ORDINANCE NO. 874

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LOMITA,

CALIFORNIA, ADOPTING UPDATED FIRE HAZARD SEVERITY ZONES AS

RECOMMENDED BY THE CALIFORNIA DEPARTMENT OF FORESTRY AND FIRE PROTECTION PURSUANT TO GOVERNMENT CODE SECTION 51178

AND FINDING THE ORDINANCE TO BE EXEMPT FROM CEQA

THE CITY COUNCIL OF THE CITY OF LOMITA DOES HEREBY ORDAIN AS FOLLOWS:

Section 1. Recitals.

A. The City of Lomita herby approves the updated Fire Hazard Severity Zone (FHSZ) map as recommended by the California Department of Forestry and Fire Protection pursuant to Government Code Section 51178.

B. The map, approved by the City of Lomita, is hereby incorporated by reference, and entitled “City of Lomita Fire Hazard Severity Zones.” C. On April 15, 2025, relevant information and FHSZ Map were presented to the public at a City Council meeting. The same information was made available at the City’s website for public review and comments.

Section 2. Adoption of Fire Hazard Severity Zone Map. The Fire Hazard Severity Zone Map entitled “City of Lomita Fire Hazard Severity Zones” dated March 24, 2025, as set forth in Exhibit A, is hereby approved.

Section 3. Environmental Findings. Adoption of this ordinance is exempt from the California Environmental Quality Act (CEQA) in that it can be seen with certainty that there is no possibility that the ordinance may have a significant effect on the environment pursuant to State CEQA Guidelines Section 15061(b)(3). The adoption of the proposed ordinance is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. As the proposed ordinance adopts local amendments to the California Building Standard Code reasonably necessary to mitigate threats to the public health and safety posed by local climatic, geological, or topographical conditions, the City’s adoption is largely administrative in nature and designed to improve environmental quality; therefore, the action poses no potential of causing significant adverse effects to the environment.

Section 4. Severability. If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this ordinance or any part hereof is for any reason held to be invalid, such invalidity shall not affect the validity of the remaining portions of this Ordinance No. 874

The City Council of the City of Lomita hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases be declared invalid.

Section 5. Effective Date. This ordinance shall take effect thirty (30) days after the date of its passage and adoption; and within fifteen (15) days after its passage and adoption, the City Clerk shall cause a copy of this ordinance to be published in accordance with the provisions of the law. The City Clerk shall certify the adoption of this ordinance.
