Other than a simple administrative report describing the nature of the request, no work on an item added by a member of the City Council shall be undertaken by City Staff, including but not limited to, fiscal review, legal review, and policy review for consistency with existing City policies, until the City Council has had the opportunity to have a discussion and provide direction as provided herein.
For the purposes of this section, work will be defined as generating, compiling, analyzing, researching, or writing new information, new policies, laws or plans and specifically excludes meetings or discussions with the City Manager and department heads jointly to obtain their comments on a Councilmember requested item. However, the City Councilmember requesting that the item be added for initial consideration shall have the right and privilege of submitting a letter or memorandum (and any other related materials) describing their item and the reasons therefore which shall be included in the City Council agenda packet so long as the letter or memorandum (and any other related materials) is submitted to the City Clerk at least one week prior to the City Council meeting.
At the meeting, where the item is initially considered, if a majority of the City Council supports further study of the item by way of motion, second and simple majority vote, then a full staff analysis shall be prepared thereafter for consideration by the City Council. The date set for further consideration shall be set in light of legal notice requirements, existing City Council priorities, the urgency of the item, and the advice of the City Manager and staff as to its impact on the timing of existing work and/or projects of the City. 25 The City Council of the City of Live Oak does ordain as follows:

Any such closed session shall be appropriately agendized.

The Mayor and Vice Mayor so selected and seated at that time shall hold their respective offices until the first regular City Council meeting following the first Wednesday of the month in the year following the year in which they were selected and seated. The Mayor shall preserve strict order and decorum at all regular and special meetings of the Council. The Mayor shall state every question coming before the Council, announce the decision of the Council on all subjects and decide all questions of order subject, however, to an appeal to the Council in which event a majority vote of the Council shall govern and conclusively determine such question of order. The Mayor shall vote on all questions, his or her name being called last.
H. Attendance by the Public. Except as specifically provided by law for closed sessions, all meetings of the Council shall be open and public. All persons desiring to attend shall be permitted to attend any meeting. In the event any meeting is willfully interrupted by a group or groups of persons so as to render the orderly conduct of the meeting unfeasible the Council may proceed as set forth in Municipal Code Section 2.04.050 et seq related to the Rules of Decorum.

Adoption of the consent calendar may be made by one motion only and by the roll call vote of the Council; provided, however, the chair shall first advise the persons in attendance that the consent calendar matters will be adopted in toto by one action of the Council unless any Council member, any member, any individual or organization interested in one or more consent calendar matters has any question or wishes to make a statement. In that event, the chair may defer action on the particular matter or matters, and the Council shall consider those matters separately; H. Public Hearings;
I. Business Items;

The agenda shall specify the time and location of the regular meeting and shall be posted in a location that is freely accessible to members of the public. No action shall be taken on any item not appearing on the posted agenda.
28 C. Items Not Appearing on Agenda. Notwithstanding the above, the Council may take action on items of business not appearing on the posted agenda under any of the following conditions:
1.. Upon a determination by a majority vote of the Council that an emergency situation exists as defined in the public meeting law (Section 54956.2(b)(1) of the Government Code);
2.. Upon a determination by a two-thirds vote of the Council or if less than twothirds of the Council members are present, a unanimous vote of those members present that the need to take action arose subsequent to the agenda being posted; and

D. Items to be Placed on Agenda. During the “Councilmember Comments” portion of the City Council meeting, any member of the City Council may request that an item be placed on a future City Council agenda for initial consideration by the City Council. Initial consideration will allow Council to discuss the item during an open and public meeting and determine by a simple majority vote whether to direct the City Manager to add the item to a future agenda and provide specific direction. No motion, second, or vote or other action shall be required of the City Council to have the item placed on a future City Council agenda for initial consideration so long as the item is to be on an agenda thirty or more days later.
E. Agenda Items Added by City Council.
The date set for further consideration shall be set in light of legal notice requirements, existing 29 City Council priorities, the urgency of the item, and the advice of the City Manager and staff as to its impact on the timing of existing work and/or projects of the City. 30 Live Oak, CA Logo
City of Live Oak
Report to City Council
Meeting Date: July 5, 2023
Title: Assessment of Liens: Cost of Refuse Disposal
Contact Information: James Ramsey, Finance Director
Location: Citywide
Background: The City of Live Oak adopted a mandatory garbage ordinance on June 19, 1996. This ordinance gave the City the authority to lien a homeowner's property if refuse collection service went unpaid.
On June 21, 2023, Recology Yuba-Sutter mailed a delinquent notification to both the renter (if applicable) and the homeowner informing them of the delinquent balance owed and that if the balance went unpaid a lien would be placed against the property. The letter noticed the account holders that this matter would be reviewed by the City Council at the July 5, 2023 City Council meeting.
At this Council meeting, the Council will hear testimony from those homeowners who wish to discuss this delinquent balance. The Council may make determinations to alter the lien listing if the requested collections have been unduly charged.
Fiscal Impacts: None.
Recommendation: Conduct a public hearing and upon conclusion, adopt resolution: 1) Ordering that costs for refuse disposal be assessed against properties identified in Exhibit A; 2) Confirming that the assessment shall constitute a special assessment against any lien upon each identified property; and 3) Directing the City Manager to submit a certified copy of the resolution to the Sutter County Auditor with a request for collection.
