Clarissa Menchaca, City Clerk
10 City of Live Oak
Report to City Council
Meeting Date: September 7, 2022
Title: Findings to Hold Virtual City Council, Commission, Committee, Board and Other City Bodies Meetings Under AB 361
Contact Information: Nicole Rosser, City Attorney
Background: On March 17, 2020, Governor Gavin Newson issued Executive Order N-29- 20 suspending certain provisions of the Ralph M. Brown Act in order to allow for local legislative bodies to conduct their meetings completely telephonically or by other electronic means. As the City Council is well aware, this allowed City Council meetings to be conducted by Zoom with councilmembers and staff all joining from remote locations.

The suspension of certain provisions of the Brown Act was further extended by the Governor on June 11, 2021 by the issuance of Executive Order N-08- 21 which continued to allow for complete virtual City Council (and other legislative body) meetings until September 30, 2021.

On September 16, 2021, Governor Newsom signed AB 361 to amend the Brown Act to allow legislative bodies to meet via teleconference during a proclaimed state of emergency in accordance with procedures established by AB 361 rather than under the Brown Act's more narrow standard rules. AB 361 allows legislative bodies to meet virtually, provided there is a state of emergency, and either (1) state or local officials have imposed or recommended measures to promote social distancing; or (2) the legislative body determines by majority vote that meeting in person would present imminent risks to the health and safety of attendees.

AB 361 preserves many of the provisions of the earlier executive orders, while also adding new requirements to the management of remote and teleconference public meetings in order to better achieve the levels of transparency that the Brown Act demands. Specifically, AB 361 imposes two new rules on remote public meetings:

1. Local governments and agencies hosting teleconference meetings in lieu of traditional in-person public meetings must permit direct public comment during the teleconference, and must leave open the opportunity for public comment until the comment period for a given item is closed during the 11 ordinary course of the meeting. The opportunity to make public comment must be of a sufficient duration so as to allow actual public participation.

2. Any action by the governing body during a public teleconference meeting must occur while the agency is actively and successfully broadcasting to members of the public through a call-in option or an internet-based service option. If a technical disruption within the agency's control prevents members of the public from either viewing the meeting of the public agency, or prevents members of the public from offering public comment, the agency must cease all action on the meeting agency until the disruption ends and the broadcast is restored. Action taken during an agency-caused disruption may be challenged as a violation of the Brown Act.

The City has been implementing the above stated requirements for conducting public meetings and is in full compliance with AB 361, thus there will be no change of the currently established procedures. Teleconference accessibility via call-in option or an internet-based service option (via the Zoom Webinars platform) is listed on the published agenda for each meeting as well as on the City's website and the City provides access for public comment opportunities in real time.

In order to continue to qualify for AB 361's waiver of in-person meeting requirements, the Council must adopt a resolution making the findings required by AB 361. This resolution will become a standing item on the City Council's agenda, it must be approved at every meeting until the proclaimed state of emergency is ended. The findings must include (a) state or local officials continue to recommend measures to promote social distancing, or that (b) an in-person meeting would constitute an imminent risk to the safety of attendees. The findings need not be in the form of a resolution, but a resolution is helpful in formalizing these findings.

The enclosed resolution makes the required findings under AB 361, and if adopted, it will allow the City to continue to offer teleconference accessibility for public meetings, to help mitigate the spread of COVID-19, as well as during other state-proclaimed emergencies where physical attendance may present a risk.

Lastly, it is important to note that having virtual meetings under the provisions of AB 361 is optional. If the Council wishes, it may meet in person or in a hybrid format.

Fiscal Impacts: None.

Recommendation: Adopt resolution making findings and determinations under AB 361 for the continuation of virtual meetings and authorizing virtual City Council, Commission, Board, and other City meetings pursuant to AB 361.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LIVE OAK MAKING FINDINGS AND DETERMINATIONS UNDER AB 361 FOR THE CONTINUATION OF VIRTUAL MEETINGS AND

AUTHORIZING VIRTUAL CITY COUNCIL, COMMISSION, BOARD, AND OTHER CITY MEETINGS PURSUANT TO AB 361
The City Council of the City of Live Oak does hereby find, order and resolve as follows:

WHEREAS, all meetings of the Live Oak City Council are open and public, as required by the Ralph M. Brown Act (Cal. Gov’t Code section 54950 et seq.), so that any member of the public may attend, participate and view the legislative bodies conduct their business; and WHEREAS, the Brown Act, Government Code section 54953(e), makes provisions for remote teleconferencing participation in meetings by members of a legislative body, without compliance with the requirements of Government Code section 54953(b)(3), subject to the existence of certain conditions and requirements; and
WHEREAS, Government Code section 54953(e) requirements include but are not limited to (1) the existence of a state of emergency declared by the Governor pursuant to Government Code section 8625 and (2) State or local officials have imposed or recommended measures to promote social distancing; and
WHEREAS, on March 4, 2020, Governor Gavin Newson issued a Proclamation of State of Emergency in response to the COVID-19 pandemic and as of the date of this Resolution, the proclaimed state of emergency remains in effect; and
WHEREAS, on March 17, 2020, Governor Gavin Newson issued Executive Order N-29-20, which suspended and modified the teleconferencing requirements under the Brown Act (California Government Code Section 54950 et seq.) to allow local legislative bodies to hold public meetings via teleconference; and
WHEREAS, on June 11, 2021, Governor Gavin Newson issued Executive Order N-08021, which extended the provisions of N-29-20 concerning the conduct of public meetings through September 30, 2021, and the Governor subsequently signed legislation revising Brown Act requirements for teleconferenced public meetings (Assembly Bill 361, referred to hereinafter as “AB 361”); and WHEREAS, to preserve public health and safety, the State Public Health Officer has issued various orders and guidance regarding COVID-19 prevention measures, which includes references and a statement of support for social distancing recommendations; and WHEREAS, the California Department of Industrial Relations has issued COVID-19 Prevention regulations in Title 8 of the California Code of Regulations (Section 3205 et seq.); and WHEREAS, based on the foregoing, the City Council finds that (1) the Governor’s Proclaimed State of Emergency as a result of the COVID-19 pandemic is currently in effect and has not been terminated, and (2) State officials have imposed or recommended measures to promote social distancing; and WHEREAS, the City Council has considered the circumstances of the state of emergency, including all information relate to this matter, the associated staff report; and 13 WHEREAS, in light of the foregoing, the City Council desires to continue to have the flexibility to meet via tele/video conference and the City Council finds that it and its legislative bodies shall be permitted to conduct their meetings by teleconferencing without compliance with Government Code section 54953(b)(3) pursuant to section 54953(e), and such legislative bodies shall comply with the requirements to provide the public with access to the meetings as prescribed by section 54953(e)(2).

NOW, THEREFORE BE IS RESOLVED, FOUND AND ORDERED by the Live Oak City Council as follows:

1. The facts set forth in the above recitals are true and correct and incorporated into this resolution by reference.

2. As a result of the continuing COVID-19 state of emergency declared by Governor Newsom, State officials continue to impose or recommend measures to promote social distancing based on the State Public Health Officer’s guidance and recommendations supporting social distancing and the Department of Industrial Relations’ issuance of COVID-19 Prevention regulations through Title 8 of the California Code of Regulations, section 3205 et seq. promoting social distancing in the workplace.

3. Under the present circumstances, the City Council by and through its City Manager, is hereby authorized and directed to take all actions necessary to carry out the intent and purpose of this resolution including conducting open and public meetings in accordance with Government Code section 54953(e) and other applicable provisions of the Brown Act.

4. This Resolution shall take effect immediately upon adoption and shall be effective until the earlier of (i) Thirty (30) days from adoption of this Resolution or (ii) such time as the City Council adopts a subsequent resolution in accordance with Government Code section 54953(e)(3) to extend the time during which its legislative bodies may continue to teleconference without compliance with Section 54953(b)(3).

5. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the Resolution which can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. The City Council hereby declares that it would have adopted this Resolution irrespective of the invalidity of any particular portion thereof.

14 City of Live Oak
Report to City Council
Meeting Date: September 7, 2022
Title: Purchase of WIMS (Water Information Management Solution) Report System for the Wastewater Treatment Plant
Contact Information: Ron Walker, Director of Public works Background: The state-issued discharge permit for the wastewater treatment plant requires multiple reporting on a monthly, quarterly, semi-annual, and annual basis.

For the past 10-plus years, staff has utilized a reporting tool built and maintained by Bill Lewis who provides contract wastewater consulting services for the City. Last year, Bill informed staff of his intention to fully retire, and thus he will no longer be supporting his reporting tool.

Staff contacted the City of Yuba City, the City of Colusa, and the City of Lincoln to find out what reporting building tool they were using, and all were either using the WIMS system or their staff stated that they would like to change to the WIMS system.

The Lab Director at the City of Yuba City indicated that, because they are using the same system it is possible for laboratory data to be directly loaded into the report building tool, thus helping to eliminate manual input mistakes.

Staff has obtained a quote for the WIMS Report System of $49,167.

Fiscal Impacts: Budget-Approved Item
Recommendation: Approve purchase of WIMS software, setup, and training package.

26 City of Live Oak
Report to City Council
Meeting Date: September 7, 2022
Title: Authorization of the Submittal of a Financial Assistance Application for P Street Sewer Lift Station
Contact Information: Aaron Palmer, City Manager
Location: City Wide
Background: The City Council previously received a Report of Sewer Lift Station Evaluations dated July 15, 2019 prepared by Operations and Permitting Specialists, Bill Lewis Principal Engineer. The Report recommended the complete rehabilitation of P Street Sewer Lift Station. The City Council awarded the design of the project to KSN Engineering on October 7, 2020.

The design is complete. City staff recently became aware of the possibility to obtain funding for this project from the CSWRCB. This funding is prioritized toward small, disadvantaged communities. Based on 2020 census data, Live Oak meets the criteria to apply for potential funding.

To obtain the funding, a complete package of information is required to be submitted. Staff has already submitted a brief preliminary application. This application was reviewed by the SWRCB staff and was determined to potentially meet funding eligibility. The SWRCB recommended that a full application be submitted. The complete application will consist of several packages including a General Information, Technical, Environmental, Financial Security, and Final Budget Approval.

Once the packages are reviewed and approved by the SWRCB, they will determine funding options ranging from not allowed, low interest loan, and loan with full principal forgiveness (grant) for project expenses taking place after Final Package is approved. Expenses taking place prior to Final Package approval can not be reimbursed.

Further, City Council action and authorization will be required prior to acceptance of any loan or loan principal forgiveness documents.

Fiscal Impacts: None.
27 Recommendation: Adopt resolution making the findings and determinations authorizing the City Manager or designee to file a Financial Assistance Application for P Street Sewer Lift Station with the California State Water Resources Control Board (CSWRCB).

GENERAL INFORMATION PACKAGE
The General Application and attachments may be submitted in one of three ways. Applicants are encouraged to utilize the Financial Assistance Application Submittal Tool (FAAST) to streamline the application submittal and review process, but if that will create a hardship, email or mail can be utilized instead:

1.) Apply online via the FAAST: https://faast.waterboards.ca.gov To submit a CWSRF Construction Application in FAAST, you must complete all the tabs in FAAST and attach (at minimum) the General Information Package. (Note: Once the CWSRF Construction Application has been uploaded, you must still complete the application by clicking on the “Submit” button.) Once the CWSRF Construction Application is submitted in FAAST, a project manager will be assigned to help the applicant complete the application process.

To submit additional documents for the same project, DO NOT start a new application, instead click on the Submitted Applications link on the Main Menu and choose the project from the list of previously submitted applications. Open the Attachments tab, and then the Post-Submission sub-tab. Choose a document from the Attachment Category dropdown list and then select the file to upload. The project manager will receive an email notification letting them know you have submitted additional information for review.

If you need assistance, you can also contact the FAAST Help Desk, which is staffed Monday through Friday 8am through 5pm, at 1-866-434-1083 or [email protected].

The Honorable Sarah H. Heckman
Presiding Judge of the Sutter County Superior Court
1175 Civic Center Boulevard
Yuba City, CA 95993
To the honorable and presiding Judge Heckman:

I am herewith submitting the response to the findings and recommendations of the 2020-2021 Grand Jury Final Report. I have responded to the following reports as requested by the Sutter County Grand Jury:
 F1 - When the LO city council did not appoint a council person to fill the vacant council seat it cost the citizens of Live Oak financially.
 F2 - The City Council of Live Oak did not pass the budget in a timely fashion.  F3 - The City Council of Live Oak scheduled a budget workshop to resolve the budget deadlock, but all members of the council did not attend.  F4 - The City Council of Live Oak did not pass the authorization to collect the annual CFDs and special assessments by September 2021, therefore these could not be added to the tax rolls.
 F5 - This year’s CFD taxes could not be collected. This has cost the city over $800,000 in budget reserves.

I want to thank the honorable Judge Sarah H. Heckman and the Grand Jurors for their service to the residents of Sutter County. Grand Jury service and Judicial services requires a great amount of time and effort, and each juror’s and judge’s dedication is truly appreciated. I would be happy to meet with the Grand Jury to discuss any or all of these issues.

Sincerely,
Mayor
Nancy Santana
37 Please accept this response on behalf of the Live Oak City Council regarding the findings of the Grand Jury for FY 2020/2021. It has been my honor to get to know the Grand Jury members and to provide an overview of the Live Oak City Council. I want to express my appreciation of the Grand Jury and the role they play in helping to bring deficiencies to our attention. I have reviewed the proposed report and offer the following responses to both the "Findings" and the "Recommendations" suggested by the Grand Jury.

Findings
The following is the City of Live Oak’s official response to the Grand Jury’s five findings:

F1: When the City of Live Oak did not appoint a council person to fill the vacant council seat, it cost the citizens of Live Oak financially.

Response: Disagrees in part. The City of Live Oak had nine applicants for the open City Council seat. Six of those were moved to a vote, and each of the six candidates failed on a 2-2 vote each time. Five of the six candidates Santana and Woten voted yes and Thiara and Ghag voted no. The sixth candidate Thiara and Ghag voted yes and Woten and Santana voted no. However, it should be noted that we disagree in part because not all candidates are necessarily qualified to fill the position.

F2: The City Council did not pass the budget in a timely fashion.

Response: Agree. The City Council was presented with the final 2021-2022 Annual Budget for approval at the June 2, 2021, meeting and it was moved to the June 16, 2021, meeting. The budget was then tabled at the June 16, 2021, meeting. There was a budget workshop and then a special council meeting to approve the budget. However, only Council Members Woten and Santana were present. Council Members Thiara and Ghag were absent. At the following seven meetings the budget was presented for adoption and failed each time to a 2-2 vote. The dates for those seven meetings were, June 29, 2021; July 7, 2021; July 14, 2021; June 21, 2021; August 4, 2021; September 9, 2021; September 15, 2021. Each time Council Members Woten and Santana voted yes while Council Members Thiara and Ghag voted no. At the December 20, 2021, Council meeting, the City Council passed the 2021-2022 Annual Budget by a vote 4-0. It is to note that the original budget that was presented to the City Council on June 29, 2021, for approval was the same that was passed at the December 20, 2021, Council meeting. There were no changes between the original presented budget and the budget that was adopted.

F3: The City Council of Live Oak scheduled a budget workshop to resolve the budget deadlock, but all members of the Council did not attend.

Response: Agree. At the request of Council Member Thiara, a Budget Workshop was scheduled for June 29, 2021. Council Members Woten and Santana attended; however, Council Members Thiara and Ghag did not attend. The Grand Jury did commend the two Council Members who took part in the scheduled budget workshop as well as commended them in making a great effort to work cooperatively with the rest of the Council.

F4: The City Council of Live Oak did not pass the authorization to collect the annual CFDs and special assessments by September 2021, therefore these could not be added to the tax rolls. 38 Response: Agree. The 92-1 and 2004-1 CFDs were presented to the City Council for adoption on August 4, 2021 and failed on a 2-2 vote. Council Members Woten and Santana voted yes while Council Members Thiara and Ghag voted no.

The special assessments were presented to the City Council for adoption on September 1, 2021 and failed on a 2-2 vote. Council Members Woten and Santana voted yes while Council Members Thiara and Ghag voted no.

F5: This years CFDs could not be collected. This has cost the City over $800,000 in budget reserves.

Response. Agree. CFDs were presented to the City Council for adoption. Council Members Woten and Santana voted yes while Council Members Thiara and Ghag voted no, resulting in over $800,000 in lost Revenues. Instead of the City taking funds out of the general fund, the City used the ARPA funding to make up the difference for the lost revenue.

Recommendations
The following is the City of Live Oak’s official response to the Grand Jury’s five recommendations:

R1: The City Council of Live Oak will pass the budget in a timely fashion.

Response: The recommendation has been implemented. The City Council passed the 2022-2023 Annual Budget ahead of schedule on May 18, 2022, by a vote of 4-1. This is approximately 6 weeks before the State’s deadline to have such budgets adopted.

R2: The City Council of Live Oak will establish budget workshop dates with sufficient time to resolve any concerns prior to voting on the budget resolution.

Response: The recommendation has been implemented. The FY 2022-2023 Annual Budget had three workshops. Those dates were: March 30, 2022; April 6, 2022; and April 20, 2022.

R3: All members of the City Council will participate in any budget workshops to understand the proposed budget and to discuss areas of concerns.

Response: The recommendation has been implemented. All five Council Members attended all three budget workshops for the FY 2022-2023 Annual Budget.

R4: The City Council of Live Oak will pass the authorization to collect the annual CFDs and special assessments in a timely manner, so that these levies can be added to the current year’s tax rolls.

Response: The recommendation has been implemented in part. The CFDs 92-1 and 2004-1 were adopted for collection at the August 3, 2022, City Council meeting by a vote of 3-2. The special assessments will be placed on a City Council meeting for adoption once received by the Sutter County Assessor’s Office.

The mayor is grateful for the recommendations of the Grand Jury. If the Grand Jury would like to discuss any of these issues in greater detail, please feel free to contact the mayor.

Mayor Nancy Santana
