Associate Planner MacMonan presented the staff report per the agenda material. The property is consistent with both zoning and General Plan designations. She shared the property's parking and landscaping plans and stated that the developer will replace the dilapidated sidewalk.

As there were no questions for staff, Mayor Uphoff opened the public hearing at 7:13 p.m.

Bill Lockwood, Lomita resident, expressed concerns about the poect due to insufficient stormwater drainage on 253'd Street, which leaves his yard flooded at times.

Joseph Jurado, Lomita resident, commented via email which was read by Mr. Lockwood.

Mr. Jurado expressed concerns about insufficient drainage and inadequate street parking in the area.

Rogena Waialae-Wightman, Lomita resident, also expressed concerns relative to drainage inadequacies in that area, as her driveway and yard have experienced four floods in the last twenty years.

George Kivett spoke in support of the project.

Joe Gonzalez, Lomita resident, expressed concems about possible drainage issues at the project site and suggested a retention tank be installed.

As there were no further requests to speak on this item, Mayor Uphoff closed the public hearing at 7:30 p.m. and brought the item back for Council discussion.

Director Rindge stated that drainage issues were discussed by the Planning Commission prior to their recommendation of approval to the Council. This project will be reviewed extensively and studies will be done prior to Council final map approval. Conditions of approval will reflect any additional requirements found to be necessary and studies will include public infrastructure related issues as well.

Brief Council discussion took place relative to drainage concerns and existing such problems in that area, and receiving assurances that they will be addressed by the developer. Other concems discussed included the number of proposed units on the lot and potential street parking challenges.

Associate Planner MacMonan clarified that approval of the vesting tentative tract map merely gives the developer assurance to move forward with the required studies and does not guarantee approval of the final tract map. There are specific conditions relative to stormwater as part of the resolution, and a soils report is also required prior to the final map hearing.

Director Rindge stated that a study could demonstrate that nine units are not feasible on the property. Tonight's approval would not allow for any construction. Additional language is not warranted now, as stormwater/flooding issues are addressed in the Conditions of Approval, including in the form of the LID (low impact development) checklist. Such standards are also part of the City's Municipal Code, and the State's own requirements.

Director Rindge presented the staff report per the agenda material. She gave the project background, and stated that this item is back before Council based on complaints from people who use the alley who are worried about losing that space. ln addition, the City's Public Works Department discovered a complicated utilities situation onsite which makes the alley vacation virtually impossible.

It was initially required for the developer to build 16 units and staff had rounded down to add more acreage to the project, but based on subsequent research Lomita City Code does not specify whether to round up or down on units, but the State and Lomita's Code require rounding up when it comes to density bonus in particular. Therefore, for consistency, the project was allowed l6 units without alley involvement.

As there were no questions for staff, Mayor Uphoff opened the public hearing at 7:52 p.m.
