1. Section -16 of the .Sid Proposal Form .and Enclosures of. Instruction to.Bidders, Page No. 9, of the Bid Contract Documents requires the submittal of a complete Subcontractor List with their Bid Proposal.

Schreder & Brandt Mfg. Inc. submitted an incomplete Subcontractor List with the Bid Proposal that did not contain the Percent of Project Work amount for the individual Subcontractors as required by the City's Specifications.

Additional individual percent information on Subcontractor List, not submitted with your Bid Proposal, was submitted by Schreder & Brandt Mfg. Inc. on June 23rd, 2025 and after the required 24 hours from Bid Opening on June 19th at 2:30 PM.

California Public Contract Code Section 4104 specifies that additional information may be submitted by prime contractors within 24 hours of Bid Opening. As a general law city, Livermore is required to follow this statutory bidding procedure and a bid that is inconsistent with this requirement is nonresponsive.

2. Instruction to Bidders, Section 5 Bidder Information, Page No. 8 of Bid Contract Documents requires Bid Proposals submitted by corporations, must be signed by two officers of the corporation, under California Corporation Code, Section 313.

Schreder & Brandt Mfg. Inc. submitted an incomplete Bid Proposal that has only one signature for one officer. Failure to comply with this requirement also results in a bid being subject to rejection as nonresponsive.

These errors and omissions are not merely clerical errors that can be waived, but are material errors that affect the responsiveness and amount of Schreder & Brandt Mfg., Inc's bid. For City staff to waive these errors and omissions as being inconsequential would result in prejudicing other bidders that submitted responsive bids without errors and omissions, would result in a bid that failed to follow the bidding instructions and did not respond accurately and completely to the City's project advertisement and would therefore, undermine the competitive bidding requirements. As a result, the City has determined Schreder & Brandt Mfg. lnc.'s bid to be non-responsive.

Instruction to Bidders, Section 22.4 Response to Protest, Page No. 11 of Bid Contract Documents allows three working days after Bid Protest for protested bidder's response to the bid protest.

The City is planning to award this construction contract to the most responsive and responsible bidder, GradeTech Inc. at the July 28, 2025, City Council Meeting.

Re: SPRINGTOWN OPEN SPACE IMPROVEMENTS,

SPRINGTOWN COMMUNITY PARK AND DISC GOLF COURSE
CITY PROJECT NO. 202319
Subject: Protest of Schreder and Brandt Mfg. Bid on above project.

To Whom It May Concern
Introduction
Pursuant to the City of Livermore's Springtown Open Space Improvements Springtown Commwtlty Park and Disc Golf Course Bid (the project), and including without limit- the Bid Proposal, Bid Schedule & Sub-Contractors List, Gradetech inc is protesting Schreder and Brandt Mfg. Low Bid.

Basis for Protest
(Complete statement of legal grounds for protest)
On June 19th. 2025, The City of Livermore City Clerk received, opened and read aloud bids for the Project with Schreder and Brandt Mfg. as (Preliminary) Apparent Low bidder. Gradetech Inc. is protesting Schreder and Brandt Mfg. 's bid on the project for failure in completely and accurately filling out bid proposal. Specifically, First, an inaccurate Bid Schedule with Missing Bid Item 1.47 Park Sigtlage Cost, Left Blank, and Nwnerous Mathematical errors (Bid Items 1.12,1.13, 1.16,1.17, 1.21,

1.22, 1.24, 1.26, 1.27, 1.31, 1.41, 1.57, 1.58, 1.59, 1.60, 1.64, 1.65, 1.66, 1.68, 2.7A, 2.10,

2.17, and 2.22.) and numerous Bid Items with different Unit price than calculated Bid Item Total prices (Bid Items l.7,1.8,l.25A) and
Secondly, for not listing sub-contractor's percent of work on Sub-contractor's page. Schreder and Brandt Manufacturing failed to list any Sub-contractor's percentage of work (Contract Documents, page 9 per Instructions to Bidders item 13 - "The Contractor must perform, with its own forces, at least 30 percent of the Work on the Project, calculated as a percentage of the Base Bid price excluding the amount for "specialty items" as designated by the letter S on the Bid Schedule fonn. The remaining Work may be performed by qualified SubcontractoI(s)."

As there are not percentages listed for Subs-Contractors, it is unknown how much work the Contractor or Sub-contractor would be performing so City could verify at least 30% General Contractor's work perfonned with own forces.

Since Schreder and Brandt Mfg.'s Bid, failed to list percentages of work for Subcontractors on Bid, The Bid should be deemed irresponsive by City of Livermore.

Additionally, per Bid Proposal Page 13 Number 1" Bidder must fully complete and submit the Bid Schedule in order for its bid to be complete" and also per Instructions to Bidders number "1. Each Bid Must ... The bid price(s), including unit prices, must include all costs to perform the Work as specified," As there are missing Bid Item costs and Errors resulting in multiple prices for same bid items, The City should deem Schreder and Brandt Mfg.' s Bid irresponsive.

Conclusion
Schreder and Brandt Mfg.' s Bid failed to list required sub-contractors percentages of work as well as Bid Schedule containing several Omissions and errors should be deemed un-responsive and project awarded to next lowest bidder.

Sincerely,
I/I~((/~(/?

Dear Council,
I am writing to urge you to adopt a resolution ratifying, reaffirming, and readopting the Amended and Restated Disposition, Development, and Loan Agreement with Eden Housing, allowing for the construction of 130 units of affordable housing in the heart of Livermore.

As someone who works in Downtown Livermore, I’ve seen firsthand how important it is for our city to offer more affordable housing options. This project supports the workers, families, and community members who help make Livermore a vibrant and welcoming place to live and work.

The Downtown Livermore Apartments should have been built long ago, and there is an even greater need for affordable housing for Livermore’s workforce and its families. This is an opportunity for you to reaffirm your support for this important development. Please follow staff’s recommendation and vote in support of this project on item 7.1.

RE: Endorsement of Downtown Livermore Apartments
Dear Mayor and Livermore City Council,
For over 65 years, Greenbelt Alliance has helped create cities and neighborhoods that make the Bay Area a better place to live—healthy places where people can walk and bike; communities with parks, shops, transportation options; homes that are affordable and resilient to the impacts of climate change. Greenbelt Alliance’s Climate SMART—Sustainable, Mixed, Affordable, Resilient, Transit-Oriented—Development Endorsement Program provides support for projects that advance the right kind of development in the right places.

After careful review, Greenbelt Alliance was pleased to endorse the proposed Downtown Livermore Apartments Project in 2021.

I am writing to urge you to adopt a resolution ratifying, reaffirming, and readopting the Amended and Restate Disposition, Development, and Loan Agreement with Eden Housing, allowing for the construction of 130 units of affordable housing in the heart of Livermore.

This 2.1 acre, 100% affordable residential development is designated for low-income families earning between 20% and 60% of Alameda County’s Average Median Income. The traffic and environmental benefits that will be provided by this project are exactly what Livermore needs to grow smartly. This currently underutilized area will contribute to the City’s vision for high quality, higher-density development. This project will encourage a walkable and vibrant community in Livermore for residents across the income spectrum, provide a public open space with its large public park, and offer a host of other environmental and quality of life benefits.

This is the kind of climate-smart development that we need in the Bay Area to meet our housing goals, reduce greenhouse gas emissions, and make sure that local residents are able to grow and thrive in their own communities. The Downtown Livermore Apartments should have been built long ago, and there is an even greater need for affordable housing for Livermore’s workforce and its families. This is an opportunity for you to reaffirm your support for this important development. Please follow staff’s recommendation and vote in support of this project on item 7.1.

Honorable Mayor and City Council Members
I encourage you to approve Item No. 7.1 on your July 28, 2025, meeting agenda.

There is a well-established critical shortage of affordable housing in Livermore and most every where in California. The downtown Eden Housing units should have been built long ago. Hopefully this third approval will be the charm that gets it done. It would be truly wonderful if the small group of wealthy elites fighting this housing has finally run out of options for frivolous lawsuits and other nefarious delaying tactics.

Dear City Clerk:

Please register my support for Item 7.1 of the Agenda for the regular Livermore City Council meeting scheduled for July 28, 2025. Please convey my comment to respected Mayor and the City Council in the following terms:

Honorable Mayor and Council Members:

I am writing to request you to retake the action in Resolution No. 2024-109 ("Companion Resolution"), and thereby, ratify, reaffirm, and readopt the Amended and Restated Disposition Development and Loan Agreement ("A&R DDLA"), which remains in effect as of May 24, 2022. Consistent with the Appellate's Court's decision of March 6, 2024, in Move Eden Housing versus City of Livermore, the Companion Resolution had ensured that Eden DT Housing would be built at its intended (and, court-validated) Downtown site, while severing off all provisions related to Veterans Park from the A&R DDLA.

The scope and effect of the Companion Resolution is consistent with the Severability Clause, Section

13.9, on page 46, of the A&R DDLA. The adoption of the Companion Resolution was very well indeed a legally sound and good-faith step that the learned City Attorney had recommended at last year's City Council meeting of June 24, 2024. Given the year long delay solely attributable to Move Eden Housing and their barrage of malicious lawsuits, we must not wait anymore and proceed to retake the action in the Companion Resolution in the best interests of our town.

I also want to express my gratitude to respected Mayor Marchand and Councilmembers, the City Attorney, former City Clerk, Marie Weber, and the City Manager and her team, for acting not just fairly, but also resiliently and persistently, in this extremely contentious and belabored matter, and for consistently taking steps all along the way that uphold the inclusive values of Livermore. Your policies and fair decisions is precisely the reason for Livermore's increasing popularity and desirability among people from everywhere wanting to live, work, and invest in this town.

I know that some years from now, we are going to look at Eden DT Housing and the exemplary precedent Livermore's officials established for all other local governments in how to protect public land promised and zoned for housing to at-risk working class individuals and families. I'm keeping my fingers crossed and looking forward to Eden DT Housing development being built soon in Livermore Downtown.

Sincerely,
Mini Chopra

RE: Agenda Item 7.1
Dear Mayor Marchand and City Council Members,
We are writing to support the adoption of the resolution ratifying, reaffirming, and readopting the Amended and Restated Disposition, Development, and Loan Agreement with Eden Housing, Inc., allowing for the construction of 130 units of affordable housing in the heart of Livermore.

SPARC Theater remains in favor of finishing the remaining elements of the City of Livermore’s approved plan for the downtown catalyst site. Veteran’s Way and Stockmen’s Park are done. The L Street Parking Garage and the expansion of Blacksmith Square are well underway. The community will be well served by focusing on completing the Quest Science Center, SPARC Theater, Veteran’s Park, downtown hotel, and Eden Housing affordable workforce housing. We believe it is in the best interests of Livermore and the stakeholder organizations including SPARC Theater to stay the course and complete the planned vision.

The Downtown Livermore Apartments address the great need for affordable housing for Livermore’s workforce and its families. This opportunity to reaffirm support for this important development should be embraced. Please follow the staff recommendation and vote in support of this project on item 7.1.

Subject: City Council Regular Meeting, Agenda Item 7.1
Dear Mayor and Councilmembers,
On behalf of Innovation Tri-Valley Leadership Group (ITV), I am writing in strong support of ratifying, reaffirming, and readopting the Amended and Restated Disposition, Development, and Loan Agreement with Eden Housing. This decision is a crucial step towards bringing 130 units of much-needed affordable housing to the heart of Livermore.

About Innovation Tri-Valley Leadership Group
ITV is a collaborative network of business, education, research, and civic leaders committed to positioning the Tri-Valley as a global hub of innovation. We promote initiatives that drive economic vitality, support sustainable development, and improve quality of life for residents.

In 2021, we launched the Tri-Valley Vision 2040 Plan, a roadmap shaped by over 1,000 community voices. Among its priorities: creating vibrant, inclusive communities with housing options for all.

The Tri-Valley’s strongest economic asset has long been our workforce, which stands out as one of the most diverse and dynamic in our entire nation. However, because our region lacks a wide enough range of housing options, teachers, healthcare professionals, first responders, and countless other Tri-Valley workers are relocating to more affordable areas, both in California and beyond. In the long term, this housing shortage lowers revenue for our school districts and cities, slows foot traffic for local businesses, and undermines our economic competitiveness, especially with many of our neighboring regions expanding their own affordable housing stocks.

By adding 130 units of high-quality, low-cost housing, the Downtown Livermore Apartments will immediately transform the lives of numerous Tri-Valley families, and go a long way towards addressing our region’s housing needs. Although this project should have been built years ago, Eden Housing remains committed to Livermore, upholding its nationally acclaimed reputation as a trustworthy and effective partner for every community it serves.

I am writing to urge you to adopt a resolution ratifying, reaffirming, and readopting the Amended and Restated Disposition, Development, and Loan Agreement with Eden Housing, allowing for the construction of 130 units of affordable housing in the heart of Livermore.

Not only have the citizens of Livermore voted and shown time after time the majority of them want this to move forward, but a lot of money and time have been wasted by futile attempts to stall or shut down this project. We, the members of the local wine industry, have been waiting for a very long time for the opportunity for Livermore to have a viable tourism industry to support our amazing wineries. I have been in this industry for almost 30 years, and I can tell you that without a strong downtown environment with a walkable hotel in place, our winegrowing region will always struggle. I would like to see this project be completed and successfully operational as soon as possible. It begins with the Downtown Apartments.

Dear City Council:

Move Eden Housing can pound sand. They do not represent Livermore and certainly do not have our best interests in mind.

My name is Matt Roberts, and I have lived in Livermore for 10 years, working here for

7. My wife and I enjoy all that Livermore has to offer and look forward to raising our 2 young kids here.

We have been extremely frustrated that community groups (whatever their name is this week) funded by a few out of touch rich people have delayed such a necessary and exciting project.

I am writing to express my gratitude for your unwavering support for the Downtown Livermore Apartments affordable housing project.

The California Court of Appeals' recent decision clarifies that the Eden housing project can proceed independently from the Veterans Park. I am delighted that this important project can move forward.

I urge the Council to take the necessary steps to remove the Veterans Park components from the Disposition, Development, and Loan Agreement to facilitate these next steps.

Open space in residential areas is very important. Both private space - balconies and court yards - and large public space for residents and the general public. It is especially needed for high density residential areas. The trees and grass can have a cooling effect in these times of climate change in our downtown.

I urge the Council to facilitate as much open space in our downtown area that will be for the community at large and not just space between the apartment building that is more like space only for the residents.

Thank you.

Dear Council,
I am writing to urge you to adopt a resolution ratifying, reaffirming, and readopting the Amended and Restate Disposition, Development, and Loan Agreement with Eden Housing, allowing for the construction of 130 units of affordable housing in the heart of Livermore.

Having volunteered for the last decade with local non-profits that serve lower income families. I’ve seen the many benefits that come from safe, stable housing. It’s vital to any improvement. Also, our children grew up in Livermore. They would like to live in Livermore, but due to the cost of housing, they live out of state.

The Downtown Livermore Apartments should have been built long ago, and there is an even greater need for affordable housing for Livermore’s workforce and its families. This is an opportunity for you to reaffirm your support for this important development. Please follow staff’s recommendation and vote in support of this project on item 7.1.

Thank you,
Joe Clark
