Water Division Updates
Cypress Water Production Facility (CWPF) and Distribution System Updates On November 5, the Water Subcommittee, administrative staff, the City’s water treatment division, and Hazen and Sawyer team toured the Cypress Water Production Facility to receive an update on the project. Much progress has taken place just over the last six months and we are excited to report that mechanically we are very close to the finish line, with the final three components on order and anticipated to be received within a few weeks. Hazen will then proceed with testing of the GAC for purposes of obtaining the permit to operate the facility.
We have been in contact with our regulators and feel confident that our project has met all the permitting standards required by the Division of Drinking Water.
Hazen is developing the GAC system standard operating procedures and will provide training to our staff on how to operate the facility. Once the plant is operational, Hazen will be on hand to support the city and hand the project back to city staff.
Staff continues to participate in meetings with West Basin, MWD, and LA Department of Water and Power (DWP) to construct a new emergency connection with LADWP to support a request for a shutdown of a West Basin connection, WB-08A. MWD has postponed the request for shutdown, but staff

Public Safety & Traffic
The Public Safety & Traffic Commission (PSTC) did not meet in October. The Technical Traffic Advisory Committee (TTAC) met in October and reviewed two new traffic items.
One item was related to parking around Lomita Magnet School and will be addressed Tuesday, November 19, 2024 Reg CC MTG, Page *33
3 by the City-Wide School Loading Zone Study. The second item was related to congestion at 245th Street and Narbonne. The Committee will be performing observation before issuing a decision on the request.
City staff has continued to virtually attend the PV Peninsula Project coordination meetings to share information about the Narbonne South project and learn about any projects impacting Lomita.
External Funding
The Metro and SBCCOG Boards recently approved Lomita’s Local Travel Network (LTN) application for $6.65 Million in Measure M funding. This project, led by the South Bay COG proposes a 243-mile network of existing, low-speed routes designed to accommodate travel via small, low-speed vehicles (street worthy golf carts, e-bikes, pedal bikes, e-scooters, etc.) to provide connectivity for Lomita residents and help reduce vehicular congestion while providing a network for alternative transportation.
Approximately 5.35 miles of LTN network would be deployed within Lomita. Traffic calming and active transportation measures would be deployed on Eshelman Avenue as part of the project’s scope. The agreement will be taken to Council for approval soon.
Staff submitted a grant application for a Sustainable Communities Program – Active Transportation & Safety Grant to support quick-build traffic calming projects throughout the City. The City requested $940,000, and it is anticipated the City will receive a decision in June 2025.
The request for federal funding for the Tom Rico Center Roof Replacement Project was included in the final draft of a House bill, which passed through the Transportation-HUD Appropriations Subcommittee. Next step will be for the project to be considered in the final spending bill which will include earmarks for many projects that help fund local government projects. It is anticipated this will occur in December.
Staff submitted a grant application to the State's Integrated Climate Adaptation and Resiliency Program (ICARP) Extreme Heat and Community Resilience Program (EHCRP) to support planned CIPs. The City requested $4 million, and it is anticipated the City will receive a decision in either December 2024 or January 2025.

*The Governmental Accounting Standards Board (GASB) has established Statement No. 31 for setting investment valuation standards. We report the unrealized gain/(loss) monthly and book realized gain/(loss) at year end as a GASB 31 requirement.
GASB 31 is a reporting requirement that reports the "Fair Value" of investments held in our portfolio. Fair value is the amount at which a financial instrument (investment) could be exchanged in a current transaction between willing parties at current market prices. It is important to understand the relationship between prevailing interest rates and fixed coupon investments. As market interest rates fall, the "Fair Value" of held securities will rise (unrealized Gains). The opposite occurs as market interest rates rise (market prices of held investments will fall). It should be noted that investments held in the city pool are to be held until maturity so both gains and losses (unrealized) will not be taken.

1 TO: City Council
FROM: Andrew Vialpando, City Manager
PREPARED BY: Susan Kamada, Administrative Services Director MEETING DATE: November 19, 2024
SUBJECT: Professional Services Agreement with Liebert Cassidy Whitmore for Labor Negotiation Services
RECOMMENDATION
Authorize the City Manager to execute the Professional Services Agreement for an amount not to exceed $40,000 for labor negotiation services provided by Liebert Cassidy Whitmore.
BACKGROUND
The City’s current MOU with the Lomita City Employees Association (LCEA) is set to expire on June 30, 2025. It is expected that negotiations could begin early next year.
The LCEA represents 36 members consisting of non-management City staff.
On May 5, 2005, the City entered into an agreement with Liebert Cassidy Whitmore (LCW) to provide legal services pertaining to employment relations matters.
DISCUSSION
Since 2010, the Assistant City Manager has served as lead labor negotiator on behalf of the City, except for 2019 when an attorney from LCW was appointed. With the pending retirement of the Assistant City Manager, the City reached out to human resources consultants who specialize in labor relations to assist with the upcoming labor negotiations with the LCEA. Staff received proposals from two retired human resources directors with extensive experience in labor relations/negotiations Staff interviewed both consultants and is recommending that the City retain Matt Doyle, Senior Consultant with LCW. Mr. Doyle is a retired Human Resources Director with three decades of experience, most recently with the City of Glendale and oversaw all aspects

11. TERMINATION.
A. Except as otherwise provided, CITY may terminate this Agreement at any time with or without cause. Notice of termination shall be in writing.
B. CONSULTANT may terminate this Agreement. Notice will be in writing at least 30 days before the effective termination date.
C. In the event of such termination, CONSULTANT shall cease services as of the date of termination, all finished or unfinished documents, data, drawings, maps, and other materials prepared by CONSULTANT shall, at CITY’s option, become CITY’s property, and CONSULTANT will receive just and equitable compensation for any work satisfactorily completed up to the effective date of notice of termination.
D. Should the Agreement be terminated pursuant to this Section, CITY may procure on its own terms services similar to those terminated.
12. INDEMNIFICATION.
A. CONSULTANT shall indemnify, defend with counsel approved by CITY, and hold harmless CITY, its officers, officials, employees and volunteers from and against all liability, loss, damage, expense, cost (including without limitation reasonable attorney’s fees, expert fees and all other costs and fees of litigation) of every nature arising out of or in connection with CONSULTANT's performance of work hereunder or its failure to comply with any of its obligations contained in this AGREEMENT, regardless of CITY’S passive negligence, but excepting such loss or damage which is caused by the sole active negligence or willful misconduct of CITY. Should CITY in its sole discretion find CONSULTANT’S legal counsel unacceptable, then CONSULTANT shall reimburse CITY its costs of defense, including without limitation reasonable attorney’s fees, expert fees and all other costs and fees of litigation.
CONSULTANT shall promptly pay any final judgment rendered against CITY (and its officers, officials, employees and volunteers) covered by this indemnity obligation. It is expressly understood and agreed that the foregoing provisions Tuesday, November 19, 2024 Reg CC MTG, Page *54
are intended to be as broad and inclusive as is permitted by the law of the State of California and will survive termination of this Agreement.
B. The requirements as to the types and limits of insurance coverage to be maintained by CONSULTANT as required by Section 17, and any approval of said insurance by CITY, are not intended to and will not in any manner limit or qualify the liabilities and obligations otherwise assumed by CONSULTANT pursuant to this Agreement, including, without limitation, to the provisions concerning indemnification.
13. ASSIGNABILITY. This Agreement is for CONSULTANT’s professional services.
CONSULTANT’s attempts to assign the benefits or burdens of this Agreement without CITY’s written approval are prohibited and will be null and void.
14. INDEPENDENT CONSULTANT. CITY and CONSULTANT agree that CONSULTANT will act as an independent CONSULTANT and will have control of all work and the manner in which is it performed. CONSULTANT will be free to contract for similar service to be performed for other employers while under contract with CITY. CONSULTANT is not an agent or employee of CITY and is not entitled to participate in any pension plan, insurance, bonus or similar benefits CITY provides for its employees. Any provision in this Agreement that may appear to give CITY the right to direct CONSULTANT as to the details of doing the work or to exercise a measure of control over the work means that CONSULTANT will follow the direction of the CITY as to end results of the work only.
15. AUDIT OF RECORDS.
A. CONSULTANT agrees that CITY, or designee, has the right to review, obtain, and copy all records pertaining to the performance of this Agreement.
CONSULTANT agrees to provide CITY, or designee, with any relevant information requested and will permit CITY, or designee, access to its premises, upon reasonable notice, during normal business hours for the purpose of interviewing employees and inspecting and copying such books, records, accounts, and other material that may be relevant to a matter under investigation for the purpose of determining compliance with this Agreement.
CONSULTANT further agrees to maintain such records for a period of three (3) years following final payment under this Agreement.
B. CONSULTANT will keep all books, records, accounts and documents pertaining to this Agreement separate from other activities unrelated to this Agreement.
16. CORRECTIVE MEASURES. CONSULTANT will promptly implement any corrective measures required by CITY regarding the requirements and obligations of this Agreement. CONSULTANT will be given a reasonable amount of time as determined by CITY to implement said corrective measures. Failure of CONSULTANT to implement required corrective measures shall result in immediate termination of this Agreement.

17. INSURANCE REQUIREMENTS.
A. CONSULTANT, at CONSULTANT’s own cost and expense, shall procure and maintain, for the duration of the contract, the following insurance policies:
1. Workers Compensation Insurance as required by law. CONSULTANT shall require all subconsultants similarly to provide such compensation insurance for their respective employees. Any notice of cancellation or non-renewal of all Workers’ Compensation policies must be received by CITY at least thirty (30) days prior to such change. The insurer shall agree to waive all rights of subrogation against CITY, its officers, agents, employees, and volunteers for losses arising from work performed by CONSULTANT for CITY.
2. General Liability Coverage. CONSULTANT shall maintain commercial general liability insurance in an amount of not less than one million dollars ($1,000,000) per occurrence for bodily injury, personal injury, and property damage. If a commercial general liability insurance form or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to the work to be performed under this Agreement or the general aggregate limit shall be at least twice the required occurrence limit.
3. Automobile Liability Coverage. CONSULTANT shall maintain automobile liability insurance covering bodily injury and property damage for all activities of CONSULTANT arising out of or in connection with the work to be performed under this Agreement, including coverage for owned, hired, and non-owned vehicles, in an amount of not less than one million dollars ($1,000,000) combined single limit for each occurrence.
4. Professional Liability Coverage. CONSULTANT shall maintain professional errors and omissions liability insurance for protection against claims alleging negligent acts, errors, or omissions which may arise from CONSULTANT’S operations under this Agreement, whether such operations be by CONSULTANT or by its employees, subconsultants, or subconsultants. The amount of this insurance shall not be less than one million dollars ($1,000,000) on a claims-made annual aggregate basis, or a combined single-limit-per-occurrence basis. When coverage is provided on a “claims made basis,” CONSULTANT will continue to renew the insurance for a period of three (3) years after this Agreement expires or is terminated.
Such insurance will have the same coverage and limits as the policy that was in effect during the term of this Agreement, and will cover CONSULTANT for all claims made by CITY arising out of any errors or omissions of CONSULTANT, or its officers, employees or agents during the time this Agreement was in effect.
B. Endorsements. Each general liability, automobile liability and professional liability insurance policy shall be issued by a financially responsible insurance Tuesday, November 19, 2024 Reg CC MTG, Page *56
company or companies admitted and authorized to do business in the State of California, or which is approved in writing by CITY, and shall be endorsed as follows. CONSULTANT also agrees to require all CONSULTANTs, and subconsultants to do likewise.
1. “The CITY, its elected or appointed officers, officials, employees, agents, and volunteers are to be covered as additional insureds with respect to liability arising out of work performed by or on behalf of the CONSULTANT, including materials, parts, or equipment furnished in connection with such work or operations.”
2. This policy shall be considered primary insurance as respects CITY, its elected or appointed officers, officials, employees, agents, and volunteers.
Any insurance maintained by CITY, including any self-insured retention CITY may have, shall be considered excess insurance only and shall not contribute with this policy.
3. This insurance shall act for each insured and additional insured as though a separate policy had been written for each, except with respect to the limits of liability of the insuring company.
4. The insurer waives all rights of subrogation against CITY, its elected or appointed officers, officials, employees, or agents.
5. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to CITY, its elected or appointed officers, officials, employees, agents, or volunteers.
6. The insurance provided by this policy shall not be suspended, voided, canceled, or reduced in coverage or in limits except after thirty (30) days’ written notice has been received by CITY.
C. CONSULTANT agrees to provide immediate notice to CITY of any claim or loss against CONSULTANT arising out of the work performed under this agreement.
CITY assumes no obligation or liability by such notice, but has the right (but not the duty) to monitor the handling of any such claim or claims if they are likely to involve CITY.
D. Any deductibles or self-insured retentions must be declared to and approved by CITY. At CITY’s option, CONSULTANT shall demonstrate financial capability for payment of such deductibles or self-insured retentions.
E. CONSULTANT shall provide certificates of insurance with original endorsements to CITY as evidence of the insurance coverage required herein.
Certificates of such insurance shall be filed with CITY on or before commencement of performance of this Agreement. Current certification of insurance shall be kept on file with CITY at all times during the term of this Agreement.
Tuesday, November 19, 2024 Reg CC MTG, Page *57
F. Failure on the part of CONSULTANT to procure or maintain required insurance shall constitute a material breach of contract under which CITY may terminate this Agreement pursuant to Section 11 above.
G. The commercial general and automobile liability policies required by this Agreement shall allow CITY, as additional insured, to satisfy the self-insured retention (“SIR”) and/or deductible of the policy in lieu of the CONSULTANT (as the named insured) should CONSULTANT fail to pay the SIR or deductible requirements. The amount of the SIR or deductible shall be subject to the approval of the City Attorney and the Finance Director. CONSULTANT understands and agrees that satisfaction of this requirement is an express condition precedent to the effectiveness of this Agreement. Failure by CONSULTANT as primary insured to pay its SIR or deductible constitutes a material breach of this Agreement. Should CITY pay the SIR or deductible on CONSULTANT’S behalf upon CONSULTANT’S failure or refusal to do so in order to secure defense and indemnification as an additional insured under the policy, CITY may include such amounts as damages in any action against CONSULTANT for breach of this Agreement in addition to any other damages incurred by CITY due to the breach.
18. USE OF OTHER CONSULTANTS. CONSULTANT must obtain CITY’s prior written approval to use any CONSULTANTs while performing any portion of this Agreement. Such approval must include approval of the proposed CONSULTANT and the terms of compensation.
19. FINAL PAYMENT ACCEPTANCE CONSTITUTES RELEASE. The acceptance by the CONSULTANT of the final payment made under this Agreement shall operate as and be a release of CITY from all claims and liabilities for compensation to the CONSULTANT for anything done, furnished or relating to the CONSULTANT’S work or services. Acceptance of payment shall be any negotiation of CITY’S check or the failure to make a written extra compensation claim within ten (10) calendar days of the receipt of that check. However, approval or payment by CITY shall not constitute, nor be deemed, a release of the responsibility and liability of CONSULTANT, its employees, sub-CONSULTANTs and agents for the accuracy and competency of the information provided and/or work performed; nor shall such approval or payment be deemed to be an assumption of such responsibility or liability by CITY for any defect or error in the work prepared by CONSULTANT, its employees, sub-CONSULTANTs and agents.
20. CORRECTIONS. In addition to the above indemnification obligations, the CONSULTANT shall correct, at its expense, all errors in the work which may be disclosed during CITY’S review of CONSULTANT’S report or plans. Should the CONSULTANT fail to make such correction in a reasonably timely manner, such correction shall be made by CITY, and the cost thereof shall be charged to CONSULTANT. In addition to all other available remedies, CITY may deduct the cost of such correction from any retention amount held by CITY or may withhold Tuesday, November 19, 2024 Reg CC MTG, Page *58
payment otherwise owed CONSULTANT under this Agreement up to the amount of the cost of correction.
21. NON-APPROPRIATION OF FUNDS. Payments to be made to CONSULTANT by CITY for services preformed within the current fiscal year are within the current fiscal budget and within an available, unexhausted fund. In the event that CITY does not appropriate sufficient funds for payment of CONSULTANT’S services beyond the current fiscal year, the Agreement shall cover payment for CONSULTANT’S only to the conclusion of the last fiscal year in which CITY appropriates sufficient funds and shall automatically terminate at the conclusion of such fiscal year.

FROM: Andrew Vialpando, City Manager
PREPARED BY: Kathleen Gregory, City Clerk
MEETING DATE: November 19, 2024
SUBJECT: Resolution Authorizing the Destruction of Obsolete Records
RECOMMENDATION
Adopt a resolution authorizing the destruction of obsolete records and authorize the City Clerk to schedule disposition of records listed in attached exhibit.
BACKGROUND
At its meeting on February 4, 2013, the City Council adopted Resolution No. 2013-05, establishing a Citywide Records Management Policy for Preservation, Protection, Retention and Legal Disposition of Records and Records Retention Schedule for all City Departments. The Records Retention Schedule is the City's most effective control to properly manage paper records. It is a carefully planned, systematic, and consistently written policy governing the period of retention, or the lifespan, of all types of records.
While the Records Retention Schedule contains the legal authority for the disposition of City records and demonstrates compliance with government regulations, obtaining approval from the City Council for the destruction of public records is still required (California Gov't Code Section 34090 et seq.).
DISCUSSION
At this time, City departments have identified records that no longer have sufficient historical, legal, fiscal or reference value to retain in original form, and is requesting the City Council's authorization to destroy such records. The proposed destruction follows the City's Records Retention Schedule and is consistent with Section 34090 of the Government Code of the State of California. Section 34090 provides for the destruction of any City record, document, instrument, book, paper, etc., without making a copy

2 thereof, after the same is no longer required, if done with the approval of the City Council and the written consent of the City Clerk and City Attorney. Section 34090 does not authorize the destruction of records affecting the title to real property or liens thereon, court records, records required to be kept by statute, records less than two years old, and the minutes, ordinances, or resolutions of the City Council.
Records proposed for destruction were carefully reviewed by staff and approved by the corresponding department directors. In addition, and in accordance with law, the City Attorney has reviewed the list of records and has given consent for destruction of the records.
FISCAL IMPACT
The approximate cost to shred the designated documents is $300 and is included in the Adopted Budget.

MEETING DATE: November 19, 2024
SUBJECT: Resolution Amending Conflict of Interest Code for the City of Lomita pursuant to the Political Reform Act of 1974
RECOMMENDATION
Adopt a Resolution amending the City’s Conflict of Interest Code.
BACKGROUND
The Political Reform Act of 1974 requires all public agencies to review and if necessary, amend their Conflict of Interest Code every even-numbered year. The purpose of the Code is to provide for the disclosure of designated employees’ assets and income which may be materially affected by their official actions, and in appropriate circumstances, to provide that designated employees should recuse themselves from acting on such official actions to prevent a conflict of interest.
Each person holding a designated employee position shall file a Statement of Economic Interest (Form 700) disclosing his/her interest in investments, business positions, real property, and income, as designated as reportable under the category to which his/her position is assigned. The Form 700 is a public document intended to alert public officials and members of the public to types of financial interests that may create conflicts of interest.
The Fair Political Practices Commission (FPPC) requires that the Code be reviewed every even-numbered year to determine if it is accurate and up-to-date. The Code reviewing body for the City of Lomita is the City Council. The amendment process also involves the posting of a Notice of Intent to amend the code, which has been posted. The amended Code must be submitted to the City Council for approval and is not effective until it has been approved by the City Council. The amendments to this Conflict of Interest Code are identified in the attached resolution. Appendices A and B to the resolution set forth the

PREPARED BY: Montserrate Gastelum, Administrative Analyst MEETING DATE: November 19, 2024
SUBJECT: Education Compact Between the City of Lomita and the Los Angeles Unified School District
RECOMMENDATION
Approve the Education Compact between the City of Lomita and the Los Angeles Unified School District (LAUSD).
BACKGROUND
The Los Angeles Unified School District (LAUSD) has reached out to a number of cities whose students are served by LAUSD to consider approval of an Education Compact between each of the parties. LAUSD has already established Education Compacts with numerous cities, including Carson, San Fernando, West Hollywood, and South Gate. The Compact is part of LAUSD’s 2022-2026 Strategic Plan, with a focus on building innovative programs that support student success and community enrichment, without mandating financial commitments from either party.
DISCUSSION
The Education Compact is an initiative by LAUSD aimed at enhancing the collaborative partnership between LAUSD and the agencies it serves. The Compact is a non-binding, non-legal document that promotes the educational experience and overall well-being of Lomita’s students and families. Modeled after similar agreements in cities like Carson and San Fernando, the Compact aligns resources and efforts in areas such as student safety, health services, academic support, and family engagement. By fostering close collaboration between the City, LAUSD, and local stakeholders, this partnership seeks to enhance communication, increase access to educational and extracurricular opportunities, and address critical community needs like digital connectivity and traffic safety.

EDUCATION COMPACT
Between The Los Angeles Unified School District And The City of Lomita
As part of the 2022-2026 Strategic Plan for the Los Angeles Unified School District (“District” or “Los Angeles Unified”), new education compacts are to be established between the District and local governmental entities. Education Compacts with the municipal governments in the South region are intended to align resources and implement innovative programs to equip students with the tools they need to be Ready for the World.
As a member of the South region, the City of Lomita (“City”) is served by the District and accounts for approximately 2,193 student enrollment at District schools located in the City of Lomita (LAUSD SY 24-25 Enrollment). The City of Lomita has 20,000 residents (2020 US Census) and spans a total area of 1.9 square miles. Students who live in the City of Lomita attend these and other schools: Lomita Magnet Elementary School, Eshelman Avenue Elementary School, Fleming Middle School, and Narbonne High School. The District and the City may each be referred to individually herein as a “Party” or, collectively, as “the Parties.” Through this Education Compact (“Compact”), the City and the District will collaborate to meet the educational needs of youth and families in the City through the end of the District’s Strategic Plan (June 2026). The City and the District may choose to revisit the Compact after June 2026 to renew their shared commitments to students and families of the City of Lomita.
The commitments outlined are not legally binding, nor do they mandate budgetary expenditures on behalf of the Parties. They represent a shared philosophical goal of improving educational opportunities and enriching the lives of children and families attending District sites or living within the City. The Parties recognize there may be financial expenditures associated with one or more of the following aspects; however, any financial expenditure should not be made unless the responsible Party’s governing board has authorized the expenditure through its budgetary process and should be voluntary in nature.
The Compact between the District and the City should undertake efforts that would be enriched, expedited, or enhanced through collaborative efforts in the following areas:
1. Communications and Ongoing Engagement
2. Enrollment and Positive Attendance
3. Safe Routes to School and Other Traffic Safety Improvements
4. Safe and Positive School Climate
5. Student Mental Health & Wellness Services
6. Parent and Family Engagement
7. Academics and Expanded Learning
Tuesday, November 19, 2024 Reg CC MTG, Page *82
8. Digital Access and Connectivity
9. Shared Facilities and Green Spaces
10. Transportation
Key Focus Areas:
1. Community Collaboration and Communication:
o Joint efforts to improve communication between the City and LAUSD.
Information about schools, programs, and events should be shared via City websites, social media, and newsletters.
o Promotion of educational programs and job opportunities through city-sponsored events and initiatives.
o The Compact encourages partnerships with local businesses to create mentorship and volunteering opportunities, aimed at boosting student success. o The City, as part of its annual Lemonade Day, will promote this event to increase participation from District students and empower youth to explore entrepreneurship. The District will also collaborate with the City to share information about this event with students, families, and staff. This annual initiative, hosted by the Lomita Chamber of Commerce in partnership with the City of Lomita, provides students with an experiential learning program that teaches them how to start, own and operate their own lemonade stand.
2. Enrollment and Positive Attendance:
o The City should support student recruitment efforts and collaborate on campaigns aimed at improving school attendance.
o Regular attendance campaigns and events should help ensure that all eligible youth in Lomita are enrolled in District schools.
3. Safe Routes to School and Other Traffic Safety Improvements:
o The City and LAUSD should work together to ensure safe routes to school. o The District will promote programs such as the Traffic Safety Valet to alleviate congestion and improve pedestrian safety around schools. o Both parties should regularly assess traffic conditions and implement safety improvements near school campuses.
4. School Safety and Positive Climate:
o Safety Collaborative and other meetings between the City, District, and law enforcement agencies should review safe passage issues with the goal of addressing school safety, crime prevention, and updates on local initiatives. o Data-sharing agreements should be explored to better understand and address crime trends near schools, enhancing student safety and well-being.
5. Student Mental Health & Wellness Services:
o Joint efforts should be made to expand public health education, particularly focusing on combating drug overdoses and improving mental health services for students.
Tuesday, November 19, 2024 Reg CC MTG, Page *83
o The City and District should explore bringing mobile health services and expanding mental health resources in Lomita.
6. Parent and Family Engagement:
o The District should develop workshops and classes tailored to Lomita families through the Family Academy, with the City supporting the promotion of these offerings.
o The City and District should explore creating a Parent Resource Center at a City facility, providing a centralized hub for information and resources.
7. Academic and Expanded Learning:
o Both parties should work to promote academic and enrichment programs like tutoring, summer programs, and extracurricular activities to help students address learning gaps.
o Cultural enrichment programs such as the Cultural Arts Passport should be offered to Lomita families, with a focus on leveraging local cultural and historical sites.
8. Digital Access and Connectivity:
o The District will continue its advocacy to urge increased connectivity funding to provide students access to devices and internet services for off-campus use. o Partnerships should be explored to improve broadband access and eliminate digital divides, ensuring that all families in Lomita have access to high-speed internet.
9. Shared Facilities and Green Spaces:
o The City and District should collaborate on the use of shared facilities, including athletic fields, and green spaces, to host school and community events and provide recreation opportunities for students and families. o Both parties should work to increase green spaces on school properties, creating more recreational areas for families and students to enjoy. o The District should examine how to strengthen the collection of developer fees for all new residential, commercial, and industrial construction projects within the school district boundaries, including opportunities for increased collaboration with the City in support of these efforts to collect and transmit developer fees for construction projects in the City.
10. Transportation:
o The City should support the promotion of free Metro GoPass Program passes for students, ensuring that all eligible youth have access to reliable public transportation.
Duration and Review

This Compact is effective through the end of the LAUSD’s Strategic Plan (June 2026). Both Parties may revisit and renew the Compact after this date to continue their collaborative efforts in support of the Lomita community.

APPENDIX
Cultural Arts Passport
The Los Angeles Unified Cultural Arts Passport is a program to provide students access to the Arts. In partnership with Southern California’s finest cultural organizations and venues, the Cultural Arts Passport program ensures equal access to arts, culture and environmental experiences for every child. The Cultural Arts Passport is partially supported through generous monetary and in-kind donations from the community. Founding partners who generously support the initiative include The Broad Foundation, Creative Arts Agency, the Fender Play Foundation and other cultural institutions.
Digital Divide Partnerships
The District has developed partnerships with LTE/5G and fixed broadband providers such as Verizon and AT&T to allow piggyback on our contracts with very affordable pricing for other governmental entities.
Everyone Mentors LA
Everyone Mentors LA is a new mentoring initiative by Los Angeles Unified that will invest in the lives of historically underserved students to ensure every student graduates Ready for the World. The new initiative will match students contending with declining grades, chronic absenteeism, a need for socio-emotional support and other challenges that have inhibited their academic success with a mentor from the Los Angeles community. More information on this program can be found at https://achieve.lausd.net/everyonementors.
Family Academy
The Los Angeles Unified Family Academy is designed to leverage families’ assets to be empowered as they support their child from the early primary years to college and career success. This effort complements family knowledge by connecting them to actionable learning focused on their child’s development, as well as opportunities to accelerate their own careers and quality of livelihood. Families may expand and share prior knowledge with other parent leaders by attending learning segments offered by the Family Academy course catalog, which offers webinar and regional segments hosted in-person. The course catalog is available at achieve.lausd.net/familyacademy.
A second path to learning with the Family Academy is through four family courses which are geared for the following family audiences: youngest learners, multilingual learners, twice exceptional, and Black and African-American students. The curriculum is organized as a 7-class course experience where families engage in a culturally relevant curriculum, in a cohort learning environment, define family engagement, and develop their action plan to stay engaged in their child’s education. Course registration information is available at Tuesday, November 19, 2024 Reg CC MTG, Page *86
achieve.lausd.net/familyacademy. Families may also contact the Los Angeles Unified Family Hotline for more information: 213-443-1300.
Traffic Safety Valet Program
The Los Angeles Unified Safety Valet program is designed to help improve student safety and provide more fluid movement of vehicular traffic around schools during the morning drop off. A Valet directs drivers through a queue of traffic cones where volunteers assist students to safely exit the car. This eliminates the need for parents to exit their vehicles and for students to cross busy intersections.

MEETING DATE: November 19, 2024
SUBJECT: Second Reading and Possible Adoption of Ordinance No. 864 to Incorporate By Reference the Amended Title 32 of the Los Angeles Fire Code
RECOMMENDATION
Conduct public hearing; adopt Ordinance No. 864; and direct the City Clerk to file a copy of the ratification of the more restrictive code standards, and required local findings, with the adopted City Ordinance to the State Department of Housing and Community Development.
BACKGROUND
At its meeting on November 5, 2024, the City Council held a first public hearing as prescribed by law regarding adoption of an Ordinance incorporating by reference the Los Angeles County Fire Code (Title 32). Adopting Ordinances by reference require that the item be bought before the City Council at a public meeting twice.
DISCUSSION
The attached Ordinance ratifies building standards relating to fire and life safety, which are more restrictive than those contained within the California Building Standards Code.
California law requires building standards adopted by local jurisdictions that are more restrictive than those adopted by the State to be enacted by Ordinance after the State adopts the California Building and Fire Code. California Health and Safety Code Section 13869.7 authorizes the County Fire District to adopt these more stringent standards, but requires ratification by the City where these standards will apply. The findings made by the County supporting these changes begin on page 273 of the Los County Ordinance (Attachment 1).

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOMITA, CALIFORNIA, AMENDING SECTION 3-1 (FIRE PREVENTION) OF TITLE 3 OF THE LOMITA MUNICIPAL CODE; ADOPTING BY REFERENCE TITLE 32 (FIRE CODE) OF THE LOS ANGELES COUNTY CODE INCORPORATING BY REFERENCE THE 2022 EDITION OF THE CALIFORNIA FIRE CODE WITH CERTAIN CHANGES AND AMENDMENTS THERETO; AND FINDING
THE ACTION EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT
THE CITY COUNCIL OF THE CITY OF LOMITA DOES HEREBY ORDAIN AS FOLLOWS:
Section 1. Findings.
A. California law requires that on January 1, 2023, all portions of the 2022 California Code of Regulations Title 24 will be effective within the City.
B. The City may amend the provisions of the California Code of Regulations Title 24 provided express findings for each amendment, addition or deletion is made based upon climatic, topographical or geological conditions.
C. The City receives fire prevention, plan review and inspection services from the County of Los Angeles. The Los Angeles County Fire Prevention Division has recommended modifying certain parts of California Code of Regulations Title 24 due to local climatic, topographical and geological conditions in the City of Lomita.
D. The findings supporting the necessity for the amendments to building standards herein are contained in Exhibit 1 to this Ordinance in accordance with California Health and Safety Code Section 18941. 5 and are incorporated by reference herein.
E. The City of Lomita City Council hereby finds, determines and declares that those certain amendments to the State Code are appropriate and necessary to meet local conditions existing in the City of Lomita, and this Council hereby further finds, determines and declares that each such change is required for the protection of the public safety and is reasonably necessary because of local climatic, geological conditions.
Section 2. Section 3-1.01 of Title 3 of the City of Lomita Municipal Code is amended to read as follows:
Tuesday, November 19, 2024 Reg CC MTG, Page *90
Attachment No. 1
Ordinance No. 864
3-1.01. County fire code adopted.
Except as hereinafter provided, Title 32, Fire Code, of the Los Angeles County Code, as amended and in effect on March 2, 2023, adopting the California Fire Code, 2022 Edition (California Code of Regulations Title 24, Part 9) and supplement – 9 in effect on July 1, 2024, is hereby incorporated herein by reference as if fully set forth herein, and shall constitute and may be cited as the Fire Code of the City.
In the event of any conflict between provisions of the California Fire Code, 2022 Edition, Title 32 of the Los Angeles County Code, or any amendment to the Fire Code contained in the City of Lomita Municipal Code, the provision contained in the latter listed document shall control.
A copy of Title 32 of the Los Angeles County Code and the California Fire Code, 2022 Edition, has been deposited in the office of the City Clerk and shall be at all times maintained by the City Clerk for use and examination by the public.
Section 3: Ratification of Building Standards. Pursuant to Health and Safety Code section 13869.7, subdivision (a), as part of its amendments to Title 32 (Fire Code), the Consolidated Fire Protection District of Los Angeles County proposed building standards relating to fire and panic safety that are more stringent than those building standards adopted by the State Fire Marshal and contained in the California Building Code. Pursuant to Health and Safety Code section 13869.7, subdivision (c), by adoption of this ordinance, the City Council hereby ratifies the building standards included within the ordinance amending Title 32 (Fire Code) as amended and in effect on March 2, 2023.
The City Council hereby finds that the more restrictive building standards contained in the District Fire Code are reasonably necessary due to the local climatic, geological, or topographical conditions in the City and adopts by reference the specific findings made by the Los Angeles County Board of Supervisors regarding these local conditions, a copy of which is attached as Exhibit 1.
Accordingly, the City Council finds the modifications in this Ordinance to the State Fire Code to be necessary for the protection of the public health, safety, and welfare.
Section 4. To the extent the provisions of this ordinance are substantially the same as previous provisions of the Lomita Municipal Code, these provisions shall be construed as continuations of those provisions and not as new enactments.
Section 5. Adoption of this ordinance is exempt from the California Environmental Quality Act (CEQA) in that it can be seen with certainty that there is no possibility that the ordinance may have a significant effect on the environment pursuant to State CEQA Guidelines Section 15061(b)(3). The adoption of the proposed ordinance is covered by the general rule that CEQA applies only to projects that have the potential for causing a Tuesday, November 19, 2024 Reg CC MTG, Page *91

significant effect on the environment. As the proposed ordinance adopts local amendments to the California Building Standard Code reasonably necessary to mitigate threats to the public health and safety posed by local climatic, geological, or topographical conditions, the City’s adoption is largely administrative in nature and designed to improve environmental quality; therefore, the action poses no potential of causing significant adverse effects to the environment.
Section 6. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance or any part hereof is for any reason held to be invalid, such invalidity shall not affect the validity of the remaining portions of this ordinance or any part thereof. The City Council of the City of Lomita hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared invalid.
Section 7. Effective Date. FINDINGS IN SUPPORT OF ADOPTION OF MORE RESTRICTIVE BUILDING STANDARDS.
The provisions of this ordinance contain various changes, modifications, and additions to the 2022 California Fire Code. Some of those changes are administrative in nature in that they do not constitute changes or modifications to requirements contained in the building standards adopted by the State Fire Marshal and published in the California Building Standards Code. Pursuant to Health and Safety Code Sections 17958.5, 17958.7, and 18941.5, the Board of Supervisors hereby expressly finds and determines that all of the changes and modifications to requirements contained in the building standards published in the California Building Standards Code, contained in this ordinance, which are not administrative in nature, are reasonably necessary because of local climatic, geological, or topographical conditions in the County of Los Angeles and in the Consolidated Fire Protection District of Los Angeles County (“District”). This expressed finding is supported and based upon the following more specific determinations:
CLIMATIC – The County of Los Angeles/District is located in an area subject to climatic conditions with long periods of low humidity and hot weather, combined with unpredictable seasonal high winds (Santa Ana wind conditions), resulting in increased exposure to fire risk. This combination of events creates an environment that is conducive to rapidly spreading fires. Control of such fires requires rapid response.

With the time that is required to deal with potential obstacles from the wind, such as fallen trees, street lights, and utility poles, in addition to the time required to climb 75 feet vertically up flights of stairs, the ability to respond rapidly is negatively impacted.
Additionally, there is a significant increase in the amount of wind at 60 feet above the ground. Use of aerial-type firefighting apparatus above this height would place rescue personnel at increased risk of injury. High winds will also cause burning embers to become airborne resulting in the rapid spread of a fire to nearby structures. Immediate containment of a fire is the only method by which it can be controlled during high wind conditions. In high fire severity zones, a unique combination of low humidity, strong winds, and dry vegetation exists.
GEOLOGICAL – The County of Los Angeles/District is located in the middle of the seismically active area identified as Seismic Zone 4. The viability of the public water system would be questionable at best after a major seismic event. Tall buildings would become vulnerable to uncontrolled fires due to a lack of available water and an inability to pump sufficient quantities of any available water to floors above the 55-foot level. A severe seismic event has the potential to negatively impact any rescue or fire suppression activities because it is likely to create significant physical obstacles and logistical challenges. With the probability of strong aftershocks, there exists a need to provide increased protection for anyone on upper floors.
Geological conditions created by the numerous faults will result in increased fire danger to structures, delayed Fire Department response, and unique rescue challenges.
Seismic events of sufficient magnitude will cause substantial damage to structures.
These damages are likely to be accompanied by a substantial number of fires that may Tuesday, November 19, 2024 Reg CC MTG, Page *94

exceed the Fire Department suppression capabilities. Accordingly, built-in fire suppression systems provide the only adequate measure to mitigate the potential hazards from and damage caused by such fires.
The County of Los Angeles/District is subject to occasional severe rainstorms.
The impacts from these rainstorms are exacerbated if hillside areas have been burned by wildland fires because significant mud and debris flows can occur. Mud and debris flows can impair Fire Department access or delay response times if access roads are obstructed by mud or debris.
TOPOGRAPHICAL – The topographical conditions of the County of Los Angeles/District includes many mountains, hills, and canyons which tend to accelerate the periodic high-velocity winds by means of a Venturi effect. These canyon winds and the significant growth of vegetation of a combustible nature increase the fire danger. Additionally, long periods of dry, hot weather, combined with unpredictable seasonal winds (Santa Ana wind conditions) result in increased exposure to fire risk.
The hillside areas have access roads that are narrow, steep, and contain many sharp curves, all of which makes timely response by large fire apparatus difficult.
The specific sections of this code that constitute more restrictive building standards are identified in the table set forth below. The more restrictive building standards contained in this code and identified in the table below shall be applicable only in those cities served by the District which have ratified the aforesaid sections in accordance with California Health and Safety Code Section 13869.
