DIFFERENTIAL FEES AND FEE WAIVER
A differential in fees for special situations and groups may only be determined by the City Council or City Manager. Examples of special situations are as follows:

Special non-profit groups/organizations, schools or organizations providing a free service to the community identified by the Recreation Department may be granted special consideration in the form of reduced rates or free services.

Due to limited income, special rates may be determined for the use of a facility or participation in a Recreation sponsored program on a case by case basis.

VARIANCES
It is understood that on occasion special consideration may be needed in determining fees for groups or individual having circumstances uncommon to those in the fee structure criteria. In these cases, the City Council or City Manager will approve these requests. Requests for a variance shall be submitted in writing to the City Manager 30 days prior to the date of promotion.

DETERMINATION OF FEES FOR FACILITIES AND EQUIPMENT RENTALS Fees shall be charged according to the user group the renter is identified with. There are 4 classifications of user groups associated with the rental of facilities and equipment.

They are as follows:

Class I

Class III
Individual residents or resident groups conducting classes, activities or parties. Private groups that have select memberships and/or specific intent, i.e. employee clubs, corporations, company picnics, family picnics and or reunions.

Class IV
Non Resident individuals or groups. (Not residing in the City of Livingston) Resident/Non-Resident Description

1 STAFF REPORT
AGENDA ITEM: Council approve or provide direction for fee waiver for Memorial Park and kitchen use for the Livingston High School All Class Reunion on September 26, 2026
MEETING DATE: April 7, 2026
PREPARED BY: Jacquelyn Benoit, Recreation Superintendent RECOMMENDATION:

Staff recommends the City Council approve or provide direction regarding a fee waiver for the use of Memorial Park and Kitchen by the Livingston High School All Class Reunion on September 26, 2026.

BACKGROUND:

Sandra Betschart submitted a facility use form and a fee waiver application to Recreation staff requesting the City’s permission for the Livingston High School All Class Reunion to use Memorial Park Facilities, including the kitchen, for their All Class Reunion on September 26, 2026.

Previously, the Livingston High School All Alumni Group used the Park for various events with no issues or complaints. The Group must follow all rules and requirements applicable to the use of the Park, including but not limited to obtaining and providing the insurance certificate(s) and not providing alcohol.

The City of Livingston has a Parks and Recreation Fee Policy in place which was adopted in 2008 and is attached for reference. The fee policy states “Special non-profit groups/organizations, schools or organizations providing a free service to the community identified by the Recreation Department may be granted special consideration in the form of reduced rates or free services.”
According to policy, “It is understood that on occasion special consideration may be needed in determining fees for groups or individuals having circumstances uncommon to those in the fee structure criteria. In these cases, the City Council or City Manager will approve those requests.

Requests for a variance shall be submitted in writing to the City Manager 30 days prior to the date of promotion.”
The Group is categorized as a Class II user group. If charged for the facility, the fee would be $680.00 (39.5 hours for games at $23.00 per hour). Should the Council approve the fee waiver, the revenue loss would be $680.00.

DISCUSSION:

The City Council has discretion to approve or deny the waiving of fees for facility use. Staff recommends the following three (3) options for the City Council consideration:

Page 305 ends

2 1. Allow the Livingston High School All Alumni Reunion group to use Memorial Park and waive any and all fees.

2. Deny the waiving of fees.

3. Continue the item or provide alternative directions
FISCAL IMPACT:

Recreation Center Facility Rentals Revenue line would not receive $680.00.

AGENDA ITEM: Adopting a Resolution Establishing a City Council Policy Prohibiting Councilmembers from Using Electronic Devices to Communicate With Each Other During City Council Meetings.

MEETING DATE: April 7, 2026
PREPARED BY: Maria S. Sullivan, Deputy City Attorney
Jose Antonio Ramirez, City Manager
REVIEWED BY: Jose Antonio Ramirez, City Manager

RECOMMENDATION
It is recommended that the City Council adopt a Resolution establishing a City Council policy that prohibits councilmembers from using electronic devices to communicate with each other during City Council meetings.

BACKGROUND
In July 2025, the City Council expressed concern about the use of electronic devices during City Council meetings. The City Attorney’s Office prepared materials in response to the City Council’s request, but the item was continued. City Council again requested the item to be brought back before the council. On February 17, 2026, the matter was returned to the City Council agenda.

DISCUSSION
At the February 17, 2026, City Council meeting, City Council voted to adopt a policy prohibiting the use of electronic devices by councilmembers to communicate with each other during City Council meetings. The purpose of the policy is to ensure that public meetings remain open and transparent, to limit Public Records Act requests, and to ensure that there are no inadvertent violations of the Brown Act by councilmembers privately messaging one another.

City Council has determined that personal (e.g. emergency) communications can be had between Councilmembers and family members or other outside persons. Councilmembers will therefore only be strictly prohibited from using electronic devices to communicate with each other during meetings.

FISCAL IMPACT
There is no fiscal impact associated with the recommended action.
