RECOMMENDED ACTION: Set public hearing for March 16, 2022, to consider resolution adopting pre-approved, Proposition 218 Consumer Price Index- based annual adjustment to rates for solid waste collection.

BACKGROUND INFORMATION: The franchise agreement with Central Valley Waste Services allows rates for solid waste collection to be adjusted annually, on April 1st.

Section 7c of the franchise agreement allows Central Valley Waste Services the option to either:
(a) adjust rates equal to 80 percent of the annual change in the Consumer Price Index (CPI) for all Urban Consumers for San Francisco-Oakland-San Jose, California Area, all Items (1982 – 84 = 100), plus an adjustment for extraordinary increases in landfill fees, fuel and energy costs, and changes in law, up to 100 percent of the change in the CPI, or (b) 100 percent of the annual change in the CPI, without the other adjustments, but with a certification that costs had increased by more than 100 percent of the change in the CPI.

Central Valley Waste Services is requesting the option to increase rates by 80 percent of the annual change in the CPI (option a) plus an adjustment for increased landfill gate fees at County owned disposal sites. The annual change in the CPI is 3.211 percent. The increase in rates based on 80 percent of the CPI change is 2.569 percent and 0.854 percent for the landfill gate fee increase. The total rate adjustment requested is 3.423 percent.

For most residential customers, the rate increase will be $1.01 per month. The effective date of the proposed rates is April 1, 2022. The complete schedule of proposed rate changes is shown in Exhibit A.

FISCAL IMPACT: Franchise and billing fees paid to the City will increase by approximately $54,000 annually.

RECOMMENDED ACTION: Conduct public hearing to consider adopting resolution setting pre- approved Engineering News Record adjustment index for usage- based and flat water rates for residential, commercial, and industrial customers.

BACKGROUND INFORMATION: The City Council has made numerous water rate decisions over the past several years. On March 20, 2019, City Council approved a five-year rate plan in accordance with the Proposition
218 rate setting process. The proposed rate adjustments are needed to generate sufficient revenue to meet projected operation and maintenance costs and debt service obligations, as well as, necessary capital maintenance improvements. The rate plan also included a rate “sunset” that rolled back rates on January 1, 2021 to January 1, 2016 levels. Prior to this rate rollback, there had not been an increase to rates since fiscal year 2018/19.

While the approved five-year rate plan allows for a maximum increase of 3 percent, staff has analyzed the water financial plan and recommends a 2 percent increase. A 2 percent increase will support a healthy reserve balance that is between the recommended level of 50% and the minimum level of 25%. A summary of current and proposed rates for flat-rate and usage-based rate customers is provided in Exhibit A, which reflects a 2 percent increase. For a resident still on the flat rate, the monthly charge for a three-bedroom home will increase from $45.89 to $46.81, or $0.92 per month. A metered resident using an average of 1,500 cubic feet of water per month will see an increase from $36.88 to $37.65, or $0.77 per month. The water utility, due to the foregoing of the January 1, 2020 pre-approved rate increase and implementation of the January 1, 2021 rate rollback, projects fund balances to dip below the 50 percent reserve target starting in Fiscal Years 2024/25.

Staff recommends adopting resolution setting pre-approved Engineering News Record adjustment index for usage-based and flat water rates for residential, commercial, and industrial customers.

FISCAL IMPACT: Increased revenues are required to properly fund capital maintenance, and to keep up with cost of service increases.

BACKGROUND INFORMATION: At its regular meeting on December 1, 2021 the Council adopted a resolution of intention to vacate an existing 10-foot public utility easement located at 800 thru 830 Talavera Circle; APNs: 027-310- 29, 28, 27, 26, 25, and 24, and refer the matter to the Planning Commission. Posting, publishing and mailing notices have been accomplished.

The proposed easement vacation is requested by the current owner, Michael Florsheim, DM2 Investments, LLC. In 1993, a 10-foot public utility easement was dedicated over the property formerly known as 2040 Cochran Road, as shown on Exhibit A. The easement was originally dedicated for the purpose of overhead electrical utility services. The easement is no longer needed as the current development was conditioned to dedicate new public utility easements for the undergrounding of the electric utility lines. The recommended public utility easement abandonment will allow full use of the parcel by the new parcel owners.

The vacation request was approved by the Planning Commission at the regularly scheduled Planning Commission meeting on January 26, 2022. The Planning department concurs with the proposed Council action.

The City of Lodi Electric Utility Department, City of Lodi Water/Wastewater and Street Divisions, AT&T, Pacific Gas & Electric, and Comcast have approved the 10-foot public utility easement vacation without further comment or conditions.

Staff recommends that vacating the existing 10-foot public utility easement located at 800 thru 830 Talavera Circle; APNs: 027-310-29, 28, 27, 26, 25, and 24.

BACKGROUND INFORMATION: At its regular meeting on January 5, 2022, the Council adopted a resolution of intention to vacate existing 16.5-foot and 3-foot public utility easements located at 2525 West Century Boulevard and refer the matter to the Planning Commission. Posting, publishing and mailing notices have been accomplished.

The proposed easement vacations are requested by Michael Carouba, on behalf of C Note Limited Partnership, owner/developer of the above-mentioned parcel. In 2005, the public utility easements were dedicated, as shown on Exhibits A & B, for overhead Pacific Gas & Electric utilities and future City of Lodi Electrical overhead utilities. As part of the public improvements of The Benjamins project at the subject parcel, the existing overhead utilities were either removed or undergrounded to the public right-of- way. The 16.5-foot and 3-foot public utility easements are no longer needed.

The vacation request was approved by the Planning Commission at the regularly scheduled Planning Commission meeting on January 26, 2022. The Planning Department concurs with the proposed Council action.

The City of Lodi Electric Utility Department, City of Lodi Water/Wastewater and Street Divisions, AT&T, Pacific Gas & Electric, and Comcast have approved the public utility easement abandonments without further comment or conditions.

Staff recommends vacating the existing 16.5-foot and 3-foot public utility easements located at 2525 West Century Boulevard.

BACKGROUND INFORMATION: The Lodi Greenline is a conceptual project that considers the possibilities of repurposing the existing Union Pacific R ailroad (UPRR) spur line that stretches from the UPRR mainline westerly to the community of Woodbridge. The conceptual trail would link the greater downtown Lodi area to Lodi Lake and Woodbridge providing bike and pedestrian access to various commercial, outdoor recreational, educational, and civic centers of the City.

On M
arch 20, 2018, Council received information from members of Bike Lodi regarding this project, and indicated support for further study of the concept. On November 27, 2018, the City of Lodi, with support from Bike Lodi, applied for the Cal trans Sustainable Transportation Planning Grant to obtain funding to conduct the Lodi Green line Feasibility Study. In May of the following year, the City received notice of a conditional grant award in the amount of $80,750, and on August 7, 2019, Council authorized execution of the grant program agreements.

The San Joaquin Council of Governments (SJCOG), in partnership with the City of Lodi, retained Toole Design Group to complete the feasibility st udy. The primary objective of the study was to produce a foundational planning document detailing potential use scenarios of the 1.75-mile railroad spur line. The study includes evaluation of “rail -with-trail” or “rail- to-trail” options, a railroad spur line appraisal, and various conditional assessments of the corridor. Outreach to the Lodi community regarding the potential project included a site visit, online surveys, and two virtual community workshops.

BACKGROUND INFORMATION: The City of Lodi is a member of California Public Employee’s Retirement System (PERS); as such the City must comply with the Government Code which sets forth post-retirement employment requirements which are applicable to all retirees. The Government Code provides specific criteria for hiring qualified annuitants. With the passage of Public Employees' Pension Reform Act of 2013 (PEPRA), all retirees must serve a 180-day waiting period before they can be hired as an annuitant. Section 7522.56(f) (1) of the Government Code provides for the following exception to the 180-day waiting period:

The em
ployer certifies the nature of the employment and that the appointment is necessary to fill a critically needed position before 180 days have passed and the appointment has been approved by the governing body of the employer in a public meeting. The appointment may not be placed on a consent calendar.

n December 30, 2021, Transportation Manager, Georgina Graham retired from the Transportation Division of Public works, prior to a new Manager being hired. Ms. Graham possesses a wealth of institutional and transit knowledge that is pertinent to the City. It is critical to the Transportation Division of the Public Works Department to ensure the continuity of workflow and to provide a transition of that institutional knowledge to the newly hired Transportation Manager.

T
he Transit Division is subject to a myriad of complex State and Federal regulatory requirements that must be performed in order to secure Transit funding. The City proposes to hire Ms. Graham, as a retired annuitant to provide as-needed expertise to the Transit Division regarding these requirements, as well as act as a resource for the new Transportation Manager during their transition into the position to provide input regarding Transit operations. Ms. Graham possesses the required knowledge and experience to perform this work. Ms. Graham will be paid an hourly rate of $61.68 and shall be limited to working no more than 960 hours in the fiscal year. It is anticipated that this assignment will last between nine and twelve months.

taff requests that Council approve the resolution approving the exception to the 180 -day waiting period and appoint Georgina Graham as a retired annuitant in the position of part -time Transportation Manager, effective February 17, 2022.

FISCAL IMPACT: This position will cost $61.68 an hour and will be utilized based on need, not to exceed $50,000.

PERIOD FOR RETIRED ANNUITANT

WHEREAS, in compliance with Government Code section 7522.56, the City of Lodi must provide CalPERS this certification resolution when hiring a retiree before 180 days has passed since his or her retirement date; and

WHEREAS, Georgina Graham, CalPERS ID 5390635470, retired from the City of Lodi in the position of Transportation Manager, effective December 30, 2021; and

WHEREAS, section 7522.56 requires that post -retirement employment commence no earlier than 180 days after the ret irement date, which is June 28, 2022 without this certification resolution; and

WHEREAS, section 7522.56 provides that this exception to the 180-day wait period shall not apply if the retiree accepts any retirement-related incentive; and

WHEREAS, the Lodi City Council, the City of Lodi , and Georgina Graham certify that Georgina Graham has not and will not receive a Golden Handshake or any other retirement - related incentive; and

WHEREAS, the Lodi City Council hereby appoints Georgina Graham as an extra help retired annuitant to perform the duties of the part-time Transportation Manager for the City of Lodi under Government Code section 21224, effective February 17, 2022; and

WHEREAS, the entire employment agreement, contract , or appointment document between Georgina Graham and the City of Lodi has been reviewed by this body and is attached herein; and

WHEREAS, no matters, issues, terms or conditions related to this employment and appointment have been or will be placed on a consent calendar; and

WHEREAS, the employment shall be limited to 960 hours per fiscal year; and

WHEREAS, the compensation paid to retirees cannot be less than the minimum nor exceed the maximum monthly base salary paid to other employees performing comparable duties, divided by 173.333 to equal the hourly rate; and

WHEREAS, the maximum monthly base salary for this position is $10,691.20 and the hourly equivalent is $61.68, and the minimum monthly base salary for this position is $8,794. 93 and the hourly equivalent is $50.74; and

WHEREAS, the hourly rate paid to Georgina Graham will be $61.68; and

WHEREAS, Georgina Graham has not and will not receive any other benefit, incentive, compensation in lieu of benefit, or other form of compensation in addition to this hourly pay rate; and

BACKGROUND INFORMATION: Due to the resignation of the City Clerk , it is necessary to appoint a new secretary to the above listed agencies.

The City Council will appoint the Assistant City Clerk to serve as the secretary for each of these agencies until such time as a new City Clerk is appointed.

There is no other business to come before the agencies at this meeting.
