b. POTENTIAL CITY POLICY FOR THE INSTALLATION OF SPEED HUMPS RECOMMENDED ACTION: Discuss and consider a potential City policy for the installation of speed humps; and, provide staff with direction.

City Manager Vialpando introduced Water Quality and Environmental Specialist Bucklew, who gave the presentation. Among the topics outlined were adopted regulations and criteria, regional policy changes, types of vertical roadway deflections, implementation process and costs, and City Council options this evening.

Brief City Council discussion included Eshelman Avenue’s classification as an arterial road, future improvements by way of the Local Travel Network and the School Loading Zone Study, implementation of the Traffic Calming Toolkit, and opposition by some residents to having a speed hump in front of their homes, which reduces street parking.

FROM: Andrew Vialpando, City Manager
PREPARED BY: Lina Hernandez, Assistant City Manager
MEETING DATE: March 3, 2026
SUBJECT: Agreement with CommLine, Inc. for the Purchase and Installation of Handheld Radios and Related Communication Equipment to Support Field Operations Across Multiple City Departments

RECOMMENDED ACTION
Approve an Agreement with CommLine, Inc. for the purchase and implementation of handheld radios and related communication equipment to support Community Safety field operations, in an amount not to exceed $37,750, including contingency for unexpected work; and, appropriate the $37,750 from the General Fund available balance.

BACKGROUND
The City of Lomita maintains a workforce that delivers core municipal services to its residents. Day-to-day functions of City employees invovle operating autonomously in the field and in coordination with one another within their respective departments and interdepartmentally. As part of this integrated service delivery model, field staff from multiple departments perform a range of field-based, non-emergency public safety, infrastructure, and quality-of-life functions throughout the City.

Reliable, consistent, and interoperable radio communication is a critical component of daily field operations. Handheld radios provide field staff with the ability to communicate in real time with one another, coordinate responses, relay information, and maintain situational awareness while working in the field. These communication capabilities directly support officer safety, operational efficiency, and coordinated response to issues that impact Lomita stakeholders.

Staff has identified the need to procure handheld radios and related communication equipment to ensure that City personnel are equipped with reliable and properly configured devices that meet current operational requirements and integrate with existing communication infrastructure.

CITY OF LOMITA

CITY COUNCIL REPORT
Item No. 7d
Tuesday, March 03, 2026 Reg CC MTG, Page *28
2 DISCUSSION
Staff is recommends the purchase and installation of a comprehensive Citywide radio system that will be deployed across multiple City departments to support reliable, direct communication among field staff throughout the City. The proposed scope of work includes the procurement of handheld radio equipment, system programming and configuration, coordination related to system requirements, and associated labor necessary to place the equipment into service.

In addition to supporting routine operations, the proposed radio equipment enhances the City’s operational readiness during emergencies or disaster events, when cellular networks may be disrupted or unavailable, by providing a reliable and independent means of communication among field personnel. Reliable radio communications are particularly important for staff working independently in the field, responding to service requests, addressing quality-of-life concerns, maintaining City facilities and infrastructure, and preserving consistent visibility and coordination throughout the community.

CommLine, Inc. was selected based on its experience providing public safety communication equipment and services, familiarity with applicable communication system requirements, and ability to deliver the proposed equipment and services within the City’s operational needs and timeline. CommLine, Inc. is an authorized dealer of Motorola devices and equipment. The proposed agreement is based on a detailed vendor quote that outlines the equipment, services, and associated costs.

FISCAL IMPACT
The proposed agreement is based on a vendor quote totaling $32,797.30. Staff recommends including a 15 % contingency to address unforeseen costs related to equipment configuration, installation, or coordination, resulting in a total not-to-exceed amount of $37,750. If approved, $37,750 would need to be appropriated from the General Fund available balance.

VISION, MISSION, VALUES, AND STRATEGIC OUTCOMES
The City’s Vision, Mission, and Values establish priorities and provide a framework for policy decision making. This item supports Strategic Outcome No. 1: Safety & Security – Keeping Lomita safe, prepared, and resilient, by equipping City field personnel with reliable communication tools that enhance operational effectiveness and officer safety.

E. CONTRACTOR shall submit to CITY, by not later than the 10th day of each month, its bill for services itemizing the fees and costs incurred during the previous month. CITY shall pay CONTRACTOR all uncontested amounts set forth in the CONTRACTOR'S bill within 30 days after it is received

3. PAYMENTS. For CITY to pay CONTRACTOR as specified by this Agreement, CONTRACTOR must submit an invoice to CITY which lists the reimbursable costs, the specific tasks performed, and, for work that includes deliverables, the percentage of the task completed during the billing period. Nothing in this Section shall entitle CONTRACTOR for compensation not specified in Section 1 of this Agreement.

Any extensions shall be approved in writing in advanced by both parties.

7. KEY PERSONNEL. CONTRACTOR’s key person assigned to perform work under this Agreement is Jon Nagel, Sales Manager for CommLine, Inc. CONTRACTOR shall not assign another person to be in charge of the work contemplated by this Agreement without the prior written authorization of CITY..

Contracting staff whose primary job duties are related to implementation of BMPs shall be adequately trained to effectively implement, operate, and maintain such BMPs and must be versed in factors affecting BMP effectiveness. The contractor shall certify they have received all applicable training to implement the requirements in Municipal NPDES Permit No.

CAS004004 and shall provide documentation to that effect.

9. CHANGES. CITY may order changes in the services within the general scope of this Agreement, consisting of additions, deletions, or other revisions, and the contract sum, and the contract time will be adjusted accordingly. All such changes must be authorized in writing, executed by CONTRACTOR and CITY. The cost or credit to CITY resulting from changes in the services will be determined in accordance with the written agreement between the parties.

10. TAXPAYER IDENTIFICATION NUMBER. CONTRACTOR will provide CITY with a Taxpayer Identification Number.

11. PERMITS AND LICENSES. CONTRACTOR will obtain and maintain during the term of this Agreement all permits, licenses, and certificates that may be required by local, state, and federal laws in connection with the performance of services under this Agreement, including a business license as specified in Title VI, Chapter 2 of the Lomita Municipal Code.

12. LAWS AND REGULATIONS; EMPLOYEE/LABOR CERTIFICATION.

Page 4 of 12 ends

A. Except as otherwise provided, CITY may terminate this Agreement at any time with or without cause. Notice of termination shall be in writing.

B. CONTRACTOR may terminate this Agreement. Notice will be in writing at least 30 days before the effective termination date.

C. In the event of such termination, CONTRACTOR shall cease services as of the date of termination, all finished or unfinished documents, data, drawings, maps, and other materials prepared by CONTRACTOR shall, at CITY’s option, become CITY’s property, and CONTRACTOR will receive just and equitable compensation for any work satisfactorily completed up to the effective date of notice of termination.

D. Should the Agreement be terminated pursuant to this Section, CITY may procure on its own terms services similar to those terminated.

2. INDEMNIFICATION.

A. CONTRACTOR shall indemnify, defend with counsel approved by CITY, and hold harmless CITY, its officers, officials, employees and volunteers from and against all liability, loss, damage, expense, cost (including without limitation reasonable attorneys fees, expert fees and all other costs and fees of litigation) of every nature arising out of or in connection with CONTRACTOR's performance of work hereunder or its failure to comply with any of its obligations contained in this AGREEMENT, regardless of CITY’S passive negligence, but excepting such loss or damage which is caused by the sole active negligence or willful misconduct of CITY. Should CITY in its sole discretion find CONTRACTOR’S legal counsel unacceptable, then CONTRACTOR shall reimburse CITY its costs of defense, including without limitation reasonable attorneys fees, expert fees and all other costs and fees of litigation.

CONTRACTOR shall promptly pay any final judgment rendered against CITY (and its officers, officials, employees and volunteers) covered by this indemnity obligation. It is expressly understood and agreed that the foregoing provisions are intended to be as broad and inclusive as is permitted by the law of the State of California and will survive termination of this Agreement.

B. The requirements as to the types and limits of insurance coverage to be maintained by CONTRACTOR as required by Section 19, and any approval of said insurance by CITY, are not intended to and will not in any manner limit or qualify the liabilities and obligations otherwise assumed by CONTRACTOR pursuant to this Agreement, including, without limitation, to the provisions concerning indemnification.

3. ASSIGNABILITY. This Agreement is for CONTRACTOR’s professional services.

CONTRACTOR’s attempts to assign the benefits or burdens of this Agreement without CITY’s written approval are prohibited and will be null and void.

Page 5 of 12 ends

4. INDEPENDENT CONTRACTOR. CITY and CONTRACTOR agree that THE CONTRACTOR will act as an independent contractor and will have control of all work and the manner in which it is performed. THE CONTRACTOR will be free to contract for similar service to be performed for other employees while under contract with CITY. CONTRACTOR is not an agent or employee of CITY and is not entitled to participate in any pension plan, insurance, bonus or similar benefits CITY provides for its employees. Any provision in this Agreement that may appear to give CITY the right to direct CONTRACTOR as to the details of doing the work or to exercise a measure of control over the work means that CONTRACTOR will follow the direction of the CITY as to end results of the work only.

5. AUDIT OF RECORDS.

A. THE CONTRACTOR agrees that CITY, or designee, has the right to review, obtain, and copy all records pertaining to the performance of this Agreement.

CONTRACTOR agrees to provide CITY, or designee, with any relevant information requested and will permit CITY, or designee, access to its premises, upon reasonable notice, during normal business hours for the purpose of interviewing employees and inspecting and copying such books, records, accounts, and other material that may be relevant to a matter under investigation for the purpose of determining compliance with this Agreement.

CONTRACTOR further agrees to maintain such records for a period of three (3) years following final payment under this Agreement.

B. CONTRACTOR will keep all books, records, accounts and documents pertaining to this Agreement separate from other activities unrelated to this Agreement.

6. CORRECTIVE MEASURES. CONTRACTOR will promptly implement any corrective measures required by CITY regarding the requirements and obligations of this Agreement. CONTRACTOR will be given a reasonable amount of time as determined by CITY to implement said corrective measures. Failure of CONTRACTOR to implement required corrective measures shall result in immediate termination of this Agreement.

7. INSURANCE REQUIREMENTS.

A. CONTRACTOR, at CONTRACTOR’s own cost and expense, shall procure and maintain, for the duration of the contract, the following insurance policies:

1. Workers Compensation Insurance as required by law. CONTRACTOR shall require all subcontractors similarly to provide such compensation insurance for their respective employees. Any notice of cancellation or non-renewal of all Workers’ Compensation policies must be received by CITY at least thirty (30) days prior to such change. The insurer shall agree to waive all rights of subrogation against CITY, its officers, agents, employees, and volunteers for losses arising from work performed by CONTRACTOR for CITY.

Tuesday, March 03, 2026 Reg CC MTG, Page *35

Page 6 of 12 ends

2. General Liability Coverage. CONTRACTOR shall maintain commercial general liability insurance in an amount of not less than two million dollars ($2,000,000) per occurrence for bodily injury, personal injury, and property damage. If a commercial general liability insurance form or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to the work to be performed under this Agreement or the general aggregate limit shall be at least twice the required occurrence limit.

3. Automobile Liability Coverage. CONTRACTOR shall maintain automobile liability insurance covering bodily injury and property damage for all activities of CONTRACTOR arising out of or in connection with the work to be performed under this Agreement, including coverage for owned, hired, and non-owned vehicles, in an amount of not less than one million dollars ($1,000,000) combined single limit for each occurrence.

4. Professional Liability Coverage. CONTRACTOR shall maintain professional errors and omissions liability insurance for protection against claims alleging negligent acts, errors, or omissions which may arise from CONTRACTOR’S operations under this Agreement, whether such operations be by CONTRACTOR or by its employees, subcontractors, or subcontractors. The amount of this insurance shall not be less than two million dollars ($2,000,000) on a claims-made annual aggregate basis, or a combined single-limit-per-occurrence basis. When coverage is provided on a “claims made basis,” CONTRACTOR will continue to renew the insurance for a period of three (3) years after this Agreement expires or is terminated.

Such insurance will have the same coverage and limits as the policy that was in effect during the term of this Agreement, and will cover CONTRACTOR for all claims made by CITY arising out of any errors or omissions of CONTRACTOR, or its officers, employees or agents during the time this Agreement was in effect.

B. Endorsements. Each general liability, automobile liability and professional liability insurance policy shall be issued by a financially responsible insurance company or companies admitted and authorized to do business in the State of California, or which is approved in writing by CITY, and shall be endorsed as follows. CONTRACTOR also agrees to require all contractors, and subcontractors to do likewise.

1. “The CITY, its elected or appointed officers, officials, employees, agents, and volunteers are to be covered as additional insureds with respect to liability arising out of work performed by or on behalf of the CONTRACTOR, including materials, parts, or equipment furnished in connection with such work or operations.”

2. This policy shall be considered primary insurance as respects CITY, its elected or appointed officers, officials, employees, agents, and volunteers.

Any insurance maintained by CITY, including any self-insured retention Tuesday, March 03, 2026 Reg CC MTG, Page *36

Page 7 of 12 ends

CITY may have, shall be considered excess insurance only and shall not contribute with this policy.

3. This insurance shall act for each insured and additional insured as though a separate policy had been written for each, except with respect to the limits of liability of the insuring company.

4. The insurer waives all rights of subrogation against CITY, its elected or appointed officers, officials, employees, or agents.

5. Any failure to comply with reporting provisions of the policies shall not affect coverage provided to CITY, its elected or appointed officers, officials, employees, agents, or volunteers.

6. The insurance provided by this policy shall not be suspended, voided, canceled, or reduced in coverage or in limits except after thirty (30) days’ written notice has been received by CITY.

C. CONTRACTOR agrees to provide immediate notice to CITY of any claim or loss against Contractor arising out of the work performed under this agreement.

CITY assumes no obligation or liability by such notice, but has the right (but not the duty) to monitor the handling of any such claim or claims if they are likely to involve CITY.

D. Any deductibles or self-insured retentions must be declared to and approved by CITY. At CITY’s option, CONTRACTOR shall demonstrate financial capability for payment of such deductibles or self-insured retentions.

E. CONTRACTOR shall provide certificates of insurance with original endorsements to CITY as evidence of the insurance coverage required herein.

Certificates of such insurance shall be filed with CITY on or before commencement of performance of this Agreement. Current certification of insurance shall be kept on file with CITY at all times during the term of this Agreement.

F. Failure on the part of CONTRACTOR to procure or maintain the required insurance shall constitute a material breach of contract under which CITY may terminate this Agreement pursuant to Section 14 above.

G. The commercial general and automobile liability policies required by this Agreement shall allow CITY, as additional insured, to satisfy the self-insured retention (“SIR”) and/or deductible of the policy in lieu of the CONTRACTOR (as the named insured) should CONTRACTOR fail to pay the SIR or deductible requirements. The amount of the SIR or deductible shall be subject to the approval of the City Attorney and the Finance Director. CONTRACTOR understands and agrees that satisfaction of this requirement is an express condition precedent to the effectiveness of this Agreement. Failure by CONTRACTOR as primary insured to pay its SIR or deductible constitutes a Tuesday, March 03, 2026 Reg CC MTG, Page *37

Page 8 of 12 ends

material breach of this Agreement. Should CITY pay the SIR or deductible on CONTRACTOR’S behalf upon CONTRACTOR’S failure or refusal to do so to secure defense and indemnification as an additional insured under the policy, CITY may include such amounts as damages in any action against Contractor for breach of this Agreement in addition to any other damages incurred by CITY due to the breach.

8. USE OF OTHER CONTRACTORS. THE CONTRACTOR must obtain CITY’s prior written approval to use any Contractors while performing any portion of this Agreement. Such approval must include approval of the proposed Contractor and the terms of compensation.

9. FINAL PAYMENT ACCEPTANCE CONSTITUTES RELEASE. The acceptance by the CONTRACTOR of the final payment made under this Agreement shall operate as and be a release of CITY from all claims and liabilities for compensation to the CONTRACTOR for anything done, furnished or relating to the CONTRACTOR’S work or services. Acceptance of payment shall be any negotiation of CITY’S check or the failure to make a written extra compensation claim within ten (10) calendar days of the receipt of that check. However, approval or payment by CITY shall not constitute, nor be deemed, a release of the responsibility and liability of CONTRACTOR, its employees, sub-Contractors and agents for the accuracy and competency of the information provided and/or work performed; nor shall such approval or payment be deemed to be an assumption of such responsibility or liability by CITY for any defect or error in the work prepared by CONTRACTOR, its employees, sub-Contractors and agents.

10. CORRECTIONS. In addition to the above indemnification obligations, the CONTRACTOR shall correct, at its expense, all errors in the work which may be disclosed during the CITY’S review of CONTRACTOR’S report or plans. Should the CONTRACTOR fail to make such correction in a reasonably timely manner, such correction shall be made by CITY, and the cost thereof shall be charged to CONTRACTOR. In addition to all other available remedies, CITY may deduct the cost of such correction from any retention amount held by CITY or may withhold payment otherwise owed CONTRACTOR under this Agreement up to the amount of the cost of correction.

11. NON-APPROPRIATION OF FUNDS. Payments to be made to CONTRACTOR by CITY for services preformed within the current fiscal year are within the current fiscal budget and within an available, unexhausted fund. In the event that CITY does not appropriate sufficient funds for payment of CONTRACTOR’S services beyond the current fiscal year, the Agreement shall cover payment for CONTRACTOR’S only to the conclusion of the last fiscal year in which CITY appropriates sufficient funds and shall automatically terminate at the conclusion of such fiscal year.

PREPARED BY: Andrew Vialpando, City Manager
MEETING DATE: March 3, 2026
SUBJECT: Appraisal and Administrative Fees for the Defense Fuel Support Point San Pedro Facility (Lomita Sports Complex and Community Center)

RECOMMENDED ACTION
Approve payment for the real estate property appraisal and associated administrative fees to the Department of the Navy Naval Facilities Engineering Systems Command (NAVFAC) Real Estate Division in an amount of $35,750 for the Defense Fuel Support Point San Pedro Facility (Lomita Sports Complex and Community Center).

BACKGROUND
The United States Department of Navy owns approximately 19 acres of land serving as a Defense Fuel Support Point facility operated by the Naval Weapons Station Seal Beach (NWSSB) that encompasses a large area within San Pedro (City of Los Angeles), with approximately two of the 19 acres of land situated within the City of Lomita’s southeastern boundary at 26800 S. Western Ave. The approximately six acres located within Lomita operate as youth baseball fields built over 50 years ago and have since been used by the Lomita Little League under a license agreement with the Navy (Navy Fields).

In 2021, the NWSSB was instructed by the Department of Defense (collectively “Navy”) to begin exploring relinquishing portions of the Defense Fuel Support facility in response to a directive from the Secretary of Defense. With support from Congressman Ted Lieu and Congresswoman Nanette Barragan, Congress authorized the Navy to begin negotiations to transfer the Navy Fields to the City through the adoption of the 2024 National Defense Authorization Act (NDAA) bill in December 2024. The City consequently began working with the Navy to begin the necessary real estate transactions associated with conveying the land to the City.

CITY OF LOMITA

CITY COUNCIL REPORT
Item No. 7e
Tuesday, March 03, 2026 Reg CC MTG, Page *45
2 At its meeting on May 6, 2025, the City Council authorized staff to begin the process of entering into an interim lease agreement and eventual conveyance of land with the Navy.

DISCUSSION
As part of the authorization to proceed by the City Council in May 2025, the City paid the Navy’s Facilities Engineering Systems Command (NAVFAC) Division of Real Estate an administrative fee of $35,350 to begin the process of entering into an Interim Lease Agreement. The City took the lead in surveying the land boundaries in order to establish a legal description of the property to be conveyed.

Over this time, substantial progress has been achieved. The City’s long-term funding and development framework is coming into focus, a Phase II soil analysis has been completed, and the legal and boundary description is finalized, with only minor easement issues remaining.

Given the level of progress and readiness on both sides, City staff requested from the Navy that both parties move into a new phase initiating and prioritizing the land conveyance process. Moreover, the City Attorney has advised that focusing efforts on completing the conveyance at this stage will be the most efficient approach and will help avoid duplicative legal work and unnecessary costs associated with interim arrangements.

Pursuant to the National Defense Authorization Act (NDAA) congressional bill authorizing conveyance of the land, the Navy is responsible for appraising the land value at the City’s cost. As a result, the Navy has provided the City with a proposal for the appraisal and associated administrative fees (Attachment A).

FISCAL IMPACT
The City has spent $80,520 on the lease and conveyance process so far, which includes land surveying and the Navy’s imposed real estate administrative fees. The additional costs for the appraisal and associated administrative fees is $35,750. The funds are appropriated in the current Adopted Budget.

VISION, MISSION, VALUES, AND STRATEGIC OUTCOMES
The City’s Vision, Mission, and Values set the standard for the organization, establish priorities, uniformity and guidelines; and provide the framework for policy decision making. The Strategic Outcomes were implemented to provide a pathway to achieving the City’s Vision. This item aligns with Strategic Outcome No. 4: Quality of Life & Livability – Creating vibrant spaces and services for all ages.

These are the limits set in Pay.gov. Your bank or the agency being paid may have a lower limit.

Credit Cards
 Up to a total of $24,999.99 for all transactions with one or more U.S. Government agencies conducted on the same day using the same credit card. The total could combine payments made on Pay.gov and payments made any other way, such as presenting or swiping the card directly at an agency office. Example: On a Thursday, the same credit card is used for three separate payments of $10,000 each. Two payments were made on Pay.gov. The third payment, made directly to an agency, will be rejected because the total of all payments made with the credit card is over the daily limit. You could, however, use a different credit card for the third payment.
 You may not split payments using the same card if the total will be over the limit, even if partial payments are made on different days.

Example: You must pay a fee of $35,000. You decide to make two partial payments using the same credit card. On Thursday, you pay $20,000. On Friday, you pay the remaining $15,000. Because both payments are for the same fee, the same card was used and the total of both payments is over the limit, Friday's payment will be rejected. You could use a different credit card for each partial payment.

Debit Cards
 No limit except for the funds available in your account.

Bank Accounts for ACH Debit or Credit
 Up to $99,999,999.99 per transaction, limited by the funds available in the account.

MEETING DATE: March 3, 2026
SUBJECT: Approval of the 2026-2028 Legislative Platform

RECOMMENDED ACTION
Adopt Resolution No. 2026-09 approving the 2026-2028 Legislative Platform.

BACKGROUND
Every legislative session, numerous State and Federal bills are proposed that have the potential to impact the City’s ability to operate effectively and provide quality services to its residents. To create a more efficient means of communicating the City’s position to legislators, the City Council first adopted a Legislative Platform in April 2015 and has subsequently updated it to reflect evolving priorities.

The current Legislative Platform covers the 2026 to 2028 legislative cycle. The updated Platform reflects recent discussions with legislative partners, including the California Contract Cities Association, the League of California Cities, the South Bay Cities Council of Government, and the City’s state and federal advisors. It continues to focus on protecting local decision-making authority, promoting fiscal stability, supporting public safety, advancing infrastructure investment, and encouraging sustainable community and economic development.

DISCUSSION
The proposed Legislative Platform largely maintains the City’s existing policy priorities, including protection of local decision-making authority, fiscal stability, public safety, infrastructure investment, environmental sustainability, and community and economic development. The overall framework and core positions remain consistent.

2 Additions to the updated Legislative Platform include trending issues impacting Lomita, including cybersecurity protections for local government, addressing rising insurance costs for residents and businesses, expanding efforts to combat the fentanyl and opioid crisis, and supporting traffic calming and roadway safety measures. The Legislative Platform also adds a position opposing prevailing wage mandates on public works projects and includes language supporting flexibility for future planning and use of the Lomita Sport and Community Center.

Additionally, environmental policies have been strengthened to emphasize protections for communities impacted by pollution and to reinforce accountability measures, while teleconferencing language has been clarified to further support local discretion in conducting hybrid public meetings.

FISCAL IMPACT
There are no financial implications resulting from this recommendation.

VISION, MISSION, VALUES, AND STRATEGIC OUTCOMES
The City’s Vision, Mission, and Values set the standard for the organization, establish priorities, uniformity and guidelines; and provide the framework for policy decision making. CITY OF LOMITA
2026-28 LEGISLATIVE PLATFORM
This Legislative Platform, adopted by the City Council, clearly outlines the position of the City of Lomita on priority issues that impact the City’s ability to operate effectively. The Legislative Platform allows City elected officials and staff to act quickly in reaching out to legislators, executive branch elected officials, and their staff to communicate the City’s interests at the federal, state, and regional levels.

For legislative or regulatory issues for which the City Council has established a policy within this Legislative Platform, the Legislative Affairs Ad-Hoc Committee may approve a position letter to be communicated by the Mayor, City Manager or designated staff to legislators, administration officials, legislative or administration staff, and other entities.

When timeliness of action is required, position letters on legislative or regulatory issues covered within the Platform may be communicated by the Mayor or City Manager without prior approval of the Legislative Affairs Ad-Hoc Committee.

In instances where this Legislative Platform does not provide specific policy guidance on a legislative or regulatory matter, the issue will be brought to the Legislative Affairs AdHoc Committee for a recommendation to the full City Council. These matters may also be brought directly to the full City Council if timeliness of action by the Council is required or upon the request of the City Council.

PLATFORM OVERVIEW
The city values its ability and authority to exercise local control and to protect and enhance the overall welfare of Lomita residents. To that end, the City’s primary legislative focus is to protect local government control and promote stable revenue for local governments to plan for future growth and public facilities and services needed.

FROM: Andrew Vialpando, City Manager
PREPARED BY: Susan Kamada, Deputy City Manager/Administrative Services Director
MEETING DATE: March 3, 2026
SUBJECT: Consideration of a Resolution Declaring a Fiscal Emergency Pursuant to California Constitution Article XIIIC, §2(b) and Placement of a City of Lomita Local Control and Services Measure, a 0.25% (1/4 cent) Transactions and Use (sales) Tax on the June 2, 2026, Special Municipal Election Ballot

RECOMMENDED ACTION
Adopt Resolutions No. 2026-10, 2026-11 and 2026-12 declaring a fiscal emergency pursuant to Article XIIIC Section 2(b) of the California Constitution and placing a City of Lomita Local Control and Services Measure 0.25% (1/4 cent) transactions and use (sales) tax on the June 2, 2026, Special Municipal Election ballot.

BACKGROUND
City staff is in the process of developing the City’s FY 2026-27 Budget. For years, the City Council has remained fiscally prudent and responsible by adopting balanced budgets and steadily growing the City’s reserves, or rainy-day funds. The City’s current Adopted FY 2025-26 Budget General Fund expenditures match its revenues, at just over $16 million.

The City’s reserves reflect about 50% of the City’s General Fund expenses, at just over $8 Million.

At its meeting on October 15, 2024, the City Council approved to receive and file the Lomita Sewer Master Plan, which identified nearly 3,000 linear feet of 90-year-old Cityowned sewer infrastructure that is at risk for failure, per water engineers. The report indicated that the sewer infrastructure is in need of replacement or upgrades to meet capacity needs and the City must be able to address these needs before there are major pipe breaks and flooding. Moreover, the infrastructure identified runs underneath private property, elevating the need to address this issue in a timely manner. Combined, the City’s engineering consultants estimated the work to cost at least $10 million.

CITY OF LOMITA

CITY COUNCIL REPORT
Item No. 8a
Tuesday, March 03, 2026 Reg CC MTG, Page *66
2 Currently, the City has less than $500,000 appropriated toward sewer repair and replacement.

DISCUSSION
The recent passage of Los Angeles County’s 2024 Measure A for Countywide homeless services included the repeal of Measure H, which was implemented in 2017 as a 0.25% (1/4 cent) transaction and use tax. The repeal of Measure H has created a situation where any city within the County may access this newly available 0.25% (1/4 cent) sales tax portion with voter approval.

On February 10, 2026, the Los Angeles County Board of Supervisors approved placing a new sales tax measure on the County June 2, 2026 ballot, resulting in the possibility of local sales tax revenue being redirected for purposes outside of Lomita.

If Lomita does not act to place its own measure on the ballot so taxpayer dollars stay local in Lomita to serve residents, Los Angeles County could seize this money and use it for County purposes. Placing a City of Lomita Local Control and Services measure on the June ballot is an opportunity to generate tax dollars that are spent in Lomita, not controlled by County bureaucrats. Lomita residents have indicated that they want their taxpayer dollars spent and used in Lomita, not controlled or spent by County bureaucrats.

It is estimated that the proposed transaction and use (sales) tax, if approved by voters, could generate annual revenues of $650,000 for the City’s general fund. The additional revenue for the City will reduce the risk of depleting City reserves for significant sewer repairs and could help avoid reduction of City services provided for the benefit of its residents. Furthermore, the Lomita Local Control and Services measure will require that all revenue is collected and spent only to benefit Lomita residents and businesses to maintain City services and address local issues.

The City Council commissioned a community survey in 2025 to gauge residents’ priorities in order to guide the City Council’s future budgetary goals and strategic outcomes. Some 73% of respondents said there is a need for additional funding for Lomita City services, and that public safety services and investment in infrastructure are top priorities per respondents to the survey.

FISCAL IMPACT
The estimated cost to run the election from the Los Angeles County RegistrarRecorder/County Clerk on the June 2026 Ballot is between $40,000 to $50,000.

RESOLUTION NO. 2026-10

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOMITA,

CALIFORNIA, CALLING FOR THE PLACEMENT OF A GENERAL TAX
MEASURE ON THE BALLOT FOR THE JUNE 2, 2026 SPECIAL

MUNICIPAL ELECTION FOR THE SUBMISSION TO THE QUALIFIED

VOTERS OF AN ORDINANCE TO ENACT A TRANSACTIONS AND USE
TAX (SALES TAX) AT THE RATE OF ONE-QUARTER CENT (1/4¢)
WHEREAS, the City of Lomita (“City”) is authorized to levy a Transactions and Use Tax (“TUT”) for general purposes pursuant to California Revenue and Taxation Code section 7285.9, subject to approval by a majority vote of the electorate pursuant to Article XIIIC, section 2 of the California Constitution (“Proposition 218”); and WHEREAS, pursuant to California Elections Code section 9222, the City Council has authority to place local measures on the ballot to be considered at “any succeeding regular or special city election” which “shall be held not less than 88 days after the date of the order of election”; and
WHEREAS, the City Council would like to submit to the voters at the June 2, 2026 Special Municipal Election a measure establishing a supplemental TUT of one-quarter cent (1/4¢) on the sale and/or use of all tangible personal property sold at retail in the City until ended by voters, as more specifically set forth in the attached proposed ordinance adding Chapter 7 to Title VII of the City’s Municipal Code; and WHEREAS, the one-quarter cent (1/4¢) TUT is a general tax, the revenue of which will be placed in the City’s general fund and will be used to pay for general City services; and
WHEREAS, pursuant to Proposition 218 (California Constitution, Article XIIIC, Section 2(b)) any measure proposing to impose a new general tax, or increase or extend an existing general tax must be consolidated with a “regularly scheduled general election” for members of the City Council, unless the City Council makes certain fiscal emergency findings by unanimous vote to place the measure on a special election at another date; and
WHEREAS, the next “regularly scheduled general election” at which City Council members are to be elected which is at least 88 days later is not until the General Municipal Election to be held on Tuesday, November 3, 2026; and
WHEREAS, for the following reasons, the health, safety and general welfare of the citizens of the City would be endangered if the City were unable to place this Measure before its voters until November 3, 2026; and
WHEREAS, the City seeks to ensure Lomita’s taxpayer dollars stay local in Lomita to serve City needs; and
Tuesday, March 03, 2026 Reg CC MTG, Page *69
WHEREAS, Lomita residents have indicated that they want their taxpayer dollars spent and used in Lomita, not controlled or spent by Los Angeles County bureaucrats; and
WHEREAS, if this Lomita Local Control and Services Measure is enacted, it will require that all revenue is collected and spent only to benefit Lomita residents and businesses to maintain City services and address local issues; and WHEREAS, water engineers have identified city water and sewer pipes, some of which are 90 years old, as at risk of failure if not upgraded, and the City is responsible for upgrading those pipes before there are major pipe breaks and flooding; and WHEREAS, the cost of upgrading these aging pipes could drain City financial reserves; and
WHEREAS, absent prompt action to seek voter approval for additional City revenue sources, the City’s General Fund reserves could be depleted, necessitating substantial reductions in important City services; and
WHEREAS, on February 10, 2026, the Los Angeles County Board of Supervisors voted to place a ½% general transactions and use tax measure on the June 2, 2026 ballot; and WHEREAS, absent special legislation, if the County transactions and use tax measure were to pass with majority County voter approval, this could impact the City of Lomita’s ability to enact a ¼% City transactions and use tax measure with City voter approval due to the combined 2% statutory cap on county and city transactions and use taxes under California Revenue and Taxation Code section 7251.1; and WHEREAS, this action by Los Angeles County threatens to seize the limited funds available to city governments for the County’s sole use; and WHEREAS, the City Council deems it necessary to place this ¼% City transactions and use tax measure on the June 2, 2026 ballot to best guard against the projected financial impacts identified above as well as to give the City the best opportunity to utilize ¼% of transactions and use taxation authority under the Revenue and Taxation Code section 7251.1 statutory cap, given the County’s recent actions in attempting to enact its own transactions and use tax measure; and
WHEREAS, all of the circumstances described above create an emergency situation warranting the placement of this Measure on a special municipal election to be held on the next available election ballot date to permit the voters to decide pursuant to Proposition 218; and
WHEREAS, the next available legal election ballot date for a special municipal election is the Statewide Primary Election to be held on Tuesday, June 2, 2026; and Tuesday, March 03, 2026 Reg CC MTG, Page *70
WHEREAS, the ordinance to be considered by the qualified voters and the terms of approval, collection and use of the general TUT are described and provided for in the ordinance/measure attached hereto as Exhibit “A” (the “Measure”) and by this reference made an operative part hereof, in accordance with all applicable laws.

SECTION 2. Declaration of Emergency. SECTION 9. Filing with County. This chapter shall be known as the “Lomita Supplemental Transactions and Use Tax Ordinance”. The City of Lomita hereinafter shall be called "City." This chapter shall be applicable in the incorporated territory of the City.
7-7.02 – Purpose.

This chapter is adopted to achieve the following, among other purposes, and directs that the provisions hereof be interpreted in order to accomplish those purposes:

A. To impose a retail transactions and use tax in accordance with the provisions of Part

1.6 (commencing with Section 7251) of Division 2 of the Revenue and Taxation Code and Section 7285.9 of Part 1.7 of Division 2 which authorizes the City to adopt this tax ordinance which shall be operative if a majority of the electors voting on the measure vote to approve the imposition of the tax at an election called for that purpose.

B. To adopt a retail transactions and use tax ordinance that incorporates provisions identical to those of the Sales and Use Tax Law of the State of California insofar as those provisions are not inconsistent with the requirements and limitations contained in Part 1.6 of Division 2 of the Revenue and Taxation Code.

C. To adopt a retail transactions and use tax ordinance that imposes a tax and provides a measure therefore that can be administered and collected by the California Department of Tax and Fee Administration in a manner that adapts itself as fully as practicable to, and requires the least possible deviation from, the existing statutory Tuesday, March 03, 2026 Reg CC MTG, Page *84
and administrative procedures followed by the California Department of Tax and Fee Administration in administering and collecting the California State Sales and Use Taxes.

D. To adopt a retail transactions and use tax ordinance that can be administered in a manner that will be, to the greatest degree possible, consistent with the provisions of Part 1.6 of Division 2 of the Revenue and Taxation Code, minimize the cost of collecting the transactions and use taxes, and at the same time, minimize the burden of record-keeping upon persons subject to taxation under the provisions of this ordinance.
7-7.03 - Contract With State.

Prior to the operative date, the City shall contract with the California Department of Tax and Fee Administration to perform all functions incident to the administration and operation of this transactions and use tax ordinance; provided, that if the City shall not have contracted with the California Department of Tax and Fee Administration prior to the operative date, it shall nevertheless so contract and in such a case the operative date shall be the first day of the first calendar quarter following the execution of such a contract.
7-7.04 - Transactions Tax Rate.

For the privilege of selling tangible personal property at retail, a tax is hereby imposed upon all retailers in the incorporated territory of the City at the rate of one-quarter percent (1/4%) of the gross receipts of any retailer from the sale of all tangible personal property sold at retail in said territory on and after the operative date of this ordinance. 7-7.05 - Place of Sale.

For the purposes of this chapter, all retail sales are consummated at the place of business of the retailer unless the tangible personal property sold is delivered by the retailer or his agent to an out-of-state destination or to a common carrier for delivery to an out-of-state destination. The gross receipts from such sales shall include delivery charges, when such charges are subject to the state sales and use tax, regardless of the place to which delivery is made. In the event a retailer has no permanent place of business in the State or has more than one place of business, the place or places at which the retail sales are consummated shall be determined under rules and regulations to be prescribed and adopted by the California Department of Tax and Fee Administration.
7-7.06 - Use Tax Rate.

An excise tax is hereby imposed on the storage, use or other consumption in the City of tangible personal property purchased from any retailer on and after the operative date of this chapter for storage, use or other consumption in said territory at the rate of onequarter percent (1/4%) of the sales price of the property. The sales price shall include delivery charges when such charges are subject to state sales or use tax regardless of Tuesday, March 03, 2026 Reg CC MTG, Page *85
the place to which delivery is made.
7-7.07 - Adoption of Provisions of State Law.

Except as otherwise provided in this chapter and except insofar as they are inconsistent with the provisions of Part 1.6 of Division 2 of the Revenue and Taxation Code, all of the provisions of Part 1 (commencing with Section 6001) of Division 2 of the Revenue and Taxation Code are hereby adopted and made a part of this chapter as though fully set forth herein.
7-7.08 - Limitations on Adoption of State Law and Collection of Use Taxes.

In adopting the provisions of Part 1 of Division 2 of the Revenue and Taxation Code:

A. Wherever the State of California is named or referred to as the taxing agency, the name of this City shall be substituted therefor. However, the substitution shall not be made when:

1. The word “State” is used as a part of the title of the State Controller, State Treasurer, California Victim Compensation Board, California Department of Tax and Fee Administration, State Treasury, or the Constitution of the State of California;

2. The result of that substitution would require action to be taken by or against this City or any agency, officer, or employee thereof rather than by or against the California Department of Tax and Fee Administration, in performing the functions incident to the administration or operation of this chapter.

3. In those sections, including, but not necessarily limited to sections referring to the exterior boundaries of the State of California, where the result of the substitution would be to:
a. Provide an exemption from this tax with respect to certain sales, storage, use or other consumption of tangible personal property which would not otherwise be exempt from this tax while such sales, storage, use or other consumption remain subject to tax by the State under the provisions of Part 1 of Division 2 of the Revenue and Taxation Code, or; b. Impose this tax with respect to certain sales, storage, use or other consumption of tangible personal property which would not be subject to tax by the state under the said provision of that code.

4. In reference to Sections 6701, 6702 (except in the last sentence thereof), 6711, 6715, 6737, 6797 or 6828 of the Revenue and Taxation Code.

B. The word “City” shall be substituted for the word “state” in the phrase “retailer Tuesday, March 03, 2026 Reg CC MTG, Page *86
engaged in business in this state” in Section 6203 of the Revenue and Taxation Code and in the definition of that phrase in Section 6203.

1. “A retailer engaged in business in the City” shall also include any retailer that, in the preceding calendar year or the current calendar year, has total combined sales of tangible personal property in this state or for delivery in the State by the retailer and all persons related to the retailer that exceeds five hundred thousand dollars ($500,000). For purposes of this section, a person is related to another person if both persons are related to each other pursuant to Section 267(b) of Title 26 of the United States Code and the regulations thereunder. 7-7.09 - Permit not Required.

If a seller’s permit has been issued to a retailer under Section 6067 of the Revenue and Taxation Code, an additional transactor’s permit shall not be required by this chapter. 7-7.10 - Exemptions and Exclusions.

A. There shall be excluded from the measure of the transactions tax and the use tax the amount of any sales tax or use tax imposed by the State of California or by any city, city and county, or county pursuant to the Bradley-Burns Uniform Local Sales and Use Tax Law or the amount of any state-administered transactions or use tax.

B. There are exempted from the computation of the amount of transactions tax the gross receipts from:

1. Sales of tangible personal property, other than fuel or petroleum products, to operators of aircraft to be used or consumed principally outside the county in which the sale is made and directly and exclusively in the use of such aircraft as common carriers of persons or property under the authority of the laws of this State, the United States, or any foreign government.

2. Sales of property to be used outside the City which is shipped to a point outside the City, pursuant to the contract of sale, by delivery to such point by the retailer or his agent, or by delivery by the retailer to a carrier for shipment to a consignee at such point. For the purposes of this paragraph, delivery to a point outside the City shall be satisfied:

With respect to vehicles (other than commercial vehicles) subject to registration pursuant to Chapter 1 (commencing with Section 4000) of Division 3 of the Vehicle Code, aircraft licensed in compliance with Section 21411 of the Public Utilities Code, and undocumented vessels registered under Division 3.5 (commencing with Section 9840) of the Vehicle Code by registration to an out-of-City address and by a declaration under penalty of perjury, signed by the buyer, stating that such address is, in fact, his or her principal place of residence; and
Tuesday, March 03, 2026 Reg CC MTG, Page *87
b. With respect to commercial vehicles, by registration to a place of business out-of-City and declaration under penalty of perjury, signed by the buyer, that the vehicle will be operated from that address.

3. The sale of tangible personal property if the seller is obligated to furnish the property for a fixed price pursuant to a contract entered into prior to the operative date of this chapter.

4. A lease of tangible personal property which is a continuing sale of such property, for any period of time for which the lessor is obligated to lease the property for an amount fixed by the lease prior to the operative date of this chapter.

5. For the purposes of subparagraphs (3) and (4) of this subsection, the sale or lease of tangible personal property shall be deemed not to be obligated pursuant to a contract or lease for any period of time for which any party to the contract or lease has the unconditional right to terminate the contract or lease upon notice, whether or not such right is exercised.

C. There are exempted from the use tax imposed by this chapter, the storage, use or other consumption in this City of tangible personal property:

This exemption is in addition to the exemptions provided in Sections 6366 and 6366.1 of the Revenue and Taxation Code of the State of California.

3. If the purchaser is obligated to purchase the property for a fixed price pursuant to a contract entered into prior to the operative date of this chapter.

4. If the possession of, or the exercise of any right or power over, the tangible personal property arises under a lease which is a continuing purchase of such property for any period of time for which the lessee is obligated to lease the property for an amount fixed by a lease prior to the operative date of this chapter.

5. For the purposes of subparagraphs (3) and (4) of this subsection, storage, use, or other consumption, or possession of, or exercise of any right or power over, tangible personal property shall be deemed not to be obligated pursuant to a contract or lease for any period of time for which any party to the contract or lease has the unconditional right to terminate the contract or lease upon notice, whether or not such right is exercised.

7. “A retailer engaged in business in the City” shall also include any retailer of any of the following: vehicles subject to registration pursuant to Chapter 1 (commencing with Section 4000) of Division 3 of the Vehicle Code, aircraft licensed in compliance with Section 21411 of the Public Utilities Code, or undocumented vessels registered under Division 3.5 (commencing with Section 9840) of the Vehicle Code. That retailer shall be required to collect use tax from any purchaser who registers or licenses the vehicle, vessel, or aircraft at an address in the City.

D. Any person subject to use tax under this chapter may credit against that tax any transactions tax or reimbursement for transactions tax paid to a district imposing, or retailer liable for, a transactions tax pursuant to Part 1.6 of Division 2 of the Revenue and Taxation Code with respect to the sale to the person of the property the storage, use or other consumption of which is subject to the use tax. 7-7.11 – Amendments.

All amendments subsequent to the effective date of this chapter to Part 1 of Division 2 of the Revenue and Taxation Code relating to sales and use taxes and which are not inconsistent with Part 1.6 and Part 1.7 of Division 2 of the Revenue and Taxation Code, and all amendments to Part 1.6 and Part 1.7 of Division 2 of the Revenue and Taxation Code, shall automatically become a part of this chapter, provided however, that no such amendment shall operate so as to affect the rate of tax imposed by this chapter. 7-7.12 - Enjoining Collection Forbidden.

No injunction or writ of mandate or other legal or equitable process shall issue in any suit, action or proceeding in any court against the State or the City, or against any officer of the State or the City, to prevent or enjoin the collection under this chapter, or Part 1.6 of Division 2 of the Revenue and Taxation Code, of any tax or any amount of tax required to be collected.

1 TO: City Council
FROM: Andrew Vialpando, City Manager
PREPARED BY: Andrew Vialpando, City Manager
MEETING DATE: March 3, 2026
SUBJECT: Memorandum of Understanding (MOU) with the City of Los Angeles Harbor Department for the Waterfront Red Trolley Car

RECOMMENDED ACTION
Approve a Memorandum of Understanding with the City of Los Angeles, Harbor Department for the Port of Los Angeles Waterfront Red Trolley Car; and authorize the City Manager to execute the MOU.

BACKGROUND
In 2023, the Port of Los Angeles (POLA) informed the City of Lomita of its interest to loan one of its replica Waterfront Red Trolley Railcar (Red Car) built in 2003 to be displayed at the Lomita Railroad Museum. Numerous updates and progress reports have been presented to the City Council since 2023 regarding the Red Car.

The last action on the Red Car by the City Council was taken during its meeting on February 17, 2026, when the City Council authorized staff to pursue design and cost estimates for constructing a suitable area to house the Red Car at the Railroad Museum Annex Pocket Park. The City Council also directed the City Manager to return to the City Council meeting on March 3, 2026 to present the proposed MOU with the POLA for approval.

DISCUSSION
Staff and the POLA have maintained active discussions and open negotiations regarding the terms and conditions for the lease of the Red Car to the City since May 2024. The POLA indicates that an estimated timeframe for delivery of the Red Car is summer 2026.

Approving the MOU will effectively commit the City to the Red Car Project. Agreeing to terms with the POLA would demonstrate the City’s commitment to the project and provide

CITY OF LOMITA

CITY COUNCIL REPORT
Item No. 8b
Tuesday, March 03, 2026 Reg CC MTG, Page *99
2 a clearer path for securing POLA Grant funding towards construction of the site.

The City Attorney has reviewed the proposed MOU and provided feedback and legal counsel throughout the negotiation process.

Below are some of the key provisions included in the final draft of the proposed MOU:
• 20-year Lease to the City with option to extend for an additional five-year period • Preparation and construction of the Red Car site is entirely the City’s responsibility • POLA will provide City with 60 feet of rail line
• Termination of lease by either party may occur only if there is a breach in terms or failure to comply with laws
• Public access is required and no admission may be charged • POLA will pay for delivering and placement of the Red Car, as well as removing the Red Car if the MOU is terminated
• No Early Termination Repayment Terms

FISCAL IMPACT
There is no fiscal impact associated with the approval of this MOU, however approving the terms of the MOU commits the City to the Red Car project. As discussed at the February 17, 2026 City Council meeting, the currently adopted budget does not include funding for the project. Execution of the MOU provides the City with a more competitive grant application for project funding. If awarded the POLA grant to augment the Railroad Foundation’s contribution, $150,000 would be available on July 1, 2026. If the City does not receive POLA grant, the only funding available is the $50,000 pledged by the Railroad Foundation.

Final cost estimates for constriction of the new site at the Annex Park are still being determined. Preliminary estimates range from $200,000 to $300,000.

The City Council may appropriate an amount to fund the project in the FY 26-28 Biennial Budget in June 2026.
