RECOMMENDATION:

It is recommended that the City Council approve the proposed Public Service Projects and Construction Improvement projects and fund allocations for the FY 2024-2025 CDBG program as follows:

Public Service Projects:

San Bernardino County Library $ 10,000
Public Service Activities Total $ 10,000
City Projects:

Replace Access Ramps and Sidewalks Citywide $ 131,000
FY 2024-2025 Allocation Total $ 141,000
BACKGROUND:

The County of San Bernardino, which administers the local CDBG Program, calculated the estimated allocation. The calculation includes the Census poverty and overcrowded housing counts in addition to the population estimates. The County has submitted a list of public service projects (see attached), which identify benefits to the City. The City has been tasked with much of the administrative duties previously handled by the County.

Public service projects must be adequately funded to provide a new service or a quantifiable increase in the present level of service. One project is recommended for funding and has been approved by the County. This same project has received City support in the past.

ANALYSIS:

Public Service Projects:

One (1) public service project proposal was screened by the San Bernardino County Economic Development Agency and forwarded to the City for consideration. The San Bernardino County Library, Loma Linda Branch, will be one of the recommended beneficiaries of this grant.

Construction Improvement Projects:

Citywide access ramps and sidewalks replacement is proposed as the public construction improvement projects.

RECOMMENDATION:

It is recommended that the City Council: Receive the report of the Fall 2023 Weed Abatement Program, approve the report and accounting of costs, and adopt Council Bill #R-2024-03 establishing liens and assessments on the properties.

BACKGROUND:

The California Fire Code, 2022 edition, Section 304, adopted and amended by Loma Linda Municipal Code, Chapter 15.28, establishes the authority for removing combustible vegetation when it is determined to be a fire hazard. Section 304.1.2 states "Weeds, litter, flammable waste, grass or other vegetation capable of being ignited and endangering property shall be cut down and removed by the owner or occupant of the premises." Vegetation clearance requirements in the wildlandurban interface areas shall be in accordance with Chapter 49.

ANALYSIS:

The Fall 2023 Weed Abatement program began on September 20th – 22nd, 2023 with an initial inspection of approximately 300 parcels. According to Sections 104.5 of the International Fire Code, 158 Notices to Clean Property, Exhibit "A", were sent by regular mail on Oct 2nd, 2023 to the OWNER OF RECORD as provided by the County Assessor's office. 2 letters were returned to sender. Returned notices were posted on the physical properties for the owner of the record to see.

Updated property owner information by checking current records on hand with the assessor’s office. If any changes for the property owner occurred a notice was generated manually, sent to the corrected address by certified mail, and the parcel was added to the extension list. Follow-up inspections began on November 2nd – 3rd. If abatement had not been accomplished, or if arrangements for a time extension had not been made with this office, the parcel was placed on an abatement list which was given to a City contractor for initiation of the abatement work. Combustible vegetation/fire hazards were abated by the City contractor on 7 parcels.

On January 3, 2024 invoices (See Exhibit "B") specifying the cost of the work performed by the contractor, plus the City's administrative fee, were mailed to the OWNER OF RECORD for each parcel allowing them to make payment of the bill by February 13th, 2024. Parcels abated by the City contractor and which remain unpaid are listed on Exhibit "C". Upon completion and documentation of the abatement work payment was made to the contractor by the City.

Owners have the opportunity to appear at the hearing to ask questions or dispute any bills or proceedings.

RECOMMENDATION
INTRODUCE, WAIVE FIRST READING, AND SET SECOND READING for Council Bill#O-2024-01, an Ordinance to amend Title 17 (Zoning) of the Loma Linda Municipal Code by adding Chapter 120 pertaining to streamlined housing development projects on housing element sites to identify applicable sites, establish requirements and standards for lower-income target units, and establish procedures and requirements for the ministerial review and approval of housing development projects with lower-income target units (Development Code Amendment No. P23-222).

BACKGROUND
The City of Loma Linda’s Development Code regulates development within the City to serve the public health, safety, and general welfare and to provide the economic and social advantages resulting from an orderly planned use of land resources.

On February 8, 2022, the City Council adopted Resolution No. 3126 to repeal the Loma Linda General Plan 2014-2021 Housing Element and replace it in its entirety with the 2021-2029 Housing Element (“sixth cycle” housing element) (General Plan Amendment No. P20-109). Program 1.1 of the Housing Plan of the 2021-2029 Housing Element addresses adequate housing sites and includes an action to amend the Development Code to allow residential developments in which at least 20 percent of the housing units are affordable to lower-income households (“targeted income” units) by right and not subject to any discretionary review.

On October 5, 2023, staff of the State Housing and Community Development Department (HCD), informed the City that it would need to complete the Development Code Amendment identified in the Program 1.1 action item to apply to housing sites “re-used” from past housing element cycles in order for HCD to find the City in full compliance with State housing element law. Government Code Sections 65583.2(c) and 65583.2(i) require that housing development projects be approved as by-right uses if at least 20 percent of the units are affordable to households at or below the lower-income level on “re-used” sites. The Government Code defines “re-used” sites as those identified in the housing element as suitable for residential development to meet the sixth cycle Regional Housing Needs Assessment (RHNA) that are non-vacant and that were also identified as suitable sites in the fifth cycle housing element, and vacant sites that were also identified as suitable sites in the fourth and fifth planning cycles.

The proposed ordinance (Attachment A) was presented to the Planning Commission on January 3, 2024. During the discussion, members expressed concerns about the erosion of local control and the potential ramifications of state-driven decisions for cities.

Following deliberations, the Commission recommended approval to the City Council, with a 2-1 vote in support of the proposal.

ANALYSIS
The City-initiated Development Code Amendment No. P23-222 adds Chapter 120 to Title 17 (Zoning) of the Loma Linda Municipal Code. The provisions of Chapter 120 are detailed in Exhibit A of the Ordinance for Council Bill #O-2024-01 (Attachment A). The Development Code Amendment will enable the City to meet the HCD requirement to provide a streamlined ministerial (“by-right”) review process for housing developments providing a minimum 20 percent of the total units as target income units on sites that have been re-used in prior housing element cycles. Target income units are lower-income, low-income, and very low-income household units. The specific sites identified in the housing element that would qualify for the streamlined ministerial process, providing they include the required target income units, are identified in the 2021-2029 Housing Element on the HCD Site Inventory Forms Table A, and are listed in Attachment B. Of the 186 sites included in the Housing Element, 162 would qualify under the Development Code Amendment. The 162 sites consist of 72 zoned for single-family residential use and 90 zoned for multi-family residential use (I-HC, P-C and R-3 zones). Attachment B identifies the 162 sites, with an emphasis on the 90 sites designated for multi-family residential use, clearly distinguished by grey color highlighting.

The sites zoned for single-family residential use likely would not be developed through the by-right process for income-qualifying units per the Development Code Amendment since sites zoned for single-family residential use typically support only a single unit. The provisions would only be applicable where the applicant proposes to deed restrict the unit for affordable housing or in instances when an accessory dwelling unit (ADU) or urban lot split unit (Government Code §§ 65852.21 et seq.) is proposed as an income-qualifying unit. However, under California law, ADUs and urban lot split units are already subject to a ministerial approval process. Therefore, the application of the Development Code Amendment within single-family zones is anticipated to be very limited.

In zones that allow multi-family residential uses, applicable housing development project applications would be subject to design review for compliance with the objective design standards of Chapter 17.115 (Objective Design Standards), which pertain to multifamily residential development and mixed-use development with a residential component. These provisions require review of a Precise Plan of Design by the Community Development Director. If the Director finds that the application complies with Chapter 17.115, the project would be approved ministerially (without public hearing). However, if the housing development project application involves a subdivision of land, it would need to comply with Title 16 (Subdivisions) and would be subject to discretionary (not by-right) review and procedures. The projects would be subject to all development standards and regulations of the applicable zoning district and other applicable provisions of Title 17, and with all applicable regulations of Title 15 (Buildings and Construction).

The Development Code Amendment contains standards for the design, location, and phasing of the target household income units to ensure: 1) they are distributed throughout the project and among the market-rate units, 2) are constructed at the same time as the market-rate units, and 3) have similar features and appearance as the market-rate units. The target household income units are required to remain affordable for at least 45 years for owner-occupied units and 55 years for renter-occupied units. A housing agreement would be required between the City and the developer that includes the terms and provisions for providing and maintaining the target household income units. The agreement would be recorded against the property.

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) STATUS
The Land Use Development Code (Development Code) Amendment is not subject to the requirements of the State of California Environmental Quality Act (“CEQA”) pursuant to Section 15061(b)(3) of the CEQA Guidelines where CEQA only applies to projects that have the potential for causing a significant effect on the environment, and there is no possibility that the proposed Development Code Amendment may have a significant effect on the environment.

FISCAL IMPACT
There is no fiscal impact related to this text amendment.

PUBLIC NOTICING
The public notice for this project was duly posted on February 1, 2024, in “The Sun” newspaper, as well as in three public places (City Hall, library, post office) as required by State law. Additionally, the notice was made available on the City’s website.

17.120.040 Review, Permits and Approval.

A. Ministerial Approval and Design Review. Housing development projects that qualify under Section 17.120.20 and are consistent with the provisions of this Chapter shall be reviewed, permitted, and approved by the city as by-right uses and as ministerial actions, including design review, in accordance with Chapter 17.115 (Objective Design Standards), except that a housing development project with the required lower-income units that requires a subdivision action to establish a legal building site for such development shall comply with all applicable requirements of Title 16 (Subdivisions) and be subject to a discretionary review process and the application types, reviews, and procedures as outlined in Chapter 17.30 (Administration), unless otherwise exempted by state law. When an applicant elects to deviate from the objective design standards set forth in Chapter 17.11.115, a ministerial review process shall not apply and the development application shall be subject to any required discretionary application types, review and approvals as set forth in Chapter 17.30 (Administration).

B. Zoning Development Standards and Building Standards. Notwithstanding Section

17.120.040(A), all housing development projects pursuant to this Chapter shall comply with all development standards and regulations of the applicable zoning district and other applicable provisions of Title 17 (Zoning), and with all applicable regulations of Title 15 (Buildings and Construction).

C. California Environmental Quality Act. All housing development projects pursuant to this Chapter, and that are in conformance with the provisions of this Chapter, that qualify for a ministerial review process shall be considered exempt from the California Environmental Quality Act (CEQA). This exemption does not preclude a determination by the city that certain technical reports are required as part of the standard submittal checklist established by the Community Development Director, or as required through the imposition of standard conditions of approval. Any required technical reports shall conform to city requirements established for such reports. Projects that do not qualify for a ministerial review process shall be reviewed in compliance with the applicable CEQA guidelines for discretionary application types.
3 D. Building Permit. All housing development projects pursuant to this Chapter, and that are in conformance with the provisions of this Chapter, shall require a building permit, subject to all the standard application, review and processing fees and procedures that apply to building permits generally.

17.120.050 Targeted Income Unit Requirements and Standards.

The targeted income units that represent at least twenty (20) percent of the total units of the housing development project must be constructed on the same site as the housing development project and must conform to the following standards.

A. The units shall remain restricted and affordable to the designated income group for a period of at least forty-five (45) years for owner-occupied units and at least fifty-five (55) years for renter-occupied units.

B. The units shall have the same exterior appearance and quality of construction as that of market-rate units in the same housing development project.

C. The units shall have the same amenities as the market-rate units in the same housing development project, including the same access to and enjoyment of common open space, parking, storage, and other facilities in the development.

D. The unit mix based on bedroom count shall be proportional to the unit mix based on bedroom count provided for the market-rate units in the same housing development project.

E. The units shall be dispersed throughout the housing development project, on each floor and section of the building(s) and throughout the site such that:

1. No more than fifty (50) percent of the proposed lower-income units are consolidated into one structure in developments with more than one multi-unit structure; and

2. No more than twenty (20) percent of the proposed lower-income units in a single multiunit structure are located adjacent to each other or stacked on consecutive floors unless it is unavoidable due to the required unit mix and distribution.

F. All targeted units shall be made available for occupancy concurrently with the market-rate units of the housing development project as follows:

1. In ownership projects, the city may not issue building permits for more than fifty (50) percent of the market-rate units until it has issued building permits for all of the targeted income units, and the city may not approve any final inspections or certificates of occupancy for more than seventy-five (75) percent of the market-rate units until it has issued final inspections or certificates of occupancy for all of the targeted income units.

2. In rental projects, the city may not issue building permits for more than fifty (50) percent of the market-rate buildings until it has issued building permits for all buildings containing targeted income units, and the city may not approve any final inspections or certificates of occupancy for more than seventy-five (75) percent of the market-rate buildings until it has issued final inspections or certificates of occupancy for all of the buildings containing targeted income units.
4 3. In the event the city approves a phased project, the targeted income units shall be provided proportionally within each phase of the housing development project.

17.120.070 Housing Agreement.

A housing agreement that includes provisions and terms for meeting the requirements of this Chapter shall be approved by the Community Development Director and recorded as a restriction (agreement) against the property prior to issuance of a certificate of occupancy for the housing development project. The restriction (agreement) shall be completed by the developer on a form acceptable to the City Attorney and submitted with an application for the housing development project.

17.120.80 Continued Affordability.

A. All units restricted to a designated targeted income group (namely, extremely low-income, very low-income, or lower-income) shall remain affordable to the targeted income group for a period of at least forty-five (45) years for owner-occupied units and at least fifty-five (55) years for renter-occupied units.

B. The occupancy of the targeted income units shall be governed by the terms of the housing agreement recorded as a restriction (agreement) recorded against the property, which shall establish, at a minimum, the following:

1. Any eligible household that occupies a unit at a targeted income level (namely, extremely low-income, very low-income or lower-income) must occupy that unit as its principal residence unless otherwise approved in writing for rental to a third-party eligible household 5 for a limited period due to household hardship, as may be specified in the housing agreement.

2. No household may begin occupancy of a targeted income unit until the household as been determined to be eligible to occupy that unit by the Director or designee.

17.120.090 Administration and Monitoring.

A. The City Council, by resolution, may from time to time establish fees for the ongoing administration and monitoring of the targeted income units, which fees may be updated periodically, as required.

B. The City Council, by resolution, may from time to time adopt procedures for implementing this Chapter, including documents that establish standards for determining household income, affordable rent and/or affordable housing cost, provisions for continued monitoring of tenant eligibility, and other eligibility criteria, and enforcement.

RECOMMENDATION:

Staff recommends that City Council approve the net decrease to revenues of $553,200 and net increase to appropriations of $1,308,700, as presented and summarized by funds in Attachments II and III, respectively.

BACKGROUND:

On June 27, 2023, the City Council adopted City budget of $54,055,800, with a general fund budget of $25,209,100. The general fund was projected to yield a positive position change of $146,400 to un-assigned fund balance. Throughout the fiscal year staff has proposed and Council has approved several budget amendments increasing the appropriation spending for the City by $4,165,422 and $928,400 for the general fund. For the 2023-2024 fiscal year mid-year review, the City Manager asked department heads to assess their departmental expenditures for any changes necessary and for Finance department to revise revenue projections. The changes proposed are presented in the summary of changes in revenues and expenditures for the general fund, enterprise funds, special revenue funds and capital projects funds. If adopted, the proposed mid-year and previously adopted changes will net a negative position decrease of $490,200 to the general fundunassigned fund balance.

ANALYSIS:

For analysis purposes, a summary of changes in revenues, expenditures and fund balance by fund is provided - see attachments I-III. The "Budget Summary of Available Revenues and Other Resources, and Expenditures and Uses of Budget Resources" - attachment I illustrates the overall projected mid-year budget impact. Changes to line item revenues are presented in Attachment II and detailed changes to line item expenditures are presented in Attachment III. Some of the major increases in the general fund revenues are the net result of increases in property tax, franchise tax, sales tax, refuse collection service charges, interest revenue and overhead allocation. Decreases in revenue can also be seen in transient occupancy tax, building activity service charges (fire permits, plan checks and inspections, engineering plan checks), facilities rental, credit card processing fee and transfers in. Major expenditure increases requested include - overtime for fire services provided while on Strike team as well as workers comp coverage; refuse contract; sewer pass thru fees; salary recalculations and adjustments based on position vacancies and retirements; utilities; repair and maintenance costs; and Attachments

Attachment III - Expenditure Requests
information technology costs across several departments. Decreases in expenditures include the recalculation of salaries and benefits based on personnel changes (retirements leaving positions vacant or filled at lower steps).

Based on current revenue projections staff is proposing revenue increase of $483,500 in sewer, $4,700 in LLCCP, and $113,900 in water. Sewer expenses are being increased by $28,200 mainly due to pass-thru fees. LLCCP expenses are being increased by $48,500 due to additional staffing. Water expenses are being increased by $95,500 due to recalculation of overhead based on revised budgeted expenditures. Additionally, staff is proposing across the board net revenue decrease of $2,628,700 in capital projects funds, special revenue, grant funds, special district funds and housing authority primarily due to the timing of development activity. Net decrease in these fund expenditures of $45,100 include increased costs in the Landscape and Streetlight Districts offset by reduction in Capital Funds.

All changes to available cash balances, proposed revenues, and proposed expenditures are reflected in the "Summary of Available Revenues and Other Resources, and Expenditures and Uses of Budget Resources" (attachment I), hence illustrating the overall impact on the 2023-2024 budget.

Peter Dangermond expressed gratitude to the City Council for the opportunity to speak and provide an update on the proposed development plans for the Adobe property, emphasizing their commitment to incorporate the property's rich 200-year history into the project. He briefly discussed design plans and site amenities that would include an area for small group events, a fish pond, a garden, a picnic area, an educational area for visitors, and a mural of the Zanja on one of the buildings. He discussed the landscape plans and the irrigation system. He noted they would need to raise funds and recruit volunteers to accomplish the project. He pointed out that Jacinto volunteered to do grading and construction work; that the Dangermond Family will donate plant material; that Supervisory Rowe donated funds to the project and that the City and Lennar Homes have provided assistance with property security. Finally, he noted that they would like to host a community event for the neighboring community in the historic district to keep them informed and involved.

Joe Frink thanked staff for keeping him informed and including him in meetings, where he discovered much information on restoration. When appropriate, he would like to work with City staff on the connection of non-potable water. He asked for the City's help to coordinate the community event. He pointed out that Lennar Homes was irrigating and maintaining the existing orange trees. He asked if he could do minor maintenance work on-site, such as painting the bark and fertilizing the trees. He noted it will be a beautiful project. He asked if the City could schedule a Historic Meeting in February.

Mr. Oza commented on the challenges he has had getting in touch with his local elected representatives. He noted that a nearby city holds monthly coffee meetings with a Council member. He noted that he was pleased to hear the Senior Center is now serving hot lunches, but does not think the City has done enough to add programs and activities to the Senior Center. He stated that Redlands Senior Center provides more activities. He noted some volunteer instructors for Redlands have told him they would hold classes in Loma Linda. He submitted a petition for the record, which the petition is a request for the City to provide more resources, activities, and services for seniors, veterans, and disabled individuals in the community.

2. Scheduled and Related Items
2A. Joint meeting of the City Council and Housing Authority regarding presentation of Annual Comprehensive Financial Report for FY 2022/2023- 7:29 PM Mayor Dupper Called to Order the Housing Authority meeting for discussion of this item.

Finance Director Sonia Fabela introduced Brad Welebir and Veronica Hernandez from Rogers, Anderson, Malody & Scott, LLP (RAMS), who will present the Annual Financial Statement, and Anna Briones, Financial Analyst, who will present the financial data.

Brad Welebir, Rogers, Anderson, Malody & Scott, LLP (RAMS), stated that they provided a summary of the Annual Audit to the Finance Staff and Audit Committee before the City Council meeting and that Ms. Hernandez will summarize and present the results of the Annual Audit for Fiscal Year ending June 30, 2023.

Ms. Veronica Hernandez presented the report summarizing the responsibilities of the City: 1) Present the City's financial position and results of its operations fairly and in conformity with generally accepted accounting principles; 2) Adopt sound accounting policies; 3) Provide reasonable accounting estimates; 4) Establish and maintain internal controls; and 5) Prevent and detect fraud.

She outlined the responsibilities of RAMS: 1) Obtain reasonable assurance that the financial statements are free of material misstatements; 2) Examine, on a test basis, evidence supporting amounts and disclosures; 3) Assess accounting principles used, estimates made, and evaluate the overall financial statement presentation; 4) Review the City's internal control policies and procedures; and 5) Express an opinion on the City's financial statements.

She noted that their Opinion was 1) The Financial Statements were fairly presented in all material respects; 2)The significant accounting policies had been consistently applied; 3)The estimates were reasonable; and 4) The disclosures were properly reflected in the financial statements.

She concluded by outlining Other Key Points: 1) No disagreement with management; 2) No material errors or irregularities were discovered; 3) No significant accounting issues were discovered; and 4) No internal control findings.

Mr. Welebir thanked Ms. Fabela and her team for the significant amount of time and effort spent in this process, including implementing the Council's directives and following policies throughout the year. He noted that the City is receiving the unmodified opinion on the financial statements, which is the highest level of assurance they can offer, and no findings they can report. He congratulated Ms. Fabela and her team for their excellent work.

Anna Briones, Financial Analyst, presented the Annual Comprehensive Financial Report (ACFR) for Fiscal Year ending June 30, 2023, briefly describing the three main sections of the report: 1) Introductory; 2) Financial, and 3) Statistical (Unaudited). She explained the Financial Statements include: 1) The City; 2) the Loma Linda Housing Authority (Special Revenue Fund); and the Successor Agency (Private Purpose Trust Fund). She noted there are two presentations, the first being Government-Wide Statements that are presented using the full accrual basis of accounting and reporting the City as a whole, and, the second, is the Fund's Financial Statement of the Governmental funds that is based on the modified accrual basis of accounting and reporting the most significant funds.

She summarized the Statement of Activities of the City's Financial Results, for the year-end as follows:

Government-Wide Financial Statement, including the Housing Authority, with calculations of the Beginning Net Position, the Net Change in Position, and the Net Position at Year End totaled $131,392,829 (Governmental Activities); $31,705,403 (Business-Type Activities) with a total of $163,098,232.

Government-Wide Financial Statements for Net Investments in Capital Assets with calculations of Restricted and Unrestricted to June 30, 2023, totaled $131,392,829 (Governmental) and $31,705,403 (Business-Type).

Government-Wide Financial Statements, Statement of Activities with calculations of the Total Cost of City Services, Net Program Revenues for Governmental Actitivies and Business-Type Activities for 2023 totaled ($10,966,274), General Revenues totaled $17,409,684, resulting in a Change in Net Position of $6,443,410.

That concluded her presentation. Financial Analyst Briones thanked everyone for their assistance in the preparation of the 2023 ACFR.

Fund Financial Statements for General Fund-Fund Balance - with calculations of NonSpendable, Restricted, Committee, Assigned, and Unassigned for 2023 totaled $19,329,610.

General Fund-Statment of Revenues, Expenditures, and Change in Fund Balance with the calculation of Revenues, Expenditures, and Other Financing Sources with the Results of Operation totaled $2,317,341 with the Begining Fund Balance totaled $17,012,269 and with an Ending Fund Balance for 2023 totaled $19,329,610. A brief discussion ensued regarding the American Rescue Plan Act (ARPA) Federal funds, totaling around $2.9 million for each Fiscal Year in 2022 and 2023. The funds, allocated as recovery funds from the COVID-19 public health emergency, were used for Fire Safety services. It was noted that FY 2023 marks the final year the City will receive those funds.

Fund Financial Statements - General Fund-Budgetary Comparisons with calculations of the Budgeted Amount of Revenues, Expenditures, and Other Financing Sources (Uses) for Revenues Over (Under) Expenditures for the Oringal Budget totaled $1,916,700, for the Final Budget Amount totaled $1,376,800, for the Actual Amounts totaled $2,317,341, and for the Variance with Final Budget totaled $940,541.

Statement of Net Position for the Proprietary Funds - Summary Change in Net Position by Business-Type Activities with calculations of Water Acquisition, Water Enterprise, Sewer Capital, and Loma Linda Connected Communities Program (LLCCP) in 2023 for a Change in Net Position totaled (84,759). Discussion ensued regarding the LLCCP deficit. City Manager Thaipejr stated that there is an ongoing discussion with the Finance staff and the City Attorney to strategize an exit plan from LLCCP due to the unsustainable deficit. He noted the difficulties of competing with larger internet companies.

Statement of Fiduciary Net Position for the Successor Agency for 2023 with calculations of Assets, Liabilities, and Deferred Inflow of Resources for 2023 totaled ($1,279,862).

Statement of Changes in Fiduciary Net Position for the Successor Agency with calculations of Additions and Deductions for the Change in Net Position for 2023 totaled $4,488,549, for the beginning of the year for 2023 totaled ($5,768,411), and at the end of the year for 2023 totaled ($1,279,862).

In response to Councilman Jindal's inquiry about the programs and activities necessitating support of the General Fund, it was noted that the Landscape Maintenance District (LMD) was one program that relies on General Fund subsidies. This is attributed to the fact that the assessment fees for maintenance and operations in several annexations were set never to increase, leading to the program being subsidized by the General Fund. To change that would have to go to the vote of the people, which probably would not pass. Finance Director Fabela pointed out that pages 19-20 of the ACFR provide in detail the list of activities that are subsidized by the General Fund. She noted that the report also provides how the program revenues received offset expenses. She concluded, stating that historically the program revenues received would hardly ever cover all of the expenses combined in the City.

Mayor Dupper discussed his experience sitting through numerous meetings with the Auditors.

He was surprised to learn that the Auditors review all the City Council minutes to ensure the City is implementing all given directions. He acknowledged that Loma Linda is doing well compared to other cities, but pointed out that there will be a shortfall in revenues in the coming year requiring the City to strategize accordingly.

City Manager Thaipejr thanked Sonia, Anna, the Finance team and City Staff for their dedicated time and effort to gather all the data and put this report together.

The Annual Comprehensive Financial Report (ACFR) was accepted for filing.

5A. Approve an Agreement with CGI Digital in their Street Banner Program [Community Development]- 8:03 PM
Community Development Director Matarrita brought to the City Council's attention the recently approved video that showcased the City of Loma Linda, previously presented a few months ago. She noted that the same company, CGI Digital, approached the City with an offer to participate in a street banner program at no cost to the City for a three-year agreement. She noted that CGI Digital would provide the banners, hardware, installation, maintenance, repair, and insurance, and would seek out sponsorship from local businesses to promote their businesses on the banners. The sponsorship money would go to CGI Digital. As part of the agreement, CGI Digital will replace and repair banners that get damaged throughout the year.

After a year, new banners will be installed. She explained that the City will have control over the design, content, theme, size, and locations of the banners; that the City will also determine the sponsor area on the banner, which is typically one-third or one-fourth of the banner space; and that the City can change the designs and themes of the banners each year, some considered themes were holidays, a salute to local veterans, fire and law enforcement officers, and the Blue Zone designation. The banners would be placed on public right-of-way so no violation of the City's Codes. She stated that CGI Digital will provide a minimum of 25 banners to the City, which will not be contingent on sponsorship. If more than 25 sponsorships are received, the City will receive additional banners. She is requesting City Council to approve the three-year agreement.

Mayor pro tempore Dailey stated that he was not opposed to the program but expressed concern about the maintenance of the banners after several months becoming dirty and deteriorating, which would not be aesthetically pleasing for the City. He was also concerned with having an excessive number of banners cluttering around the City.

Community Development Director Matrarrita stated that City staff had similar concerns and would be considerate of those concerns. She pointed out that the agreement states CGI Digital will repair and/or replace damaged banners throughout the year. She did not foresee the vendor obtaining more than 25 sponsors since they had difficulties obtaining sponsors for the City video. She said City Council can establish a cap on the number of banners posted if they so choose.

Motion by Bhavin Jindal, seconded by Ronald Dailey, and passing by a vote of 5-0-0-0 To Approve
the three-year agreement with Community Showcase Banners, LLC (DBA CGI Digital) for participation in their no-cost decorative street banner program.

6. Reports
6A. Reports of Council Members- 8:18 PM
Councilman Jindal reported on the following items:

The Council of Government for San Bernardino County (COGS) has been underfunded for several years and is proposing a fee increase that will be applied towards program activities, namely, 1) a nurse triage program and 2) a grant research and writing program to bring more funds into our region. The projected increase for Loma Linda would be from $14,000 to $25,000, which is not nearly as much as other cities.

In speaking with residents and business owners regarding concerns about crime, he noted that the community is not fully aware of what the City is doing to address crime, such as the Flock cameras. He recommended keeping the community informed through social media, the city's website, or social community events.

He discovered that the Redlands Police Department has an online reporting system and asked if the Sheriff's Department considered exploring that type of program.

He recognized that the City has been actively posting information on its social media sites.

He encouraged the continued ongoing promotion of the Senior Center through its posts.

Lt. Kaysie Smith explained that the Sheriff's Department does not have an online reporting system, but has a reporting program where a group of trained individuals will take remote incident reports and issue a police report number.

Mayor Dupper stated that he was involved in the research of online reporting programs several years ago, but found that it would generate more man-hours on the back end. He noted that the online reports would still require staff review. He mentioned that certain reports necessitate investigations, and for this, an office must be involved in filling the report. If investigative reports are submitted online, an officer would have to go out and refile the report. He noted that it appeared to be a good program in the front end, but after their team's research, it was not costbeneficial. He stated that the previous Sheriff preferred to have a live person respond to nonemergency calls for reporting; however, he noted the new Sheriff is more technology-minded and that option may be revisited.

He noted that CONFIRE has been operating a nurse triage program that has been successful.

He pointed out that CONFIRE was awarded the administration ambulance service contract for the County that will go into effect in October of 2024. He noted that CONFIRE can determine when to send an ambulance to a fire call. Currently, he noted that AMR will go to fire calls. He stated that the First Responders will attend to and stabilize the patient and follow the patients when they are transported to the hospitals by AMR. First Responders are there from start to finish. He noted AMR will bill the insurance and collect all the money. The City cannot charge the insurance for services.

Chief Harker stated that it is a 5-year contract with CONFIRE. He emphasized that CONFIRE's approach focuses on more than just profit, prioritizing the enhancement of the system. The funds collected will initially be used to repay any debt and explore options to improve the program.

Discussion ensued pertaining to the fee increase and services from COGS. Comments pointed out that city representatives determined the selection of this organization; and that the fee The Farmer's Market is positive exposure to attract businesses into our community.

Consider reaching out to the veteran's village for volunteering opportunities.

Commended staff on investigative work on a tree claim.

increase, in comparison to other cities, is nominal considering the level of services that will benefit the City in regional activities.

RECOMMENDATION:

It is recommended that the City Council authorize the purchase of seven (7) street light poles with mast arms from South Coast Lighting & Design of San Clemente, CA for an amount of $22,914.12 and allocate 10%, $2,300, for contingency.

BACKGROUND:

City staff continually monitors and checks our infrastructure throughout the City. Currently, several street light poles need to be replaced along Mountain View Avenue and along Anderson Street. Additionally, street lights are sometimes knocked down through car accidents. We carry an inventory of 3 or 4 poles for quicker replacement of the knocked-down poles. The City has the street lights in stock that will be installed on these poles.

ANALYSIS:

Quotes were requested and received from three (3) vendors, informal bid results are attached. The lowest quote from South Coast Lighting & Design is $22,914.12. This vendor has supplied the City with lighting equipment in the past. The City is satisfied with their service commitment and references. It is not unusual for a project to change the quantities of work or the scope of work as field conditions dictate. This is generally caused by unforeseen circumstances or work needed to maintain the integrity of the project. Staff recommends an allocation of ±10% of the construction amount ($2,300.00) for a contingency allocation. City staff will provide construction management services, including construction inspection.

RECOMMENDATION:

It is recommended that City Council declare the antiquated out-of-service, 2007 Polaris Ranger ARV surplus and authorize the donation to Colton Fire Department.

BACKGROUND:

For over a decade, the Loma Linda Fire Department has utilized the ARV in the south hills of Loma Linda. However, due to the escalating maintenance costs and the significant financial commitment required to maintain its dependability, the ARV has been retired from our fleet. Despite offering its return to LLUMC, they have declined, and no other departments within the City of Loma Linda has a need for it.

ANALYSIS:

The Colton Fire Department has expressed a need for the Polaris ARV to enhance its service capabilities. This donation would enable them to access off-road areas efficiently, thereby allowing our resources to remain available for responding to the needs of Loma Linda residents. Currently, ARV 251 is offering off-road support as required within Colton’s jurisdiction.

RECOMMENDATION:

City Council to consider closing the pedestrian bridge crossing over the flood control channel at Ragsdale Road.

BACKGROUND:

The Mission Creek Subdivision Home Owners Association (HOA) has requested closing the pedestrian bridge crossing the San Timoteo Creek Channel at Ragsdale Road. The bridge was originally installed, at the Developer’s expense, as a component of the Walkable-Livable community concept. It connects this neighborhood with the regional San Timoteo Creek trailhead. There would be an installation of gates on both sides of the bridge that would be locked.

On February 10, 2015, the City Council approved the closure of the Pedestrian Bridge from Bryn Mawr Veteran's Memorial Park to Mission Creek Subdivision at the request of the Mission Creek HOA and a recommendation by the Trails Development Committee. The cost to install and lock the gates was funded by the HOA.

ANALYSIS:

The Mission Creek HOA reported recent criminal activity along Ragsdale Road. There is suspicion that persons responsible are using the pedestrian bridge.

ENVIRONMENTAL IMPACT:

FINANCIAL IMPACT:

The cost to install the gates has not been determined.
