SUBJECT: Service Order with Spectrum Enterprise re: Establishment of a PEG Channel Service
RECOMMENDATION
Authorize the City Manager to sign a service order with Spectrum Enterprise to establish service for a City PEG channel and direct the City Manager/City Attorney to approve as to form.
BACKGROUND/ANALYSIS
Public, Educational, and Governmental (PEG) Access Channels are channels dedicated for use and available by the public, education, and government. In our instance, as a governmental entity, we have requested a dedicated channel to provide city content for the community. For the benefit of its residents, a PEG channel can be used to broadcast city meetings, provide live or pre-recorded city content and other city-related information.
In 2017, the City approved a new ordinance establishing the collection of PEG fees from cable television operators. Enactment of the ordinance enables the City to collect 1% of the gross revenues of any state-licensed cable television operator in the City. The City currently receives approximately $35,000 annually in PEG fees from the various cable providers. These fees can and have been used to further PEG-related activities including Council Chambers upgrades which enhance the broadcast of our city meetings, PEGrelated infrastructure costs and cost to produce other content for the PEG channel itself.
In 2018, TimeWarner (currently Spectrum) notified the City that they would no longer provide hosted support for the established PEG channel that had been in use for many years. In order to continue operation of the City’s PEG channel, TimeWarner provided a quote to complete the infrastructure necessary for the City to host the PEG channel onsite. This was put on hold at that time as the City was contemplating a Council Chamber Item No. 7d

2 AV upgrade and it made sense to complete any PEG channel infrastructure work concurrently with the larger project.
Previously, on the PEG channel the City would re-broadcast Council meetings as well as provide informational content (through a PowerPoint slide show) for the benefit of the community.
The approval of this service order will re-establish a PEG channel for the City in order to provide City-related content to the greater community.
OPTIONS:
1) Move staff recommendation.
2) Provide further direction to staff.
FISCAL IMPACT
In order to establish the necessary infrastructure for the Spectrum PEG Channel, the one-time cost would be $5,435 with a recurring monthly cost of $705.00. These costs would be paid from annual PEG revenue.

THIS SERVICE ORDER (“Service Order”), is executed and effective upon the date of the signature set forth in the signature block below (“Effective Date”) and is by and between Charter Communications Operating, LLC on behalf of those operating subsidiaries providing the Service(s) hereunder (“Spectrum”) and Customer (as shown below) and is governed by and subject to the Spectrum Enterprise Commercial Terms of Service posted to the Spectrum Enterprise website, https://enterprise.spectrum.com/ (or successor url) or, if applicable, an existing services agreement mutually executed by the parties (each, as appropriate, a “Service Agreement”).
