1 TO: City Council
FROM: Andrew Vialpando, City Manager
PREPARED BY: Lina Hernandez, Deputy City Manager/Public Works Director MEETING DATE: November 5, 2024
SUBJECT: Fourth Amendment to the Agreement with Willdan Financial Services for Impact Fee Studies

RECOMMENDATION
Approve the Fourth Amendment to the Agreement with Willdan Financial Services for Preparation of Parks & Recreation and Sewer Impact Studies, and authorize the City Manager to execute the agreement.

BACKGROUND
On September 1, 2020, the City Council approved agreements with Willdan Financial Services (WFS) to prepare a Comprehensive User Fee and Charges Study and a Water Rate study. On August 17, 2021, the City Council approved a First Amendment extending the user fee study agreement with WFS to March 31, 2022, to allow additional time for the completion of the studies. On January 18, 2022, the City Council adopted the fee schedule prepared by WFS.

Parks and Recreation Facilities fees and a new Sewer Facilities Fees were also commissioned to be updated. In addition to user fees, developing comprehensive impact fees programs enable the City to recover costs on future development projects based on their impact on public infrastructure. On February 28, 2022, the City Council approved the Second Amendment to update the existing Park and Recreation Facilities impact fee and establish a Sewer Facilities impact fee schedule.

Although progress had been made to the Lomita Parks and Recreation Facilities Impact Fee analysis, data from the Sanitary Sewer Master Plan was needed to proceed with the Sewer Impact Fee assessment. On May 2, 2023, the City Council approved a Third Amendment to allow additional time for the completion of the Sanitary Sewer Master Plan

2 needed to proceed with the Sewer Impact Fee assessment. The term of this agreement is set to expire December 31, 2024.

DISCUSSION
On October 15, 2024 the City Council approved Lomita’s first ever Sanitary Sewer Master Plan. This document contained the data needed to complete the sewer impact fee analysis and has been provided to the consultant. It is anticipated that the Parks & Recreation and Sewer Impact Fee Studies will be presented to the City Council for approval in early 2025.

The attached amendment, if approved by the City Council, would only adjust the term with WFS to December 30, 2025, to allow more time to complete and present the studies, but make no other amendments to the scope of the agreement.

FISCAL IMPACT
There are no financial implications resulting from this recommendation. The cost to prepare these studies is $19,500. It is anticipated that the cost of the study would be recovered through the collection of these impact fees.
