1 TO: City Council
FROM: Andrew Vialpando, City Manager
PREPARED BY: Adrian Fernandez, Community and Economic Development Director
Bryan Martinez, Associate Planner
MEETING DATE: August 19, 2025
SUBJECT: Discussion and Consideration of Vesting Tentative Parcel Map No. 83039 and Site Plan Review No. 1222 for the Creation of Two Lots from One Existing Legal Lot and Construction of a Single-Family Residence and Accessory Dwelling Unit on Each Resultant Lot Located at 25307 Oak Street in the Residential Single-Family (R-1) Zone

RECOMMENDATION
Adopt Resolution No. 2025-31 approving Vesting Tentative Parcel Map (VTPM) No. 83039 and Site Plan Review (SPR) No. 1222 to subdivide a 19,148 square foot, singlefamily residential lot into two lots and to construct a 2,908 square foot, two-story, singlefamily residence and 1,000 square foot, single-story, detached accessory dwelling unit (ADU) on each resultant lot; and, find that the project is categorical exemption from the California Environmental Quality Act (CEQA).

BACKGROUND
On October 11, 2021, the Planning Commission held a public hearing to consider the project and made a recommendation to the City Council to approve VTPM No. 83039.

Subsequently, on December 7, 2021, the City Council adopted Resolution No. 2021-42 approving the proposed VTPM subject to the conditions of approval in Planning Commission Resolution No. 2021-17. Condition No. 2 stated that the approval shall automatically become null and void after 24 months from the date of issuance unless extended. The City Council granted a one-year time extension, and the application expired on the extended date of December 7, 2024. The applicant failed to submit a second time extension request to further extend the approval.

CITY OF LOMITA

CITY COUNCIL REPORT
Item No. 9a
2 At the time of the application expiration, the final parcel map was under review and a few minor incomplete items remain outstanding. The applicant demolished the original residence which was a condition of approval to the final map. The original application excluded the development of the resultant lots. The development of the resultant lots was expected to be processed separately. However, future development associated with a vesting map is customarily considered concurrently with the vesting map. The subject application includes both the vesting map and proposed development.

DISCUSSION
On May 29, 2025, the developer, Mr. Ryan Baksh, submitted a new application to reinstate the previously approved VTPM. However, at this time, the new application includes the proposed development. On July 14, 2025, the Planning Commission considered the new application. The Commission adopted Resolution No. 2025-04 recommending that the City Council approve VTPM No. 83039 and SPR No. 1222, subject to the conditions of approval.

The proposed VTPM is identical to the previously approved VTPM. The VTPM would subdivide an existing 19,148 square foot lot into two. The developer proposes to develop each resultant lot with a 2,908 square foot, two-story, single-family residence and a 1,000 square foot, detached ADU. The project plans depict 1,200 square foot ADUs. Condition No. 11 was added for the applicant to revise the proposed ADUs not to exceed 1,000 square feet which would make the ADUs consistent with the maximum allowable square footage for ADUs. Additionally, Condition No. 12 was added to require the developer to record a covenant agreement requiring a reciprocal access easement for a shared driveway to be recorded at the time the resultant lots are not commonly owned. This shared driveway is required to comply with fire department access.

Analysis
The General Plan designation for the subject property is Low-Density Residential. The Low-Density Residential designation “applies to areas of the City which are developed with single-family residential uses” and prescribes a density not to exceed 10.89 units per acre. The lots have been designed in compliance with lot size requirements and can therefore accommodate single-family residences as envisioned by the General Plan. The applicant proposes to develop each resultant lot with a 2,908 square foot, two-story, single-family residence and a 1,000 square foot ADU.

The zoning designation for the subject property is R-1. The R-1 Zone is established to create single-family dwelling areas with minimum lot areas of 5,000 square feet and lots with a minimum frontages of 50 feet. Lot 1 is proposed as 9,572 gross square feet with a street frontage of 52.81 feet and Lot 2 is proposed as 9,574 gross square feet with a street frontage of 52.82 feet. Both resultant lots are consistent with the minimum standards established by the R-1 zoning district. VTPM No. 83039 complies with all General Plan and municipal code requirements. The project site is adequate in size, shape, topography, location, and other factors to accommodate the proposed two single- 3 family lots. In addition to the Planning Division’s review, the VTPM was reviewed by the City of Lomita’s Public Works Department and the City’s land development engineer consultants.

Planning Commission Resolution No. 2025-04 (Attachment 2), contains all conditions proposed by reviewing agencies and City departments.

Environmental Exemption
The project is categorically exempt pursuant to the California Environmental Quality Act (CEQA), Article 19, Section 15315 – Minor Subdivision of Lands. Specifically, the division of property in urbanized areas zoned for residential use into four or fewer parcels may be considered exempt so long as the proposal is compliant with the General Plan and zoning, and all service and access to the parcels is available. Additionally, pursuant to Section 15303(a) – New Construction or Conversion of Small Structures of the CEQA Guidelines, the construction of one single-family residence or a second dwelling unit in a residential zone may be considered exempt from CEQA review. The parcel does not have a slope in excess of 20 percent, and the parcel was not involved in a previous division within the past two years. The proposed project complies with all the criteria for exemption.

FISCAL IMPACT
There are no financial implications resulting from this recommendation.
