STAFF REPORT
AGENDA ITEM: Adopt a Resolution Supporting AB 1012 – A State Law to Secure the Efficiency of Transportation Funding and Implementing a Timely use of the Federal/State Funding under the Federal Transportation Act for the Livingston Sidewalk Improvements Project
MEETING DATE: February 21, 2023
PREPARED BY: Mario Gouveia, City Engineer
REVIEWED BY: Christopher Lopez, Interim City Manager
RECOMMENDATION:

Adopt Resolution No. 2023-_____, supporting and implementing AB1012 “Timely Use of Federal/State Funding.”
BACKGROUND:

In October of 2022, the Merced County Association of Governments (MCAG) issued a “Call for Projects” for approximately $3 million of Congestion Mitigation and Air Quality (CMAQ) funding available in the upcoming Federal Fiscal Year 2022/2023 (October 2022 – September 2023). CMAQ project applications were due by December 21, 2022. City Staff identified a potential project that met the funding requirements and an application was submitted to MCAG on December 21, 2022. A Resolution supporting and implementing AB 1012 “Timely Use of Funding” is required to be adopted by the City and a copy of the Resolution provided to MCAG.

DISCUSSION:

The Livingston Sidewalk Improvements project was identified as part of the City’s Regional Transportation plan and best fit the application requirements. The project was presented to City Council on December 20, 2022 where direction was given to Staff to prepare and submit an application to MCAG in response to the open “Call for Projects.” The application was submitted to MCAG on December 21, 2022. The CMAQ Committee evaluated the submitted application and the City of Livingston was awarded a CMAQ Grant for the design and construction of the Livingston Sidewalk Improvements project. A summary of the proposed project is listed below with an estimated cost.

Livingston Sidewalk Improvements Project
The project consists of constructing new concrete sidewalk and curb cut ramp improvements in various locations near the City of Livingston’s (City) downtown corridor. This is a “quality of life” project and a continuation of previous CMAQ project efforts to close gaps in the City’s pedestrian infrastructure. This project focuses on the construction of sidewalks where there are still discontinuities in pedestrian facilities, hence providing connectivity and safe pedestrian access to schools, commercial areas, parks, churches, etc. The estimated project cost is $886,000.00. The total CMAQ funds awarded to the City is $784,000.00 with a local match of $102,000.00 being provided by the City from transportation funds.

FISCAL IMPACT:

The Livingston Sidewalk Improvements project will be funded using a combination of Federal CMAQ funds and Local Transportation Funds.

I have a daughter who participated in Livingston Recreation sports and now have a son who is an active participant in the city's recreational sports. More recently I assisted my husband with coaching his baseball team, I was more of a team mom, but stepped in where needed. I have also helped other coaches with team mom type duties. I don't have a lot of experience/ knowledge in parks/rec and arts, but I do have the ability to learn what is needed. I also can look at the whole situation/concern/idea and then weigh in the positives and negatives before planning. I also have the ability listen to others, take in their thoughts and opinions and then make a decision that would be beneficial for all participants. RECOMMENDATION:

City Council to Consider:
• Adopting Resolution 2023-_, appointing Jose Flores as alternate member to the Planning Commission.
• Direct staff to continue to advertise for a second alternate member to the Planning Commission.

BACKGROUND AND DISCUSSION:

At their meeting of January 17, 2023, the City Council appointed Steve Bassi, Andres Fuentes and Harpreet (Happy) Bains as Regular Members to the Planning Commission. These appointments created two vacancies in the Alternates to the Planning Commissioner. The current Planning Commission roster is included as Attachment 1.

The Livingston Municipal Code contains provisions for two alternates to serve on the Commission.
"LIVINGSTON MUNICIPAL CODE (LMC) Title 2- BOARDS AND COMMISSIONS LMC Sections 2-2-2: MEMBERSHIP AND TERMS OF OFFICE:
(A) Membership and Compensation: The Planning Commission shall consist of five (5) members and two (2) alternates appointed by majority vote of the City Council. The alternate members may participate, but may not vote on an item before the Planning Commission unless a Planning Commissioner is absent or is disqualified due to an expressed conflict of interest. All members shall be qualified electors of the City. The compensation of the Planning Commission shall be established by resolution of the City Council.
(B) Terms: Terms of office of the members of the Planning Commission are for a period of four ( 4) years or until their successors are appointed and such terms are staggered with terms of one member of the Planning Commission expiring each year, except that every fourth year the terms of two (2) members expire.

Terms expire December 31 of each year.
(C) Chairperson and Vice Chairperson: The Planning Commission shall rotate the positions of Chair and Vice Chairperson among the appointed members.

Officers hold offices for one year, or until their successors are appointed. Terms expire on December 31 of each year. (Ord. 637, 3-19-2019)." The Planning Commission vacancies are summarized below.

Planning Regular or Term Date of Status
Commissioner Alternate Expiration Vacancv
Seat (1) Alternate 12/31/2024 1/18/2023 Vacant
Seat (2) Alternate 12/31/2023 1/18/2023 Vacant
The City advertised two Alternate Planning Commission vacancies from January 19, 2023, through February 15, 2023. Only an application from Mr. Jose Flores was submitted, which is included as Attachment 2.

Staff recommends that Mr. Jose Flores be appointed as an Alternate Planning Commissioner with a term expiring on December 31, 2024.

If the Council wishes to have two alternate members, staff would suggest the City re-advertise for a second alternate member.

To whom it may concern,
I've been a Livingston resident and an active member of this community for most of my life. I'm currently working at Livingston High School, teaching public service. In addition, I'm a part-time Merced County Fire firefighter supporting the Livingston Fire Department. I was previously a Fire Inspector and Fire Plan Examiner for the County of Merced and covered the City of Livingston as part of my duty. I hold the following professional qualification from the California State Fire Marshal's office: Firefighter I & II, Fire Officer, Fire Inspector I & 11, Fire Plan Examiner, and others. In addition, I have a degree from Merced College in Fire Technology.

When working as a Fire Inspector & Plan Examiner, I regularly participated in preliminary application reviews, similar to what would be covered during the planning commission meetings, and reviewed potential construction or business applications. In addition, as a professional in fire protection, I would provide my recommendations for fire and life safety features to be considered by the applicant before the plan or business application submittal.

If provided the opportunity to join the planning commission, I hope to support the group by being a fire and life safety resource. In addition, I can help educate the public and new business owners to keep their customers safe. I appreciate what the planning commission has done over the years. Thank you for your time.
