LODI CITY COUNCIL

SHIRTSLEEVE SESSION
CARNEGIE FORUM, 305 WEST PINE STREET
TUESDAY, APRIL 26, 2022
An Informal Informational Meeting ("Shirtsleeve" Session) of the Lodi City Council was held Tuesday, April 26, 2022, commencing at 7:03 a.m.

Present: Council Member Khan, Council Member Kuehne, Council Member Nakanishi, Mayor Pro Tempore Hothi, and Mayor Chandler

Absent: None
Also Present: City Manager Schwabauer, City Attorney Magdich, and City Clerk Nashed Public Works Director Charles Swimley provided a brief introduction regarding the proposed Animal Services facility. LPA Partners Consultants Carolyn Natividad and Paris Allen provided a PowerPoint presentation regarding the project. Specific topics of discussion included project description and goals, interior and exterior building design, animal care approach, project location, and cost.

Council Member Kuehne stated he loved the concept and that he is thrilled for a new shelter.

Council Member Khan stated that this project has been long overdue and that he is excited to move forward and ensure that the City takes care of the homeless animals.

Mayor Chandler stated that the project couldn’t be soon enough and asked how long will it take to complete. In response, LDA Partners Consultant Natividad stated that the totality of the project will take about 14 months. Public Works Director Swimley stated that the staff’s goal is to complete the project by September 2024, with a rough cost estimate of about eleven to twelve million dollars.

In response to Council Member Kuehne’s question regarding if there will additional storage space for the Lodi Police Department, Public Works Director Swimley responded yes, there will be.

Council Member Nakanishi stated that since this project is mainly due to Measure L, he is recommending that there should be a plaque at the new animal services facility that states that the project was paid for by the people of Lodi. He also asked about the impact on Animal Services from 10 years ago versus today. In response, Animal Services Supervisor Jennifer Bender responded that the City has grown from 24 dog kennels to 48 kennels and that the shelter will help maintain the growth.

In response to Council Member Nakanishi’s follow up question on maintenance costs, City Manager Steve Schwabauer stated that the new shelter will easier to maintain over the next five to ten years.

In response to Council Member Nakanishi’s follow up question on whether 12,000 square feet is the general size, Public Works Director Swimley stated that the size is consistent with other cities A. Call to Order / Roll Call
B. Topics
B-1 Receive Information on Proposed Animal Services Facilit y and Request Council Feedback Regarding Concept Plans and Potential Site Locations. (PW) 1 Exhibit A
similar in size to the City of Lodi and that this size is just preliminary.

City Manager Schwabauer stated that City staff is looking for direction from the City Council regarding the overall concept, whether they desire a medical facility, and a confirmed location. He stated that if the Council wishes to include the medical facility, there were will be no additional funds for park improvements, as was discussed prior.

In response to Council Member Nakanishi’s question regarding whether the money allocated to park improvements at the April 20, 2022 City Council Meeting will be impacted, Deputy City Manager Andrew Keys stated that those one-time funds will not be impacted.

Mayor Chandler asked about the difference between a medical facility within the Animal Shelter and taking the animals to a veterinarian. In response, Animal Services Supervisor Bender and Contract Veterinarian Dr. Elaine Dornton stated that every animal admitted must be neutered before adoption. However, local veterinarians are too busy with their own clients, which delays the neutering and adoption processes. Dr. Dornton stated that fifty percent of the animals have medical needs; if those needs are met sooner, the animals can be adopted sooner.

Council Member Khan stated that the City should look forward to 20 years from now and that he was in favor of having care in the same facility and it will save money.

Police Chief Sierra Brucia thanked Public Works Director Swimley and LDA Partners for their efforts on the project. He stated that the Police Department is currently looking into contracting services with a veterinarian in Elk Grove. He further stated that this would increase costs, staff time, and may require an increase in staffing; this contract would be the future of Lodi Animal Services, if there was no medical facility.

Mayor Chandler asked about the pros and cons of Pixley Park housing the new Animal Services facility. In response, City Manager Schwabauer stated that there will be a park in the vicinity, it will be viewable to residents from the road, and that the location is less industrial. He stated that the con is that the structure will be more constrained than the design suggests.

None.

No action was taken by the City Council. The meeting was adjourned at 8:00 a.m.

\\cvcfilv02\pubwks$\WP\COUNCIL\2022\CSPA_WSWPCF SOUTH ELECT BLDG NEW FORMAT.docx 5/4/2022 AGENDA TITLE: Approve Plans and Specifications and Authorize Advertisement for Bids for White Slough Water Pollution Control Facility Electrical Building & Related Improvements Project
MEETING DATE: May 18, 2022
PREPARED BY: Public Works Director
RECOMMENDED ACTION: Approve Plans and Specifications and Authorize Advertisement for Bids for White Slough Water Pollution Control Facility Electrical Building & Related Improvements Project
BACKGROUND INFORMATION: The White Slough Water Pollution Control Facility (WSWPCF) South Electric Building (SEB) was constructed in 1990. The existing building is located downwind of the headworks facility and has been subjected to poor air quality due to hy drogen sulfide gas exposure from the headworks. This has accelerated corrosion of the internal switchgear, conduit, wire, and other electrical components of the SEB.

Additionally, the aged components of the SEB are based on pre- 1990 technology that are now obsolete and both replacement parts and product support are difficult to obtain. Considering the SEB and associated infrastructure are the “central nervous system” of the treatment plant, relocating this building to a less corrosive location, and updating the electrical components to current standards, is now the priority project. By relocating the SEB to a more desirable location, the building can be constructed with minimal disruption to plant operations. Once the new building is completed, power will be “switched over” to the new building and the existing building will be decommissioned and repurposed for storage/machine shop purposes.

The design of this facility (including delays associated with the COVID pandemic) has taken approximately 24 months to complete. The project includes the construction of all elements of the SEB including the building structure, motor control centers, communication/security and switchgear systems, heating, ventilating and air conditioning system, pad mount transformers, wire and conduit runs, and general site improvements such as access, parking, fencing, underground utilities, and area lighting.

The construction work associated with this complex project is expected to take between 18 and 24 months upon contract award. The schedule could be impacted due to lingering supply chain interruptions, and long lead times associated with obtaining the specialty electrical equipment being installed. The costs for both the design and construct ion of this project are programmed into the City’s wastewater utility rate model over the next four fiscal years, through Fiscal Year 2023/24 S
taff recommends Council approve plans and specifications and authorize advertisement for bids for White Slough Water Pollution Control Facility Electrical Building & Related Improvements Project.

Approve Plans and Specifications and Authorize Advertisement for Bids for White Slough Water Pollution Control Facility Electrical Building & Related Improvements Project
May 18, 2022

Page 2 ends

The plans and specifications are on file in the Public Works Department. The planned bid opening date is June 29, 2022. The project cost is not expected to exceed $12 million dollars. Project award is scheduled for July 20th, 2022 with construction anticipated to begin this Fall.

FISCAL IMPACT: Relocating and updating the SEB will enhance overall treatment plant reliability, reduce employee exposure to potentially dangerous electrical conditions, and will reduce the City’s exposure to regulatory violations due t o electrical system failures. Through prudent financial planning, funding for this work is available over the next several fiscal years in accordance with the City’s wastewater rate model projections . The project does not impact the General Fund.

FUNDING AVAILABLE: Funding is available from the Wastewater Enterprise Capital Fund and will be identified at project award.

Since the award of the contract, there has been one change order executed for $11,389 bringing the contract total to $875,846. Change O rder No. 1 included planting and maintenance for additional areas that were not included in the original scope of work.

T
he current contract includes service for the commercial areas once a month. Well maintained and attractive landscaping is a reflection of the City ’s image to shoppers a nd visitors. M onthly maintenance intervals represents the minimum level of service acceptable for these high traffic areas and at times not enough to keep up with trash and pruning requirements. I n order to address the deficiency and possibly improve business development opportuni ties, s taff recommends bi -monthly maintenance along the commercial corridors (Exhibit A).

S
ervicing these areas includes visiting the sites to test irrigation, litter pickup and weed removal. The City has requested that the commercial areas be serviced twice per month. These areas currently cost $5,340 per month . Doubling the frequency of service for these areas will cost an additional $69,145 for the remaining 13 months of this contract (beginning June 1, 2022).

Adopt Resolution Approving Change Order No. 2 for the 2021- 2023 Landscape Maintenance of Miscellaneous Areas and Lodi Consolida ted Landscape Assessment District 2003-1 for $69,415 and Authorizing City Manager to Execute Change Orders for an Additional $80,000 (and Appropriating Funds) May 18, 2022

Page 2 ends

K:\WP\PROJECTS\STREETS\2021-2023 Landscape Maintenance Contract\CAwardAuthority2.doc 5/4/2022 Change Order No. 2 exceeds the remainder of City Manager’s change order authority of $68,611.

Increasing the Change Order authority by an additional $80,000 allows Change Order No. 2 to be processed and allows additional change orders to be authorized by the City Manager for the remainder of the contract.

To address the additional scope of work, staff recommends authorizing Change Order No. 2 for the 2021- 2023 Landscape Maintenance of Miscellaneous Areas and Lodi Consolidated Landscape District No. 2003-1 contract in the amount of $69,415, authorize the City Manager to award additional change orders in the amount not-to-exceed $80,000, and appropriate funds in the amount of $69,415.

FISCAL IMPACT: Well-maintained landscaping is necessary to maintain a positive image of the community.

EETING DATE: May 18, 2022
P
REPARED BY: Public Works Director
RE
COMMENDED ACTION: Accept improvements under contract for Water Meter Program Phase 8.

B
ACKGROUND INFORMATION: The Water Meter Program Phase 8 contract was awarded to DSS Company dba Knife River Construction, of Stockton, in the amount of $4,441.635, on August 21, 2019. This contract has been completed in substantial conformance with the plans and specifications approved by City Council on May 15, 2019.

T
he project area for Phase 8 (final phase) is presented in Exhibit A and included the installation of 876 meters and the installation of 18,490 feet (3.5 miles) of water main. While Phase 8 is not the largest phase of the water meter program, over 570 of the 876 meter installations are type “E” meter installations. Type “E” meter installations consist of installing a new water meter service (and meter assembly) from a new water main that has been relocated from the backyard to the street. Based on experience gained from prior water meter phases, these installations encounter unforeseen conditions (especially in older, more established neighborhoods) and often require plumbing modifications to the residence to accommodate the new service location.

T
he original contract completion was 210 calendar days. Two hundred and twenty-four (224) calendar days were added by change orders to accommodate extra work requested by the City. The contract work was completed within the 434 calendar day contract duration. The final contract price was $6,148,469.19. The difference between the contract amount and the final contract price is due to eleven change orders, totaling $1,721,892.19, and minor adjustment in unit quantity bid items installed totaling ($15,058.00) as credit.

C
hange Order No. 1 ($40,671.82) included the emergency repair of a storm drain pipe at Harney Lane and Stockton Street which was blocked and needed immediate repair.

C
hange Order No. 2 included the installation of a water main and water service to Henderson School site (13451 N Extension Road, Lodi) at Lodi Unified School District’s (LUSD) request. This school is located just outside the City limit south of Harney Lane and west of Lower Sacramento Road. The school site’s domestic water well was having water quality problems and LUSD requested the City supply domestic water to the school site. The City Council approved the out-of-city service and Change Order No. 2 for the work on February 5, 2020. The total cost of this change order was $213,410.00 and has been reimbursed by LUSD in full.

C
hange Order No. 3 ($108,000.00) included the emergency repair of a sewer main at Turner Road and Lincoln Avenue at the request of the Utility Manager due to a pipe failure.

Accept Improvements Under Contract for Water Meter Program Phase 8 May 18, 2022

Page 2 ends

Change Order No. 4 ($161,370.77) included various field work for which the City requested time and material changes due to unforeseen field conditions. The work included addition pot-hole activities and water pipe work.

Change Order No. 5 ($32,823.00) included the reconstruction of the alley east of Garfield Street, north of Lodi Avenue. A new water main was installed in the alley per plan. Staff determined that the existing pavement in the alley should be replaced with the trench repair work due to its poor condition.

Change Order No. 6 through No. 9 ($462,351.60) included various field work changes due to unforeseen field conditions. The additional field work included water main work, fire hydrants replacement, additional trench paving, pot holes, and other miscellaneous work.

Change Order No. 10 and No. 11 included the site improvements and landscaping work at the Harmony Home site which were approved by the City Council on April 7, 2021 and June 2, 2021, respectively. The total cost of Change Order No. 10 and No. 11 was $597,000.00 and was paid by San Joaquin Continuum of Care Homeless Emergency Aid Program (HEAP) grant and California Department of Housing and Community Development Permanent Local Housing Allocation (PLHA) grant.

Following acceptance by the City Council, as required by law, the City Engineer will file a Notice of Completion with the County Recorder’s office. The notice serves to notify vendors and subcontractors that the project is complete and begins their 30-day period to file a stop notice requiring the City to withhold payments from the prime contractor in the event of a payment dispute.

FISCAL IMPACT: Water main leak and service repairs will be reduced. No additional costs will be incurred for reading water meters as they are automatically read concurrent with the reading of the electric meters.

FUNDING AVAILABLE: Funding for Water Meter Program Phase 8 was from Water Capital Fund (561).

The work reflected in Change Orders No. 1 through No. 11 were funded by the respective funds as mention in the report.

\\cvcfilv02\pubwks$\WP\PROJECTS\STREETS\_Completed Projects\2020 Extruded Traffic Stripes\CAccept.doc 4/27/2022 AGENDA TITLE: Accept Improvements Under Contract for 2020 Extruded Traffic Stripes MEETING DATE: May 18, 2022
PREPARED BY: Public Works Director
RE
COMMENDED ACTION: Accept improvements under contract for 2020 Extruded Traffic Stripes.

BACKGROUND INFORMATION: This project consisted of placing approximately 14.3 miles of extruded thermoplastic traffic stripes and 4,500 square feet of thermoplastic traffic legends at locations shown in Exhibit A. Since 2009, the City has been using extruded thermoplastic traffic stripes rather than sprayed thermoplastic. The extruded thermoplastic material is a superior product that lasts much longer.

The contract was awarded to Central Striping Service, Inc. of Rancho Cordova, in the amount of $61,374, on February 3, 2021. The contract has been completed in substantial conformance with the plans and specifications approved by City Council. The original project completion date was June 30, 2021 and the actual completion date was March 10, 2022. The delay was due to material shortages for the specified primer needed for the striping. In addition, Staff requested some work to be modified to bring the striping to City standard.

The final cost of the project was $65,499. The difference between the original contract amount and final contract amount was due to the City requesting striping modifications at the railroad crossings at Pine Street and Lodi Avenue which was outside of the original scope of work.

FISCAL IMPACT: This project will extend the useful life of the lane lines which will reduce overall maintenance costs.

FUNDING AVAILABLE: This project was funded by Fiscal Year 2020/21 Budget Gas Tax (30399000.77020)

AGENDA TITLE: Adopt Resolution Authorizing City Manager to Execute Professional Services Agreement for PowerClerk Software Program Application, Setup and Subscription with Clean Power Research, LLC of Napa ($85,710)
MEET
ING DATE: May 18, 2022
PREPARED BY: Electric Utility Director
RE
COMMENDED ACTION: Adopt a resolution authorizing the City Manager to execute a professional services agreement for PowerClerk software program, application and one-year subscription with Clean Power Research, LLC of Napa, California in an amount not to exceed $85,710.

B
ACKGROUND INFORMATION: Electric Utility staff has been processing solar installation permits for Lodi residents ever since solar panels became a source of renewable energy for homes. The process includes engineering design review, feedback, inspection, interconnection agreement etc.

T
he current solar permit processing system is entirely paper based where an application packet is submitted by the contractor along with design proposals. Upon review staff signs off of those proposals along with the interconnection agreement. The contractor then retrieves the signed off documents from staff to obtain the building permit. Historically staff was processing a few solar permits per week.

I
n 2018, State of California mandated that new single-family homes, as well as multi-family dwellings up to three stories high, must include solar panels starting in 2020. This mandate coincides with the substantial growth in new single-family homes that Lodi has experienced in the last few years. Existing and new home solar permits combined, staff is currently processing almost twice the historical amount of solar permits per week.

T
o process the large amount of new solar permits more efficiently and in a timely manner, staff is proposing to replace the paper-based system with a new electronic document submittal and review system. Staff researched various software tools to manage the solar permits process and found that PowerClerk is the utility industry’s leading program management software for solar permits. It is a cloud and browser-based service that is currently used by more than forty utilities and agencies.

P
ursuant to Lodi Municipal Code 3.20.075, staff has deemed PowerClerk as the most qualified and user- friendly software program to provide solar permit engineering feedback, processing and management services for customers. Staff allocated funds in the budget to implement this project in this fiscal year. Staff is requesting council approval to roll any unused funds into the next fiscal year 2022/23.

FISCAL IMPACT: Not to exceed $85,710
FUNDING AVAILABLE: Costs included in budget.

COMMENDED ACTION: Adopt a resolution authorizing the City Manager to execute a three-year Professional Services Agreement with a one-year renewal option with Efficiency Services Group, LLC of Hillsboro, OR for energy efficiency services, electric vehicle strategy program services, CARE assistance services, and program administration in an amount not-to-exceed $1,063,760.

B
ACKGROUND INFORMATION: Since 2014, Efficiency Services Group, LLC (ESG) has provided turnkey services to help Lodi Electric Utility (LEU) customers achieve energy efficiency savings. Those services include:
• Pe
rforming residential snapshot energy audits and direct installation of energy efficient devices • Reviewing and approving customer rebate applications for eligible equipment • Performing energy savings analyses and consultation for commercial and industrial customers • Serving as a direct point of contact with all applicants and customers for provided services • Monitoring state and federal energy efficiency related legislative and regulatory changes • Representing LEU at various NCPA working group and committee meetings • Completing energy efficiency annual compliance reporting, as required by state law T
he current Professional Services Agreement (PSA) executed in 2019 expires on June 30, 2022 after a two- year term and a one-year renewal option. Since 2014, the energy efficiency program administration provided by ESG has delivered $4.5 million in rebates to 3,846 residential customers and 271 businesses in Lodi. The program has generated over 19 million kilowatt hours of energy savings - enough to power over three thousand homes in California for one year.

In addition to the services described above, the new proposed contract includes developing and implementing a new pilot electric vehicle (EV) rebate program as authorized by the City Council on April 20, 2022.

Adopt Resolution Authorizing City Manager to Execute Three-Year Professional Services Agreement with One-Year Renewal Option with Efficiency Services Group, LLC of Hillsboro, OR for Energy Efficiency Services, Electric Vehicle Strategy Program Services, CARE Assistance Services, and Program Administration ($1,063,760)
May 18, 2022

Page 2 ends

Funding for each year of the proposed contract is provided below. It is important to note that over the proposed contract period, the only cost increase is a small inflationary adjustment of 2.5 percent per year for program administration. The average annual cost of the contract is approximately $266,000. This compares to approximately $237,000 for the current contract which expires June 30, 2022. The increase is attributed to an estimated increase in the number of customers to be served by the direct install program, increased scope of services associated with a new pilot EV rebate program, and small increase in monthly program administration fees.

Activity Year 1 Year 2 Year 3 Year 4
(Optional)
EV Program Set-Up $1,500
Administration $94,200 $97,170 99,599.25 $102,089.23
Travel $9,600 $9,600 $9,600 $9,600
CARE $2,700 $2,700 $2,700 $2,700
Direct Install $150,000 $150,000 $150,000 $150,000
Marketing $5,000 $5,000 $5,000 $5,000
Total $263,000 $264,470 $266,899.25 $269,389.23

ESG provides many of the same services to NCPA members, and as a result, members, including LEU benefit from economies of scale where costs are shared. Equally important are the efficiencies realized in terms of mandatory State compliance reporting provided by ESG for all NCPA member agencies. ESG has consistently demonstrated its superior efficiency and effectiveness in the field, its ability to keep secure confidential customer data, its expertise in the energy industry, its responsiveness to the needs of LEU and its customers and continues to maintain an excellent working relationship with LEU staff as well as key commercial and industrial customers as it relates to both short and long term energy efficiency projects and goals.

Therefore, in accordance with Lodi Municipal Code, Section 3.20.070, staff requests that City Council waive the bid process and authorize approval of the PSA with ESG as LEU’s energy services administrator as outlined above.

FISCAL IMPACT: Total not-to-exceed cost of $1,063,760 for the proposed three-year agreement with a one-year renewal option.

FUNDING AVAILABLE: Funding will be included each year in the Public Benefits Fund 504 as part of the annual budget process starting in Fiscal Year 2022/23.

RE
COMMENDED ACTION: Adopt a resolution authorizing the City Manager to execute Amendment No. 3 to the Professional Services Agreement with Hinderliter de Llamas and Associates of Brea, to continue to provide Sales, Use and Transaction Tax Services for the City and Measure L, Business License Tax and Administration Services, Business License Tax Audit, Transient Occupancy Tax Administration (TOT) and Short Term Rental Administration Services.

B
ACKGROUND INFORMATION: H dL has provi ded sales tax audit, economic analysis, recovery, and consulting services to the City of Lodi for over 30 years. HdL is the pre- eminent provider of these services in California due to their years of experience, established relationships, and interface with the California Department of Tax and Fee Administration (CDTFA).

I
n June 2017, the City Council approved a five year agreement , which expires on May 31, 2022, with HdL to continue performing sales tax audit, economic analysis, recovery and consulting services, The cost of the contract was funded through the General Fund. HdL, in its history with the City, has recovered substantial amounts of money through audits of CDTFA (formerly State Board of Equalization) by identifying non or underreporting businesses and ensuring those businesses accurately report past and future sales tax revenues.

I
n January 2019, the City Council approved Amendment No. 1 adding Transaction and Use Tax Services or Measure L. HdL’s service in assistance with forecasting economic activity and auditing business activity for the purpose of revenue recovery was critical to the success of Measure L. These services help ensure the Measure L tax is being uniformly collected on eligible transactions, the businesses are treated equally under Measure L, and that the City receives the full revenue from Measure L as authorized by the voters.

In February 2020, the City Council approved Amendment No. 2 adding ongoing consultation for Business License Administration, Transient Occupancy Tax and S hort-Term Rental Administration Services. HdL leverages its database for TOT and business license tax services. They perform auditing and revenue recovery functions for these revenues, similar to how they perform the City’s sales and use tax services. With HdL’s assistance, the customer service operations is better able to utilize staff time and resources to provide more responsive service to the City’s customers.

HdL has continuously improved revenue for Business License taxes and TOT, since the inception of HdL in 2020. See charts below:

Business License Revenue
2018 2019 2020 2021 2022

The City now requests to extend its current contract with HdL an additional two years, until May 31, 2024, to provide services for Sales Tax, Transaction Tax (Measure L), Business License Tax and Transient Occupancy Tax services. The compensation for Business License Tax, Transient Occupancy Tax and Short -Term Rental Services will increase to $13.92 per Business License and $802.92 per monthly TOT filing and $750 for Quarterly filings. These fees will be indexed to CPI-U each January and all other fees will remain the same.

FISCAL IMPACT: Based on the increase price in business license , short term rentals, and TOT services the estimated cost will be approximately $160,000 annually. Estimates are based on current volume of all business licenses and TOT’s. Actual costs will be based primarily on transactions and reduced by collection recoveries.

For both Sales Tax and Measure L tax, HdL is compensated for periodic reports at a nominal fee and for audit services on a revenue recovered basis. HdL shares in some of the recovered taxes owed that were not paid and in prospective tax revenue for a period after a successful audit. The table below shows the breakdown of these fees. Throughout the City’s relationship with HdL, the City has benefited greatly from these services with HdL returning substantial revenue to the City above the cost of service.

COMMENDED ACTION: Adopt a resolution authorizing City Manager to execute a mendment to agreement with Ray Morgan Company of Chico, CA for city-wide copier maintenance and approve purchase of new equipment in the amount of $81,691.

B
ACKGROUND INFORMATION: The City of Lodi entered into a master copier maintenance agreement with Ray Morgan Company in 2013. At that time, the city-owned 16 Canon copier machines located throughout city offices. Before that agreement, as machines have needed to be replaced or purchased, departments have entered into separate agreements with Ray Morgan for their copier maintenance needs and the Police Department was one of those departments.

C
urrently, the Lodi Police Department is in a month-to-month lease and maintenance agreement with Ricoh. The five-year agreement concluded in May of 2021. Our current machines leased through Ricoh are end of life causing downtime, increased service calls for repairs, and delayed repairs due to unavailable replacement parts.

In addition, there has been multiple complaints from Records, Animal Services, Administration, and the Investigations staff that machine troubles are disrupting workflow.

R
ay Morgan Company representatives have analyzed over a year’s worth of copier usage reports and have interviewed the supervisors of the police department divisions where machines are placed. From these interviews they have recommended the machines that are listed. The department has reviewed the recommendations and these machines will work well for the various divisions considering their staffing and usage needs.

The cost of maintenance is dependent upon the machine model but ranges from $0.0078 to $0.0111 per black and white copy and $0.058 per color copy. Per-copy maintenance costs include service, parts, labor, and toner.

The department is budgeting $30,000 for the remainder of the contract.

Staff recommends approving the amendment to the agreement under the Shasta Union High School District Contract No. A77-2031 which is a publicly bid contract already in existence and allowable under Lodi Municipal Code 3.20.045 State and Local Agency Contracts, and that Council also approve the purchase of new equipment with pricing set under the same agreement in the amount of $51,690.19. If funds are not expended by the end of the fiscal year 2022, funding will roll forward to the next fiscal year.

FISCAL IMPACT: Funding for the maintenance agreement is already budgeted in the Police Administration account. Funding for the new equipment purchase was requested during the mid-year budget. Salary savings from retirements and unfilled positions has allowed the department to appropriate funds for this purchase.

COMMENDED ACTION: Adopt Resolution Designating Portion of Pixley Park (1041 Auto Center Drive) as Future Animal Services Facility Site; Adopt Resolution Authorizing City Manager to Execute Professional Services Agreement with LDA Partners, Inc., of Stockton, California for Design and Construction Document Services for the City of Lodi Animal Services Facility in the amount of $992,000 and Appropriate Funds in the amount of $900,000.

B
ACKGROUND INFORMATION: The City’s current animal services facility has been serving the community since 1958. The facility was last expanded in 1983 and remains significantly undersized and outdated despite substantial growth in the City.

In addition to being undersized, the current facility does not meet requirements for comprehensive animal care.

The proposed facility will be sized to serve the community for the next 30-50 years and will include modern amenities to assist City staff in providing a standard of care that is consistent not only with government regulations, but also in line with our moral obligations as a community.

O
n April 12, 2022, Staff from LDA Partners Architecture and Design (LDA) and City staff conducted a community meeting where attendees were provided a presentation on the proposed building layout and site plans for two potential City owned locations. During this meeting, members of the public and staff were encouraged to provide input on the facility as a whole and asked to provide their preferred site location. The feedback included overwhelming support for the Pixley Park Site along with a strong recommendation to include provisions to conduct veterinary services at the facility.

A
t the April 26, 2022 shirtsleeve meeting, Council received a presentation that included concept level renderings reflecting the proposed architecture of the facility, proposed floorplans, site layout drawings at two City owned locations and an introduction to facility costs. The presentation also provided Council with the feedback obtained from the April 12, 2022 community meeting. Upon conclusion of the meeting, Council indicated overall support for the proposed concept design and layout. Council also indicated support to establish Pixley Park as the preferred site to construct the facility (Exhibit A), and to include provisions to conduct veterinary services at the facility.

Adopt Resolution Designating Portion of Pixley Park (1041 Auto Center Drive) as Future Animal Services Facility Site; Adopt Resolution Authorizing City Manager to Execute Professional Services Agreement with LDA Partners, Inc., of Stockton, California for Design and Construction Document Services for the City of Lodi Animal Services Facility ($992,000); and Appropriate Funds ( $1,200,000) May 18, 2022

Page 2 ends

In November of last year, Staff engaged LDA to prepare a conceptual project design and site assessment study to evaluate the proposed facility size, layout and features needed to serve the community. LDA has designed several animal services facilities throughout California and has provided excellent service to the City during the preliminary design process.

Staff requested a proposal (Exhibit B) from LDA to perform the design and construction Document Services for the City of Lodi Animal Services Facility. The scope of work includes schematic design, design development (including civil, landscaping, architectural, structural, mechanical, plumbing and electrical, construction documents) construction administration, and cost estimating. Additional Services provided include topographic survey of site with utility locations, and geotechnical services.

Staff recommends Council adopt resolution designating a portion of Pixley Park (1041 Auto Center Drive) as future Animal Services Facility site; adopt resolution authorizing City Manager to execute a Professional Services Agreement with LDA Partners, Inc., of Stockton, California for the Design and Construction Document Services for the City of Lodi Animal Services Facility in the amount of $992,000; and Appropriate Funds in the amount of $900,000.

FISCAL IMPACT: The City’s operations and maintenance budget for the current Animal Services Facility is $ 641,360. Constructing a new, larger facility will result in additional facility maintenance costs that are currently unknown but not expected to be significant. Operating costs are also expected to increase but are intended to be absorbed into the current Animal Services budget at this time.

FUNDING AVAILABLE: Funding is available from savings associated with refinancing the City’s 2012 Lease Revenue Bonds.

Requested appropriation:

General Fund Capital (43199000.77020) $900,000

ilv02\pubwks$\WP\COUNCIL\2022\CC Streets_Fleet Approp.docx 5/9/2022 AGENDA TITLE: Adopt Resolution Approving Appropriation to Fleet Operating Budget MEETIN
G DATE: May 18, 2022
PREPA
RED BY: Public Works Director
RECOMMENDED ACTION: Adopt Resolution Approving Appropriation to Fleet Operating Budget.

BACKGROUND INFORMATION: At the time of this staff report, there still remains 2 months of expense to post in the City’s 2021/22 fiscal budget and the operating budget in the Fleet division has exceeded their fiscal year appropriation. The budget overages
are associated with the utilities, s upplies and services line items and do not include the appropriations
intended for personnel costs.

Staff includes projected vehicle repair costs based on an average of the past three years of actual expenses.

During
this fiscal year, the Fleet operating budget has absorbed unexpected and substantial repair costs associated with specialty vehicle repairs that have contributed to budget overages at a cost of approximately $75,000.

In general, the more costly than anticipated repairs are associated with fire apparatus, street sweeper and transit bus vehicles.

The
other significant budget overage is attributed to the price of fuel. As noted above, the current fuel prices ar
e significantly higher than anticipated when staff prepared this fiscal year budget. The fuel line item in the Fl
eet operating budget has been exceeded.

An additional appropriation of $220,000 will cover the needed operating expenses through the end of the fiscal year.

Since the Fleet budget is a special revenue fund, the unanticipated expenses associated with vehicle repairs
and fuel prices will ultimately be recovered from the departments utilizing fuel and repairs services on a proportional basis.

Staff recommends adopting the resolution approving the additional budget for the Fleet operating budget to address current overages and to continue normal operations through the end of the fiscal year.

FISCAL IMPACT: The additional appropriation request is needed to fund Fleet Operations from April through the end of this fiscal year.

FUNDING AVAILABLE: Requested Appropriation:
$120,000 Fleet account 65055000.72533
Fleet account 65055000.72551 $100,000

AGENDA TITLE: Adopt Resolution Authorizing the Purchase of Property and Evidence Lockers for Use by the Police Department from Systems and Space of Pleasanton, CA ($61,300) M
EETING DATE: May 18, 2022
P
REPARED BY: Chief of Police
RE
COMMENDED ACTION: Adopt resolution authorizing the purchase of property and evidence lockers for use by the Police Department from Systems and Space of Pleasanton, CA in the amount of $61,300.

B
ACKGROUND INFORMATION: The police department utilizes a locker system to submit a property for evidence and safekeeping. Officers place items in a locker and shut the door, securing the item inside. The Property Clerk then removes the item from a door in the backside of the locker, accepting the item into evidence or safekeeping. Properly functioning lockers are a critical part of police work as they ensure the chain of custody for evidence. The chain of custody must be airtight for prosecutors to use evidence during criminal trials. Failure to maintain the chain of custody can lead to lost property, mistrials, and other miscarriages of justice.

T
he police department’s current evidence lockers were installed during the original construction of the police department 20 years ago. They are composed of pressed wood and a laminate, and are coming to the end of their life cycle. 7 of the 32 doors are no longer functioning, and failures are coming at a more rapid rate.

T
he following three companies have been contacted for quotes in accordance with the City’s purchasing policy:
• S
outhwest Solutions: This company was contacted twice in January 2022. Messages were left on both occasions. There has been no response.
• SystemsNSpace: $61,300
• Combat Weapon Storage: $44,607
A
lthough Combat Weapon Storage (CWS) was a lower quote, SystemsNSpace (SNS) has been selected as the vendor for this project.

C
WS has only built property lockers for one law enforcement agency in California. CWS primarily contracts with State and Federal governments for weapons storage and equipment lockers. The company was very unresponsive during the quote process. It took nearly two months to obtain a quote and required repeated requests.

SNS was highly responsive and had a wider variety of choices, configurations, and colors. SNS was able to configure a “Code-3” locker for items that have to be temporarily stored for an emergency purpose by an officer.

SNS also provides a “Pass Back” locker; this is a locker with a digital keypad. Using it, investigators can retrieve items of evidence after hours when the Property Clerk places items in the locker, secures it, and provides the investigator with a unique passcode, allowing them to retrieve the item. SNS built lockers locally for both the Fairfield Police Department and the San Joaquin County Sheriff’s Department. I inspected the lockers at the Sheriff’s office on April 7th, 2022. Employees found them to be of high quality and had no complaints regarding the product. They have been in use for several years and continue to be durable and functional.

Funding for this project has been allocated as a part of the mid-year budget review in the 2021/22 fiscal period.

FISCAL IMPACT: Funding for the lockers is budgeted in the Police Administration account.

Funding for the new equipment purchase was requested during the mid- year budget. Salary savings from retirements and unfilled positions has allowed the department to appropriate funds for this purchase.

FUNDING AVAILABLE: Repairs to Buildings ($61,300) - 10030001.72534

As the materials exceed $500 in value and are attached to a building, the State Contractors law requires that it be sold and installed by a current Licensed Contractor from the State of California. The requirement that the seller have a license is required whenever installation labor (assembly) and materials are sold by the seller. Should the seller and a separate installer invoice the customer separately then the seller does not need to have the contractor’s license. As we are supplying in this proposal both the materials and the assembly labor then we are required to have a contractor’s license. We meet this requirement.

PREPARED BY: Public Works Director
RECOMMENDED ACTION: Set public hearing for June 15, 2022, to consider adopting resolution setting pre -approved Engineering News Record adjustment index for wastewater rates for residential, commercial, and industrial customers.

BACKGROUND INFORMATION: The City Council has made numerous wastewater rate decisions over the past several years. On March 20, 2019, Council voted to approve a five-year program of rate adjustments for water, wastewater, and solid waste services, in accordance with the Proposition 218 rate setting process. The proposed rate adjustments are needed to generate sufficient revenue to meet ongoing operation and maintenance costs and debt service obligations, as well as, necessary capital maintenance improvements.

For the wastewater utility, the annual rate adjustment, if approved, is the lesser of the Engineering News Record (ENR) index change or three percent. A summary of the past years’ wastewater rate adjustments relative to the ENR index change is provided in the table below. The purpose of this table is to demonstrate that, due to sound financial management, past actual rate increases have frequently been below the approved maximum or deferred to coordinate with the programming of capital improvement projects. In fact, staff has not recommended a wastewater rate increase since July 1, 2019.

\\cvcfilv02\pubwks$\WP\COUNCIL\2022\CC_ PH Solid Waste Ordinance.docx 4/27/2022 AGENDA TITLE: Public Hearing Introducing Ordinance Amending Lodi Municipal Code Title 13 “Public Services,” by repealing and reenacting Chapter 13.16 – Solid Waste in its entirety MEETING DATE: May 18, 2022
PREPARED BY: Public Works Director
RECOMMENDED ACTION: Public Hearing introducing ordinance amending Lodi Municipal Code Title 13 “Public Services,” by repealing and reenacting Chapter 13.16 “Solid Waste” in its entirety.

BACKGROUND INFORMATION: SB 1382, enacted in 2016, is the latest in a series of bills since 2006 to reduce the impact of greenhouse emissions in California. Specifically addressed in SB 1383 is the production of methane by organic materials in landfills. SB 1383 has mandated the reduction of organic material in landfills and directed the California Department of Resources and Recycling and Recovery (CalRecycle) to develop regulations that would meet these mandates.

The regulations developed require local jurisdictions to implement actions and enforce requirements on residents and businesses. Some of the requirements were to be in place by January 1, 2022, with the rest phasing in through 2024. Recognizing that agencies may need more time to develop organics recycling programs, the Governor signed AB 619 in 2021 authorizing agencies to extend the SB 1383 implementation date by filing a Notice of Intent to Comply (NOIC) with CalRecyle.

The City has recently filed the NOIC providing the City until January 1, 2023 to implement these requirements.

The option to file the NOIC is conditional upon each jurisdiction to adopt an enforceable ordinance mandating that waste generators, collectors, and other entities change the ways in which they collect, manage and process organic waste. This proposed ordinance will allow the City to enforce SB 1383 requirements on businesses and residents beginning on January 1, 2024 that is required by SB 1383 regulations.

At its meeting on March 16, 2022, City Council accepted this amendment to the ordinance. Due to an oversight, a required section was left out related to the requirements of commercial edible food generators.

This s ubsequent amendment would add the State required section covering commercial edible f ood generators and its related definitions.

FISCAL IMPACT: City could face fines from the State if an enforcement ordinance is not adopted.

FUNDING AVAILABLE: N ot applicable.
