B
ACKGROUND INFORMATION: National Public Safety Telecommunicators Week is a national event to recognize the men and women who dispatc h our police forces. Although they are not as visible as the men and women who arrive at the scene of emergencies, they are equally important to the safety and level of service provided to our community.

E
very day, in all of our communities, dedicated public safety telecommunicators answer calls for assistance.

They dispatch our calls for help to the City’s police department and facilitate the execution of law -enforcement operations in our city.

W
e depend upon public safety telecommunicators to notify emergency personnel promptly, clearly, and calmly.

We depend on them to keep our loved ones calm and assured in an emergency. We depend on them for guidance and support in our most frantic and panicked moments.

T
he Lodi Police Department has 14 dispatchers/jailers, two lead dispatchers, and one dispatch supervisor working 12-hour shifts. Lodi is one of the very few departments in the state where dispatchers not only staff the Communications Center for business and 911 calls, they also serve as jailers; booking, processing, and providing care for prisoners while they await arraignment in court or transfer to other agencies. Several of the dispatchers are also cross-trained to work special assignments such as assisting the Property Clerk, acting as Field Evidence Technicians, members of the Hostage Negotiations Team, and Tactical Dispatch.

R:\GROUP\ADMIN\Council\2023\04192023\Earth Day Proclamation\Council Communication- Earth Day- 2023- final.doc 4/4/2023 AGENDA TITLE: Presentation of Earth Day Proclamation Recognizing Lodi Unified School District Educators in the 2022/23 “Salmon in the Classroom Program” MEETING DATE: April 19, 2023
PREPARED BY: Public Works Director
RECOMMENDED ACTION: Presentation of Earth Day Proclamation recognizing the Lodi Unified School District Educators in the 2022/23 “Salmon in the Classroom Program”.

BACKGROUND INFORMATION: Since 2000, the City of Lodi Public Works Department, has overseen a watershed education outreach program to help meet the stormwater permit requirements outlined in the “National Pollutant Discharge Elimination System for Small Municipal Separate Storm Sewer Systems.” Since 2015, the City of Lodi has partnered with Lodi Unified School District (LUSD) teachers to help sponsor a “Salmon in the Classroom Program” as a way to connect students to the Mokelumne River watershed, hoping to encourage them to see the river and watershed area as a unique ecosystem worthy of protection and stewardship.

Since 2020, LUSD Science Coaches have taken the helm for the program and expanded its reach to include securing funding sources for more tanks and equipment, providing teacher workshops, fish tank build days, on-line curriculum resources and scheduled activity release day events. In the 2022/23 school year, approximately 1,200 students from forty classrooms were able to participate, receiving 1,400 salmon eggs from the Mokelumne River Fish Hatchery to their classroom in January, then raising them and returning them to the river once they fully developed to the fry stage, in late February and early March. LUSD teachers who participated are to be commended for their dedication achieving a salmon survival rate of nearly 95%.

Program success is due to the many partnerships spawned in the Lodi region, including the Department of Fish and Wildlife, Mokelumne River Fish Hatchery, East Bay Municipal Utility District, Delta Fly Fishers, City of Stockton, San Joaquin County Office of Education, San Joaquin County-Public Works, and the Upper Mokelumne Stewardship Through Education, who all play key roles in the delivery, raising and/or educational needs of the “Salmon in the Classroom” environmental education program for San Joaquin County students.

The City of Lodi recognizes the hard work and dedication of LUSD staff, teachers, parents and partners who have served in the 2022/23 “Salmon in the Classroom” program. This group of outstanding role models and team players, demonstrate to the Lodi and the San Joaquin County region, that the 2023 Earth Day ethic, “Invest in Our Planet”, begins at home when we invest time and energy into our youth and in our local watershed’s stewardship.

A representative of Lodi Unified School District will be present to accept the proclamation. _______________________________

RE
COMMENDED ACTION: Mayor Hothi will present a proclamation in recognition of the upcoming Love Lodi event.

B
ACKGROUND INFORMATION: Love Lodi was first introduced in Lodi in 2014 under the then-leadership of Salvation Army Captain Martin Ross. Love Lodi is the product of a large investment from our faith-based and non-profit communities. Each year since its inception, it has created over 100 annual community projects, including home and yard cleanups, alley cleanups, tree plantings, refurbishment of tot lot fall protections, public landscaping projects, smoke alarm installations, Highway 99 cleanups, and Lodi Arch repainting, just to name a few. Not only have these projects directly improved our community infrastructure, they have instilled and grown community pride. As such, staff wholeheartedly supports Council issuance of a proclamation recognizing the Love Lodi event.

T
he community will come together on April 29, 2023, to “love” Lodi by meeting needs, demonstrating kindness, and impacting lives through a variety of projects.

COMMENDED ACTION: Approve plans and specifications and authorize advertisement for bids for Lower Sacramento Road Resurfacing Project.

B
ACKGROUND INFORMATION: This project includes localized pavement repair, resurfacing of the pavement, and replacing the traffic striping. The project limits will include Lower Sacramento Road (from Kettleman Lane to the Turner Road).

Low
er Sacramento Road was last reconstructed in 2000 with an open-graded rubberized asphalt mix. In 2020, 92,000 square feet of pavement was repaired to prolong the structural integrity. While most of the road still has plenty of structural integrity, the road’s top layer is chipping off, creating an uneven driving surface. This project will create a smoother and quieter driving surface while prolonging the life of the road.

T
he specifications are on file in the Public Works Department. The planned bid opening date is May 10, 2023.

The contract estimate is $2,500,000.

F
ISCAL IMPACT: By investing in the recommended maintenance project, significant capital dollars will be saved by extending the useful life of the pavement and foregoing more costly pavement reconstruction

B
ACKGROUND INFORMATION: On November 16, 2022, Council approved plans and specifications and authorized advertisement for bids for the White Slough Water Pollution Control Facility Electrical Building Associated Improvements Project.

The White Slough Water Pollution Control Facility (WSWPCF) South Electric Building (SEB) was constructed in 1990. The existing building is located downwind of the headworks facility and has been subjected to poor air quality due to hydrogen sulfide gas exposure from the headworks. This has accelerated corrosion of the internal switchgear, conduit, wire, and other electrical components of the SEB.

he construction work associated with this complex project is expected to take up to 36 months from notice to proceed due to lingering supply chain interruptions, and long lead times associated with obtaining the specialty electrical equipment being installed. The costs for both the design and construction of this project are programmed into the City’s wastewater utility rate model through Fiscal Year 2023/24 but may extend to Fiscal Year 2024/2025.

A. Amendment No. 2 To Task Order No. 48 With West Yost & Associates Of Davis, for Engineering Services ($841,683)

On October 2, 2019, Council authorized Task Order No. 48 with West Yost & Associates, Inc., of Davis, for design of the White Slough Water Pollution Control Facility (WSWPCF) Electrical Building Project (Project). If approved, Amendment No. 2 will add an additional $841,683 to the current task order to address the following:

• A portion of the current budget for assisting the City during the bid phase and construction phase of the project was utilized for obtaining a building permit for the Project. This cost was under estimated in the original agreement. In addition, the construction period for the Project is expected to be almost 1-year longer than initially anticipated resulting in an overall increase in the level of effort required for providing engineering services during construction (ESDC) for the Project. ($119,143) • The City has requested the design team provide control system programming services during construction. These services were not included in the original contract and require a substantial amount of programming and control system integration effort, as nearly every critical process function will be controlled from signals originating from the building’s new electrical components. This element of work will also include staff training and commissioning support. ($722,540).

B. C. Overaa & Co. of Richmond for Construction ($11,408,000); and Authorize the City Manager to execute change orders in an amount not-to-exceed $1,100,000.

The New Electrical Building Project includes replacing the existing SEB (South Electrical Building) with a new building to house new electrical distribution and motor control equipment. In addition, the New Electrical Building will include a new satellite control room, and a redundant SCADA HMI server. The project will also include control network infrastructure improvements to integrate the New Electrical Building control elements into the existing plant SCADA system. Staff recommends awarding the construction contract to the low bidder, C.

Overaa & Co. in the amount of $11,408,000.

Plans and specifications for this project were approved on November 16, 2022. The City received the following three bids for the project on February 2, 2023:

Above/(Below)
Bidder Location Bid Estimate
Engineer’s Estimate $12,000,000.00
C.Overaa & Co. Richmond $11,408,000.00 ($592,000.00)
Diede Construction Woodbridge $12,105,000.00 $105,000.00 Myers & Sons Construction Sacramento $12,188,000.00 $188,000.00

C. Amendment No. 1 with Terracon Consultants, Inc., of Lodi, for Construction Testing and Inspection Services ($114,080)

The City currently contracts construction testing and inspection services with Terracon Consultants, Inc., of Lodi.

Staff utilizes these services on an on-call basis for conducting testing and inspections on various projects throughout the City. Amendment No. 1, if approved will add $100,000 to the existing contract that will be available to provide the construction testing and inspection services required to complete the WSWPCF electrical building improvements.

Adopt Resolution Authorizing City Manager to Execute Agreements with the Following Entities for the White Slough Water Pollut ion Control Facility Electrical Building Associated Improvements Project ($14,400,000) and Appropriate Funds ($6,400,000):

A. Amendment No. 2 to Task Order No. 48 With West Yost & Associates, Inc., of Davis, for Engineering Services ($841,683) B. C. Page 3 ends

\\cvcfilv02\pubwks$\WP\COUNCIL\2023\Electrical Building CC.doc 4/5/2023 Contingencies, Equipment and Project Administration ($2,036,237)

This element of the project includes a contingency allowance of approximately 10% of the contract price to provide funds needed to address unforeseen changes in the work. Unforeseen changes in the work are expected due to the age of the treatment plant infrastructure that was installed approximately 60 years ago. Lodi Electric will be providing primary power for the new facility so this item also includes the anticipated cost to procure electrical transformers, vaults and primary wire needed to get power to the new electric building. Finally, this item includes the City’s project administration and construction management staff time costs.

Staff recommends adopting a resolution authorizing City Manager to execute agreements with the following entities for the White Slough Water Pollution Control Facility Electrical Building Associated Improvements Project in the amount of $14,400,000 and Appropriate Funds in the amount of $6,400,000:

A. Amendment No. 2 to Task Order No. 48 With West Yost & Associates, Inc., of Davis, for Engineering Services ($841,863)
B. C. Overaa & Co. of Richmond, for Construction ($11,408,000); Authorize the City Manager to Execute Change Orders, in an Amount Not-to-Exceed $1,326,000
C. Amendment No. 1 with Terracon, of Lodi, for Construction Testing and Inspection Services ($100,000)

FISCAL IMPACT: The cost for constructing the Electrical Building is included in the 5-Year CIP and the Wastewater Financial Plan over FY 2022/23 and FY 2023-24. The additional appropriation request is to appropriate the necessary funds in the current fiscal year budget in order to award the contract.

The SEB was originally constructed in 1990. The existing building is located downwind of the headworks facility and has been subjected to poor air quality due to hydrogen sulfide gas exposure from the headworks. This has accelerated corrosion of the internal switchgear, conduit, wire, and other electrical components of the SEB.

Justification/factor driving project
Includes engineering and design of all elements of the South Electric Building (SEB) including the building structure, motor control centers, communications/security and switchgear systems, heating, ventilating and air conditions system, pad mount transformers, wire and conduit runs and general site improvements such as access, parking fencing underground utilities and area lighting.

MEETING DATE: April 19, 2023
PREPARED BY: Public Works Director
RECOMMENDED ACTION: Adopt resolution authorizing City Manager to execute Amendment No. 1 to Professional Services Agreement with ICR Refrigeration, Inc., of Lodi, for on-call heating, ventilation, and air conditioning services, in the amount of $250,000.

BACKGROUND INFORMATION: The Public Works Facilities Division provides regular preventive maintenance to the heating, ventilation, and air conditioning (HVAC) systems in various city owned buildings. Facilities staff occasionally requires services from an outside HVAC contractor to provide dialogistic and repairs on the HVAC units when they are not functioning as intended.

On May 19, 2021, Council awarded the Professional Services Agreement to ICR Refrigeration, Inc. in the amount of $500,000. The original agreement includes a 2-year term with options for 3 additional 1-year extensions. Over the past 2 years, in addition to regular maintenance, staff has utilized this contract to address several deferred maintenance issues that include duct cleaning at the Police Facility and City Hall, and the replacement of the boiler in the City Hall Annex. Due to these unanticipated large expenditures, current funding is nearly exhausted.

If approved, Amendment No. 1 will extend the Agreement through June 30, 2024 and increase funding by $250,000 for a total not-to-exceed amount of $750,000. The additional funding will be utilized to address HVAC repairs/replacements anticipated through the remaining contract term.

Staff recommends authorizing City Manager to execute Amendment No. 1 to Professional Services Agreement with ICR Refrigeration, Inc., of Lodi, for on-call heating, ventilation, and air conditioning services, in the amount of $250,000.

FISCAL IMPACT: Ongoing City facilities HVAC system maintenance and repairs are necessary to maintain a comfortable working environment in City facilities and to avoid more costly system failures. This project will impact the General Fund in proportion to the General Fund facilities requiring HVAC services.

FUNDING AVAILABLE: Funding is budgeted in the operating accounts associated with the location of the repairs.

COUNCIL COMMUNICATION
APPR
OVED: ________________________________
Stephen Schwabauer, City Manager
AGENDA TITLE: Adopt Resolution Approving City of Lodi Pay Schedule Dated April 19, 2023 M
EETING DATE: April 19, 2023
P
REPARED BY: Human Resources Manager
RE
COMMENDED ACTION: Adopt resolution approving City of Lodi pay schedule dated April 19, 2023.

B
ACKGROUND INFORMATION: Public Employees’ Retirement Law (PERL) Government Code sections 20636 and 20636.1 define earnable compensation for State, School, and Public Agency members. Only compensation that meets the provisions and regulations of the PERL will be considered by CalPERS for calculating retirement benefits. Government Code section 20636 and 20636.1 require pay schedules to be publicly available. Compensation earnable is further clarified by California Code of Regulations (CCR) Section 570.5.

C
CR 570.5 specifies the required elements necessary to meet the definition of a publicly available pay schedule as follows:

1. H
as been duly approved and adopted by the employer’s governing body in accordance with r
equirements of applicable public meeting laws;

2. Identifies the position title for every employee position;

3. Shows the payrate for each identified position, which may be stated as a single amount or as multiple am
ounts within a range;

4. Indicates the time base, including, but not limited to, whether the time base is hourly, daily, bi-weekly, monthly, bi-monthly, or annually;

5. Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer’s internet website;

6. Indicates an effective date and date of any revisions;

7. Is retained by the employer and available for public inspection for not less than five years; and

8. Does not reference another document in lieu of disclosing the payrate.

A
ll eight (8) requirements must be met in one schedule for each member’s pay, in order for CalPERS to approve the pay amount as payrate and reportable compensation earnable. If an agency cannot provide a document meeting the requirements for a publicly available pay schedule, the CalPERS Board, in its sole

discretion, may determine an amount that will be considered to be payrate. CCR 570.5 outlines the process by which CalPERS may determine a member’s payrate when there is no publicly available pay schedule.

As such, and in accordance with the above regulations, the Human Resources Manager will present, from time to time, an updated pay schedule for City Council adoption.

Staff recommends that the City Council adopt the resolution approving the attached City of Lodi salary schedule effective April 19, 2023.

AGENDA TITLE: Adopt Resolution Authorizing City Manager to Implement a Citywide Cash Handling Policy
M
EETING DATE: April 19, 2023
P
REPARED BY: Revenue Manager
RE
COMMENDED ACTION: Adopt resolution authorizing City Manager to implement a Citywide Cash Handling Policy
B
ACKGROUND INFORMATION: The Revenue Division manages the City's cash handling and safety of all money received. There has been no formal cash handling policy, and this causes inconsistency in cash handling practices and the safekeeping of money throughout the departments. Currently, the Revenue Division has to recount money that a department has processed. This can lead to issues because too many people are handling the money instead of being handled by a solitary person.

A
formal cash handling policy in the City will give all departments consistency, best practices, controlled safekeeping, training, and accountability. The Revenue Division will train all staff regarding cash handling and counting and reconciling cash drawers before the execution of the policy. Each department will be given the tools to perform the duties to ensure the proper handling, safekeeping of monies, and balance of a drawer.

Training to balance and reconcile a drawer correctly will eliminate the need for a second person in the Revenue Division to handle the money already processed by the initial department. In addition, this policy will help keep and maintain accurate records between cash drawers and the general ledger.

T
he Revenue Division has created cash-handling training for each new hire and all employees to repeat every two years. Audits will be performed randomly on cash drawers to maintain the balanced integrity of the cash drawers and cash handling practices. Safes will be bought for each department that does not currently have one that bolts to a wall or ground to store checks and cash safely.

T
herefore, staff proposes implementing an Administrative Policy and Procedure titled Cash Handling Policy and provide the information needed to safely keep and handle money for the City.

B
ACKGROUND INFORMATION: The Community Development Block Grant (CDBG) program is funded by the U.S. Department of Housing and Urban
Development (HUD). The program provides funding for
activities that benefit low -income persons, eliminate slum or blight, and/or serve an urgent need.

Eligible activities include property acquisition, public improvements, housing rehabilitation, economic development, and public services.

The Annual Action Plan presents a detailed description of each activity proposed, funding, and goals served for the period of July 1, 2023 to June 30, 2024. This will be the final program year of the 2019- 23 Consolidated Plan cycle.

Funding Allocation
The City is estimating that it will receive approximately $600,000 in CDBG funds for the 2023-24 program year. EETING DATE: April 19, 2023
P
REPARED BY: Public Works Director
RE
COMMENDED ACTION: Set Public Hearing for May 3, 2023, to consider resolution adopting pre- approved, Proposition 218 Consumer Price Index- based annual adjustment to rates for solid waste collection.

B
ACKGROUND INFORMATION: The current franchise agreement (effective through December 31, 2030) with Waste Management (WM) allows rates for solid waste collection to be adjusted annually, on April 1st throughout the contract term.

E
arly in 2022, staff began negotiations with WM on an amended franchise agreement to address the service changes associated with Senate Bill 1383 (SB 1383). The implementation of the mandatory residential food waste collection required under SB 1383 (an unfunded State mandate) will result in additional costs to both the City and WM, prompting a modification to the current rate structure.

W
M, acknowledging the new rate structure to achieve SB 1383 compliance was intended to take effect on April 1, 2023, or shortly thereafter, chose to delay the City’s contract obligation to implement the annual CPI rate increase as reflected in Section 7c of the current agreement until April 1, 2024.

S
ince the new rate structure was not adopted by Council, WM is opting to exercise Section 7c of the current agreement and requests the annual rate increase effective retroactively to April 1, 2023, per the attached letter dated April 7, 2023 (Exhibit A).

S
ection 7c of the franchise agreement allows WM the option to either:
(
a) adjust rates equal to 80 percent of the annual change in the Consumer Price Index (CPI) for all Urban C
onsumers for San Francisco-Oakland-San Jose, California Area, all Items (1982 – 84 = 100), plus an adj
ustment for extraordinary increases in landfill fees, fuel and energy costs, and changes in law, up to 100 percent of the change in the CPI, or
(
b) 100 percent of the annual change in the CPI, without the other adjustments, but with a certification that costs had increased by more than 100 percent of the change in the CPI.

April 19, 2023

Page 2 ends

4 /10/2023
WM is requesting the option to increase rates by 80 percent of the annual change in the CPI (option a) plus an adjustment for increased landfill gate fees at County owned disposal sites. The annual change in the CPI is

5.599 percent. The increase in rates based on 80 percent of the CPI change is 4.479 percent and 0.469 percent for the landfill gate fee increase. The total rate adjustment requested is 4.948 percent.

AGENDA ITEM C-15

COUNCIL COMMUNICATION
APPROVED: ________________________________
Stephen Schwabauer, City Manager
AGENDA TITLE: Set Public Hearing for May 17, 2023 to Consider Introducing an Ordinance Amending Lodi Municipal Code Chapter 13.20 – “Electrical Service” by Repealing and Reenacting Article III “Rates” in its Entirety
MEETING DATE: April 19, 2023
PREPARED BY: Electric Utility Director
RECO
MMENDED ACTION: Set public hearing for May 17, 2023 to consider introducing an ordinance amending Lodi Municipal Code Chapter 13.20 – “Electrical Service” by repealing and reenacting Article III “Rates” in its entirety.

BACKGROUND INFORMATION: Lodi Electric Utility (LEU) maintains a financial planning model which identifies the necessary rates and charges to be collected to ensure sufficient revenue requirements to cover the cost of providing electric service to Lodi residents and businesses.

In 2015, LEU implemented a 5 percent rate increase across all utility rate classes to address deferred maintenance and capital infrastructure needs of the utility. At that time, staff recommended annual inflationary increases of no more than 2 percent through 2019 to be brought back to the City Council for consideration if the need arose. At that same time, City Council expressed a preference for smaller, inflationary increases.

In 2017, LEU returned to the City Council with an updated financial forecast through 2025 and a 2 percent rate increase was approved to meet debt service coverage requirements, gradually close the annual projected deficit for non-power supply costs, sufficiently fund deferred capital maintenance, and meet reserve targets set forth by City Council policy and contractual requirements.

Based on the utility’s most current financial forecast through 2030, it is projected that LEU reserves will fall below City Council approved reserve targets by 2024 with projected annual deficits ranging from $1.2 million to $3.8 million annually.

Reserves have been steadily declining since 2020 for a number of reasons including the COVID pandemic, energy market instability and supply chain disruption. Approximately $2M was used in 2020 to provide utility bill relief in the form of bill credits during a period when customers were severely financially impacted by job losses/layoffs during COVID and $4.5M in reserves was used in 2021 and 2022 to mitigate rising energy prices that would have otherwise been passed on to customers through the Energy Cost Adjustment. Finally, since 2017, LEU has seen a significant increase in material costs associated with capital maintenance and infrastructure projects due to supply chain constraints with price increases ranging from 150 percent to over 200 percent.

To provide the additional needed revenue to close projected deficits and maintain a financial reserve that meets City Council approved reserve targets in accordance with the City’s adopted Budget and Fiscal Policy, LEU is proposing a 2 percent increase in Fiscal Year 2023/24 and an additional 2 percent increase in Fiscal Year 2024/25. LEU reviews the Handy Whitman Index (HWI) to evaluate cost trends. The HWI, published since 1924, calculates cost trends for various types of utility construction and provides an index relative to the electric industry and even more specific to electric distribution systems. LEU has not requested an inflationary base rate increase since 2017. These proposed revenue increases of approximately 2 percent per year will help address inflationary trends since 2017 but to a lesser extent than those indicated on average by the HWI for the same period – (4.9% in 2018; 3.4% in 2019; 5.7% in 2020; 4.8% in 2021; 11% in 2022).

Set Public Hearing for May 17, 2023 to Consider Introducing an Ordinance Amending Lodi Municipal Code Chapter 13.20 – “Electrical Service” by Repealing and Reenacting Article III “Rates” in its Entirety
April 19, 2023

Page 2 ends

LEU is proposing to collect the additional needed revenue through an increase to the monthly customer charge which is intended to cover the fixed costs of the utility – those costs that do not change based on the amount of energy a customer uses. LEU’s annual budget is approximately $100 million; of which, approximately $14 million is attributed to fixed costs.

LEU currently collects less than 30% of its fixed costs through monthly customer charges. The remainder is collected through variable energy rates. Increasing the monthly customer charge will help ensure better alignment of costs and charges as well as ensure revenue stability for the utility moving forward. Below is a summary of the proposed changes:

In addition, similar changes are proposed to the current mobile home park rates for tenants in conjunction with changes to the master metered customer rates to ensure mobile home parks have equitable cost recovery for both tenants and park owners.

Approving incremental adjustments such as this will help avoid future potential rate shock while maintaining the financial integrity and bond rating of the City’s Electric Utility. Failure to approve the proposed rate increases subjects LEU to system reliability issues resulting from potential delays associated with capital maintenance; an inability to meet reserve requirements; and possible downgrading by rating agencies resulting in future higher borrowing costs – including those associated with the financing needed for the 230 kV Interconnection Project. In addition, LEU’s ability to transact in the energy markets through Northern California Power Agency is dependent on its ability to meet contractual program reserve requirements as well as maintain sufficient credit with the California Independent System Operator.

It is recommended the first year’s increase take effect August 1, 2023 with the second year increases effective July 1, 2024 with the start of the Fiscal Year.

FISCAL IMPACT: The proposed rate increase is anticipated to generate an additional $25 million in rate revenue through 2030. Actual additional revenue realized will depend on customer growth.

FUNDING AVAILABLE: Not applicable.
