A. INTRODUCTION AND SUMMARY
The purpose of this Addendum is to demonstrate that further environmental review is not required given that the proposed modifications to the approved project would not trigger the applicable criteria set forth in the CEQA Guidelines Section 15162.
The City of Livermore, Community Development Department, has reviewed the Arroyo Vista Neighborhood Project (proposed project) and on the basis of the whole record before it, has determined that pursuant to CEQA Guidelines Section 15162, no substantial changes have occurred with respect to the circumstances under which the original CEQA document was adopted (in this case, the Arroyo Vista Neighborhood Plan Initial Study/Mitigated Negative Declaration [IS/MND], as amended by the Arroyo Vista Neighborhood Project Addendum), and there is no new available information, which was not known and could not have been known at the time that the original CEQA document was adopted. The proposed project, as identified in this Addendum, would not have a significant effect on the environment beyond that which was evaluated in the Arroyo Vista Neighborhood Plan IS/MND (2007 IS/MND) or the approved and entitled 2017 residential project. Therefore, the proposed project would not trigger the applicable criteria set forth in the CEQA Guidelines Section 15162.
This Addendum to the 2007 IS/MND, as amended by the 2017 Addendum, has been prepared pursuant to Title 14, Section 15164 of the California Code of Regulations and City of Livermore environmental standards.
B. PROJECT BACKGROUND AND LOCATION
The approximately 28-acre Arroyo Vista Neighborhood Plan Project site is located southeast of the intersection of Las Positas Road and Arroyo Vista in the City of Livermore, California, and is bisected by the Arroyo Seco Channel (see Figure 1 and Figure 2). Surrounding existing land uses include light industrial and commercial uses to the north; undeveloped land and a modular building manufacturer to the east, across Bennett Drive; commercial uses to the west, across Las Positas Road; and light industrial and commercial uses to the south, across Las Positas Road.
The 2007 IS/MND, adopted by City Council in 2007, analyzed two conceptual plans for future development of the Arroyo Vista Neighborhood Plan, a residential community, on the site. Plan A (see Figure 3) assumed development of a residential community with 402 residential units consisting of 87 single-family homes and 315 townhomes, and 8.5 acres of open space. Plan B (see Figure 4) assumed development of up to 495 residential units consisting of 170 multi-family residences and 325 townhomes, and 9.3 acres of open space. In addition, the project included a multi-use trail along the west side of the Arroyo Seco Channel and a pedestrian bridge over the channel to connect the western and eastern neighborhoods. The project required approval of a Rezone of the site from Planned Unit Development to Planned Development Residential, a Tentative Map, a Development Agreement, and Site Plan Design Review.
The 2017 Addendum was adopted by City Council in June 2017, along with a land use entitlement package submitted by a homebuilder that refined the original project to focus solely on one site plan. The site plan that was approved in 2017 is shown in Figure 5 and Figure 6. The refined project – approved with a tentative tract map, site plan design review, planned development, and development agreement – included a total of 435 dwelling units, including a mix of 86 singlefamily detached houses, 249 detached townhomes, and 100 multi-family condominiums. Of the total 435 dwelling units, 195 units would be located on the western portion of the site and 240 units would be located on the eastern portion of the site.

The single-family detached houses would be two-story and have a maximum height of 30 feet, and the townhomes and condominiums would be three-story and have a maximum height of 45 feet.
In addition, the 2017 approved project included a 0.5-acre neighborhood park on the western portion of the site with a play area, pergola, picnic tables, community building, outdoor kitchen, outdoor fireplace, seating, and pool area. The eastern portion of the site included an approximately 0.2-acre neighborhood park with a community garden, barbeque area, and play area. Similar to the Arroyo Vista Neighborhood Plan land use concept, the 2017 approved project included a multi-use trail on the west side of the Seco Arroyo Channel and an eight-foot-wide pedestrian bridge across the Arroyo Seco Channel, which would connect the western and eastern neighborhoods.
C. PROJECT DESCRIPTION
The current proposed project would involve minimal modifications to the approved 2017 residential project and IS/MND, as amended in 2017. Specifically, the proposed project would include the addition of a third story to the 86 single-family detached residences on the western portion of the site that were originally proposed as two-story buildings, and the elimination of the pedestrian bridge component. The addition of a third story to the 86 single-family detached residences on the western portion of the site (see Figure 7) would accommodate the square footage and bedroom needs of the current market. The proposed modification would increase the maximum allowed height of the single-family detached residences from 30 feet to 45 feet. The revisions would be to the architecture only, with special care to match previous design styles and corner enhancements visible from the public realm. The number of lots and streets would remain within substantial conformance to previous approvals.
As shown in Figure 5 and Figure 6, the pedestrian bridge was designed to connect the western and eastern neighborhoods by crossing the Arroyo Seco Channel, which is owned and maintained by Zone 7 Water Agency. However, an aerial easement could not be obtained, which would allow for construction, access, and maintenance of the pedestrian bridge over the Arroyo Seco Channel. Thus, the proposed project would eliminate the pedestrian bridge component from the previously approved project, and the original bridge landing areas would be improved as pocket parks to serve as additional outdoor amenity spaces, including dining and barbeque areas (see Figure 8).
The City of Livermore General Plan designates the site as Light Intensity Industrial (LII)/Urban High Residential, 14 to 18 dwelling units per acre (UH-3), and the site is zoned Planned Development Residential (PDR-16-004). The proposed project would not involve any changes to the land use designations for the site. However, revisions to the PDR-16-004 design standards and Site Plan Design Review would be required to allow for the proposed three-story single-family detached residences and elimination of the pedestrian bridge component. In addition, amendments to the Arroyo Vista Neighborhood Plan, Development Agreement, Site Plan Design Review, and Conditions of Approval would be required for the elimination of the pedestrian bridge.
D. RATIONALE FOR PREPARATION OF THE ADDENDUM

(a) The lead agency or a responsible agency shall prepare an addendum to a previously certified EIR if some changes or additions are necessary but none of the conditions described in Section 15162 calling for preparation of a subsequent EIR have occurred. (b) An addendum to an adopted negative declaration may be prepared if only minor technical changes or additions are necessary or none of the conditions described in Section 15162 calling for the preparation of a subsequent EIR or negative declaration have occurred.
(c) An addendum need not be circulated for public review but can be included in or attached to the final EIR or adopted negative declaration. (d) The decision-making body shall consider the addendum with the final EIR or adopted negative declaration prior to making a decision on the project. (e) A brief explanation of the decision not to prepare a subsequent EIR pursuant to Section 15162 should be included in an addendum to an EIR, the lead agency’s required findings on the project, or elsewhere in the record. The explanation must be supported by substantial evidence.
New significant effects or other grounds require preparation of a subsequent EIR in support of further agency action on a project pursuant to Public Resources Code Section 21166 and State CEQA Guidelines Sections 15162 and 15163. Under the guidelines, a subsequent or supplemental EIR or Mitigated Negative Declaration shall be prepared if any of the following criteria are met:
(a) When an EIR has been certified or negative declaration adopted for a project, no subsequent EIR shall be prepared for that project unless the lead agency determines, on the basis of substantial evidence in the light of the whole record, one or more of the following:
(1) Substantial changes are proposed in the project which will require major revisions of the previous EIR or negative declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects;
(2) Substantial changes occur with respect to the circumstances under which the project is undertaken which will require major revisions of the previous EIR or negative declaration due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; or
(3) New information of substantial importance, which was not known and could not have been known with the exercise of reasonable diligence at the time the previous EIR was certified as complete or the negative declaration was adopted, shows any of the following:
(A) The project will have one or more significant effects not discussed in the previous EIR or negative declaration;
(B) Significant effects previously examined will be substantially more severe than shown in the previous EIR;
(C) Mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more

significant effects of the project, but the project proponents decline to adopt the mitigation measure or alternative; or
(D) Mitigation measures or alternatives which are considerably different from those analyzed in the previous EIR would substantially reduce one or more significant effects on the environment, but the project proponents decline to adopt the mitigation measure or alternative.
E. USE OF A PRIOR ENVIRONMENTAL DOCUMENT:
The California Supreme Court has held that a lead agency has the responsibility of initially deciding whether an original environmental document retains “some relevance” to the ongoing decision-making process. The City of Livermore has determined that the 2007 IS/MND as amended in 2017 for the approved project is relevant and has prepared an addendum to that document to evaluate the proposed project.
Based on the above, in accordance with Sections 15162 through 15164 of the CEQA Guidelines, the proposed project would not require major revisions to the 2007 IS/MND, as amended in 2017, if the proposed project would not involve new significant environmental effects or a substantial increase in the severity of previously identified significant effects. The analysis that follows concludes that none of the conditions identified in CEQA Guidelines Sections 15162 and 15163 apply to the proposed project. Thus, preparation of an addendum would provide the appropriate level of environmental review.
In cases where an approved project has already undergone environmental review, and the environmental document has been certified by the lead agency, the lead agency can restrict its review to the incremental effects of the modified project, rather than having to reconsider the overall impacts of the project. In other words, if the project under review constitutes a modification of a previously approved project subjected to environmental review, then the “baseline” for purposes of CEQA is adjusted such that the originally approved project is assumed to exist.1 F. DISCUSSION
The following sections provide discussions of any potential impacts associated with the proposed project beyond those previously identified in the 2007 IS/MND as amended in 2017. Given the limited scope of changes that would occur as a result of the proposed project in comparison to the 2017 approved project, this Addendum provides a detailed evaluation of select CEQA topics potentially affected by the changes, including Aesthetics, Air Quality, Greenhouse Gas Emissions, Energy, Noise, Transportation, Land Use and Planning, Population and Housing, Public Services, Utilities, and Hydrology and Water Quality. The remaining CEQA topics are appropriately discussed at a lesser level of detail.
Aesthetics
The proposed project would modify the previously approved 2007 IS/MND, as amended in 2017 by adding a third story to the 86 single-family detached residences on the western portion of the site that were originally proposed as two-story buildings. As a result, the 86 detached residences would more closely match the design of the three-story, attached residences proposed on the eastern and western portions of the project site. The additional story would increase the maximum 1 See Michael H. Remy et al. Guide to CEQA, 11th Edition. Point Arena: Solano Press Books (2007), p. 207; Stephen L. Kostka and Michael H. Zischke. building height for the single-family residences located on the western portion of the project site from 30 feet to 45 feet. The revisions are to the architecture only, with special care to match previous design styles and corner enhancements visible from the public realm. The proposed project would be subject to the same rules governing aesthetics and glare. Furthermore, the previous IS/MND, as amended in 2017, concluded that scenic vistas are not visible from the site or surrounding properties, and, due to the area surrounding the project site being heavily developed, a less-than-significant impact would occur from the proposed project buildout. The visual character of the proposed project would be consistent with what was intended for the site within the 2007 IS/MND, as amended in 2017. Accordingly, any impacts associated with aesthetics as a result of the proposed project would remain the same as what was previously identified in the 2007 IS/MND, as amended in 2017, which concluded mitigation measures were not needed. Thus, based on the above, the proposed project would not result in any changes, new circumstances, or new information that would involve new significant impacts or substantially more severe impacts related to aesthetics from what has been anticipated for the project site in the 2007 IS/MND, as amended in 2017.
Air Quality, Energy, and Noise
Because the proposed project would not involve any changes to the anticipated land uses associated with the site and would result in the same area of disturbance and number of units, the same level of air pollutant emissions, energy usage, and noise associated with both construction and operation of the proposed project would occur as what has already been anticipated for the project site and analyzed in the 2007 IS/MND, as amended in 2017. In addition, statewide standards related to air quality and energy consumption have progressively become more stringent over time, such as the 2022 California Building Standards Code (CBSC), including the 2022 Building Energy Efficiency Standards Code, and the California Green Building Standards Code (CALGreen Code). Such standards, as well as technological innovations, would ensure that as cumulative development occurs under the increasingly stringent regulations, air pollutant emissions and energy use associated with such cumulative development is anticipated to be reduced over time. The proposed project would be required to comply with all applicable standards and regulations associated with air quality and energy, including the most recent version of the CALGreen Code and California Building Energy Efficiency Standards Code. The applicable CEQA thresholds of significance have not changed related to air quality, energy, and noise since the 2007 IS/MND, as amended in 2017, were prepared. Therefore, impacts associated with air quality, energy, and noise, as a result of the proposed project would be the same as what was previously identified, and the mitigation measures for impacts related to noise set forth in the 2007 IS/MND, as amended in 2017, would remain applicable.
Based on the above, the proposed project would not result in any changes, new circumstances, or new information that would involve new significant impacts or substantially more severe impacts related to air quality, energy, or noise from what has been anticipated for the project site in the 2007 IS/MND, as amended in 2017. Implementation of the mitigation measures in the 2007 IS/MND, as amended in 2017, would continue to ensure impacts would be less than significant.
Greenhouse Gas Emissions
Because the proposed project would not involve any changes to the anticipated land uses associated with the site and would result in the same area of disturbance and number of units, the same level of greenhouse gas (GHG) emissions associated with both construction and operation of the proposed project would occur as what has already been anticipated for the project site and analyzed in the 2007 IS/MND, as amended in 2017. In addition, as noted above statewide standards related to air quality and energy consumption have progressively become more

stringent over time, such as the 2022 California Building Energy Efficiency Standards Code and the CALGreen Code. Such standards, as well as technological innovations, are also anticipated to reduce GHG emissions over time.
In addition to advancements in statewide standards and regulations, since the 2007 IS/MND and 2017 Addendum were approved, the City has taken numerous actions towards promoting sustainability within the City, including updating the City’s Climate Action Plan (CAP). The City adopted the updated CAP on November 28, 2022. The Bay Area Air Quality Management District (BAAQMD) thresholds of significance related to GHG emissions have also been updated since the 2007 IS/MND and 2017 Addendum were approved. According to the BAAQMD’s current thresholds of significance for GHG emissions, a project must either include specific project design elements related to buildings and transportation or be consistent with a local GHG reduction strategy that meets the criteria under State CEQA Guidelines Section 15183.5(b). The City of Livermore 2022 CAP meets the criteria to be a GHG reduction strategy under CEQA Guidelines Section 15183.5(b). Therefore, the analysis herein, similar to the analysis within the 2017 Addendum, is based on consistency with City’s CAP.
The 2022 CAP is intended to create a roadmap to achieve emissions reductions of 40 percent below 1990 levels by 2030, and carbon neutrality (i.e., net zero carbon emissions) by 2045. The CAP contains mitigation strategies and actions, consistent with State climate mitigation targets, which were developed to reduce the City’s GHG emissions to reach its adopted reduction targets for 2030 and 2045. The project’s consistency with the applicable mitigation strategies and actions of the 2022 CAP is assessed in Table 1 below.

Strategies and Actions Consistency Discussion
Strategy D-1: Improve water
conservation and reuse.
All landscaping improvements would be required to comply with Section
13.25 of the Municipal Code, Water Efficient Landscape, and would be irrigated by an automatic irrigation system. The proposed project would be required to comply with Section 4.301 of the CALGreen Code to conserve water used indoors, outdoors, and in wastewater conveyance.
Therefore, the proposed project would be consistent with Strategy D-1.
Action D-1.3: Continue
implementing the Water
Efficient Landscape
Ordinance.
As discussed above, all landscaping improvements would be required to comply with Section 13.25, Water Efficient Landscape, of the City’s Municipal Code. Therefore, the proposed project would be consistent with Action D-1.3.
Action F-1.5: Require new
hardscape to be permeable.
must first update standards for new development hardscape to be consistent with CALGreen Tier 1 and/or increase the current fee for installation of new impervious surfaces. The City has not yet updated its standards and, thus, consistency with Action F-1.5 is not required.
Strategy B-1: Require new
buildings to be all-electric
and incentivize electrification
retrofits of existing buildings.
According to Section 15.26.200 of the City of Livermore Municipal Code, all newly constructed buildings within the City are required to be allelectric. The project applicant has committed to the prohibition of natural gas infrastructure in the proposed project design, in compliance with Section 15.26.200 of the City of Livermore Municipal Code. Thus, the proposed project would be consistent with Strategy B-1.
Action B-1.1: Require new
construction to be all-electric.
See consistency discussion for Strategy B-1.

Strategies and Actions Consistency Discussion
Action T-1.1: Expand EV
infrastructure to support EV
adoption.
The 2022 CBSC, as well as the City’s Reach Code amendments to the CBSC, require new developments to include the necessary electrical infrastructure for electric vehicle (EV) charging stations. The proposed project would be required to comply with the 2022 CBSC or the City’s Reach Code, whichever is the more stringent standard at the time of construction. For example, under the City’s Reach Code, new construction of one- and two-family dwellings and townhouses with attached private garages are required to provide two Level 2 EV Ready spaces, where Level 2 EV Ready means a listed raceway to accommodate a dedicated 208/240-volt, 40-amp circuit.
Given the proposed project’s required compliance with the 2022 CBSC and/or the City’s Reach Code, the proposed project would be consistent with Action T-1.1.
Strategy W-1: Reduce the
amount of waste that is
landfilled.
The project would be required to comply with all applicable provisions of Chapter 8.08, Solid Waste Management, of the City’s Municipal Code.
In addition, as discussed below, the proposed project would be required to comply with the CALGreen Code’s construction waste diversion standards during construction of the proposed project. Therefore, the proposed project would generally be consistent with Strategy W-1.
Action W-1.5: Reduce
construction waste.
The CALGreen Code requires all new construction projects to recycle and/or salvage for reuse a minimum 65 percent of all non-hazardous construction and demolition waste. The proposed project would be required to comply with the CALGreen Code standards, and, therefore, would be consistent with Action W-1.5.
Source: City of Livermore Climate Action Plan, 2022.
As presented in the table, the proposed project would comply with the applicable mitigation strategies and actions set forth in the 2022 CAP and would, therefore, be consistent with the local GHG reduction strategy that meets the criteria under State CEQA Guidelines Section 15183.5(b).
Based on the above, the proposed project would not result in any changes, new circumstances, or new information that would involve new significant impacts or substantially more severe impacts related to GHG emissions from what has been anticipated for the project site in the 2007 IS/MND, as amended in 2017.
Transportation
Because the proposed project would not involve any changes to the anticipated land uses associated with the site and would result in the same area of disturbance and number of units, the same level of traffic associated with both construction and operation of the proposed project would occur compared to what has already been anticipated and analyzed for the project site in the 2007 IS/MND, as amended in 2017. Additionally, elimination of the pedestrian bridge component would not result in any new significant impacts or substantially more severe impacts.
The pedestrian bridge was intended to be a private amenity for the future on-site residents of the Arroyo Vista Neighborhood only, serving to provide connection between the eastern and western portions of the site. The pedestrian bridge was not intended to provide regional connectivity or connectivity to off-site areas. For example, the pedestrian bridge is not identified in the General Plan or the City’s Bicycle, Pedestrian, and Trails Active Transportation Plan (ATP). The multi-use trail along the west side of the Arroyo Seco Channel is identified in the ATP, which would remain
EXHIBIT D
649

with the proposed project. In addition, pedestrian connectivity between the eastern and western portions of the site would still be available along Las Positas Road, located just south of where the pedestrian bridge was previously proposed. Internal connectivity throughout the eastern and western portions of the site would also continue to be provided with the proposed project.
Wayfinding amenities are proposed to help enhance the path of travel for residents from Las Positas Road into the project. Therefore, impacts associated with transportation as a result of the proposed project would be the same as what was previously identified, and the mitigation measures set forth in the 2007 IS/MND would remain applicable.
Based on the above, the proposed project would not result in any changes, new circumstances, or new information that would involve new significant impacts or substantially more severe impacts related to transportation from what has been anticipated for the project site in the 2007 IS/MND, as amended in 2017. Implementation of the mitigation measures in the 2007 IS/MND and 2017 Addendum would continue to ensure impacts would be less than significant.
Land Use, Planning, Population, Housing, Public Services, and Utilities Because the proposed project would not involve any changes to the anticipated land uses or number of residential units for the site compared to what was anticipated in the 2007 IS/MND, as amended in 2017, an increase in housing and/or population associated with buildout of the site would not occur, which would result in the same level of demand for public services and utilities as previously anticipated and planned for the site. Additionally, the proposed project would adhere to Section 15.26.200 of the City of Livermore Municipal Code which requires all newly constructed buildings within the City to be all-electric. Therefore, overall, impacts associated with land use, planning, population, housing, public services, and utilities as a result of the proposed project would be the same as what was identified in the 2007 IS/MND, as amended in 2017.
Based on the above, the proposed project would not result in any changes, new circumstances, or new information that would involve new significant impacts or substantially more severe impacts related to land use and planning, population and housing, public services, or utilities from what has been anticipated for the project site in the 2007 IS/MND, as amended in 2017. .
Hydrology and Water Quality
The disturbance area associated with the proposed project would be the same as what has been anticipated for the site in the 2007 IS/MND, as amended in 2017. Accordingly, short-term construction-related impacts associated with hydrology and water quality as a result of buildout of the project site would be the same as what has been anticipated previously. In addition, the same amount of impervious surface area and associated stormwater runoff would be expected on the site as a result of the proposed project compared to what is already anticipated. Therefore, the same impacts related to operational hydrology and water quality would occur under the proposed project as compared to what was anticipated for the site in the 2007 IS/MND, as amended in 2017. Overall, impacts associated with hydrology and water quality as a result of the proposed project would be the same as what was identified in the 2007 IS/MND, as amended in 2017.
Based on the above, the proposed project would not result in any changes, new circumstances, or new information that would involve new significant impacts or substantially more severe impacts related to hydrology and water quality from what has been anticipated for the project site in the 2007 IS/MND, as amended in 2017.

Remaining Impact Areas
Because the disturbance area associated with the proposed project would be the same as what is anticipated for the site in the 2007 IS/MND, as amended in 2017, the proposed project would involve the same level of impacts associated with buildout of the site related to the conversion of or conflicts associated with agricultural land/farmland, the potential discovery of previously unknown cultural or tribal cultural resources, the suitability of soils on the site for development, the presence of potentially hazardous conditions, mineral resources, recreation, and exacerbation of wildfire risks. For similar reasons, impacts associated with biological resources due to development of the site would also be the same as what is anticipated for the site in the 2007 IS/MND, as amended in 2017. However, because the pedestrian bridge would not be constructed under the proposed project, any impacts and associated mitigation measures identified in the 2007 IS/MND specific to the pedestrian bridge (e.g., Mitigation Measure 7.c.1 from the 2007 IS/MND) would no longer be required. All other mitigation measures related to biological resources set forth in the 2007 IS/MND and 2017 Addendum would remain applicable to the proposed project.
Accordingly, the proposed project would not result in any changes, new circumstances, or new information that would involve new significant impacts or substantially more severe impacts related to agriculture resources, biological resources, cultural and tribal cultural resources, geology and soils, hazards and hazardous materials, mineral resources, recreation, and wildfire from what has been anticipated for the project site in the 2007 IS/MND, as amended in 2017.
Implementation of the mitigation measures set forth in the 2007 IS/MND and 2017 Addendum would continue to ensure impacts would be less than significant.
G. CONCLUSION
As established in the discussions above regarding the potential effects of the proposed project, the proposed project would not result in any new significant information of substantial importance, new significant impacts, a substantial increase in the severity of previously identified significant impacts, or new mitigation measures from what was analyzed in the 2007 IS/MND, as amended in 2017. As such, the proposed project would not result in any conditions identified in CEQA Guidelines Section 15162, and a subsequent IS/MND is not required.

RESOLUTION NO. ________
IN THE CITY COUNCIL OF THE CITY OF LIVERMORE, CALIFORNIA A RESOLUTION APPROVING SPECIFIC PLAN AMENDMENT 24-002, FOR THE
ARROYO VISTA RESIDENTIAL DEVELOPMENT, TO REMOVE THE ARROYO VISTA NEIGHBORHOOD PLAN’S BRIDGE REQUIREMENT AND AMEND FIGURES
TO REMOVE THE BRIDGE
In December 2016, the City of Livermore (“City”) received an application from SummerHill Livermore LLC to develop the approximately 29-acre vacant parcel located at the southeast corner of the Arroyo Vista and Las Positas Road intersection with a residential development project.
On January 19, 2023, TH Arroyo Vista LLC (“Applicant”) acquired the project property from SummerHill Livermore LLC to develop the approximately 29-acre vacant parcel located at the southeast corner of the Arroyo Vista and Las Positas Road intersection with a residential development project, consistent with the 2017 approval.
On January 25, 2024, the City received a modified application from the Applicant for approximately 15-acres of the site that is currently being graded to allow construction of the residential buildings that are not subject to this amendment. The entitlements for the modified Project include Site Plan Design Review Modification (SPDRM) 24-002, Development Agreement Amendment (DAA) 24-001, Planned Development (PD) 24-001, and Specific Plan Amendment (SPPA) 24-002 (collectively, the “Project”). The modified Project would remove the bridge requirement due to it becoming infeasible. The modified Project would develop at the intersection of southeast of Las Positas and Arroyo Vista Road, consistent with the 2017 approval. The modified Project would be increased from two stories to three stories and allow a height of up to 45 feet on the 86 for sale singlefamily residential homes. The Project also includes a Development Agreement Amendment between the City and Developer, Planned Development rezoning, and Specific Plan Amendments. The Development Agreement Amendment removes the bridge requirement that became infeasible due to liability issues. In place of the bridge landings, the Project proposes two pocket parks. Additionally, an in-lieu contribution of $2,000,000 would be provided to the Community Benefit Fund and the Social Opportunity Endowment Fund. The Planned Development rezoning removes the bridge requirement as well and allows for building heights of up to 45 feet and 3 stories. Finally, the Specific Plan amendments removes the bridge requirement.
The proposed Arroyo Vista Neighborhood Plan (“Neighborhood Plan”) amendments would allow the Project to be implemented by removing the bridge requirement due to the construction of the bridge becoming infeasible. Removing the bridge requirement would facilitate the Project.
On July 16, 2024, at a duly noticed public hearing, the Planning Commission considered the Project, heard public testimony, made the necessary findings, and adopted Planning Commission resolution No. 25-24, attached hereto as Exhibit A, recommending the City Council approve the Project.

On September 9, 2024, the City Council held a duly noticed public hearing to consider the Project, Planning Commission and staff recommendations, all public comments and testimony, and findings.
Together with this resolution, the City Council concurrently considered resolutions for Site Plan Design Review Modification (SPDRM) 24-002 and ordinances for: 1) the Project’s Development Agreement (DAA) 24-001 application; and 2) the Project’s Planned Development rezoning (PD) 24-001 application.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Livermore that prior to taking action on the Project, and at a properly noticed public hearing, the City Council reviewed written and oral staff reports, conducted a public hearing on the Project and took testimony, and received into the record all pertinent documents related to the Project (collectively, the “Record Evidence”). The City Council’s determination is based on the Record Evidence, which is incorporated into this Resolution by reference.
BE IT FURTHER RESOLVED that the City Council of the City of Livermore has considered the Record Evidence and approved a resolution adopting the Arroyo Vista Neighborhood Project Addendum to the Arroyo Vista Neighborhood Plan Initial Study/Mitigated Negative Declaration [IS/MND] (SCH #2007052028), as amended by the 2017 addendum, consistent with the requirements of the California Environmental Quality Act (“CEQA”).
BE IT FURTHER RESOLVED that the City Council of the City of Livermore has considered the findings made in Planning Commission Resolution No. 25-24, attached hereto as Exhibit A, and the City Council hereby adopts the same findings by this reference and incorporates them as their own findings as part of this resolution, and as described below:
1. A Specific Plan may only be amended if first found consistent with the General Plan in compliance with Government Code Section 65454.
Findings: The Project proposes a Specific Plan Amendment to: 1) Amend Arroyo Vista Neighborhood Plan to remove the bridge requirement; and 2) Amend the figures to remove the bridge. Each component of the Amendment is consistent with the General Plan, as follows:
Consistency with Open Space and Conservation
The Project site has a General Plan land use designation of Light Intensity Industrial (LII), Urban High Density Residential (UH-3), and Open Space (OS) floating designation. The Project is consistent with the land use designation and implements the General Plan goals for UH-3 and OS. The proposed amendments would facilitate the Project, which removes the 653
RESOLUTION NO. ________
bridge requirement due to the construction of the bridge becoming infeasible. For example, removing the bridge requirement would reduce the maintenance obligations for the City by $73,000 per year. Per the General Plan Open Space and Conservation Element, Objective OSC-5.4, Policy 1:
The City shall continue to encourage public access to, and maintenance of, existing recreational trails in the Planning Areas. The City would ultimately be responsible for the maintenance of the bridge over the public walking trail. The tax revenue generated from the property tax would help to offset maintenance costs such as the benches along the trail. The maintenance costs for the bridge are substantial and the revenue from property tax would not offset the cost of maintenance for the bridge. Therefore, amending the bridge requirement would facilitate the proposed Project.
Consistency with Economic Development and Fiscal Element Furthermore, the proposed amendment would facilitate the Project by sustaining a level of maintenance expenses that are consistent with the tax base generated by the residential taxes. The maintenance obligations of the bridge are estimated to be $73,000 a year. Per the General Plan Economic Development and Fiscal Element, Objective ED-3.1, P2: The City shall strive to maintain taxes and fees at a level adequate to provide necessary services. Amending the bridge requirement creates consistency between the Project and the Economic Development and Fiscal Element by ensuring that the tax base can support the maintenance expenses.
BE IT FURTHER RESOLVED that, based upon the City Council’s own independent review of the Record Evidence and considerations, the City Council hereby approves Specific Plan Amendment (SPPA) 24-002, attached hereto as Exhibit B for the Arroyo Vista Residential Development.
BE IT FURTHER RESOLVED that the City Council of the City of Livermore directs the Planning Manager to file a Notice of Determination with the Alameda County Clerk.
BE IT FURTHER RESOLVED that the City Council of the City of Livermore finds that the effective date of this resolution shall be the effective date of Specific Plan Amendment (SPPA) 24-002.
The documents that constitute the record of proceedings upon which this decision is based can be found in the City Clerk’s Office, 1052 S. Livermore Avenue, in Livermore California.

Arroyo Vista Neighborhood Plan Amendments
Staff recommends the following amendments to the Neighborhood Plan. Text additions are shown in underline and text deletions are shown in strikeout.
Project Description
1. Page i-v, is amended as follows: As shown in the illustrative plans in Chapter 2, the street and open space network serves as the framework for development of this traditional neighborhood. Although the Plan Area includes two sub-neighborhoods, both are tiered off of an open space and circulation system that includes parks which are easily accessible to all neighborhood residents. Similarly, the buffer areas along the Arroyo Seco Channel are easily accessed by both neighborhoods. A pedestrian bridge over the channel is proposed to facilitate access to either side. Primary building entries front onto sidewalks and tree lined streets, paseos, or common open space areas.
Buildings all front or side onto public or common landscape areas, and garages are located away from primary roads and walkways.
Chapter 1 – Existing Conditions
2. Page 1-4, Figure 1.2: Neighborhood Analysis is amended to remove the Pedestrian Bridge. Refer to attachment 1 for a copy of the revised figure.
3. Page 1-9, is revised as follows: Currently, Las Positas is a two-lane road along the Site’s frontage (from Arroyo Vista Road to Bennett Drive). An existing development agreement between the Arroyo Vista property owner and City requires certain public improvements to be constructed in conjunction with any development on this Site. These improvements are outlined in specific detail in the City’s Traffic Impact Fee (TIF) program and include:
widening Las Positas Road from 2 to 4 lanes, adding a median, and providing bike lanes on both sides. and constructing a new bridge to cross the Arroyo Seco Channel, which traverses the midpoint of the Site from north to south.
4. Page 1-15, is amended as follows: The location of the channel and future trail improvements along the Zone 7 service road through the Site provide an opportunity for direct connectivity to the trail from the Site. There is also opportunity for enhanced, natural landscaping and open space areas in the proposed setback area adjacent to the channel. However, the location of the channel is also a constraint in that it bisects or divides the Site into two sub-neighborhoods. For this reason, careful attention should be paid to provide a separated connection to the trail and to both sides of the project along the Arroyo Seco Channel and Las Positas Road. A pedestrian bridge is also recommended to cross the channel and connect the two sub-neighborhoods.
Chapter 2 – Neighborhood Land Uses
1. Page 2-5, is amended as follows: As shown in the conceptual plans, the street and open space network serves as the framework for development of this traditional neighborhood. Although the Plan Area includes two neighborhoods on each side of the channel, both are organized around usable, well defined park areas which are easily
EXHIBIT B
668
accessible to all neighborhood residents. Similarly, the buffer area along the Arroyo Seco Channel is easily accessed by both. The two neighborhoods are to be connected by a pedestrian bridge facilitating access to either side. Primary building entries front onto sidewalks and tree lined streets, paseos, or common open space areas. Buildings all front or side onto public or common landscape areas, and garages are located away from primary road and walkways.
5. Page 2-6, Figure 2.1: Conceptual Land Use Plan A (14.1 du/acre) is amended to remove the Pedestrian Bridge. Refer to attachment 2 for a copy of the revised figure.
6. Page 2-7, Figure 2.2: Conceptual Land Use Plan B (17.3 du/acre) is amended to remove the Pedestrian Bridge. Refer to attachment 3 for a copy of the revised figure.
7. Page 2-9, is amended as follows: The Arroyo Vista Neighborhood Plan envisions a walkable community with a series of pedestrian connections and a hierarchy of interconnected streets and pedestrian pathways. The neighborhood should be a unique community that focuses on livability, quality of life, and that provides a variety of amenities such as a private neighborhood center with pool, playground facilities, parks and open space. Multi-use trails will be constructed parallel to and along both sides of the Arroyo Seco Channel. Trail crossings will be provided at Arroyo Vista and Las Positas Roads. A pedestrian bridge will connect either sides of the Channel providing easy access to both sides of the community.
8. Page 2-20, is amended as follows: The street and open space network serves as the basic framework for neighborhood development. Although the Plan Area includes two neighborhoods on each side of the channel, both include one usable, well defined open space area easily accessible to all residents and a pedestrian bridge over the Arroyo Seco linking the two areas. The Arroyo Vista Neighborhood should have at least one park, of a minimum .20 acre size on each side of the Arroyo Seco. These neighborhood parks are to be easily accessible to residents and visible from the adjacent streets and surrounding uses.
9. Page 2-21, is amended as follows: A multi-use pathway is also proposed within the required minimum 30-foot building setback from the site property line on either side of the channel. Along with the public multi-use trail proposed for the 20-foot Zone 7 service road, a minimum 50-foot setback will be provided from the top of the creek bank to any building. This trail will provide connectivity from different areas of the community to the Arroyo Seco and ultimately leading to the public citywide multi-use trail. The buffer area along the Arroyo Seco Channel is easily accessed by both neighborhoods with a pedestrian bridge leading to either side of the channel. A trail on the east side of the channel shall also be required.
Chapter 3 – Circulation System
1. Page 3-4, Figure 3.1: Conceptual Circulation is amended to remove the Pedestrian Bridge. Refer to attachment 4 for a copy of the revised figure.
2. Page 3-17, Figure 3.8: Concept Plan A (14.1 du/acre) – Parking Diagram is amended to remove the Pedestrian Bridge. Refer to attachment 5 for a copy of the revised figure.

Chapter 6 – Implementation
1. Page 6-5 is amended as follows: The developer(s) of the Site will be required to fund improvements to implement trail standards for a public multi-use trail along the existing

Zone 7 service Road along the west side of the Arroyo Seco Channel adjacent to the Project Site. This proposed trail is outlined within the City’s Bikeways and Trails Master Plan. Potential improvements would include upgrading the road with asphalt, striping and decomposed granite. In order to implement a publicly accessible trail for recreation purposes on property owned and maintained by Zone 7, the City will need to enter into a License Agreement with Zone 7 for maintenance and liability.
The developer(s) of the Site will also be required to fund improvements for a neighborhood trail on the east side of the Channel, adjacent to the Project Site, in conjunction with a pedestrian bridge crossing across the Channel. The pedestrian bridge must clear span the Arroyo. Specific bridge design details including bridge height are subject to Zone 7 standards and must be coordinated with Zone 7.

RESOLUTION NO. ________
IN THE CITY COUNCIL OF THE CITY OF LIVERMORE, CALIFORNIA
A RESOLUTION APPROVING SITE PLAN DESIGN REVIEW MODIFICATION (SPDRM) 24-002 SUBJECT TO CONDITIONS OF APPROVAL FOR THE ARROYO
VISTA NEIGHBORHOOD DEVELOPMENT
The City of Livermore (“City”) received an application for Site Plan Design Review Modification (SPDRM) 24-002 to modify the 2017 approval located southeast of the Arroyo Vista and Las Positas Road intersection (“Project”). The modified Project would be increased from two stories to three stories and allow a height of up to 45 feet on the 86 for sale single-family residential homes, two approximately 0.2-acre neighborhood parks with an additional approximately 0.5 acre of pocket parks, street improvements, street trees, and utility infrastructure.
Finally, the Specific Plan amendments remove the bridge requirement.
At a duly noticed public hearing on July 16, 2024, the Planning Commission considered the Project and staff recommendation, heard public testimony, made the necessary findings and adopted Planning Commission Resolution No. 25-24, attached hereto as Exhibit A, containing the Planning Commission’s actions and/or recommendations thereon.
On September 9, 2024, the City Council held a duly noticed public hearing to consider the Project, Planning Commission and staff recommendations, all public comments and testimony, and findings.
BE IT FURTHER RESOLVED that the City Council of the City of Livermore has considered the Record Evidence and adopted a resolution finding the project to be exempt from the California Environmental Quality Act.

Hearing to consider the "Arroyo Vista" residential development Project on approximately 15 acres within the Arroyo Vista Neighborhood. Subject: Arroyo Vista (Pell) SFD Revision, SUB24-002
Southeast Las Positas Road and Arroyo Vista Intersection, Livermore, CA Zone 7 Referral No. 23-034C Rev
Dear Kaitlyn Harrison,
In response to your referral letter regarding the subject project, we offer the following comments:
Water Supply Facilities
There are no existing nor planned Zone 7 water supply facilities at this project site.
The scope of this review by Zone 7 does not include an analysis of potable water supply availability or source of sufficient water supply for the proposed project; the project proponent should coordinate with the appropriate water service provider (City of Livermore, City of Pleasanton, Dublin San Ramon Services District, or California Water Service Company) to identify availability and source of potable water supply for this development. If the proposed project includes the installation of water supply wells, please contact Zone 7 ([email protected]) for more information.
Groundwater Management
Wells - Our records indicate that there is one well (3S2E03Q003) in the project area (Figure 1) that must be protected or decommissioned. Please immediately notify Zone 7 if any other wells exist in the project area. All well locations should be field verified and noted on the plans.
Figure 1 also shows the approximate location of one destroyed well in the project area. No permit or notification is required for this well, however, please note that this well has likely
EXHIBIT C
762
been backfilled with cement and may be encountered during future grading activities. For additional information please email [email protected].
Also, please be advised that a Zone 7 drilling permit is needed for any water well or soil boring work that may be planned for this project. The drilling permit application and permit fee schedule can be downloaded from our website: https://www.zone7water.com/post/welldrilling-and-soil-boring-permits. For additional information please email [email protected].
It should be noted that the subject property (or project) is located within the basin area under sustainable groundwater management by Zone 7 as per the Alternative Groundwater Sustainability Plan for the Livermore Valley Groundwater Basin and is subject to all relevant sustainable groundwater management actions.
Water-wise Landscaping - Zone 7 encourages the use of sustainable, climate-appropriate, and drought-tolerant plants, trees and grasses that thrive in the Tri-Valley area. Find more information at: http://www.trivalleywaterwise.com.
Flood Protection
Zone 7 has an existing Flood Protection facility, Arroyo Seco (Line P) at this location.
The developer had plans to construct a pedestrian bridge over the channel, which would have required an aerial easement. An aerial easement had been prepared for the City of Livermore and approved by the Alameda County Board of Supervisors in January 2024. The developer has applied for an amendment with the City of Livermore to remove the bridge from the project’s scope of work. The developer would still be providing trail improvements on the west bank of the channel to meet the City’s requirements. The City had notified Zone 7 of the proposed bridge removal on May 21, 2024, and Zone 7 subsequently, is revising its comments to Referral 23-034C. Trail improvements and maintenance of the trail would still fall under the City’s responsibility under the existing Recreational Use License Agreement between Zone 7 and the City.
Developments creating new impervious areas within the Livermore-Amador Valley are subject to the assessment of the Development Impact Fee for Flood Protection and Storm Water Drainage. These fees are collected for Zone 7 by the local governing agency: 1) upon approval of the final map for public improvements creating new impervious areas and/or 2) upon issuance of a building or use permit required for site improvements creating new impervious areas. Fees are dependent on whether post-project impervious area conditions are greater than pre-project conditions.
EXHIBIT C
763
If you have any questions regarding comments from Flood Protection, please contact Jeff Tang at (925) 454-5075. If you have floodplain-related questions, such as whether the project is located within a natural floodplain, please contact the Floodplain manager at the City of Livermore.
In an effort to ensure that mailed notices and referrals from your agency make their way to the appropriate staff at Zone 7 in a timely manner, we are requesting that your databases/mailing lists are updated to reflect the following points of contact, specifically for routine development referrals and for CEQA / environmental reviews.

On July 24, 2017, SummerHill Livermore LLC and the City of Livermore entered into a Development Agreement (DA) 17-002 and recorded as Document No. 2017251014 in the Official Records of Alameda County.
On January 25, 2024, the City received an amended application from the Applicant for approximately 15-acres of the site that is currently being graded to allow construction of the residential buildings that are not subject to this amendment. The applications for the modified Project include Site Plan Design Review Modification (SPDRM) 24-002, Development Agreement Amendment (DAA) 24-001, Planned Development (PD) 24-001, and Specific Plan Amendment (SPPA) 24-002 (collectively, the “Project”). The modified Project would remove the bridge requirement due to it becoming infeasible. Additionally, the modified Project would allow for taller homes of up to 45 feet and 3 stories that meet current market demands. The modified Project would develop at the intersection of southeast of Las Positas and Arroyo Vista Road, consistent with the 2017 approval. The Project includes 86 residential units, amenity space, two approximately 1.5-acre neighborhood parks with an additional approximately 0.5 acres of pocket parks, street improvements, street trees, and utility infrastructure. The residential units consist of for sale detached single-family homes. The Project also includes a Development Agreement Amendment (the “Development Agreement Amendment”) between the City and Developer, and Neighborhood Plan amendments.

DATE: September 9, 2024
TO: Honorable Mayor and City Council
FROM: Marianna Marysheva, City Manager
SUBJECT: Designation of voting delegate and alternates for the 2024 League of California Cities General Assembly.
RECOMMENDED ACTION
Staff recommends the City Council appoint one voting delegate and up to two alternates to represent the City of Livermore at the 2024 League of California Cities General Assembly.
SUMMARY
Each year the League of California Cities (“League”) holds a General Assembly where League membership considers and takes action on resolutions that establish League policy. In order to vote during the General Assembly, the City Council must designate a voting delegate and up to two alternates.
DISCUSSION
The League of California Cities is an association of California city officials who work together to shape policies affecting local government. The League’s Annual Conference is scheduled for October 16-18, 2024, at the Long Beach Convention Center, including the General Assembly on October 18, 2024. At the General Assembly, cities will vote on resolutions that establish League policy. In order to vote on behalf of the City of Livermore during the General Assembly, the City Council must designate a voting delegate and up to two alternates, one of whom may vote in the event that the designated voting delegate is unable to serve in that capacity. This action must be taken by the City Council and cannot be accomplished by individual action of the mayor or city manager.
The voting delegate and alternates must be registered to attend the League’s Annual Conference (either the entire conference or October 18th only). To cast the City’s vote, the delegate or alternate must have in their possession the City’s voting card and voting tool, and be registered with the League’s Credentials Committee. The voting card may be transferred freely between the voting delegate and alternates.
After the delegate and alternates have been designated by the City Council, staff will submit the online 813
Voting Delegate Form to the League by the deadline of September 25, 2024.
FISCAL AND ADMINISTRATIVE IMPACTS
There are no fiscal and administrative impacts associated with the designation of a voting delegate and alternates.

TO: Mayors, Council Members, City Clerks, and City Managers RE: DESIGNATION OF VOTING DELEGATES AND ALTERNATES
League of California Cities Annual Conference and Expo, Oct. 16-18, 2024 Long Beach Convention Center
Every year, the League of California Cities convenes a member-driven General Assembly at the Cal Cities Annual Conference and Expo. The General Assembly is an important opportunity where city officials can directly participate in the development of Cal Cities policy.
Taking place on Oct. 18, the General Assembly is comprised of voting delegates appointed by each member city; every city has one voting delegate. Your appointed voting delegate plays an important role during the General Assembly by representing your city and voting on resolutions.
To cast a vote during the General Assembly, your city must designate a voting delegate and up to two alternate voting delegates, one of whom may vote if the designated voting delegate is unable to serve in that capacity. Voting delegates may either be an elected or appointed official.
Action by Council Required. Consistent with Cal Cities bylaws, a city’s voting delegate and up to two alternates must be designated by the city council. Please note that designating the voting delegate and alternates must be done by city council action and cannot be accomplished by individual action of the mayor or city manager alone.
Following council action, please submit your city’s delegates through the online submission portal by Wed., Sept. 25. When completing the Voting Delegate submission form, you will be asked to attest that council action was taken. You will need to be signed in to your My Cal Cities account when submitting the form.
Submitting your voting delegate form by the deadline will allow us time to establish voting delegate/alternate records prior to the conference and provide pre-conference communications with voting delegates.
Conference Registration Required. The voting delegate and alternates must be registered to attend the conference. They need not register for the entire conference; they may register for Friday only. Conference registration is open on the Cal Cities website.
Council Action Advised by September 25, 2024

For a city to cast a vote, one voter must be present at the General Assembly and in possession of the voting delegate card and voting tool. Voting delegates and alternates need to pick up their conference badges before signing in and picking up the voting delegate card at the voting delegate desk. This will enable them to receive the special sticker on their name badges that will admit the voting delegate into the voting area during the General Assembly.
Please view Cal Cities’ event and meeting policy in advance of the conference.
Transferring Voting Card to Non-Designated Individuals Not Allowed. The voting delegate card may be transferred freely between the voting delegate and alternates, but only between the voting delegate and alternates. If the voting delegate and alternates find themselves unable to attend the General Assembly, they may not transfer the voting card to another city official.
Seating Protocol during General Assembly. At the General Assembly, individuals with a voting card will sit in a designated area. Admission to the voting area will be limited to the individual in possession of the voting card and with a special sticker on their name badge identifying them as a voting delegate.
The voting delegate desk, located in the conference registration area of the Long Beach Convention Center in Long Beach, will be open at the following times: Wednesday, Oct. 16, 8:00 a.m.-6:00 p.m. and Thursday, Oct. 17, 7:30 a.m.-4:00 p.m. On Friday, Oct. 18, the voting delegate desk will be open at the General Assembly, starting at 7:30 a.m., but will be closed during roll calls and voting.
The voting procedures that will be used at the conference are attached to this memo.
Please share these procedures and this memo with your council and especially with the individuals that your council designates as your city’s voting delegate and alternates.
Once again, thank you for submitting your voting delegate and alternates by Wednesday, Sept. 25. If you have questions, please contact Zach Seals at [email protected].

five additional member cities or
individual members.
How it works: Cal Cities
Resolutions and the General Assembly
General Assembly
General Resolutions Policy Committees
Developing League of California Cities policy is a dynamic process that engages a wide range of members to ensure Cal Cities represents cities with one voice. These policies directly guide Cal Cities’ advocacy to promote local decision-making, and lobby against statewide policies that erode local control.
The resolutions process and General Assembly is one way that city officials can directly participate in the development of Cal Cities policy. If a resolution is approved at the General Assembly, it becomes official Cal Cities policy. Here’s how resolutions and the General Assembly work.
The petitioned
resolution is an
alternate method
to introduce policy
proposals during
the annual conference. The
petition must be signed by
voting delegates from 10% of
member cities, and submitted to
the Cal Cities President at least
24 hours before the beginning
of the General Assembly.
Petitioned Resolutions
The Cal Cities
President assigns
general resolutions
to policy committees
where members
review, debate, and recommend
positions for each policy proposal.
Recommendations are forwarded
to the Resolutions Committee.
Who’s who
The Resolutions Committee
includes representatives
from each Cal Cities
diversity caucus, regional
division, municipal
department, and policy
committee, as well as
individuals appointed by
the Cal Cities president.
Voting delegates
are appointed by each
member city; every city
has one voting delegate.
The General Assembly is a
meeting of the collective
body of all voting
delegates —one from
every member city.
Seven policy committees
meet throughout the year
to review and recommend
positions to take on bills
and regulatory proposals.
Policy committees include
members from each Cal
Cities diversity caucus,
regional division, and
municipal department,
as well as individuals
appointed by the Cal
Cities president.
During the General Assembly, voting delegates
debate and consider general and petitioned
resolutions forwarded by the Resolutions
Committee. Potential Cal Cities bylaws
amendments are also considered at this meeting.
Cal Cities policy
development is a memberinformed process,
grounded in the voices and
experiences of city officials
throughout the state.

Resolutions Committee
The Resolutions
Committee considers
all resolutions. General
Resolutions approved1 by
either a policy committee
or the Resolutions Committee are next
considered by the General Assembly.
General resolutions not approved, or
referred for further study by both a
policy committee and the Resolutions
Committee do not go to the General
Assembly. All Petitioned Resolutions
are considered by the General
Assembly, unless disqualified.2
During the Annual Conference and Expo
1 The Resolution Committee can amend a general resolution prior to sending it to the General Assembly. 2 Petitioned Resolutions may be disqualified by the Resolutions Committee according to Cal Cities Bylaws Article VI. Sec. 5(f).

Subject: Save the trees!
Exercise CauƟon: This message is from outside the City email system. Do not open links or aƩachments from untrusted sources.
Hello I am wriƟng in today to talk about the trees in Livermore. I am hoping this will be brought up as a complaint at the city meeƟng.
We have an infested ash tree next door that is falling apart. Every wind storm a branch falls off of it. Two weekends ago another big branch snapped off and is hanging by a thread now- and there wasn’t any wind that day! It is right on the sidewalk on the corner of Pestana and Estates and the home address is Estates st. I have wriƩen on the 311 site and last week on Tuesday I spoke with someone at the city offices regarding this as well. Nothing has happened. The tree is sƟll there with its branches falling everywhere. This is so dangerous for those walking to school and back and the mulƟple people I see walking underneath it with their babies, and pets. Also cars driving underneath it are at risk as well.
I put up some caƟon tape around the fallen branch, but would be nice if the city came along and roped off the area.
Not only are these trees a danger- they also infest other trees around them. Livermore has a HUGE problem with mistletoe infesƟng our trees. Many Ɵmes they infest trees that have been trimmed wrongly over the years which brings up my next concern- seems anyone these days are calling themselves “tree trimmers”. What can the city do to curb these unqualified businesses that say they are qualified to do the job? I see them daily in our neighborhood butchering trees.
The trees get stressed out aŌer being hacked and then that opens up the door for mistletoe and other pests to eat away at that tree and then kill it. All the while infesƟng other trees in the neighborhood. Please what can the city do to help educate the ciƟzens regarding tree trimming and tree removals?! This house at Estates st and hasn’t had the home owners or anyone else living in it for over 4 months. Seems they are geƫng a renovaƟon on the whole house, but yet won’t take care of their trees. We are fed up as neighbors. Please have someone take a look at this tree and help us to get it taken down.
Thank you,
Dawn Wantroba
