Sweet Potato Festival Carnival Contract for 2023/2024
March 7, 2023
Jacquelyn Benoit, Recreation Superintendent
Christopher Lopez, Interim City Manager
RECOMMENDATION:
Staff recommends that the City Council adopt a Resolution Approving an agreement with Midway Amusements for the 2023 and 2024 Sweet Potato Festival and authorizing the Interim City Manager to execute the agreement.
BACKGROUND AND DISCUSSION:
Beginning in 2013, Paul Maurer Carnival began providing carnival rides, games, and concessions. In January 2022, the city was notified that they would no longer be able to provide this service.
With the help of neighboring agencies, staff began identifying additional vendors who would be able to provide this service without service interruption for the 2022 Sweet Potato Festival.
Harry Mason with Midway Amusements was deemed the only responsive vendor, and they conveyed an interest and desire to partner with the City of Livingston. In 2022, Midway Amusements operated at the Sweet Potato Festival and the partnership was successful.
Based on the success of the event in 2022, Midway Amusements expressed a desire to partner with the city for its 2023 and 2024 event. Staff is recommending to continue the partnership for 2023 and 2024 in order to secure a vendor well in advance of the Sweet Potato Festival.
The agreement calls for the operator to manage and provide approximately fifteen amusement rides, six game concessions, and two food concessions at 2600 Walnut Avenue within the city limits for the Sweet Potato Festival.
Entrance to the festival is free of charge to community members.

Discussion and Direction on Waiving Underground Utilities Requirements
March 7, 2023
Christopher Lopez, Interim City Manager
Christopher Lopez, Interim City Manager
RECOMMENDATION:
It is recommended that the Mayor and City Council discuss and provide direction on the following:
1. The Council's desire to amend the Municipal Code to allow for exemptions, in lieu fees, and waivers for undergrounding utility lines
BACKGROUND AND DISCUSSION:
Based on the Livingston Municipal Code Sections 6-10-38 and 5-4-7, all applicants, except for very limited exemptions, are required and responsible for removing utility poles and undergrounding utility lines within the property street frontage of a proposed development. As a result, when projects are submitted to the city, staff requires the overwhelming majority of applicants to adhere to the code and to underground utility lines as specified in the code.
Currently, there does not exist any other exemptions or waivers of this requirement. In order to encourage economic development, and to take a proactive approach to encourage infill development, staff has identified certain obstacles that may impede development in the community.
Staff is seeking council direction on whether the council would like to direct staff to explore proposed amendments that would allow for modifications to this existing requirement. Council may wish to explore amendments to the code that may accomplish the following:
Policy area exemptions to undergrounding existing utility lines the Council may seek to explore:
1. The construction of an accessory structure or accessory dwelling unit on a lot with an existing single family residence
2. The expansion of an existing building or buildings on a site where the total gross floor area of the building or buildings will be increased by a certain percentage
3. The demolition and reconstruction of all or part of an existing building or buildings on a site where the total gross floor area of the buildings on site will remain the same or will be increased by no more than a certain percentage
4. The reconstruction of an existing building damaged by fire, flood, earthquake, or other cause over which the owner had no control
5. Existing or proposed utility undergrounding districts In lieu of this requirement, the Council may wish to explore applicants paying an in lieu-fee. In these instances, the Council may want to explore the following areas:
1. The length of utilities lines to be placed underground will be less than a certain length and the utility lines have not been placed underground on any property abutting the subject property.
2. Existing on-site utility lines also serve property under separate ownership.
3. The City Engineer determines that undergrounding would not result in a net reduction of utility poles.
4. The expansion of an existing building or buildings on a site if the proposed expansion does not increase the total gross floor area of the building or buildings by more than a certain percentage. In such cases, the amount of the in lieu fee to be paid shall be prorated based on the certain percentage increase in total gross floor area on the site.
5. The demolition and reconstruction of all or part of an existing building or buildings on a site if the total gross floor area of the buildings on site will be increased by no more than a certain percentage In such cases, the amount of the in lieu fee to be paid shall be prorated based on the percentage increase in total gross floor area on the site.
6. The physical or legal character of existing utility easements will not allow utility lines to be placed underground.
7. The City Engineer determines, based on evidence provided by the developer, that the cost to underground existing overhead utility lines will exceed a certain percentage of the project's estimated hard costs. For the purposes of this subsection, "hard costs" include all direct construction costs associated with the project on the property being developed and within the adjacent public right-of-way, but do not include any development-related fees imposed by a governmental agency, including the city, architectural, engineering, financing, and legal fees, and other pre-and post-construction expenses.
Finally, the Council may seek to provide direction on waivers in which certain criteria may be met:
1. A waiver may be granted if the City Council finds that the costs of undergrounding existing utility lines and/or paying the in lieu fee would present an undue financial hardship to the developer and granting the waiver would not result in a negative impact to the public health, safety or welfare.
COUNCIL DIRECTION
The Council may direct staff to bring back revised ordinances or provide alternative direction.
Some options the Council may choose from include the following:
1. Provide direction to amend the code to allow for exemptions, proving for an in lieu fee, and providing for waivers
2. Provide direction on specific areas the Council wishes to explore including exemptions, in lieu fees, or providing waivers
3. Take no action and leave the existing code as is
FISCAL IMPACT:
There is no fiscal impact at this point. Revising the municipal code may allow for additional investment and additional economic opportunities for the Livingston community.
