AGENDA TITLE: Set a Public Hearing for July 19, 2023, to Consider Adoption of a Resolution to Approve the Recommendation of the Planning Commission for a Zoning Map Amendment (Rezone) from Community Commercial (CC) PD(35) to General Commercial (GC) for Approximately 8.3 acres at 515 S. Lower Sacramento Road, Exempt per California Environmental Quality Act (CEQA) Guidelines Section 15183 – Project Consistent with the General Plan MEETING DATE: June 21, 2023
PREPARED BY: Community Development Director
RECOMMENDED ACTION: Set a Public Hearing for July 19, 2023, to consider adoption of a resolution to approve the recommendation of the Planning Commission for a Zoning Map Amendment (Rezone)
from Community Commercial (CC) PD(35) to General Commercial (GC) for Approximately 8.3 acres at 515 S. Lower Sacramento Road , exempt per California Environmental Quality Act (CEQA) Guidelines Section 15183 – Project Consistent with the General Plan.
BACKGROUND INFORMATION: The Applicant desires to eventually develop two contiguous vacant infill parcels with commercial uses that are adjacent to S. Lower Sacramento Road and are located approximately
1,000 feet to the southwest of the S. Lower Sacramento Road and Lodi Avenue intersection. One of the parcels (APN 027-400-19) is zoned Community Commercial (CC) PD(35) and is approximately
7.7 acres. There is a drainage basin on the western portion of this parcel. The othe r parcel (APN 027-400-14) is zoned Community Commercial (CC) PD(35) and approximately 0.5 acres. For the first phase of developing these parcels, the applicant is proposing a drive -through carwash. There are existing commercial uses (mini -storage, shopping center) adjacent to the parcels to the north, an existing church and private school adjacent to the south, and a drainage canal and an existing single-family residential neighborhood to the east. To the west, there is a vacant parcel zoned Medium-Density Residential.
The proposal would rezone the parcel from Community Commercial (CC) PD(35) to General Commercial (GC) to enable a Use Permit for a Car Wash Facility on a portion of the site.
STRATEGIC PRIORITY ADDRESSED: Strategic Milestone 5-A, examine both public and private underutilized or vacant property City wide and
consider approaches for achieving highest and best
use, including policy or zoning modifications, for Council’s consideration.

MEETING DATE: June 21, 2023
PREPARED BY: Public Works Director
RECOMMENDED ACTION: Conduct Public Hearing to consider adopting resolution setting pre- approved Engineering News Record adjustment index for wastewater rates for residential, commercial, and industrial customers.
BACKGROUND INFORMATION: The City Council has made numerous wastewater rate decisions over the past several years. On March 20, 2019, Council voted to approve a five- year program of rate adjustments for water, wastewater, and solid waste services, in accordance with the Proposition 218 rate setting process. The proposed rate adjustments are needed to generate sufficient revenue to meet ongoing operation and maintenance costs and debt service obligations, as well as, necessary capital maintenance improvements.
For the wastewater utility, the annual rate adjustment, if approved, is the lesser of the Engineering News Record (ENR) index change or three percent. A summary of the past years’ wastewater rate adjustments relative to the ENR index change is provided in the table below. The purpose of this table is to demonstrate that, due to sound financial management, past actual rate increases have frequently been below the approved maximum or deferred to coordinate with the programming of capital improvement projects.

A
t present, the wastewater operating fund balance exceeds target operating reserves. This surplus will be needed to fund wastewater capital expenditures amounting to almost $30 million over the next five years without borrowing. This conservative financial strategy provides a substantial benefit to rate payers by eliminating the debt service associated with borrowing to fund capital projects.

\\cvcfilv02\pubwks$\WP\UTILITY RATES\W_WW\2023 W_WW Rate Increase\CCPH_WW Rates.docx 6/7/2023
Council recently awarded several large projects funded on a pay as you go basis, which include the White Slough Water Pollution Control Facility (WSWPCF) Electrical Building Associated Improvements Project ($14,400,000); White Slough Solids Handling Facility Improvements ($2,424,725); and recently accepted the Wastewater Rehabilitation Project Phase 9 ($1,686,099). These large projects are scheduled to be funded over the next 2 years and represent necessary capital maintenance on infrastructure that has reached its useful life. The recommended increase is being driven by projected capital expenditures programmed in the Wastewater Financial Plan, coupled with recent inflationary pressure.
The current Proposition 218 water and wastewater rate plan expires December 31, 2023. Staff is currently working with a consultant to prepare an updated rate study to establish a rate plan for the next 5 years. The rate study and proposed rate plan will be brought before Council this summer for feedback and consideration.
The recommended rate adjustment for this next year (Exhibit A) reflect a recommended increase of 3 percent.
FISCAL IMPACT: Increased revenues are required to properly fund capital maintenance, to keep up with cost of service increases, and State mandated costs.

AGENDA TITLE: Receive Presentation on Skate Park Project Options M
EETING DATE: June 21, 2023
P
REPARED BY: Christina Jaromay, PRCS Director
RE
COMMENDED ACTION: Receive Presentation on Skate Park Project Options B
ACKGROUND INFORMATION: Kofu Skate Park is approximately 20,000 SF and was built in 2002 by Spohn Ranch of Los Angeles, CA for $540,000. The modular ramps made of Skatelite surface material had an estimated life-span of ten (10) years. The location is in a storm basin and the ramps have been susceptible to damage from weather elements. While PRCS has been maintaining and trying to repair the ramps, most ramps need to be fully replaced as they are 21 years old. Over the past several months, Lodi’s skateboarding community has voiced concerns about the current skate park, the level of current and deferred maintenance and their desire for a new concrete skate park.
A
t its April 5, 2023 meeting, the Parks and Recreation Commission recommended the City Council establish a steering committee and allocate $100,000 to begin planning for a new concrete skate park, including location selection and securing a new design.
T
he following skate park project options will be presented to City Council:
1. K
ofu Skate Park Rehabilitation, $95,000 –The existing skate park infrastructure requires a professional skate park repair company to perform repairs. $85,000 would include replacing 33 Skatelite surfaces as well as the high-density polyethylene plastic (HDPE) underlayment material. This option would allow the City to keep the existing skate park open in safe condition while planning for a new concrete skate park and an additional $10,000 (annually) could fund porta potties and handwashing stations.
2. P
lanning, Public Outreach and Construction Documents, $175,000 – Whether the skate park will remain at Kofu Park or another location, planning, public outreach and construction documents will cost an estimated $175,000. PRCS would consult with a professional skate park firm to design and produce c
onstruction drawings for a new concrete skate park. The consultant would be responsible for engaging with the public at public meetings, townhalls and steering committee meetings (comprised of Park and Recreation Commissioners, staff and skate park community members).
3. N
ew Concrete Skate Park
a. New Concrete Skate Park at Kofu Park: This option will be to construct a new concrete skate park at the existing location. This will include demolition of the existing ramps and pads ,
ut
ilities, a Portland Loo restroom facility or similar and concrete skate park. Lighting, fencing and parking already exist at this location. While this option is less expensive than option 3.b. below, the location is a storm drain basin and susceptible to extreme weather events as well as Receive Presentation on Skate Park Options

closures. The Public Works Department, in an effort to alleviate storm drain capacity issues during extreme rain, plans to install a passive connection to the skate park area which will add 23% basin capacity to help eliminate flooding on Ham Lane.
