1 TO: City Council
FROM: Andrew Vialpando, City Manager
PREPARED BY: Lina Hernandez, Interim Public Works Director MEETING DATE: August 20, 2024
SUBJECT: Award a Public Works Agreement to MIK Construction, Inc. and Award a Professional Services Agreement to Fountainhead Consulting for the Appian Way Pump Station Roof Replacement Project

RECOMMENDATION
Award a Public Works Contract to MIK Construction, Inc. for the construction of the Appian Way Pump Station Roof Replacement Project for $625,700, plus a 15% contingency of $93,855, for a total of $719,555; award a Professional Services Agreement to Fountainhead Consulting Corporation for construction inspection, construction administration, and testing services for the Appian Way Pump Station Roof Replacement Project in the amount of $70,544, plus a 15% contingency amount of $10,582, for a total amount of $81,126; appropriate an additional $390,681 for a total project budget of $800,681 from available fund balance in the Water Fund; and authorize the City Manager to execute the agreements.

BACKGROUND
The Appian Way Pump Station, located at 26255 Appian Way, is more than 30 years old and has an original wooden roof with one exhaust fan and four skylights. The condition of this wooden roof has deteriorated with extensive termite damage and infestation.

This pump station is a critical water facility that must remain functional and accessible at all times since it controls the pressure and water supply for a pressure zone within the city. Tenting the building was not an option due to concerns with access and safety of drinking water pumps located inside. As a result, the project involves removing the existing wooden frame in its entirety and replacing it with a metal truss roof system along

Item No. {{section.number}}a
2 with other associated improvements such as new skylights and other ceiling-mounted fixtures.

The City Council approved this project as part of the Capital Improvement Master Plan Project List in June 2022. Staff initially appropriated $50,000 toward the project, likely at the time to pay only for the design portion of the project. The design engineer’s estimate from early 2024 for construction was $410,000 based on the extent of the damage and work needed to adequately repair. The project was advertised to solicit bids on June 24, 2024, and the bid opening took place on July 30, 2024. The lowest bid was $625,700 reflecting inflation and market value of goods and services.

DISCUSSION
Two bids were received and opened by the City Clerk pursuant to the California Code, Public Contract Code. Staff reviewed the contractors’ proposals by evaluating their experience, credentials, and bid amount. Staff tabulated the bid results as summarized below:

CONTRACTOR BID TOTAL
MIK Construction, Inc $625,700.00
Rainy Day Roofing, Inc $713,800.00
MIK Construction, Inc was determined to be the lowest responsible bidder, with a bid amount of $625,700. Staff determined that all required documents were submitted and complete, and recommends awarding a contract to MIK Construction Inc. in the amount of $625,700. Staff also recommends authorizing an additional 15% contingency for unexpected costs, for a total contract budget of $719,555.00.

The project will include occasional intermittent power shutdowns that will be coordinated with the City ahead of time. Pressure impacts to the water supply will be minimal and localized. Additionally, this work will not have any impact on the operations of the Cypress Water Production Facility. Residents in the vicinity of the area will be notified of the upcoming work as well. It is anticipated this project will begin in October and last six to eight months. The anticipated lifespan of the new roof is 50 years.

Additionally, staff recommends using the services of Fountainhead Consulting Corporation, Inc. for inspection, testing and labor compliance services. On September 5, 2023, the City Council approved the establishment of a list of three firms to provide oncall construction management, construction inspection, construction administration, and material testing services. This list includes Fountainhead Consulting Corporation.

Fountainhead Consulting Corporation, Inc. quoted the City $70,544 for construction management of the project. Staff recommends entering into an agreement with Fountainhead Consulting Corporation, Inc. in an amount of $70,544, plus a 15% contingency amount of $10,582, for a total amount of $81,126. 3 FISCAL IMPACT
Funding for this project is partially accounted for in the budget for fiscal year 2024/2025.

If approved, an additional $390,681 will need to be appropriated from the Water Fund under account code 520-840-5821.239.
