STAFF REPORT
Resolution Approving the Reclassification of the Executive Assistant/Deputy City Clerk to the Assistant to the City Manager/Deputy City Clerk, Amending the Salary Schedule to Approve the Revised Salary Range for the Position, and Other Actions Necessary to Effectuate the Change
January 21, 2025
Christopher Lopez, Interim City Manager
Arcelia Cruz, Human Resources Coordinator
RECOMMENDATION:

Staff recommends City Council adopt the resolution approving the reclassification of the Executive Assistant/Deputy City Clerk to the Assistant to the City Manager/Deputy City Clerk, amending the salary schedule to approve the revised salary range for the positions, and other actions necessary to effectuate the change.

BACKGROUND AND DISCUSSION:

The City of Livingston has historically elected its City Clerk. While many municipalities have modernized their operations and identified that the City Clerk is a professional and career pathway for this vital and crucial function at the local level, the City of Livingston continues to elect its City Clerk. State Law prescribes the requirements for the City Clerk, and for many years the Elected City Clerk did not perform the duties as prescribed under the law. As a result, and due to the City's requirement to have those actions carried out, the responsibilities were shifted to City staff.

While the City's municipal code did not allow for the transfer of these responsibilities in previous years thereby creating logistical issues in the City, the City Council approved changes to the Municipal Code allowing the shifting of these responsibilities to the Deputy City Clerk in 2024.

Without this delegation authority, staff performed the functions of the City Clerk without proper authority. Once delegated, the city needed to update the job description to ensure that the Deputy City Clerk job description was updated to reflect the entirety of responsibilities carried out by the incumbent. This was necessary to mitigate any potential employee grievances since the elected City Clerk was in fact required to do the responsibilities under the law, and prior to the code changes adopted by the Council in 2024.

The reclassification of the incumbent, and the updated job description reflect the higher level of duties performed by the individual in the position, and accurately reflects the scope and responsibilities performed by the individual.

An analysis of the job duties performed by the incumbent was performed, and a salary survey was conducted to ensure that the salary range reflected the actual responsibilities performed.

Page 1 of 3 ends
Page 152 ends

In November 2024, a new City Clerk was elected to the position.

The incumbent Deputy City Clerk continues to perform all duties of the City Clerk's Office.

The core functions of the newly created position are as follows:
• Represents and supports the City Manager with City Council, employee discussions, and city led candidate forums, and meetings; keeps the City Manager informed about projects and issues of importance to Council; provides the City Manager with accurate and timely information to support decision-making and policy direction. • Supervises, trains, and evaluates professional, para-professional, technical, and clerical personnel; makes effective recommendations regarding promotion, transfer, and disciplinary action of assigned personnel.
• Plans, coordinates, organizes and conducts responsible administrative, management and legislative analysis studies relating to assigned issues and/or programs; identifies problems; analyzes alternatives and makes recommendations; develops and presents reports of study conclusions and recommendations to city manager; develops implementation plans and assists in implementing policies and procedures; letters of support or opposition for state or federal legislation.
• Provides assistance to City Manager, as needed, regarding administrative, operational issues, policies or procedures.
• Interprets, administers, and monitors contract agreements and related ordinances. • Monitors and maintains compliance with pertinent Federal, State and local laws, codes, regulations and ordinances; assist in implementing procedures to ensure compliance with applicable laws and regulations.
• Provides guidance to City departments according to the directives of the City Manager. • Facilitate the development of legislative policy by attending, recording and coordinating support for City Council meetings and other administrative proceedings. Take and transcribe official minutes at City Council meetings.

After completing a salary survey of comparable communities, staff identified that there were not many cities that continued to have an elected city clerk with a deputy that performed the duties of the city clerk. As a result, staff compared the salaries to cities with an appointed city clerk.

That survey is attached for reference as an attachment.

The salary schedule changes are shown below:

Executive Assistant/Deputy City Clerk (old position):

Type A B C D E

Annually 91,936.oo I 96,532.ao I 101,359.44 I 106,427.41 111,748.78 I This will result in a total net increase of $36,200 at the top step for the position on an annual basis for this position.

Approving this action will resolve having an employee working out of class and will ensure that the City of Livingston has the City Clerk function properly staffed and performed as prescribed by State law and under the Livingston Municipal Code.

While the City Council chose not to place an item on the ballot allowing voters to decide whether they should continue to elect the City Clerk in 2024, it is recommended that the City Council discuss eliminating the Elected City Clerk position and transition to staff performing this function as staff continues to do the job and has done so for several years.

FISCAL IMPACT:

Funding is available for the remainder of this fiscal year. The full year's cost will be included in the FY 25/26 Budget.
