Proclamation
6 Recognizing the 75th Anniversary of the US Air Force and the Positive Contribution of Beale Air Force Base to the Yuba Sutter Community Since 1942
WHEREAS, for 75 years, American Airmen have excelled as they execute the Air Force mission to fly, fight, and win — delivering airpower anytime, anywhere in defense of our nation; and WHEREAS, Airmen are called to “Innovate, Accelerate and Thrive” as the U.S. Air Force and Department of the Air Force approach their 75th anniversaries on September 18, 2022. Airmen will always be there to provide America with the airpower it needs to defend the nation, deter or defeat our adversaries, reassure our partners and allies, and help diplomacy proceed from a position of strength; and
WHEREAS, Airmen continue to push technological and cultural boundaries which make America the leader in airpower and spacepower. Innovation is an integral part of how we train and employ our squadrons, develop our capabilities, and continue to move toward an even more effective Air Force; and
WHEREAS, from their inception 75 years ago, the U.S. Air Force and Department of the Air Force have excelled at keeping pace with rapid changes in technology and in the demands placed on the Air Force’s five core missions: air superiority; global strike; rapid global mobility; intelligence, surveillance, and reconnaissance; and command and control; and WHEREAS, Camp Beale opened in October 1942 as a training site for the 13th Armored and the 81st and 96th Infantry Divisions. Today Beale Air Force Base is home for the U-2 Dragon Lady, T-38 Talon and RQ-4 Global Hawk. The base, covering nearly 23,000 acres, is home to more than 4,500 military personnel. Beale AFB has a unique name and mission, a historic past, and a promising future.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Live Oak, California hereby recognizes the 75th anniversary of the US Air Force and the positive contribution of Beale Air Force Base to the Yuba Sutter Community since 1942.

Dated this 20th day of July, 2022.

Background: The City of Live Oak is in need of a new truck. The Parks & Recreation Department is one truck away from fulfilling our work fleet for all fulltime staff. The city is looking into getting a new truck that is four-wheel drive. The city does not own any four-wheel drive trucks in any city department.

Current city staff has had to use their personal trucks to assist city needs.

Staff recommends purchasing a new truck.

Report to City Council
Meeting Date: June 4, 2025
Title: Preliminary Budget - Fiscal Year 2025-26
Contact Information: James Ramsey, Finance Director
32 Background: Prior to the July 1 start of each new fiscal year, management brings forth the preliminary budget to the City Council for input and consideration. The adoption of the annual budget is one of the key statutory responsibilities of the Mayor and City Council. Final adoption is scheduled for June 18, 2025.

The preliminary budget as of June 4, 2025 in contained herein. The preliminary budget was first compiled by the Contract Finance Director, and staff met on May 15th, along with Vice Mayor Pamma to go over the details of the budget. The attached preliminary budget contains all of the budgeted funds of the City, including the General Fund, special revenue funds, and the Water and Sewer Enterprise Funds.

The preliminary budget was provided to the City Council on May 21, 2025.

Updates to the budget were made including the following:
* $50,000 was added to the Administrative Department budget for a feasibility analysis relating to tax measures;
* $1,200 was added to the Administrative Department budget to add in annual membership to ICMA;
* $200,000 was shown in the Pool Department budget to reflect Pool Rehab (note, this is not an increase as the amount was included in the budget estimate summary, but was not shown in the department); * $10,500 was added to the COPS Fund for subscription services for license plate readers;
* $10,500 was added to the HOME Investment Partnerships Fund for monitoring services.

Key highlights from the last meeting include:

1. Account 10-4123 VLF Motor Vehicle In Lieu - Councilmember Hernandez inquired into why the City only received $150 during FY 23 for this account line item. This is due to the State not allocating an excess amount of vehicle license fees to the City. Periodically, the State has a revenue shortfall for vehicle license fee that impacts all jurisdictions.

2. Councilmember Pamma requested a breakdown of the cuts made during the management meeting on May 15th. This is in the first two pages of the attachment.

I have also included the appropriations limit for review, which is required to have a posting period of 14 days or more prior to adoption.

Fiscal Impacts: None.

Recommendation: Provide direction and input.

Dear Fiscal Officer:

Subject: Price Factor and Population Information
Appropriations Limit
California Revenue and Taxation Code Section 2227 requires the Department of Finance to transmit an estimate of the percentage change in population to local governments. Each local jurisdiction must use their percentage change in population factor for January 1, 2025, in conjunction with a change in the cost of living, or price factor, to calculate their appropriations limit for fiscal year 2025-26. Attachment A provides the change in California’s per capita personal income and an example for utilizing the price factor and population percentage change factor to calculate the 2025-26 appropriations limit. Attachment B provides the city and unincorporated county population percentage change along with the population percentage change for counties and their summed incorporated areas. The population percentage change data excludes federal and state institutionalized populations and military populations.

Population Percent Change for Special Districts
Some special districts must establish an annual appropriations limit. California Revenue and Taxation Code Section 2228 provides additional information regarding the appropriations limit.

Article XIII B, Section 9(C) of the California Constitution exempts certain special districts from the appropriations limit calculation mandate. The code section and the California Constitution can be accessed at the following website: http://leginfo.legislature.ca.gov/faces/codes.xhtml.

Special districts required by law to calculate their appropriations limit must present the calculation as part of their annual audit. Any questions special districts have on this requirement should be directed to their county, district legal counsel, or the law itself. No state agency reviews the local appropriations limits.

Population Certification
The population certification program applies only to cities and counties. California Revenue and Taxation Code Section 11005.6 mandates Finance to automatically certify any population estimate that exceeds the current certified population with the State Controller’s Office. Finance will certify the higher estimate to the State Controller by June 1, 2025.

Please Note: The prior year’s city population estimates may be revised. The per capita personal income change is based on historical data.

If you have any questions regarding this data, please contact the Demographic Research Unit at (916) 323-4086.

Attachment A
A. Price Factor: Article XIII B specifies that local jurisdictions select their cost of living factor to compute their appropriation limit by a vote of their governing body. The cost of living factor provided here is per capita personal income. If the percentage change in per capita personal income is selected, the percentage change to be used in setting the fiscal year 2025-26 appropriation limit is:

Per Capita Personal Income
Fiscal Year Percentage change
(FY) over prior year
2025-26 6.44
B. Following is an example using sample population change and the change in California per capita personal income as growth factors in computing a 2025-26 appropriation limit.
2025-26:

Per Capita Cost of Living Change = 6.44 percent
Population Change = 0.28 percent
Per Capita Cost of Living converted to a ratio: 6.44 + 100 = 1.0644 100
Population converted to a ratio: 0.28 + 100 = 1.0028
100
Calculation of factor for FY 2025-26: 1.0644 x 1.0028 = 1.0674

City of Live Oak
Report to City Council
Meeting Date: June 4, 2025
Title: Discussion on Establishing a Social Media Policy for City Council Members Contact Information: Kary Hauck, Interim City Manager
110
Background: BACKGROUND & DISCUSSION:

As your Interim City Manager, it has been my honor to serve the community and work alongside this Council over the past 60 days. In that short time, I have observed numerous examples that highlight the need for clear guidance when it comes to how we use social media as public officials, while simultaneously protecting the First Amendment rights of Council Members.

Social media has become an increasingly important tool in local government communication-both for outreach and community engagement. However, without a formal policy in place, there is growing concern over potential Brown Act violations, inconsistent messaging, and misinterpretation of individual views as official City positions.

It's important to underscore that City Council Members are held to a higher standard than the general public, including online. Posts made by elected officials-particularly those relating to City business, decisions, or policy matters-are not private conversations. When multiple Council Members engage in online discussions or post responses related to the same issue, this could constitute a serial meeting, violating the Ralph M. Brown Act.

Moreover, informal or inaccurate posts can unintentionally erode public trust, cause confusion, or compromise the integrity of Council decisions. We have a shared responsibility to ensure that the information shared with the public is accurate, timely, and reflective of the City's official position.

NEXT STEPS:

Staff recommends that the City Council discuss a draft Social Media Policy and provide direction. Possible discussion items may include:

1. Provisions that protect Councilmembers against Brown Act violations, encourage civility, and outline best practices for personal vs. official use;

2. First Amendment Protections;

3. Violations of Policy;

4. Return the draft policy for Council review and potential adoption at a future meeting;

5. Previously considered decorum policies that were not adopted by Council.

CONCLUSION:

A well-defined social media policy will not only protect the City and its Council Members legally, but also help preserve the integrity of public service, improve the accuracy of information disseminated to residents, and foster respectful and responsible digital engagement.

Fiscal Impacts: None.
111
Recommendation: Staff recommends that the City Council discuss and provide direction on the development and adoption of a formal Social Media Policy applicable to City Council Members to promote transparency, accuracy, and legal compliance in public communications.
