The City Council immediately recessed into Closed Session CC-2022-07 - Closed Session - Consider initiation of litigation pursuant to paragraph (4) of subdivision (d) of California Government Code Section 54956.9 (1 potential case).
City Attorney Robbins announced that the City Council received the report, gave direction and there was no final action to report.
CC-2022-08 Workshop - Loma Linda Municipal Code Section 17.115 – Objective Design Standards.
Laura Stetson, MIG, noted that the City Council adopted an ordinance in November 2021 to amend the Municipal Code to establish regulation for Objective Design Standards. The workshop was to review the the Objective Design Standards. She noted that legislation is to regulate the approval process for multifamily housing that required the adoption of Objective Design Standards by local agencies. The legislation requires that cities approve multi-family housing based on whatever is in its building code.
The legislation does provide ability for a city to set objectively based standards for multi-family housing.
Should a builder come into the city and meet those standards, the project would not require Planning Commission or City Council review and approval. She noted that city staff has been working for many months to develop standards that reflect the desires of the community, high quality construction and reflect the desired aesthetics and amenities for multi-family housing in the city. Should a builder not be able to meet the standards, the project would go through the planning process, ultimately to the City Council for an exemption from the design standards. This legislation affects only new construction.
Discussion ensued.
The regular meeting of the City Council reconvened at 7:05 p.m.
The Pledge of Allegiance and invocation were led by Councilman Lenart.

The certification deadline was October 15, 2021, with a 120-day grace period to February 11, 2022. It was important to take an action this evening.
She stated that the HCD has strict content requirements in reviewing the city’s Housing Element that included:
Needs assessment;
Previous accomplishments;
Constraints to housing development;
Resources and site inventory; and
Affirmatively furthering fair housing.
Affirmatively Furthering Fair Housing analysis is a new requirement by HCD that takes meaningful action to overcome patterns of segregation and to remove barriers that restrict access to housing opportunities. Maps of the City were displayed identifying potential concentration by race and income level. She noted that Loma Linda had a good balance of both.
She went on to say that every city in California is required to provide its fair share of housing. Loma Linda’s fair share is 2,051 units. The units must be distributed under different income categories. To try and meet the objectives of the Housing Element, the City is looking at current project that can be applied as credit, new and proposed housing programs, vacant and underutilized sites for potential development and accessory dwelling units (ADU) as qualifying developments.
She identified six overarching goals for the City:
1. Housing opportunities for all Loma Linda Residents
2. Housing for households of all income levels, particularly special needs groups
3. Removal of governmental constraints to housing production
4. Conserve, preserve, and improve existing housing
5. Affirmatively further fair housing
6. Promote sustainability practices

With the adoption of Senate Bill 1035, the Safety Element is now required to be updated at the time the Housing Element is being updated. He worked closely with City staff to update and complete the comprehensive report. He noted that the LHMP is federally regulated and the Safety Element is governed by the California Government Code. SUBJECT: Council Bill #R-2022-09 – Adopt Resolution to set membership on the Historic Commission and amend appointments
RECOMMENDATION
Adopt Council Bill #R-2022-09 to set the Historic Commission membership from eleven (11) to eight (8) and amend appointments.
BACKGROUND
At the regular City Council meeting of February 8, 2022, it was the consensus of the City Council to place on the Agenda discussion of modification of membership to the Historic Commission to address the issues of quorums.
On February 9, 2021, City Council adopted Ordinance 765, Chapter 17.80.050 A. of the Loma Linda Municipal Code which reads as follow: “There is established in the City a Historic Commission, hereinafter, referred to as the “commission” consisting of members by the City Council. The number of members shall be as determined by the City Council by resolution.” Further, Chapter 17.80.050 C. of the Loma Linda Municipal Code which reads as follows: “A quorum of the commission shall be defined as a majority of the appointed members for purpose of administering this chapter.” At the March 9, 2021, City Council meeting, the City Council set the membership to 11 and made three appointments to the Commission. However, the Historic Commission continued to encounter the challenge of obtaining a quorum and conducting regular business.
City staff learned that two members relocated and could not continue their term with the Commission and one member was deceased. After careful consideration, staff determined that by reducing the number of members to eight (8), it would address the quorum issue since some of the current members had been regularly attending.
ANALYSIS
The amendment to the membership is to remove the following members: Lori Curtis, Dick Schaefer and Betty Stark. This process is to be adopted by Resolution by City Council.

Council Bill #R-2022-10 - Adopt Resolution declaring pursuant to California Government Code § 54221 that the real property (APN 0284-202-47-0000) owned by the City located on the south side of Allen Way, west of Mountain View Avenue (near Hulda Crooks Park) is designated as surplus land and not necessary for the Citf s use at this time, finding that such declaration is exempt from environmental review under the California
Environmental Quality Act, and taking related actions.
1. Adopt Resolution No. 2022 -10, declaring that pursuant to California Government Code § 54221 that the real property (APN 0284-202-47-0000) owned by the City located on the south side of Allen Way, west of Mountain View Avenue (near Hulda Crooks Park) is designated as surplus land and not necessary for the City's use at this time, finding that such declaration is exempt from environmental review under the California Environmental Quality Act, and taking related actions;
2. Direct the City Clerk to file a Notice of Exemption with the San Bernardino County Clerk of the Board of Supervisors; and
3. Approve sale of the property to Mr. Anlari Jiao (adjacent property owner) for $21,215.00
BACKGROUND
The City purchased 60 acres of land in 1995 which included a grove house known as the Allen Break Estate. In 2010 City Council declared a portion of the estate surplus property and authorized disposal. The remaining parcel, approximately 1.4 acres, is a gently sloping orange grove next to Allen Way and encompasses the end of a splinter fault from the San Jacinto fault zone. It is not practical to extend the improved park into this area due to the topography and location and, therefore, the property has not been used for public park purposes. Additionally, a lot line adjustment was recorded in 2021 to allow for the construction of a garage, reducing the parcel in question to 1.318 acres, now known as Parcel A of Lot Line Adjustment 12-02 (APN 0284-202-47-0000) (the "Property"). This item was introduced to City Council at the February 8, Council meeting.
-1- CC AGENDA ITEM 18
-2-
ANALYSIS
The previous owner in 2015 requested to purchase the remaining land from the City in order to install a swimming pool, maintain the citrus grove and landscaping and clarify boundaries. The owner moved out of state before the transaction was completed, however, a lot line adjustment was ordered to allow the construction of a new garage. An updated appraisal by a certified real estate appraiser was completed last August to establish the current value of the remaining parcel at $21,215. If City Council wishes to place restrictions upon the property, that could be done concurrently as a condition of sale.
SURPLUS LAND ACT
The attached Resolution concerns that certain real property owned in fee by the City of Loma Linda (the “City”) designated as APN 0284-202-47-0000 consisting of approximately 1.32 acres located on the south side of Allen Way, west of Mountain View Avenue (near Hulda Crooks Park) as more particularly described within Exhibit “A” to the attached Resolution (the “Property”). Pursuant to the California Surplus Land Act, Government Code (the “GC”) §§ 54220-54333 (the “Act”), as amended by AB 1486 (Chapter 664, Statutes of 2019; “AB 1486”) and Guidelines promulgated thereunder by the California Department of Housing and Community Development (the “HCD”) dated as of April 2021 (the “Guidelines”), in order for real property to be disposed by a local public entity it must be declared either surplus land or exempt surplus land by formal action at a public meeting.
If real property is declared surplus, the Act requires that a notice of availability be given to local public agencies and to housing sponsors (the “Designated Parties”) calling for written notices of interest. GC § 54222, requires the City, if it declares land it owns to be surplus, to provide written notice thereof to the Designated Parties; the form of such notification is included within Exhibit “B” to the attached Resolution (the “Notification Process”). The Notification Process provides the Designated Parties a 60-day opportunity to request to negotiate for the disposition of the Property consistent with parameters for such negotiations provided by the Act. The Notification Process is not a request for proposals, does not bind the City to any Property disposition and does not supersede the applicable provisions of the Loma Linda Municipal Code.
The Act does not impose any mandates or timeframes with respect to the disposition of real property. In addition to the foregoing, the HCD has certain oversight authority over negotiations with Designated Parties, if any, for the purpose of confirming that such negotiations were conducted within the parameters described in the Act. Failure to follow the procedure described in the Act and expounded upon by the Guidelines for providing a notice of availability of surplus land and related actions, may subject the City to financial and other penalties and measures.
If approved, the attached Resolution will confirm the City’s declaration that the Property is surplus and authorize the initiation of the notification process to local public agencies as prescribed by the Act and to housing sponsors as promulgated by HCD pursuant to the Act and the Guidelines. Staff recommends that the City declare the Property to be surplus and not necessary for the City’s use.
-3-
Pursuant to § 15060 (c) (3) of the California Environmental Quality Act (the “CEQA”) Guidelines (i.e., California Code of Regulations, Title 14, Division 6, Chapter 3, §§ 15000- 15387), approval of the Resolution is exempt from CEQA because the actions described herein will not result in a direct or indirect physical change in the environment and the actions described herein are not a “Project”, as defined within § 15378 of the CEQA Guidelines.
FINANCIAL IMPACT
Potential revenue to help cover previous costs associated with the Property.

WHEREAS, in addition to the foregoing, the HCD has certain oversight authority over negotiations with Designated Parties, if any, for the purpose of confirming that such negotiations were conducted within the parameters described in the Act; and WHEREAS, failure to follow the procedure described in the Act and expounded upon by the Guidelines for providing a notice of availability of surplus land and related actions, may subject the City to financial and other penalties and measures; and WHEREAS, if approved, this Resolution will confirm the City’s declaration that the Property is surplus and authorize the initiation of the notification process to local public agencies as prescribed by the Act and to housing sponsors as promulgated by HCD pursuant to the Act and the Guidelines; and
WHEREAS, consistent with the foregoing, City Staff recommends that the City declare the Property to be surplus and not necessary for the City’s use; and WHEREAS, pursuant to § 15060 (c) (3) of the California Environmental Quality Act (the “CEQA”) Guidelines (i.e., California Code of Regulations, Title 14, Division 6, Chapter 3, §§ 15000-15387), approval of this Resolution is exempt from CEQA because the actions described herein will not result in a direct or indirect physical change in the environment and the actions described herein are not a “Project”, as defined within § 15378 of the CEQA Guidelines; and WHEREAS, all of the prerequisites with respect to the approval of this Resolution have been met.
THEREFORE, BE IT RESOLVED, by the City Council of the City of Loma Linda, as follows:

2. The City hereby declares that the Property is surplus land and not necessary for the City’s use) at this time and authorize the initiation of the Notification Process as prescribed by the Act and as further expounded upon by the Guidelines.
2. This Resolution has been reviewed with respect to the applicability of the California Environmental Quality Act (Public Resources Code § 21000 et seq.) (the “CEQA”). City staff has determined that the designation of the Property as surplus does not have the potential for creating a significant effect on the environment and is therefore exempt from further review under CEQA pursuant to State CEQA Guidelines § 15060(c)(3) because it is not a project as defined by the CEQA Guidelines § 15378. Adoption of the Resolution does not have the potential for resulting in either a direct or indirect physical change in the environment. If and when the Property is sold or leased and that lessee or new owner proposes a use for the Property that requires a discretionary permit and CEQA review, that future use and project will be analyzed at the appropriate time in accordance with CEQA.
4. The City Clerk is directed to file a Notice of Exemption pursuant to CEQA Guidelines § 15062.
