of the implementation programs contained within the Live Oak General Plan. Overall, the City of Live Oak has made great progress towards reaching its goals. Below includes an analysis of the implementation programs that have been completed since the adoption of the Live Oak General Plan
Land Use Element
In 2009, a Wastewater Collection System Master Plan and a Water Master Plan were created for Live Oak. The Wastewater Collection System Master Plan analyzed the existing systems in place and created new recommendations and identified areas needing improvement. The Water Master Plan analyzed the current water demand, existing facilities, and provided recommendations for improvements. In 2011 the Master Drainage Study was prepared, which analyzed current conditions for drainage and areas of concern (LU-2.1). 10 2
The Live Oak Zoning Regulations were also amended in 2012 to implement the goals and policies of the Live Oak General Plan through the designation of compatible land uses, residential densities and intensity of uses (LU-3.2). The zoning update also created more flexible development standards for the Downtown Combining Zone District (LU-4.2). These standards include no minimum yard setbacks and no on-site parking or loading is required. This change helps to encourage full redevelopment of targeted revitalization areas (LU-4.2).

Circulation Element
In regards to circulation, the City has made progress towards the goals set in place in the General Plan by updating Section 17 - Zoning of the Live Oak Municipal Code. This update of the Zoning Code included the following purposes:
• To implement the goals and policies of the Live Oak General Plan through the designation of compatible land uses, residential densities and intensity of uses; • To promote and protect the public’s health, safety, comfort, convenience, and general welfare;
• To provide open space, light and air, privacy, convenience of access, aesthetic values and protection of public and private improvements;
• To protect the social and economic stability of residential, commercial and industrial uses and activities through orderly and planned use of land; and • To minimize the process necessary to obtain rights to develop property while fulfilling the objectives provided above.

Through the update of the Zoning Code, development is intentional and serves to improve the circulation and flow throughout the City. The City has also secured funding for an AB 1600 Fee Study Update, which will include the study of areawide serving transportation facilities, such as railroad and State Route 99 in the northern portion of the City.

In partnership with Caltrans, the City has completed the State Route 99 Live Oak Streetscape, Safety and Roadway Improvement Project (CIRC-8). This project rehabilitated State Route 99 to a 40-year pavement life, upgraded the drainage systems, flattened the roadway cross slopes, improved traffic signals at three intersections of State Route 99 at Pennington Road, Elm Street, and Kola Street (CIRC-6). The project also created a pedestrian focused downtown environment by enhancing parking and building access, wayfinding and signage, landscaping and facilities for bicyclists and pedestrians, and upgraded curb ramps to current American with Disabilities Act (ADA) standards (CIRC-7).

The City continues to seek funding to assess transportation impact fees and plan transportation improvements to decrease congestion while considering impacts to pedestrian, bicycle, and public transit safety and convenience.
11 3
Community Character
In 2011, the Citywide Design Guidelines were adopted to provide diversity in building design as well as improve the character of streetscapes and implement the goals, objectives, and policies of the General Plan, and provide guidance for the orderly development of the City and promote high-quality development (DESIGN-1 and -2). These guidelines have since been utilized when reviewing planning projects and guide developers and planners to create unique designs that contribute to the community character of Live Oak.

The aforementioned State Route 99 Live Oak Streetscape, Safety and Roadway Improvement Project has also contributed to the community character of Live Oak. This project has benefited motorists, pedestrians, and bicyclists while contributing to the economic welfare of the state and local economy. This project also creates a standard for future rehabilitation or development projects with regards to the streetscape and pedestrian focused design (DESIGN-3 and -6).

Conservation and Open Space Element
The City’s survey and mitigation requirements for special-status wildlife species are consistent with the current guidance from the California Department of Fish and Wildlife and the U.S. Fish and Wildlife Service (BIO-1). This includes pre-construction surveys and specific guidelines for specific species. The City continues to coordinate with the Feather River Air Quality Management District to ensure assumptions and control measures form new air quality plan updates are implemented, as appropriate (AIR-4).

The City also continues to require development projects to protect Native American and prehistoric resources (CULTURAL-1). Development projects are also required to preserve the community’s historically significant sites and buildings (CULTURAL-2).

The City also continues to identify and take advantage of state and federal grants, low-interest financing, and other funding mechanisms for energy efficiency retrofits and alternative energy projects for civic, residential, and commercial buildings (ENERGY-4). Drought-tolerant plants are also now included in the City’s landscaping requirements (WATER-2).

Economic Development
The Citywide Design Guidelines address facades, architectural style, scale, and creating pedestrian oriented visual interests(ED-1.2 and -1.3). The City also conducted an analysis on work commuter patterns as part of the 2021-2029 Housing Element. The analysis found that majority of Live Oak residents travel less than 30 minutes from home to work and only nine percent travel an extended amount of time (60 or more minutes). The number of employed persons divided by the number of households shows that there is nearly one job for households. This analysis indicates that many of the jobs are within 20 miles of the City and that there is a strong jobs/housing balance (ED-4.1).
12 4
Public Utilities, Services, and Facilities
In 2009, the Live Oak Water Master Plan was created to provide for phased improvements to meet future needs (PUBLIC-1.1). This master plan includes inventory of the existing facilities, estimates of future demand, and estimates of future growth within area planned for annexation.

This Water Master Plan is to be updated as necessary. The City of Live Oak Master Drainage program was created in March 2011 and was last updated in 2022. This Master Drainage Plan identifies deficiencies and provides for drainage improvements in the existing developed City (PUBLIC-4.1).

Parks and Recreation Element
The Live Oak Parks and Recreation Departmentseeks to provide safe and enjoyable activities that encourage participation by the entire community. A Parks and Recreation Master Plan has not yet been prepared by the City (PARKS-1), but the Parks and Recreation Department continues to work to provide recreational opportunities and coordinate seasonal activities and youth programs.

Public Safety
Many of the public safety measures included in the General Plan relate to flooding and many of the efforts made to ensure public safety have involved evaluating flood hazards and implementing mitigation measures. In 2016, the City of Live Oak amended the General Plan to be consistent with the Central Valley Flood Protection Act of 2008 (PS-3). This amendment included the assessment of current flood protection. In order to minimize the loss of life and damage to property caused by flood events, the City coordinates with the Sutter Butte Flood Control Agency to ensure that the flood control facilities protecting Live Oak’s Planning Area from flood risks to the City are well maintained and capable of protecting existing and proposed structures from flooding. The City evaluates potential flood hazards before approving development projects.

Noise Element
The noise regulations within the Live Oak Municipal Code have not been updated within the last 30 years. The City ensures that the personnel charged with enforcing the noise regulations are properly trained and equipped for on-site measurement techniques and other necessary tasks (NOISE-2). The City continues efforts for transportation planning and improvement programs that are consistent with the General Plan (NOISE-3). The City also aims to coordinate with Union Pacific Railroad with the goal of establishing a Quiet Zone within the city limits of Live Oak, as feasible (NOISE-4).
13 5
Conclusion
The City of Live Oak continues to review the General Plan annually, and is currently in the process of acquiring grant funding for a comprehensive General Plan update. 14 City of Live Oak
Report to City Council
Meeting Date: August 3, 2022
Title: Findings to Hold Virtual City Council, Commission, Committee, Board and Other City Bodies Meetings Under AB 361
Contact Information: Nicole Rosser, City Attorney
Background: On March 17, 2020, Governor Gavin Newson issued Executive Order N-29- 20 suspending certain provisions of the Ralph M. Brown Act in order to allow for local legislative bodies to conduct their meetings completely telephonically or by other electronic means. As the City Council is well aware, this allowed City Council meetings to be conducted by Zoom with councilmembers and staff all joining from remote locations.

The suspension of certain provisions of the Brown Act was further extended by the Governor on June 11, 2021 by the issuance of Executive Order N-08- 21 which continued to allow for complete virtual City Council (and other legislative body) meetings until September 30, 2021.

On September 16, 2021, Governor Newsom signed AB 361 to amend the Brown Act to allow legislative bodies to meet via teleconference during a proclaimed state of emergency in accordance with procedures established by AB 361 rather than under the Brown Act's more narrow standard rules. AB 361 allows legislative bodies to meet virtually, provided there is a state of emergency, and either (1) state or local officials have imposed or recommended measures to promote social distancing; or (2) the legislative body determines by majority vote that meeting in person would present imminent risks to the health and safety of attendees.

AB 361 preserves many of the provisions of the earlier executive orders, while also adding new requirements to the management of remote and teleconference public meetings in order to better achieve the levels of transparency that the Brown Act demands. Specifically, AB 361 imposes two new rules on remote public meetings:

1. Local governments and agencies hosting teleconference meetings in lieu of traditional in-person public meetings must permit direct public comment during the teleconference, and must leave open the opportunity for public comment until the comment period for a given item is closed during the 15 ordinary course of the meeting. The opportunity to make public comment must be of a sufficient duration so as to allow actual public participation.

2. Any action by the governing body during a public teleconference meeting must occur while the agency is actively and successfully broadcasting to members of the public through a call-in option or an internet-based service option. If a technical disruption within the agency's control prevents members of the public from either viewing the meeting of the public agency, or prevents members of the public from offering public comment, the agency must cease all action on the meeting agency until the disruption ends and the broadcast is restored. Action taken during an agency-caused disruption may be challenged as a violation of the Brown Act.

The City has been implementing the above stated requirements for conducting public meetings and is in full compliance with AB 361, thus there will be no change of the currently established procedures. Teleconference accessibility via call-in option or an internet-based service option (via the Zoom Webinars platform) is listed on the published agenda for each meeting as well as on the City's website and the City provides access for public comment opportunities in real time.

In order to continue to qualify for AB 361's waiver of in-person meeting requirements, the Council must adopt a resolution making the findings required by AB 361. This resolution will become a standing item on the City Council's agenda, it must be approved at every meeting until the proclaimed state of emergency is ended. The findings must include (a) state or local officials continue to recommend measures to promote social distancing, or that (b) an in-person meeting would constitute an imminent risk to the safety of attendees. The findings need not be in the form of a resolution, but a resolution is helpful in formalizing these findings.

The enclosed resolution makes the required findings under AB 361, and if adopted, it will allow the City to continue to offer teleconference accessibility for public meetings, to help mitigate the spread of COVID-19, as well as during other state-proclaimed emergencies where physical attendance may present a risk.

Lastly, it is important to note that having virtual meetings under the provisions of AB 361 is optional. If the Council wishes, it may meet in person or in a hybrid format.

Fiscal Impacts: None.

Recommendation: Adopt resolution making findings and determinations under AB 361 for the continuation of virtual meetings and authorizing virtual City Council, Commission, Board, and other City meetings pursuant to AB 361.

Report to City Council
Meeting Date: August 3, 2022
Title: Resolution of the City Council of the City of Live Oak Approving a Tax Collection Schedule for Fiscal Year (FY) 2022-23 for Community Facilities District No. 92-1
Contact Information: James Ramsey, Finance Director
Background: For the previous 29 years, with the exception of FY 2021-22, the City has applied these approved tax levies for collection on the County property tax roll. The listing included in the staff report of 226 parcels (Exhibit "A") covers all taxable levies within the boundaries of Community Facilities District No. 92-1 (CFD 92-1); American Dream Homes, Phases I through V.

Tax attributed to each parcel (226 parcels) was computed in accordance with Ordinances 380, 403, 438, and 439 and Resolutions 42-1992, 46-1992, and 55-1992.

The tax levies for CFD 92-1 totals $130,874.88 for FY 2022-23 of which 2/3rds will be forwarded to the Live Oak Unified School District in accordance with the district formation documents. The remaining annual levies of $43,581.34 has traditionally been used to cover the City's debt service contribution for the County animal shelter. The CFD 92-1 assessments to be used by the City are restricted for the purchase, construction, expansion or rehabilitation of sites and structures for general government, police, fire, parks, recreation, streets, and other government facilities.

The first levy was put into place during FY 1993 and is set to expire after the next levy in FY 2023-24.

Fiscal Impacts: 1) CFD 92-1 taxes reduces the burden on the City's General Fund for animal control facilities ($43,581).
2) CFD 92-1 taxes provide facility funding to the Live Oak Unified School District ($87,294).

City of Live Oak
Report to City Council
Meeting Date: August 3, 2022
Title: Resolution of the City Council of the City of Live Oak Approving a Tax Collection Schedule for Fiscal Year (FY) 2022-23 for Community Facilities District No. 2004-1
Contact Information: James Ramsey, Finance Director
Background: In 2004, the Council approved the establishment of Community Facilities District (CFD) 2004-1 and approved the recordation of liens on properties that petitioned the City for the formation of the CFD. Since then, there are 759 parcels that are subject to the levy. The tax roll included in the staff report covers all taxable parcels within the boundaries of CFD 2004-1; this development includes Pennington Ranch phases I-V, Peachtree III, Garden Glen, Sand Piper and Walnut View subdivisions, as well as the Kristen Court Apartments. The CFD rate for a single-family home has been $909.56 per year since FY 2006-07.

The special assessment attributed to each parcel was computed in accordance with Resolutions 28-2003, 29-2003, 2-2004, 3-2004, 9-2004, 10-2004, 11- 2004, and 12-2004. Formation documents stipulate that CFD 2004-1 funding be used for services related to fire and police protection, animal control services, street lighting, storm drain maintenance, parks, pool and recreation services.

Street lighting and storm drain maintenance are funded entirely from CFD 2004-1 special tax revenues. Fire and police protection, animal control, and parks, pool and recreation services are partially funded via the City's General Fund.

The CFD formation documents provide for a maximum annual increase in the levy rate of 5% for each type of developed property. The maximum rate for FY 2022-23 amounts to $1,890.91 per home. However, the City has not increased the tax levy since 2006-07. The resolution included in the staff report sets the annual tax levy to remain at $909.56 for FY 2022-23 for single family detached properties. This levy will be the same amount that has been used for the previous 14 years. The current rate for a multi-family property is $27.56 per apartment unit.
29 The City engaged a specialist in 2017 (NBS) to perform an analysis of the CFD and rate. It was noted in the report that there are a total of 907 parcels included within the CFD. 803 parcels have been developed and are now subject to the special tax.

The analysis formulated by the specialists used data from the FY 2017-2018 budgets. The FY 2017-2018 budget had the following elements:
* $2,598,584 - Total budget for the General Fund for fire, police, animal control, park operations, pool operations, and recreation services. * 8,636 - Estimate of City's population as determined by the California Department of Finance as of January 1, 2017
* $301 - Per person cost of the authorized General Fund expenditures * 2,070 - Estimated population located in the CFD (635 dwelling units multiplied by 3.26 persons per household)
* $623,070 - Authorized General Fund expenditures attributable to CFD 2004-1.
* $139,367 - Estimated expenditures for street lighting and storm drainage maintenance.
* $762,437 - Total Requirement ($623,070 + $139,367)
When the analysis was completed, there were 635 units that were developed.

This resulted in revenues to be estimated at $577,571 and a shortfall of approximately $184,866. This is the portion that the General Fund subsidizes the growth of the CFD. Based on the overall analysis, the City would need to levy a special tax of $1,313 for single family dwelling as of fiscal year 2018.

Recent development activity in the Pennington Ranch KB Homes provided for 44 new homes to begin paying the annual CFD 2004 levy. KB Homes nearly completed the occupancy of their development. In the upcoming years, we expect the remaining KB Homes to be added as well as some of the Garden Glen development.

Fiscal Impacts: 1) CFD 2004-1 taxes on new homes reduces General Fund burden. 2) Levy remains at the same level as previous 14 years and will generate approximately $730,294 in FY 2021-22.

Recommendation: Adopt resolution.

City of Live Oak
Report to City Council
Meeting Date: August 3, 2022
Title: Policy for Use of Zoom During Council Meetings
Contact Information: Nicole Rosser, City Attorney
Background: On March 17, 2020, Governor Gavin Newson issued Executive Order N-29- 20 suspending certain provisions of the Ralph M. Brown Act in order to allow for local legislative bodies to conduct their meetings completely telephonically or by other electronic means. This allowed City Council meetings to be conducted by Zoom with councilmembers and staff all joining from remote locations. The suspension of certain provisions of the Brown Act was further extended by the Governor on June 11, 2021 by the issuance of Executive Order N-08-21 which continued to allow for complete virtual City Council (and other legislative body) meetings until September 30, 2021.

The City utilized Zoom pursuant to Executive Order N-29-20, N-08-21, and AB 361. The City has not utilized Zoom for approximately two months. At the July 20, 2022 City Council Meeting, the City Council discussed various options for teleconferencing (Zoom) for the public, staff, and the City Council and legal ramifications of each. In part, the recommendation by the City Council was for the City Attorney to draft a Teleconferencing (Zoom) Policy for the Council to review and adopt.

Analysis: City Attorney has drafted a teleconferencing (Zoom) policy that is consistent with Council direction. This would allow for the public and staff/consultants to participate remotely.

Fiscal Impacts: There should be no fiscal impact because the technology is in place or negligible fiscal impact as it should only effect staff allocation of time.

Recommendation: Adopt the Teleconferencing (Zoom) Policy.

CITY OF LIVE OAK
Teleconferencing (Zoom) Policy
The City of Live Oak recognizes that utilizing teleconferencing technology such as Zoom during Council Meetings helps increase public participation and transparency while minimizing health risks to staff and the public that would be present with in-person meetings.

The City of Live Oak shall allow the use of Zoom technology for the public and City of Live Oak staff and/or consultants. Members of the public shall be able to address the City Council utilizing the teleconferencing technology (Zoom) during public comment and on any specific Agenda item.

If the remote connection fails for any reason, the meeting will continue as noticed without the teleconferencing (Zoom) technology. The public must attend in person to assure access to the meeting. If teleconferencing technology such as Zoom is being utilized pursuant to California Government Code, an Emergency Order, or Resolution of City Council authorized by law, then any specific rules set forth therein must be applied and followed.

The City Clerk shall place the specific teleconferencing technology (Zoom) information on the Agenda that is posted pursuant to the Government Code and meeting requirements so the public may properly access it.

The City Council shall continue to meet in person unless there is a change to the California Government Code that results in the use of teleconferencing technology such as Zoom or unless specifically allowed by City Council action such as AB 361 or successor Bill and duly passed by a Resolution of the City Council.
