The assessments for the Districts known as Bridgeport, Country Lane I (Liberty Square), Country Lane II (Country Lane, Kishi), Davante Villas, Sundance (Country Villas I, 2, and 3), Kensington Park South (Vineyard Estates), La Tierra (Rancho Estrada), Parkside-Forecast, Monte Cristo, Monte Cristo II (Briarwood), Somerset (Sun Valley Estates), Strawberry Fields, Sundance IV (Country Villas IV), and Vinewood Estates II (Briarwood) were approved by the property owners pursuantto a mailed ballot election conducted in accordance with Article XIII D of the California Constitution.

In each fiscal year following these balloted elections, the City Council may impose the assessments in these Districts at a rate or amount that is less than or equal to the amount authorized for the previous fiscal year after being increased by the approved annual escalation factor, without conducting another mailed ballot election. The approved annual escalation factor for these Districts is based upon the Consumer Price Index, All Urban Consumers, for the San Francisco-Oakland-Hayward Area ("CPI"). The fiscal year 2022/2023 assessment rates within these Districts are proposed to be increased over last year's rates by 3.211 %, which is the percentage increase in the CPI from 2021 to 2022, Pursuant to Proposition 218, The Right to Vote on Taxes Act, new or increased assessments must be approved by a vote of the owners of the property to be assessed. Since the assessment rates are not to be increased by any amount other than the approved CPI, there will be no need for a property owner vote.

Following actions will include a public hearing to be set for June 7, 2022. At that time, the Council will be asked to adopt a resolution confirming assessments and authorizing staff to place the assessments on the annual tax rolls.

PROCEEDINGS AND ORDERING THE PRELIMINARY ENGINEER'S REPORT FOR THE ANNUAL LEVY OF ASSESSMENTS FOR FISCAL YEAR 2022/2023 FOR THE

LIVINGSTON BENEFIT ASSESSMENT DISTRICTS, APPROVING THE ENGINEER'S

REPORT, DECLARING THE CITY'S INTENTION TO LEVY ANNUAL ASSESSMENTS

WITHIN SUCH DISTRICTS AND APPOINTING A TIME AND PLACE FOR A

PUBLIC HEARING
WHEREAS, the City Council of the City of Livingston, pursuant to the provisions of the Benefit Assessment Act of 1982, Chapter 6.4, Article 4, Section 54703 et seq of the Government Code of the State of California (hereinafter referred to as the "Act") ") desires to provide funding to pay the costs and expenses of operating, maintaining, monitoring and servicing public drainage improvements and appurtenant facilities located within public places within the boundaries of the Livingston Benefit Assessment Districts (the "Districts") for fiscal year 2022/2023, for the purposes provided thereof in the Act; and
WHEREAS, the public interest and convenience require the City to initiate annual proceedings for the levy of assessments within the Districts for fiscal year 2022/2023, for the purposes provided thereof in the Act; and
WHEREAS, as a condition of its original approval for development within the City of Livingston (hereinafter referred to as the "City"), the City has required that the developers install drainage improvements adjacent to their Projects, and that the drainage and related improvements be installed to a standard acceptable to the City, and that developers provide a means satisfactory to the City for assuring the continued maintenance, operation, monitoring and servicing of the Improvement Areas and improvements thereto; and
WHEREAS, the improvements to be installed, constructed or maintained within the Districts may include installation, construction, monitoring or maintenance of any authorized improvements under the Act, including, but not limited to any drainage facilities or improvements which are necessary or convenient for the maintenance or servicing thereof; and WHEREAS, the individual property owners of the developments are responsible for providing funding towards the costs of the continued maintenance, operation, and servicing of the Improvement Areas and improvements thereto; and
WHEREAS, the proposed assessment rates for parcels within the original 4 Districts, together with the 14 other Districts which may be increased annually by the approved CPI rate increase, provide funding for maintenance and operation of the current facilities; and WHEREAS, in order to maintain the facilities at a standard acceptable to the City the assessments within the Districts will need to be levied for fiscal year 2022/2023; and 2 of5
WHEREAS, Proposition 218, the Right to Vote On Taxes Act does hereby require that if the assessment rate is to be increased, a notice of the proposed assessment along with a ballot shall be mailed to all owners of identified parcels within the District, and that the agency shall conduct a public hearing not less than 45 days after the mailing of said notice; and WHEREAS, all assessments subject to annual rate increases, such annual rate increases were previously approved through a successful balloting of the property owners and these assessment increases require no further balloting; and
WHEREAS, notices and Assessment Ballots are not required if assessments are not considered increased; and
WHEREAS, Willdan Financial Services has prepared an Engineer's Report (the "Report") which references the location of each Districts' boundaries which are benefited by the improvements and the amounts to be assessed against each of the parcels within each; and WHEREAS, the Engineer's Report, diagrams and assessments have been filed with the City Clerk and are open to public inspection, and may be referred to for all details regarding the improvements, the boundary of the Districts, the assessments, total costs, and description of the parcels to be assessed; and
WHEREAS, this City Council has examined and considered the Engineer's Report, references to the diagrams, the assessments, and the proceedings prior thereto.

NOW, THEREFORE, BE IT RESOLVED, that the Livingston City Council hereby adopts Resolution 2022-_, takes the following actions with respect to the Livingston Benefit Assessment Districts:

Section 1. That the above recitals are true and correct.

Installation, construction, servicing, operation, monitoring and/or maintenance of any authorized improvements under the Act, including, but not limited to drainage improvements and any facilities which are appurtenant to any of the aforementioned or which are necessary or convenient for the maintenance or servicing thereof including streets.

Section 3. The City Council hereby (1) finds that the public interests and convenience requires and (2) declares its intention to order the approval of the levy and collection of assessments against the assessable lots and parcels of land within such Districts for the fiscal year commencing July 1, 2022 and ending June 30, 2023 to pay the costs and expenses of the improvements described herein. For the Bridgeport Village, Country Lane I (Liberty Square), Country Lane II (Country lane, Kishi), Somerset (Sun Valley Estates), Sundance (Country Villas 1, 2 and 3), Davante Villas, Kensington Park South (Vineyard Estates), La Tierra (Rancho Estrada), Parkside - Forecast, Monte Cristo Estates, Monte Cristo Estates II (Briarwood), Strawberry Fields (Mcroy Wilbur), Sundance IV (Country Villas IV, Dunmore Homes), and Vinewood Estates II (Briarwood) Districts, the assessments proposed by this resolution were approved by the property owners pursuant to a mailed ballot election conducted in accordance with Article XIII D of the California Constitution. For these Zones, in fiscal years subsequent to these approved balloted elections, the City Council may thereafter impose the assessment at any rate or amount that is less than or equal to the amount authorized for the previous fiscal year together with an annual increase equal to the percentage increase of the Consumer Price Index CPI) of "All Urban Consumers" for the San Francisco-Oakland-Hayward Area (CPI), as determined by the United States Department of Labor without conducting another mailed ballot election. Each year, the Engineer shall compute the percentage of difference between the Annual CPI for the current year and the Annual CPI for the previous year, and shall then adjust the existing assessment by an amount up to, but not to exceed such percentage increase for the following fiscal year. Should the Bureau of Labor Statistics revise such index or discontinue the preparation of such index, the Engineer shall use the revised index or a comparable system as approved by the City Council for determining fluctuations in the cost of living.

Section 4. The City Manager is directed to cause the preparation of a Written Report in accordance with Article 4 of the Act for the District, and upon completion, to file said report with the City Clerk, who shall then submit the same to the City Council for its consideration.

Section 5. In accordance with the City Council's order, the City's Engineer has filed with the City Clerk the Engineer's Report required by Article 4 of the Act and entitled "Annual 4 of5

Engineer's Report, Benefit Assessment Districts" (the "Report"). All interested persons are referred to the Report for a full and detailed description of the improvements, the proposed annual assessments upon assessable lots and parcels of land within the Districts.

Section 6. The Report has been presented to the City Council and the City Council has duly considered each and every part of the Report.

Section 7. Diagrams for the Districts referencing the areas to be benefited and the amount of the proposed assessment for each parcel assessment (Section 54716 of the Act) assessed for the improvements have been provided within in Appendix "A" and Appendix "B" of the Report.

The diagrams, assessments, and improvement plans have been filed with the City Clerk.

Section 8. The diagrams referenced in the Engineer's Report, which indicate by a boundary line the extent of the Districts, is hereby declared to describe the boundaries of the Districts and shall govern for all details as to the extent and location of said Districts.

Section 9. This City Council is satisfied with the correctness of the diagrams and assessments, including the proceedings and all matters relating thereto.

Section 10. The public interest and convenience require and it is the intention of the City Council of the City to levy and collect additional assessments within the Districts for the fiscal year 2022/2023.

Section 11. The City Council hereby finds that each and every part of the Report is sufficient and the City Council hereby preliminarily approves, passes on and adopts the Report as submitted to the City Council and filed with the City Clerk. The preliminary report shall stand as the Report for the purposes of all subsequent proceedings pursuant to this Resolution of Intention.

Section 12. The City Council does hereby reference the Report, which indicates the amount of the proposed assessments, the Districts' boundaries, detailed description of improvements, and the method of assessment. The Report is on file in the office of the City Clerk and reference to the Report is hereby made for all particulars.

Section 13. That notice is hereby given that on the 7th day of June 2022, at the hour 7 p.m. or as soon thereafter as possible, in the City Council Chambers at 1416 "C" Street, in the City of Livingston, the City will hold a public hearing as to the proposed assessments of each District.

Section 14. The City Clerk shall certify to the adoption of this Resolution by the following vote:

I. OVERVIEW
A. Introduction
The City of Livingston ("City") annually levies and collects special assessments in order to maintain the improvements within eighteen (18) existing Benefit Assessment Districts ("Districts") within the City.

This Annual Engineer's Report ("Report") describes the assessments per parcel for the Districts for fiscal year 2022/2023. The assessments are based on the historical and estimated costs to maintain the improvements that provide a direct and special benefit to properties within each District. These Districts, by the use of special benefit assessments, will provide funding for the maintenance of public drainage improvements. These improvements are made in accordance with the Benefit Assessment Act of 1982, Chapter 6.4, Division 2, Title 5 of the Government Code of the State of California commencing with Section 54703 (hereafter referred to as the "Code").

The word "parcel," for the purposes of this Report, refers to an individual property assigned its own assessment parcel number by the Merced County Assessor's Office.

The Merced County Auditor/Controller uses assessment parcel numbers and specific fund numbers, to identify on the tax roll, properties assessed for special district benefit assessments.

Following consideration of public comments and written protests at a noticed public hearing, and review of the Report, the City Council may order amendments to the Report or confirm the Report as submitted. Following final approval of the Report, and confirmation of the assessments, the Council may order the levy and collection of assessments for fiscal year 2022/2023 pursuant to the Code. In such case, the assessment information will be submitted to the County Auditor/Controller, and included on the property tax roll for each benefiting parcel for fiscal year 2022/2023. 8 . Compliance With Current Legislation
On November 5, 1996, California voters approved Proposition 218. This Constitutional amendment was the latest in a series of initiatives altering the revenue-raising discretion of California local agencies. The provisions of the Proposition are set forth in California Constitutional Articles XIIIC and XIIID.

As relevant to the District, California Constitution Article XIII D, Sections 1 through 5, provide for additional substantive and procedural requirements, as outlined below.

In Proposition 218, "Assessments" are defined as:
" ... any levy or charge upon real property by an agency for a special benefit conferred upon the real property. 'Assessment' includes, but is not limited to, 'special assessment,' 'benefit assessment,' 'maintenance assessment' and 'special assessment tax."' Article XIII D Section 2b

Although District assessments are generally collected on the property tax rolls, District "assessments" are not "taxes." Assessments are distinct from the regular one percent ( 1 % ) property tax and property tax debt overrides in that assessment rates are not levied on an ad valorem basis. The levies contained in this report are considered assessments under Proposition 218.

Proposition 218 requires that beginning July 1, 1997, all new and existing assessments (with some exceptions) conform to new substantive and procedural requirements. However, certain assessments are exempted from the conformity requirement until they are increased. Generally, these exemptions include:
• Assessments used exclusively to fund sidewalks, streets, sewers, water, flood control, drainage systems, or vector control.
• Assessments used exclusively for bond repayments, the cessation of which would violate the Contract Impairment Clause of the U.S. Constitution. • Assessments previously approved by a majority of voters. • Assessments approved by the persons owning all of the property at the time the assessment was initially imposed.

The Districts formed prior to the passage of Proposition 218, designated as Country Glen, Country Roads, Vinewood Estates, and Vintage West A & B maintain improvements that are exempt from the requirements. However, any new or increased assessments, if proposed, will be subject to the substantive and procedural requirements of Proposition 218.

The Districts Sundance (Country Villas 1, 2 and 3), Kensington Park South (Vineyard Estates), Monte Cristo, Monte Cristo II (Briarwood), Vinewood Estates II (Briarwood), Bridgeport Village and Davante Villas, Country Lane I (Liberty Square), Country Lane II (Country Lane, Kishi), Parkside-Forecast, Sundance IV (Country Villas IV), Strawberry Fields, La Tierra (Rancho Estrada) and Somerset (Sun Valley Estates) were formed after the passage of Proposition 218. As such, these Districts were formed in accordance with the substantive and procedural requirements and property owners were balloted for the assessments. The assessments for these Districts included an annual Consumer Price Index inflator.

C. District Boundaries
Country Glen This District is generally located south of "F" Street, and west of Sun Crest Avenue, in the southwest corner of the City. Parcels within the District are located in the Country Glen Subdivision.

Country Roads This District is generally located at the northeast corner of Dwight Way and Walnut Avenue. All parcels within the District are located within the Country Roads Subdivision.

Vintage West (Area A & B) This District is located north of Peach Avenue, through and including Burgundy and Gamay Way, west of Hammatt Avenue, through and including Amaretto Way. All parcels are within the Vintage West Subdivision. Area A parcels are generally west of Chianti Way while Area B parcels are generally east of Chardonnay Way.

Monte Cristo This District is located on Peach Avenue west of Prusso Street.

Monte Cristo II (Briarwood) This District is located on the northeast corner of Peach Avenue and Winton Parkway.

Vinewood Estates This District is generally located north of "F" Street, south of "B" Street, and west of Selma Herndon School. All parcels are within the Vinewood Estates Subdivision.

Vinewood Estates II (Briarwood) This District is generally located south of "B" street and west of Selma Herndon School. All parcels are northwest of the Vinewood Estates Subdivision.

Kensington Park South (Vineyard Estates) This District is located on Dwight Avenue north of Peach Avenue.

Bridgeport Village This District is located south of F Street and east of Winton Parkway.

Davante Villas This District is located south of F Street and east of Arena Canal.

Strawberry Fields This District is located on "I" Street and west of the Arena Canal.

Sundance (Country Villas 1, 2, and 3) This District is located southeast of Walnut Avenue and Dwight Way.

Sundance IV (Country Villas IV) This District is located east of Dwight Way and approximately 1,311 feet south of Walnut Avenue.

II. PLANS AND SPECIFICATIONS
A. Description of Each District's Services
The improvements to be serviced and maintained in each District are public drainage improvements and City streets, including, but not limited to: personnel, electrical energy costs, a lift station, detention basin, storm drain pipeline, and all appurtenant facilities required for operation and maintenance of the above-mentioned improvements. Maintenance, servicing and operation shall include, but are not limited to repairing outlets if damaged, cleaning retention basins and repairing damage related to flooding together with implementation of and compliance to applicable municipal storm water quality objectives and State and Regional water quality regulations. Such maintenance, servicing and operation shall be authorized by the City Engineer or the City Manager. The specific Districts are known and designated as:

Ill. METHOD OF APPORTIONMENT
A. Benefit Analysis

BACKGROUND
The Benefit Assessment Act of 1982 provides that assessments may be apportioned upon all assessable lots or parcels of land within a district in proportion to the estimated benefits to be received by each lot or parcel from the improvements in that district. Additionally, Proposition 218 states:
"In any legal action contesting the validity of any assessment, the burden shall be on the agency to demonstrate that the property or properties in question receive a special benefit over and above the benefits conferred on the public at large and that the amount of any contested assessment is proportional to, and no greater than, the benefits conferred on the property or properties in question." Article XIIID Section 4f Therefore, the agency also has a responsibility to identify the benefits conferred on each parcel, (i.e., "special benefit" versus "general benefit"). Proposition 218 defines special benefit as:
" ... a particular and distinct benefit over and above general benefits conferred on real property located in the district or to the public at large. General enhancement of property value does not constitute 'special benefit."' Article XIIID Section 2i This does not necessarily mean "special benefit" cannot be "estimated benefit".

Proposition 218 requires the City to identify all parcels which have a special benefit conferred upon them and upon which an assessment will be imposed. The proportionate special benefit to each parcel shall be determined in relationship to the entirety of the public improvements or the maintenance and operation expenses being provided, and
"Only special benefits are assessable, and an agency shall separate the general benefits from the special benefits conferred on a parcel. Parcels within a district that are owned or used by any agency, the State of California or the United States shall not be exempt from assessment unless the agency can demonstrate by clear and convincing evidence that those publicly owned parcels in fact receive no special benefit."

SPECIAL BENEFIT
Each and every parcel within each District receives a particular and distinct benefit from the improvements in that District over and above general benefits conferred by the improvements.

First, all of the improvements were conditions of approval for the creation or development of the parcels. In order to create or develop the parcels, the City required the original developer to install and guarantee the maintenance of storm water control structures, and appurtenant facilities to serve the parcels. Therefore, each and every parcel within each District could not have been developed in the absence of the installation and promised maintenance of these facilities.

In addition, the improvements continue to confer a particular and distinct special benefit upon parcels within each District because of the nature of the improvements.

The proper maintenance of storm water control and appurtenant facilities specially benefit parcels within each District by alleviating excess water during periods of rain.

This allows individual parcels to be used to their fullest extent. All of the abovementioned contributes to a specific enhancement of each of the parcels within each District.

GENERAL BENEFIT
In addition to the special benefits received by the parcels within each District, there are incidental general benefits conferred by the proposed improvements.

The total benefits are thus a combination of the special benefits to the parcels within each District and the general benefits to the public at large and to adjacent property owners. The portion of the total drainage maintenance costs, which are associated with general benefits, will not be assessed to the parcels in each District, but will be paid from other City Funds.

Because the drainage facilities are located immediately adjacent to properties within each District, and are maintained solely for the benefit of the properties within each District, any benefit received by properties outside of each District is merely incidental.

It is estimated that the general benefit portion of the benefit received from the improvements for each District is less than one (1 %) percent of the total benefit.

Nonetheless, the City has agreed to ensure that no property is assessed in excess of the reasonable cost of the proportional special benefit conferred on that property.

B. Assessment Methodology
The net amount to be assessed upon parcels within each District are apportioned by any method, which fairly distributes the net amount among all parcels that receive benefit from improvements within each District.

The benefit formula used within each District may vary. The formula used for each District reflects the composition of the parcels, and the improvements and services provided, to accurately proportion the costs based on the estimated special benefit to each parcel.

Each parcel in a District is assigned a weighting factor known as an Equivalent Dwelling Unit ("EDU"). All single-family residential properties are assigned an EDU of

C. Assessment Rate Per EDU
For fiscal year 2022/2023, the assessment rate per EDU for the Sundance (Country Villas 1, 2, and 3), Kensington Park South (Vineyard Estates), Monte Cristo, Monte Cristo II (Briarwood), Vinewood Estates II (Briarwood), Bridgeport Village, Davante Villas, Country Lane I (Liberty Square), Country Lane II (Kishi), Sundance IV (Country Villas IV), Strawberry Fields, Parkside-Forecast, La Tierra (Rancho Estrada), and Somerset (Sun Valley Estates) Districts have been increased by the annual percentage increase in the Consumer Price Index (CPI) of "All Urban Consumers" for the San Francisco-Oakland-Hayward Area ("CPI") calculated from Annual 2020 to Annual 2021 of 3.211 %. Should the Bureau of Labor Statistics revise such index or discontinue the preparation of such index, the Engineer shall use the revised index or a comparable system as approved by the City Council for determining fluctuations in the cost of living.

The FY 2022/2023 maximum rates per EDU for each District are shown in the budget section of this Report.

IV. DISTRICT BUDGET
A. Description of Budget Items
The following describes the services and costs that are funded through each District.

The budget displays the operations and maintenance expenses necessary broken down under the direct and admin costs.

DIRECT COSTS:

Personnel Services - Includes labor related costs required to properly maintain, service and/or operate the District improvements and appurtenant facilities.

Personnel services includes items such as salaries, insurance, retirement, Medicare and personnel expenses broken down in separate categories listed under direct costs.

Operations and Maintenance:

Detention Basin/Equip O&M - Includes non-labor costs of maintaining, servicing and/or operating the Detention Basin improvements and related equipment.

Storm Drain O&M - Includes non-labor costs of maintaining and/or serving storm drain improvements.

Utilities - Includes costs for electrical energy provided by Pacific Gas and Electric to operate the District utilities.

Equipment Purchases - Purchases of equipment to be used to maintain, service and/or operate the District improvements. This and any other budget line item that is zero for the current fiscal year may not be listed shown in the Report's budget.

ADMINISTRATION COSTS:

County Administration Fee - The costs to the District for the County to collect assessments on the property tax bills.

District Engineering/Administration - The cost to all particular departments and staff of the City for providing the coordination of District services, operations and maintenance, response to public concerns and education, and procedures associated with the levy and collection of assessments, which are shown as City/District Fees. Also includes the costs of contracting with professionals to provide any additional administrative, legal or engineering services specific to the District, which are shown as Direct Engineering Fees.

LEVY BREAKDOWN:

Replenishmentl(Use) of Reserve - Funding transferred from or to the District's Reserve to either offset a portion of the budgeted costs or to replenish the Reserve. The Reserve provides for the collection of funds to operate a District from the time period of July 1 (beginning of the Fiscal Year) through January to compensate for the approximate six-month delay between the start of the District's fiscal year and the receipt of the collections from the County. If sufficiently funded, the Reserve can eliminate the need for the City to transfer funds from non-district accounts to pay for District costs during this period.

General Fund (Contribution)/Repayment - The projected General Fund contribution to the District when projected District expenditures cannot be met by the District's annual assessments or available reserves. A negative amount indicates a projected General Fund contribution while a positive amount represents potential funds available for repayment to the General Fund of a previous contribution.

Rounding Adjustment-A necessary rounding adjustment due to limitations of the County property tax system that requires even penny levy amounts to be placed on the secured tax roll.

Balance to Levy - This is the total amount to be levied and collected through assessments for the current fiscal year. The balance to levy represents the sum of total direct and administration costs, together with any applicable adjustments to the budget as described above.

DISTRICT STATISTICS:

Charge Per EDU - The proposed assessment rate per EDU.

Maximum Rate per EDU - For each District, the maximum rate per EDU is the prior year maximum assessment rate of any District not subject to annual rate increases; the maximum rate per EDU in all other Districts is the prior year maximum assessment rate inflated by the annual percentage CPI increase.

Projected Maximum Assessment - Represents each District's total EDUs times the respective maximum assessment rate per EDU. Since this amount is not affected by rounding or other County requirements, this amount may vary slightly from the Balance to Levy.

OPERATING RESERVE
Projected Beginning Reserve Balance - The projected fund balance as of July 1, 2023.

Replenish /(Use) Operating Reserve - A positive amount increases the levy in order to replenish the reserve (or fund anticipated costs) where a negative amount reduces the levy by using the reserves to offset costs.

Transfer from/(to) the Special Projects Reserve -The amount of Operating Reserve monies expected to be transferred to or from the Special Projects Reserve in order to arrive at an operating reserve balance generally sufficient to fund District expenses for six months, to the extent that funds are available.

Ending Reserve Balance (est.) - This amount represents the projected Operating Reserve balance/(deficit) for each District as of June 30, 2023. The optimum ending balance of the Operating Reserve is considered to be an amount sufficient to fund the estimated costs of the District from July 1, 2023 to December 31, 2023.

SPECIAL PROJECTS RESERVE:

Beginning Reserve Balance - The Special Projects Beginning Reserve Balance is shown as zero as each District's entire beginning reserve balance is shown in the Operating Reserve.

Replenish /(Use) Special Projects Reserve -This amount is added to the levy to replenish the reserves and / or to fund anticipated needs of the District.

Transfer froml(to) the Operating Reserve - The amount of Operating Reserve monies expected to be transferred to or from the Special Projects Reserve in order to arrive at an operating reserve balance generally sufficient to fund District expenses for six months.

Ending Reserve Balance (est.) -The projected balance of funds in the Special Projects Reserve as of June 30, 2023. These funds are held for future rehabilitation projects, replacements, restorations, upgrades of District improvements or other improvements allowed by the Act. Periodically, funds held in a Special Projects Reserve may be needed to respond to changing maintenance needs of the improvements or other factors. VI. APPENDIX B - 2022/2023 ASSESSMENT ROLL
Parcel identification, for each lot or parcel within the District, shall be the parcel as shown on the Merced County Assessor's map for the year in which this Report is prepared. The land use classification for each parcel is based on the Merced County Assessor's Roll. A listing of parcels assessed within each District, along with the corresponding assessment amount of each, is provided in the following pages.

Non-assessable lots or parcels may include areas of public streets and other roadways (typically not assigned an APN by the County); dedicated public easements, open space areas and rights-of-ways including public greenbelts and parkways; utility rights-of-ways; common areas; landlocked parcels, small parcels vacated by the County, bifurcated lots, and any other property that cannot be developed. These types of parcels are considered to receive little or no benefit from the improvements and are therefore exempted from assessment. Properties outside the District boundary receive no direct or special benefits from the improvements provided by the District and are not assessed.

Approval of this Report (as submitted or as modified) confirms the method of apportionment and the maximum assessment rate to be levied against each eligible parcel and thereby constitutes the approved levy and collection of assessments for the fiscal year. The parcels and the amount of assessment to be levied shall be submitted to the County Auditor/Controller and included on the property tax roll for the fiscal year.

If any parcel submitted for collection is identified by the County Auditor/Controller to be an invalid parcel number for the current fiscal year, a corrected parcel number and/or new parcel numbers will be identified and resubmitted to the County Auditor/Controller. The assessment amount to be levied and collected for the resubmitted parcel or parcels shall be based on the method of apportionment and assessment rate approved in this Report.

Therefore, if a single parcel has changed to multiple parcels, the assessment amount applied to each of the new parcels shall be recalculated and applied according to the approved method of apportionment and assessment rate rather than a proportionate share of the original assessment.

Staff recommends that the City Council adopt a Resolution approving a MOU between Contract between the MUHSD and the City of Livingston for School Resource Officers Program and authorize the City Manager to execute the agreement.

BACKGROUND/DISCUSSION
A goal of the City Council is to ensure there is adequate public safety in the City, and one method of increasing safety at schools is to dedicate a School Resource Officer (SRO) to school campuses. The Police Department has developed guidelines for the SRO with a comprehensive approach to increase school safety and encourage positive learning. The SRO works under the direction of the City's Police Chief, or designee, with School District input on assignments as outlined in the MOU agreement.

MUHSD expressed a desire to partner with the City's Law Enforcement team to provide a dedicated SRO to the high school campus as early as January 2022. However, the preliminary MOU terms would have created a significant financial burden to the City. In early Spring 2022, Law Enforcement leadership was able to negotiate MOU terms that meets the needs of the MUHSD and fully funds an already budgeted position creating a positive impact to the General Fund.

Entering into an agreement with MUHSD to provide a SRO will fulfill the objective identified by Council through its Goal Setting Session. The Police Department has an existing position that will be allocated to SRO duties. The SRO will serve as a resource for teachers, providing classroom presentations that complement the school's curriculum, and discuss issues that promote responsible citizenship and give students a better understanding of our legal system.

The agreement with MUHSD will be July 1, 2022 and will extend through June 30, 2026.

FISCAL IMPACT
The MOU with MUHSD will cover the costs to provide a dedicated SRO. MUHSD contribution will be $104,097.49 for each school fiscal year. Finance will include these revenue source in the Fiscal Year 2022/23 Budget and future projections.

MERCED UNION HIGH SCHOOL DISTRICT
School Resource Officers Program - Partnership Agreement 2022-2023 to 2025-2026
THIS AGREEMENT ("Agreement") shall commence on the date signed by and between the Merced Union High School District (hereinafter referred to as "MUHSD") and the City of Livingston (hereinafter referred to as "CITY") for the next three school fiscal years of 2022-2023 through 2025-2026
WHEREAS the Merced Union High School District and the Livingston Police Department desire to set forth in this Memorandum of Understanding the specific terms and conditions of the services to be performed and provided by the School Resource Officers (hereinafter referred to as "SRO"s) in the Merced Union High School District.

NOW, THEREFORE, THE PARTIES HERETO AGREE AS FOLLOWS:

1.1 To foster educational programs and activities that will increase students' knowledge of and respect for the law and the function of law enforcement agencies;

1.2 To encourage the SRO to attend extra-curricular activities held at school, such as parent meetings, athletic events and concerts;

1.3 To act swiftly and cooperatively when responding to major disruptions and flagrant criminal offenses at school, including, but not limited to: disorderly conduct by trespassers, the possession and use of weapons on campus, the illegal sales and/or distribution of controlled substances, and riots;

1.4 To report serious crimes that occur on campus and to cooperate with the law enforcement officials in their investigation of crimes that occur at school;

1.5 To cooperate with law enforcement officials in their investigations of criminal offenses which occur off campus.
1 2.0 Employment and Assignment of School Resource Officer

2.1 The Livingston Police Department agrees to employ one Police Officer to act as a School Resource Officer (SRO) during the term of this Agreement. The SRO shall be an employee of the Livingston Police Department and be subject to their administration, supervision and control of the Livingston Police Department except as such administration, supervision and control is subject to the terms and conditions of this Agreement.

2.2 The Livingston Police Department agrees to provide and to pay the SROs' salary and employment benefits in accordance with the applicable salary schedules and employment practices of the Livingston Police Department, including but not necessarily limited to: sick leave, annual leave, retirement compensation, disability salary continuation, workers compensation, unemployment compensation, life insurance, dental insurance, and medical/hospitalization insurance if applicable. The SRO shall be subject to all other personnel policies and practices of the Livingston Police Department.

2.3 The Merced Union High School District agrees to pay the City of Livingston an amount not to exceed $104,097.49 for each school fiscal year of the full multi-year term provided under this Agreement. These costs are based on 100% of the actual expenses for SRO salary and benefits plus 100% of overtime as approved by the site principal or designee, vehicle costs up to ($2,000) with a rate of .92 cents per mile for every mile SRO drives a Livingston Police Department vehicle.

2.4 The SROs' employer is the Livingston Police Department. The Livingston Police Department shall have sole discretion, to assign, temporarily reassign, discharge, discipline and evaluate the SRO's. Each school principal shall provide input to the Livingston Chief of Police or his designee, on school related issues related to the assignment, discharge, discipline and evaluation of their assigned SRO.

2.5 In the event of a resignation, dismissal or reassignment of a SRO, or in the case of long-term absences by an SRO, the Chief may provide a temporary replacement as soon as personnel are available.

2.6 The Livingston Police Department shall assign one Police Officer to act as an SRO to Livingston High School.

2.7 In the event an SRO is absent from work, the SRO shall notify the Principal or their designee of Livingston High School and also notify a supervisor at the Livingston Police Department.
2 2.8 The school Principal will develop with the SRO, and as approved by the Chief, plans and strategies to prevent and/or minimize dangerous situations which might result in student unrest, or endangerment.

3.0 Duty Hours / place of performance
The principal of Livingston High School shall set specific SRO duty hours at the assigned school by mutual agreement between the two agencies. When school is in session, the SROs work hours will be established and scheduled by the principal of Livingston High School. The SRO may be scheduled to work community based policing activities, those activities may include:

3.1 Follow-up home visits when needed as a result of school related student problems.

3.2 School related off campus activities when officer participation is requested by the principal and approved by the City of Livingston.

3.3 Responses to off campus. School related criminal activities.

3.4 Responses to emergency law enforcement or court appearances.

3.5 Scheduled officer training.

4.0 Basic Qualifications of School Resource Officers (SRO)

4.1 Shall be a city employed police officer suited for SRO related work.

4.2 Shall possess sufficient knowledge of the applicable Federal and State laws, City and County ordinances, and Board of Education policies and regulations;

4.3 Shall be capable of conducting criminal investigations;

4.4 Shall possess communication skills, which would enable the officer to function effectively within the school environment.

5.0 Duties of School Resource Officer

5.1 The SRO shall coordinate all of his/her activities with the principal (or designee) and will seek permission, advice and guidance prior to enacting any program within the school.

5.2 The SRO shall develop expertise in presenting various subjects to the students, staff, parents and community. Such subjects shall include, but not be limited to: a basic understanding of the law, the role of the police 3 officer and law related areas, tobacco, alcohol and drug issues, evidence diffusion, violence prevention, group and safe issues to the community.

5.3 The SRO shall encourage individual and small group discussions with students, based upon material presented in class to further establish rapport with students.

5.4 When requested by the principal, the SRO shall attend parent/staff/administrative meetings to solicit support and understanding of the program.

5.5 The SRO shall make himself/herself available for conference with students, parents and faculty members in order to assist them with problems of a law enforcement or crime prevention nature.

5.6 The SRO shall become familiar with all community agencies which offer assistance to youths and their families such as mental health clinics, drug treatment centers, etc ...

5.7 Should it become necessary to conduct formal police interviews with students, the SRO shall adhere to school board policy to the extent that such policies do not conflict with police departmental general orders, regulations, policies and legal requirements to conduct such interviews.

5.8 The SRO shall take all law enforcement action as required. As soon as practical, the SRO shall make the principal or his designee aware of such action. The SRO shall take appropriate law enforcement actions against intruders and unwanted guests who may appear at the school and related school functions, to the extent that the SRO may do so under the authority of law.

5.9 The SRO shall give assistance to other law enforcement personnel in matters regarding his/her school assignment as well as responding to an officer needing assistance.

5.10 When requested by the MUHSD SRO supervisor, the SRO shall initiate the maintenance of records related to the program. These records, general in nature, may include, but not be limited to, general information related to the program. Examples include information on the day of classroom visits, home visits, number of parent contacts, number of formal student meetings, number of school related investigations, and list of most common duties of SRO.

5.11 The SRO shall not act as a school disciplinarian, as disciplining students is a school responsibility. However if the principal believes an incident is a 4 violation of the law, the principal may contact the SRO, and the SRO shall then determine whether law enforcement action is appropriate.

6.0 Chain of Command

6.1 As employees of the Livingston City Police Department, the SRO shall follow the chain of command as set forth in the Livingston Police Department Policies and Procedure Manual.

6.2 In the performance of their duties, the SRO shall make every reasonable effort to coordinate and communicate with the principals or the principals' designee(s) of the assigned schools.

7.0 Training

7.1 The SRO shall be required by the Livingston Police Department to attend police training sessions. Training sessions will be conducted to provide SROs with appropriate in-service training, such as updates in the law, inservice firearm training and law enforcement-school related training.

7.2 The School District also may provide training in Board of Trustee policies, regulations and procedures. Training related to school type incidents and student safety may also be provided by the school district.

8.0 Supplies and Equipment

8.1 The Livingston Police Department agrees to provide SRO's with standard issue equipment, firearms and rounds of ammunition as needed to perform their duties.

8.2 The School District agrees to provide an office, desk, desk chair, computer and the usual and customary office supplies to the SROs.

9.0 Access to Education Records

9.1 School officials shall allow the SRO to inspect and copy any public records maintained by the school including student directory information, classroom assignments and discipline files as needed in order to fulfill the duties of a SRO. However, law enforcement officials may not inspect and/or copy confidential student education records except as allowed by law.

9.2 If some information in a student's cumulative record is needed in an emergency to protect the health or safety of the student or other individuals, school officials may disclose to the SRO that information which is needed to respond to the emergency situation based on the 5 seriousness of the threat to someone's health or safety; the need of the information to meet the emergency situation and the extent to which time is of the essence.

9.3 If confidential student records information is needed, but no emergency situation exists, the information may be released only as allowed by law.

10.0 Discrimination
Both the MUHSD and CITY and/or its employees shall not discriminate because of race, religion, color, national origin, disability, marital status, age, or sex against any person by refusing any person or privilege offered to or engaged by the general public.

11.0 Indemnify/ Hold Harmless
MUHSD will defend, indemnify, and hold harmless the City, its agents, officers and employees against all suits and claims that may be based on injury to persons or property that is the result of an error, omission, or negligent act of the MUHSD and its officers, agents, or employees in the performance of this contract. The City of Livingston will defend, indemnify and hold harmless MUHSD, its agents, officers and employees against all suits and claims that may be based on an injury to persons or property that is the result of an error, omission or negligent acts of the City and its officers, agents, or employees in the performance of this Agreement.

12.0 Notices
Any notices herein provided to be given by either party to the other shall be deemed to have been fully given when made in writing and deposited in the United States mail, postage prepaid and addressed as follows:

13.0 Term and Termination
This Agreement shall commence on the date signed by both parties and shall remain in full force and effect until June 30, 2026, or until cancellation by either party given 90 days written notice.

14.0 Modification of Agreement
This Agreement may not be changed or modified except in writing and signed by both parties.

15.0 Agency Relationship
This Agreement is not intended to, and shall not be, to create the relationship of principal-agent, master-servant, or employer-employee between MUHSD and Livingston City.

16.0 Copies of Agreement
This Agreement is executed in counterparts, each of which shall be deemed a duplicate original.

Resolution To Appoint Four (4) Volunteer Regular Commissioners and One (1) Volunteer Alternate Commissioner for a Four (4) Year Appointment to the Parks Recreation and Arts Commission

RECOMMENDATION:

Staff recommends after review of all applications, and in person interviews, considering their volunteerism, skills and knowledge that will benefit the mission and goals of the Recreation Department the Council appoints 5 of the 11 applicants with the best fit and qualifications to the Commission's vacancies.

BACKGROUND/DISCUSSION:

In November 2021, the Recreation Department began advertising for the upcoming five (5) vacancies in the Parks, Recreation, and Arts Commission. The vacancy includes four (4) regular volunteer positions and 1 alternate volunteer position. An application deadline was set for January 21, 2022. At the first meeting in January 2022, the City Council recommended an extension to the deadline until February 21, 2022 to receive sufficient applications for the vacancies. Applications were on the city website and the openings were promoted through social media, word of mouth and the digital sign on Main Street.

Due to the 21 st falling on a holiday, applications were taken until 5pm on February 22, 2022. A total of twelve (12) applications (see attached) were taken by the deadline, however one (1) applicant was outside the sphere of influence and we already have one commissioner outside the sphere of influence as allowed per the City's Municipal Code.

Council will hold interviews on May 12, 2022 and May 17, 2022. A recommendation and appointment will take place on May 17, 2022. The terms of the newly appointed commissioners will be for four (4) years and will expire on January 30, 2026.

I am very involved in community activities. In addition to the events and activities that I participate through being a commissioner, I am very active with Yamato Colony PTA. I also started a Facebook Group, Livingston MOMS. My goal with the MOMS group is to get more family activities, for MOMS t, be able to meet other MOMS and socialize.
4) What is it about the Parks Recreation and Arts Commission that interests you? What qualities, experience and expertise would you bring to the Parks Recreation and Arts Commission? I would like to continue to be a part of the PRA Commission because I have a passion for the Rec Dept and the sense of Community it brings to our city. I believe during the last 3 years I've shown that I am reliable, a team player, willing to work hard and creative. 5) How would you see your role as a commissioner when recommending policy and working with the council? I see my role as commissioner as being an advisor to the council. It is the commissions responsibilty to study, investigate and make informed recommendations to the council regarding the rec programs, arts, and parks in Livingston.
6) What are the current issues that the Parks Recreation and Arts Commission will face? I believe some of the issues that PRA will face is growth of our programs to match the growth of the city. How to encouragE the citizens to participate and volunteer. Currently we are facing the challenges of COVID regulations and how to provide safe programing while still maintaininf budget friendly activities.
7 )If appointed, what specific goals would you like to see the Parks Recreation and Arts Commission achieve? Now that we received the grant, doing whatever is needed to see through the completion of the new Rec Center. Another goal, is to get more of an adult program going to. I see real opportur for programing for people 13 and older. I would like to see the City sponsor a yearly program fc bullying. A program that includes all ages including parents. I would like to see a playground installed at Max Foster.

I thought it was going to be_~ _a_ short term opportunity, that I was going to move on to something bigger. However, I ended up choosing to stay, even when the employment opportunity no longer suited my nee.9s_._1 _ __. had fallen in love with Livingston. I convinced my husband then boyfriend to move in wi.!_!1 me and we made Livingston our home. We have chosen Livingston to be where we raise our son. I bega looking for ways to become more involved with our city and reached out to City Hall for help.

The Recreation Dept pointed me to_some volunteer work out a Shelby school, I began coaching soccer and then I applied to become a commissioner. During my term as commissioner I raised the most money to get a new backstop and Little Guys, I started the scholarship for ---l
a LHS senior, I have volunteered at every skills assesstment, participated in all the rule changes, helped with all the recommendations to Council regarding the price increases, worked tiredlessly during a Color Run, Beer Tasting, taco nights and countless other events.

I work for the PRA because I know what an assest it is to have a wonderful program for our cit . I see the sense of communily grow during the events or sport seasons. I think with the Ace Train, the new homes and apartments, the new Rec Center that our program ca~ grow and become an program that sets standards for our surrounding communities.

Over the last 6 months, my primary civici involvement has been with the City of Livingston Parks, Recreation and Arts Commission. I have volunteered for events such as the craft beer tasting, various fundraisers, as well as the Christmas parade. 4) What is it about the Parks Recreation and Arts Commission that interests you? What qualities, experience and expertise would you bring to the Parks Recreation and Arts Commission? It is my hope to join the Parks, Recreation and Arts Commission as a way to give back to the community.

As this commission is community focused, my various years working in public service provides me knowledge and insight to the needs of our community members.
5) How would you see your role as a commissioner when recommending policy and working with the council? As a commissioner, I hope to work as a partner to city council to recommend policy that meets the needs of the community while being mindful of organizational constraints and responsibilities. 6) What are the current issues that the Parks Recreation and Arts Commission will face? Foreseeable issues the commission will face is the availability of programs, and the issue of rising costs to run current programs.

As a commissioner ii would be my goal to increase involvement by community members to work with the commission by providing input into planning and participation in the execution of events. !

CSU Stanislaus earning a degree in Business Administration - Human Resources. As a profession I work for Merced County Administration. Most recently, I became involved with the City of Livingston Parks, Recreation, and Arts commision as a volunteer and was able to assist with various community events. In the past, I have help to organize various events and fundraisers for organizations I was a part of at CSU Stanislaus.

In addition to my involvement with City of Livingston events, I am currently working with city staff to establish and promote a city-wide volunteer program for the enrichment and benefit of the community.

Members are expected to attend all Commission Meetings which are held by ordinance the 4th Thursday of the month at 6pm. Meetings are held in the City Hall Conference Room, 1416 C Street. Members are expected to send formal notification to the Commission Chair or city staff if absence is unavoidable. This action will classify the absence as "excused". Members are expected to attend the entire meeting and actively participate.

I have served as a commissioner for almost 4 years and during my terrr I have been involved in almost every single community event, activity or project put forth by the Parks Recreation and Arts Commission. 4) What is it about the Parks Recreation and Arts Commission t1at interests you? What qualities, experience and expertise would you bring to the Parks Recreation and Arts Commission? Before I moved into this community I was already involved in some community projects where I lived previously. I was not nearly invovled in those projects as I have been here in Livingston. I have learned to use my networking abilities and experiences from my life outside of the commission to help with the projects I was invovled with. The time in the commission has also helped me grow as an indvidual and build upon some of my experiences and qualities. 5) How would you see your role as a commissioner when recommending policy and working with the council? I have been supportive about the decisions we have made as a commission when recommending policies to the council and I feel like that I have a good relationship with the council and am willing to discuss policies and council's recommendations for these policies. I do believe in unity and reccomending the best policies for the community and the city of Livingston with the partnership of the council.
6) What are the current issues that the Parks Recreation and Arts Commission will face? The current issues that face the Commission are being able to continue to offer our programs to the community during this pandemic. Having the tools and resources to fully execute our vision for the community and the programs we offer. Finding ways to overcome budget issues and further cancelations of programs offered, 7 )If appointed, what specific goals would you like to see the Parks Recreation and Arts Commission achieve?
I would like to continue on one of my priorities of helping find new ways to help the Commision become self sustainable.

To help with making some of the programs offered by the Commission more accessible to more members of the community without sacrificing the quality of the programs.

DUTIES AND EJ(PECTATIONS OF THE PARl(S RECREATION AND ARTS COMMISSION The Recreation Commission is made up of 7 council appointed members and 2 council appointed alternate members that act in an advisory capacity to the city council, the city manager and the superintendent of parks and recreation., in all matters of public parks recreation and arts, and to cooperate with other governmental agencies, civic groups in the advancement and enhancement of sound recreation planning and programming.

Commissioners also recommend policies on recreation and park services, volunteer staff and discipline for approval of the city council; they advise the superintendent of parks and recreation on problems of development of recreation areas, facilities, programs and improved recreation services; recommend the adoption of standards on areas, facilities, programs and financial support. Commissioners act as ambassadors to interpret the mission statement, philosophy, policies and goals of the recreation department to the public.

What is the mission statement of the Recreation Department? The purpose of the City of Livingston Recreation Department is to provide recreational opportunities and athletic programs for residents of the City of Livingston.

Goals:

The goals of the recreational programs are to encourage community spirit and fellowship.

The goals of the athletic programs are:

1. to allow all players as equal an oppori-unil'y as possible to participate,

2. to instrua players in the development of their capabilities,

3. to build good character and encourage teamwork,

4. to develop and practice good sportsmanship,

5. to implement the principles of fair play,

Through this commission our city can better serve our citizens in the area of parks recreation and arts.

The Parks Recreation and Arts Commission is a volunteer commission that acts in an advisory capacity to the city council and as ambassadors to our community to interpret the mission statement, philosophy, policies and goals of the recreation department.

All commissioners are appointed by the city council. The council seeks candidates who:
• Are residents of the City of Livingston or live within the Livingston Union School District Boundaries. • Have had experience in recreation through education, participation orvolunteerism and agree with department philosophy.
• Are passionate about serving the community.
• Eager to assist in fund raising projects.

The council seeks informed input from this commission and your education or experience in this field qualifies you for insightful recommendations or feedback.

If this is a position you are interested in you may request an application packet from the Recreation Department at 394"8830 or get a packet online at www.cityoflivingston.org. Information in this packet is provided to help you determine your level of interest in filling a Recreation Commission position. Please read through the documents, complete the required information and turn them in to City Hall prior to the date on the cover of this packet. Qualified applicants will be called for an interview by the City Council.

DUTIES AND EXPECTATIONS OF THE PARKS RECREATION AND ARTS COMMISSION The Recreation Commission is made up of 7 council appointed members and 2 council appointed alternate members that act in an advisory capacity to the city council, the city manager and the superintendent of parks and recreation, In all matters of public parks recreation and arts, and to cooperate with other governmental agencies, civic groups In the advancement and enhancement of sound recreation planning and programming, Commissioners also recommend pollcies on recreation and park services, volunteer staff and discipline for approval of the city council; they advise the superintendent of parks and recreation on problems of development of recreation areas, facilities, programs and improved recreation services; recommend the adoption of standards on areas, facilities, programs and financial support. Commissioners act as ambassadors to interpret the mission statement, philosophy1 policies and goals of the recreation department to the public.

Goals:

The goals of the recreational programs are to encourage community spirit and fellowship, The goals of the athletic programs are:
l, to allow all players as equal an opportunity as possible to participate,

2. to instruct players in the development of their capabilities,

3. to build good character and encourage teamwork,

4. to develop and practice good sportsmanship,

5. to implement the principles of fair play,

5. to improve physical fitness,

7. to have fun.

What are the 5 principles of fair play:

1. Respect the rules.

2. Respect the officials and their decisions.
3, Respect your opponent.

4. Give everyone an equal chance to participate.

5. Maintain your self-control at all times.

Make studies and recommend rules and regulations for adoption by the city council for the use and enjoyment of all public parks and recreational facilitles1 and particularly of specific recreational facilities, including, but not limited to, playgrounds, play fields, recreational centers, swimming pools, ball diamonds, basketball courts and such other recreational areas and facilities as may require regulation from time to time; Review the annual budget of the parks and recreation department before presentation to the city manager and make recommendations thereto to the city council and the city manager and, in the case of capital improvements, also to the planning commission.

Consider the issues and needs of the senior, adult, teen and youth population of the city in recommending programs, policies, and facilities.

I have volunteered with the Parks Recreation and Arts Commission Staff through the following events: Several years ago I was asked to organize an outdoor visual art exhibition and art station area at Livingston's Annual Sweet Potato Event. I also have participated with family members to decorate 2 trees in the Annual Christmas Tree Lane. I a lso organized with the City of Livingston a collaboration with Catchlight Photography to install a temporary mural at Gallo Park during the first months of the pandemic to encourage community members to wear their masks. My participation has been hampered by my commute to work in the Bay Area and work responsibilities, but I try to support when I can.

Over the years I have been part of numerous board s and committees in the Valley, Chicago, and San Francisco. Most of the boards hove focused on children, women, families, and community safety. Currently, I am an alumnus and volunteer for a healing arts-based artist residency called A PLACE OF HER OWN. I assist in facilitating classes, making presentations, and grant writing. I also serve on the Advisory Board of the Arts Education Alliance for the Bay Area
4) What is it about the Parks Recreation and Arts Commission that interests you? What qualities, experience, and expertise would you bring to the Parks Recreation and Arts Commission?
My interest in the Commission is to grow community engagement in Livingston's Recreation and Arts Programing. The mental, emotional, and physical health of the community is critical to community vibrancy and cohesion. Livingston has a strong recreational focus and facilities and parks which I enjoy!
If selected to be a Commissioner, my passion would be to assist in growing the Arts & Cultural programs in Livingston. I love the rnurals and I know there are many amazing Livingston artists from many cultures and age groups. I would be excited to work with community artists to support their ideas and vision of how their arl con beautify and unite our community. As a youth a nd community developer, arts and c reativity are essen tia l to the soul of the City. I directed the Citywide Creative Arts for Boys & Girls Clubs of San Franciso for nine years. I witnessed the power of art in young people to develop their voice, skills, and leadership. There are many opportunities in a creative career path and or community art practice as a way of giving back.

S) How would you see your role as a commissioner when recommending policy and working with the council?
My role as Commissioner when recommending policy and working with the council is based on the following values:
• Due diligence - ask informed questions, hear all perspectives, gather the facts, understand the impact of the Commission decision or recommendation on the general Community of Livingston
• Be respectful and listen because we are in this together and the community is counting on us to do the best for them
• Find creative ways to inform the community members of policies or decisions and always be open to feedback, maybe there is a better way to do things • Consider budget and cost of policy decisions and how this impacts fees and access to programs offered by the Commission
6) What are the current issues thot the Parks Recreation and Arts Commission will face? Livingston and Merced County is a fast-growing county in the Central Valley. Livingston sits between two major Universities in Turlock (my alma mater) and Merced. The ACE Train is an amazing opportunity for Livingston.

Our recreation and art programs are a vital port of developing our community pride and engagement of residents. And they have the potential to attract more visitors and tourists alike. This increases the fun factor of our City as well as building new economic opportunities that can benefit local residents, community organizations, and businesses.

It is importanl to continue to build on the progress made by the current Commission, and ensure that Livingston is a destination spot that stands out because of the diversity of its resident's foods, cultures, histories, languages, and traditions. Ensuring that the Commission's work continues to expand to reach out to new sectors of the community is vital. For me, the issue of drugs and alcohol or behaviors that negatively impact young people and lead them down 1'he wrong path is core. For example, could we offer an art program for court-involved youth to beautify the City with murals or a wornen 's healing art group? Could there be pop-up art in the park along with a walking club? 7 )If appointed, what specific goals would you like to see the Parks Recreation and Arts Commission achieve?
• Form a working group of the Commission focused solely on developing Livingston's art & cultural programs
• A community needs assessment that factors in the impact of the pandemic on many residents ability to engage in recreational or art programs-what are the needs and possible solutions
• Continue to explore wellness programs that attract other community members such as (dance, yoga, ti chi, meditation) and help provide needed outlets for many community members who need this type of programming

Personal Bio •
Livingston born and raised by my parents Rufino and Genevieve Zamora. 8 siblings/7 sisters! My mother's family (Estrada's) have lived on Peach Street for 7 generations.

Graduated from Livingston High School and was active in art, drama, speech, debate, tennis, track, and student government. Selected for various honors during my high school days.

First in my immediate family to graduate from college, Stanislaus State University. During my college days was active in MECHA and the local community center in Modesto.

Coordinated 3 community gardens for local residents, seniors, and food pantry.

Since my college days have lived in Merced. Stanislaus, Chicago, and San Francisco. I had the opportunity to work in some of the toughest neighborhoods in Chicago (Pilsen) and San Francisco (Tenderloin) with youth and families at various non-profits I currently work in San Francisco and commute. Since March of 2020. my primary residence and home became 13655 Peach Avenue. I still rent an apartment in SF because my husband and I need a place to stay when we work for extended periods of several days on various projects related to our work. When not working on-site in SF, I live in Livingston and work virtually as well.

While living in the Central Valley, I have always worked with low-income communities for various non-profits such as Self-Help Enterprise, Central Valley Opportunity Center, Radio Bilingue 88.7. and others before moving to Chicago for 17 years.

In Chicago, I worked as a caseworker with court-involved youth in creating community-based alternatives to incarceration, school mediation program, direct programming in sports, recreation, arts, and academics.

In San Franciso, I worked for 14 years as a Club Director, Area Director that oversees multiple Club sites. and lastly as Director of Citywide Creative Arts to coordinate our digital. visual, performing, spoken word, and music programs onsite at our Clubs and managed our partnerships that provided additional programming for our Club Members such as SF Ballet, ' ' '
Youth Open Studios, and American Conservatory Theater among others.

In March of 2020, I went on leave to stay with my mother in Livingston to coordinate her care. Due to the pandemic and safety issues, I did not return to Boys & Girls Clubs of SF. I decided to assess my priorities given my mother's situation and COVID.

I currently work with the Community Arts Stabilization Trust as a Community Engagement Specialist working with artists, cultural workers, and arts organizations to secure permanent real estate to mitigate the displacement of artists/organizations in the Bay Area. I am thankful that I can work virtually and come into the Cify for specific projecfs.

My home and family (very large extended family) is in the Valley, specifically Merced Counfy. I have come back to my roofs and I want to give back to my family and community.

Given my career experience, I would like to hopefully bring new ideas, resources, and opportunifies for our Livingston Community and work in partnership with the current Commission Members.
