Recommendations
Staff recommends City Council take the following actions:

DETERMINE that the Development Code Amendment is not subject to the requirements of the State of California Environmental Quality Act (“CEQA”) pursuant Sections No. 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines which applies to proposals that are not considered projects as defined in Section No. 15378 of the CEQA Guidelines and proposals that do not result in a significant change to the environment, and;
ADOPT Council Bill #O-2023-03, an Ordinance to update Title 17 (Zoning) of the Loma Linda Municipal Code and establish a reasonable accommodation ordinance in compliance with Federal and State Law that will provide flexibility in the application of the Development Code standards in order to provide individuals with disabilities an equal opportunity to housing (Development Code Amendment No. P23-155).

Background
The Fair Housing Act and the California’s Fair Employment and Housing Act (FEHA) requires local governments to make accommodations for individuals with mental or physical disabilities seeking equal access to housing. Individuals with a disability can request a change, exception, or adjustment to the City’s Development Code standards and other land use regulations, policies, and procedures when such accommodations are considered necessary for a person with disabilities to use and enjoy a dwelling.

On February 8, 2022, the City Council approved and adopted the City of Loma Linda 2021-2029 Housing Element. The Housing Element identifies the housing needs in the City and sets forth strategies and programs to improve housing opportunities. In an effort to meet the housing needs for households of all income levels and persons with special needs, the City has set forth Program 2.2 to adopt a ministerial process for reviewing requests for reasonable accommodation and modest deviations from Development Code requirements needed to address for people with disabilities.

On August 2, 2023, Planning Commission recommended that the City Council approve Development Code Amendment No. 23-155, to amend Title 17 (Zoning) of the Municipal Code to establish a reasonable accommodation ordinance.

Project Description
The City-initiated Development Code Amendment No. P23-155, to amend Title 17 (Zoning) of the Loma Linda Municipal Code to improve housing opportunities. This amendment adds a new section to the Development Code that establishes a new procedure for addressing requests for reasonable accommodations as required by the Fair Housing Act and the California's Fair Employment and Housing Act (FEHA). Requests for reasonable accommodations are proposed to be reviewed through a ministerial process. A reasonable accommodation includes a change, exception, or adjustment to a rule, policy, or procedure when such accommodation may be necessary to afford individuals with disabilities equal housing opportunities.

In addition to creating a streamlined process to prevent discrimination against individuals with disabilities, this proposed amendment to the Development Code will ensure compliance with state and federal mandated laws and assist the City in meeting Program 2.2 of the Housing Element.

Environmental
The Development Code Amendment is not subject to the requirements of the State of California Environmental Quality Act ("CEQA") pursuant Sections No. 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines which applies to proposals that are not considered projects as defined in Section No. 15378 of the CEQA Guidelines and proposals that do not result in physical change in the environment. This proposal meets both of these criteria, and therefore is exempt from the requirements of CEQA. A Notice of Exemption will be filed upon adoption of the Development Code Amendment.

B. Intent. The intent of this chapter is to provide flexibility in the application of the Development Code for individuals with a disability when a modification or exemption of a land use regulation, policy, or procedure is necessary to provide equal opportunity to housing. A reasonable accommodation may be approved only for the benefit of one or more individuals with a disability.

C. Applicability. A reasonable accommodation may be requested by any individual with a disability, their representative, or a developer or provider of housing for individuals with a disability.

17.103.040 Review authority and procedures.

C. While a request for reasonable accommodation is pending, all laws and regulations otherwise applicable to the property that is the subject of the request shall remain in full force and effect.

17.103.050 Reasonable accommodation findings and decision.

B. The following criteria, among other factors, may be considered by the Director of Community Development, or his or her designee, regarding the reasonableness of the requested accommodation:

1. Whether there are alternative reasonable accommodations available that would provide an equivalent level of benefit; and

2. Whether the requested accommodation substantially affects the physical attributes of the property or has impacts on surrounding properties that would fundamentally alter a city program or law.

C. If an application for a reasonable accommodation is approved, the request shall be granted to an individual and shall not run with the land unless it is determined that: (1) the modification is physically integrated into the residential structure and cannot be easily removed or altered to comply with the Development Code, or (2) the accommodation is to be used by another individual with a disability.

17.103.060 Appeals
A. The decision of the Director of Community Development to grant, grant with conditions, or deny a request for reasonable accommodation shall become final.

B. The decision of the director, while final, is subject to a written appeal to the City Manager to be made within thirty days after the decision of the Director is transmitted by first class mail or email. Any appeal shall set forth in reasonable detail and clarity the basis for the appeal and the proposed remedy or actions. The decision of the City Manager is also subject to appeal to the City Council within thirty days after the decision of the City Manager is transmitted by first class mail or email. Workshop: Presentation of the 430-acre property in the South Hills through Reche Canyon City Manager Thaipejr introduced the item and the speakers from Arizona State University (ASU).

Jeff Roberts, Managing Director, explained that the 430-acre property in the South Hills through Reche Canyon was donated to Arizona State University. He noted that they have been working on this project for a few years, summarizing some of the challenges to the development of the property. He noted that ASU prides itself in managing challenging projects and that they want to effectively manage the project they were entrusted.

Mark Stapp, Director, ASU Center for Real Estate Theory & Practice, reiterated the time their staff has been working on a proposed plan. He noted that they are adhering to the regulation of Measure V in Loma Linda; analyzing traffic and utility access; moving forward with the environmental review process; considering the needs of Loma Linda and Colton; investigating the process to annex into the City of Colton and complying with the requirements from LAFCO. He explained that they have had community meetings with the City of Colton and residents in the Reche Canyon area. He stated that they received much feedback, noting that traffic was a major concern. They prepared a conceptual road improvement plan for Reche Canyon to mitigate traffic concerns. He noted that they have a preliminary plan to develop 348 homes on 116 acres of developable land and that the 227 acres of land in the Measure V area would be preserved and not developed. He noted their plan is preliminary and could change following future public and City meetings.

There was discussion regarding a portion of the donation would go to Loma Linda University for scholarship purposes, but ASU was later informed the provision was rescinded.

Mr. Stapp stated that their objective is to proceed responsibly and incorporate the feedback they receive from their meetings with the cities and community members. As far as their objective from the workshop, they want to know that the City of Loma Linda does not object to any project development, City Council Minutes Page 2

but are open to a development project that will benefit the community. There was an expressed consensus for ASU to proceed.

The regular meeting of the City Council was called to order at 7:06 p.m.

The Pledge of Allegiance and invocation were led by Mayor pro tempore Dailey.

Items To Be Added Or Deleted
City Manager Thaipejr stated that the City is requesting to add an item to the Agenda pertaining to Canyon Ranch Annexation project to disestablish the Agricultural Preserve designation that was identified in the project area.

City Attorney Robbins advised that, in order to place the item on the agenda, the City Council must determine the following findings:
 that there is an immediate need to take action on the project; and  that the request came to the attention of staff after the Agenda was posted.

Community Development Director Matarrita explained that the City Council approved the Canyon Ranch Annexation project on May 9, 2023; that the Annexation public hearing is scheduled before LAFCO on August 16, 2023; that the City was informed yesterday by the Executive Director of LAFCO, Sam Martinez, that the Canyon Ranch Annexation project had an Agricultural Preserve (AP) designation on the project map, which is a designation that was on an old county map that should have been removed. In order for LAFCO to review the project at their public hearing, the City Council had to disestablish the AP designation by Resolution before their meeting.

Motion by Rigsby, seconded by Jindal to add the above-noted item as requested to the Agenda based on the two findings that: 1) the Canyon Ranch Annexation project is scheduled for a public hearing with LAFCO on August 16, 2023, which establishes the immediate need to take action; and 2) that the item came to staff’s attention after the City Council Agenda was posted. The City Clerk called roll and the motion carried unanimously.

Oral Reports/Public Participation - Non-Agenda Items (Limited to 30 minutes; 3 minutes allotted for each speaker)
No public participation upon invitation by the Mayor.

Staff recommended the City Council adopt by Resolution the disestablishment of the AP designation from the Canyon Ranch Annexation project.

The public hearing was open and closed with no public participation.

Recommendations
It is recommended that the City Council appropriate $77,000.00 from the Water Enterprise Fund Balance into Account No. 4657010-51300; award a contract for waterline improvements on Campus Street from University Ave. to Shepardson Dr. to MCC Equipment Rentals, Inc. of Yucaipa, CA in the amount of $142,780.00; and authorize a contingency allocation of $14,200.00. City staff will provide inspection and project management.

Background
This project is included in the approved Capital Improvement Program listed in the annual budget. Generally, this is waterline improvements on Campus St. from University Ave. to Shepardson Dr.

Analysis
Six (6) bids were received and publicly opened on September 5, 2023. Bids ranged from a low of $142,780.00 to a high of $311,966.00 (see attached bid summary). The low bidder, MCC Equipment Rentals, Inc., of Yucaipa, CA, has been checked for references and found to be satisfactory. This contractor has performed satisfactorily on similar projects for the City. It is not unusual for a project to change the quantities of work or the scope of work as field conditions dictate. This is generally caused by unforeseen circumstances or work needed to maintain the integrity of the project. Additionally, this is a very favorable bid; therefore, staff recommends an allocation of ±10% of the construction amount ($14,200.00) for a contingency allocation.

Environmental
No environmental impact.

Financial Impact
Appropriate $77,000.00 from Water Enterprise Fund Balance into Account No. 4657010-51300 then funding is available.

Recommendations
It is recommended that the City Council award a contract for $24,077.29 to Tri County Pump Company of San Bernardino, CA, for rehabilitation work and authorize a contingency allocation of $2,400.00.

Background
City staff continually monitors infrastructure for signs of wear and tear. This resulted in the City Manager authorizing an in-depth inspection of Richardson Well No. 5 well pump and motor. Based on the findings, this well motor requires rehabilitation or replacement.

Analysis
Staff requested costs for repairing versus replacing the motor. There is substantially more cost, at this point, to replace versus to rehabilitate the motor. Staff was then directed to obtain quotes for the work. The lowest quote to rehabilitate is $24, 077.29 from Tri County Pump Company of San Bernardino, CA, see attached quote results. The City has worked with this contractor and has been satisfied with the work. It is not unusual for a project to change quantities or the scope of work as field conditions dictate. This is generally caused by unforeseen circumstances or work needed to maintain the integrity of the project. Therefore, the staff recommends an allocation of ±10% of the construction amount ($2,400.00) for a contingency allocation.

RECOMMENDATION:

It is recommended that the City Council approve an agreement between the City of Loma Linda and Lockheed Martin Corporation to place, where space is sufficient, a temporary above-ground water tank (approximately 5,000-gallon upright poly tank) for groundwater purge water and discharge into existing percolation pond at Mountain View Well No. 6 site.

BACKGROUND:

Lockheed Martin Corporation (LMC) owned and operated groundwater treatment facilities on City properties and nearby cities.

This Agreement request would allow LMC to store water from Colton Narrows Wells, Dearborn Well, and other monitoring wells sampling sites to the temporary above-ground water tank to perform analytical testing and discharge the clean water into the adjacent percolation pond at Mountain View Well No. 6 site.

ANALYSIS:

Lockheed Martin Corporation (LMC) has a National Pollutant Discharge Elimination System (NPDES) permit issued by the Santa Ana Regional Water Quality Control Board (RWQCB). This permit allows LMC to discharge water associated with groundwater monitoring activities into the groundwater monitoring program. LMC will consolidate purged water generated from the nearby monitoring well sampling sites into a single tank, perform water analytical testing, and discharge the clean water into the existing percolation pond at the Mountain View Well No. 6 well site for groundwater recharge. LMC will submit monthly NPDES reports to the RWQCB, in accordance with the permit requirements. The proposed tank and discharge plan will not affect the City of Loma Linda's existing National Pollutant Discharge Elimination System (NPDES).

Purged water will not be discharged to the percolation pond if the analytical results exceed the Maximum Containment Level (MCL). Purged water exceeding the MCL shall be removed from the property, and LMC shall bear the expense of such removal.

The Agreement has been reviewed by the City Attorney and City staff.

RECOMMENDATION
Staff recommends the City Council take the following actions:

1. APPROVE the amendment to the Agreement with Planning PLUS/P+ Consulting Services to increase the contract amount to a not-to-exceed total of $3,000 for additional review of a project application within Planning Area 3-3 of The Groves at Loma Linda Specific Plan.

2. APPROVE the use of funds to be deposited in the amount of $3,000 as a pass through fee to be paid for by the applicant to cover the costs of the contract planning services.

BACKGROUND
On October 11, 2022, City Council approved an agreement with Planning PLUS/P+ Consulting Services to review a submitted a Preliminary Development Review Application (PRD No. P22-204) for a future mixed-use project that would include commercial and high-density residential on a parcel south of Redlands Boulevard and east of Bryn Mawr Avenue. The parcel is also known as Planning Area 3-3 of The Groves at Loma Linda Specific Plan.

On March 9, 2023, the applicant of the proposed development submitted a revised concept site plan that reflected changes in response to the City’s detailed comments. A 2 Change Order by Planning PLUS was submitted for the additional review in the amount of $3000. That review focused on both the development rights transfer process and the conceptual plan design to ensure consistency with policies and development standards within the Groves at Loma Linda Specific Plan.

In September 2023, the applicant submitted another conceptual plan and requested the Consultant do another round of review. On September 6, 2023, Planning PLUS submitted a 3 Change Order for the same amount. This work will include the review of the developer’s proposed refinements to its concept plan. These efforts will be a continuation of the review process completed for the 1 and 2 round of review, but with a focus on the specific outstanding issues. Planning PLUS will address affordable housing, residential density, transfer development rights, mixed-use development requirements and implementation of special district features. See attached revised Scope of Work for details.

Approving the amendment to the agreement of services would authorize the City to deposit an additional $3,000 in a pass through account, paid by the applicant, to cover the costs of the contract planning services.

FINANCIAL IMPACT
The agreement with Planning PLUS to prepare and process the project application will not result in any financial impacts to the City. The associated costs will be borne by the project applicant, as indicated by the request to use funds deposited by the applicant as a pass through amount. nd

HIGHPOINTE MIXED USED DEVELOPMENT & DEVELOPMENT RIGHTS TRANSFER RELATED TO THE GROVES SPECIFIC PLAN, PLANNING AREA 3-3 (PA 3-3) PLANNING PLUS / P+ CONSULTING SERVICES
SCOPE OF WORK AND COST ESTIMATE - 9/20/22 – AMENDMENT No. 2 - 9/6/23 Project Understanding and Contract Objectives
In 2012, the City of Loma Linda (“City”) processed a General Plan Amendment that opened the door for incremental planning and processing of development programs within the +300-acre area of Special Planning Area “D”, located within the northeast portion of the city. On June 26, 2018, the Loma Linda City Council adopted The Groves Specific Plan, which establishes specific requirements and development standards for designated planning areas.

The City has been contacted by Highpointe Communities (“Highpointe”) regarding proposed development plans for PA 3-3, a 19.4-acre planning area within The Groves Specific Plan. Related to its proposed development, Highpointe has inquired as to the process and potential approval to allow transfer of residential development rights between PA 2-5 (the sending property) and PA 3-3 (the receiving property). Further, Highpointe seeks guidance on the required development standards in light of such a transfer, as well as guidance on the overall the requirements for PA 3-3, including those aspects required for implementation of special districts (i.e., Oak Woodland and Main Street).

Since 2012, Planning PLUS/P+ (“P+) has periodically assisted the City with efforts to streamline and formalize development requirements that would ensure build-out of SPA-D is accomplished in a coordinated and thoughtful manner consistent with the intent of the Implementing Policies of the Loma Linda General Plan, and now The Groves Specific Plan. It is the City’s desire that any and all development related to PA 3-3 be coordinated and implemented consistent with The Groves Specific Plan.

P+ is uniquely qualified to assist the City with project review for mixed-use development and residential development rights transfer proposed by Highpoint for PA 3-3. Based on discussion with City staff, the following scope of work addresses a staff-level supporting role through the application process, with a focus on assisting with facilitating the preliminary conceptual review and outlining guidance for the complete project review and review process. The scope is divided into two parts, phase one for the Pre-Application process and phase two for the formal Application.

Phase One – Preliminary Review
Preliminary Application & Design Review
Task 1.1 – Round One Review
Task Description: Highpointe has been encouraged to utilize the City’s Pre-Application process as means of gaining valued feedback on a conceptual design prior to investing resources into detailed building-level plans or contractual commitments related to transfer of development rights.

Working in concert with the City’s Community Development Director, P+ will: 1) coordinate with Applicant (i.e., Highpointe) regarding the pre-application materials and a preliminary processing and review schedule; 2) circulate materials to City departments and facilitate City review of conceptual plans for compliance with applicable policies, regulations and development standards; 3) identify and clarify information needs required for the subsequent formal application process; 4) coordinate with City staff and Applicant to ensure the permit strategy aligns with mutual objectives; and 5) identify preliminary conditions of approval as those might relate to transfer rights, phasing, sequencing and infrastructure staging. The Pre-Application review will focus predominantly on both the development rights transfer process and the conceptual site plan design to ensure consistency with policies and development standards for the adopted The Groves Specific Plan. Consistency review will emphasize development rights, mixed-use development requirements and implementation of special district features (i.e., as for the Oak Woodlands and Main Street districts). Concurrent with this phase, P+ will

also review the City’s Specific Plan monitoring and reporting systems and accommodate refinements for tracking the proposed Highpointe development project.

Expected within this task is up to two meetings (i.e., one meeting for an informal review and introduction to the project and a second more formal meeting to review recommendations and conceptual plan) with the Applicant/City Review Team. P+ will prepare written comments to document the City’s recommendation for the Applicant and to serve as a guideline of expectations for the subsequent PPD application process. P+ will have on-going coordination with the Community Development Director.

Assumptions: This task assumes that pre-application review is limited to two rounds of concept review expected to include an initial discussion/review directing Applicant on applicable policies, guidelines and permitted uses and a subsequent follow-up meeting to critique conceptual plans submitted in compliance with preliminary development review.

Budget Estimate: 20 hrs $ 3,000
Task 1.2 – Second Round Review
Task Description: On March 9, 2023, Highpointe submitted a revised Concept Site Plan and Site Plan Information that reflects changes in response to the City’s detailed comments (dated January 23, 2023) addressing Highpointe’s PA 3.3 Concept Site Plan submittal of September 29, 2022.

As with the initial submittal and working in concert with the City’s Community Development Director, P+ will: 1) coordinate with Highpointe regarding the revised concept plan materials; 2) circulate materials to City departments and facilitate City review of conceptual plans for compliance with applicable policies, regulations and development standards; 3) identify and clarify information needs required for the subsequent formal application process; 4) coordinate with City staff and Applicant to ensure the permit strategy aligns with mutual objectives; and 5) identify preliminary conditions of approval as appropriate related to key issues including transfer rights, phasing, sequencing and infrastructure staging. This review will carryforward the focus on both the development rights transfer process and the conceptual site plan design to ensure consistency with policies and development standards for the adopted The Groves Specific Plan. Consistency review will emphasize development rights, mixed-use development requirements and implementation of special district features.

Expected within this task is up to two meetings with the Applicant/City Review Team. P+ will prepare written comments to document the City’s recommendation for the Applicant and to serve as a guideline of expectations for the subsequent PPD application process. P+ will have on-going coordination with the Community Development Director.

Assumptions: This task assumes one additional round of substantive review, with review of minor refinements included within the parameters of the allocated budget.

Budget Estimate: 20 hrs $ 3,000
Task 1.3 – Third Round/Ongoing Review
Task Description: On August 17, 2023, P+ attended a meeting, along with the City, with the Highpointe team to discuss issues related to the City’s Comment Letter, dated June 7, 2023. Pursuant to matters discussed, Highpointe proposed to make additional revisions to its concept plans and requested opportunity to submit components individually for City comments prior to its completing a fully revised Site Plan (or formal application). For example, Highpointe proposed providing alternative layouts for the Main Street/commercial component for preliminary City feedback. Additionally, Highpointe hoped to propose alternative housing calculations for options that incorporated affordable or special needs population housing.

Page 3 ends

To facilitate review of Highpointe’s proposed refinements to its Concept Plan, P+ will continue to work in concert with the City’s Community Development Director to: 1) coordinate with Highpointe regarding the proposed refinements to plan components and/or complete revised concept plan materials; 2) circulate materials to City departments, as appropriate, and facilitate City review of plan components and/or conceptual plans for compliance with applicable policies, regulations and development standards; 3) identify and clarify information needs required for to facilitate a future formal application submittal; 4) coordinate with City staff and Applicant to ensure the permit strategy aligns with mutual objectives; and 5) identify preliminary conditions of approval as appropriate related to key issues including transfer rights, phasing, sequencing and infrastructure staging.

These efforts will be a continuation of the coordination and review process completed for the first and second round of reviews but expected to be more focused on the specific outstanding issues and refinements necessary to address those, specifically for issues including, but not limited to, affordable housing; residential density; transfer development rights, mixed-use development requirements and implementation of special district features.

A pool of up to 20 hours will be allocated to this task to cover coordination, review and meetings as needed. The nature of this review is expected to be less formal and less extensive than previous rounds of review. Detailed written comments are not anticipated. Rather, focused review will determine whether plan refinements are consistent and on-track with the goals, objectives and policies of The Groves Specific Plan and the City’s Housing Element.

Assumptions: An allocation of up to 20 hours to be applied as needed.

Budget Estimate: 20 hrs $ 3,000
Phase Two – Application Processing
Application Review and Processing
Task Description: Continuing in a support role to and working through the City’s Community Development Director (or planner designee) P+ will: 1) coordinate with Applicant on application materials and review preliminary processing schedule; 2) assist and/or facilitate City staff’s review of application materials for completeness; 3) evaluate the project design in a limited capacity The Groves Specific Plan implementing policies and development standards with focus limited to aspects of development transfer rights and mixed-use development requirements, consistency with special district requirements (i.e., Oak Woodland and Main Street districts); 4) coordinate with the Community Development Director on findings required to support Planned Development Permit, Precise Plan, Specific Plan/General Plan consistency, etc. including CEQA determination; 5) assist the Community Development Director with finalizing conditions of approval specific to development rights and mixeduse requirements, sequencing, phasing and infrastructure staging; and 6) provide guidance and peer review of Planning Commission staff report and resolutions to be prepared by Community Development Director.

Assumptions: This task includes the following assumptions: 1) application review is limited to up to one round of completeness review; 2) one meeting with Applicant and/or City Departments, as determined by the Community Development Director; and 3) within a pool of up to 8 hours to be used as needed or assigned in a supporting role to the Community Development Director. It is assumed that the phase two task is limited to assistance with validating the residential development rights and confirmation of key site plan features uniquely required for PA 3-3. If the City desires planning services support beyond that level, then an expanded scope of work would be required. Further, this task assumes that any needed GIS and graphics support will be provided by City. Because commercial uses at the site were previously considered through a CEQA review process, no additional environmental review (aside from an environmental determination or finding of exemption) is assumed under this scope.

Budget Estimate: 12 hrs $ 1,800
